IMPROCEMENTS.
WHEREAS, the L,yncaood Redevelopment .~genc} Ithe
":lgencti") is authorized t.o carry out, the redevelopmer~t of the
Rede~~elopment Project Area "A" (~he "Project"); and
WHERE9S, the P.edevelopment F'lan for the Project.
authorizes and directs the Agency to pas- all or part of the value
of the acquisition anG const.r~iction of public improvements, which
ai•e enumerated in matei•ials referenced i_n the Redevelopment Plan
and which include the const,ruct.ion of wat.er and aewer facilities
within the Project Area; and
' WHERFAS, the A~ency- desires to contribute toc.'ard ti~e
const,ructi_on of such improvements and facilities in connection with
the Towne Center project and to approve certain smendments to that
certain Disposit.ion and Decelopment Agreement bet~aeen the 9°encp
and the Developer dated February 25, 1986 (the "llD~") c-hich
amendments are referred tu herein as the "First Ar,tenr~ment"; and
WHERfiAS, Califoi°nia Health and Safety Code Sect;on
33445 provides that the recle~~elopment agencp may, wit.h tlie consent
of the le~*islative body, pay all or part, of thN value of publi c
buildings, f~cilities, structures or other improvem~~nts upon a
finding that such public improveinen'ts are uf benefit to tF,e Pro~ect
Area or the immediate neighborhood in which t.he Project is located
~ind t;hat there is no other reasonable i~ieans of f:tnancing such
public improve,ments available for the community; ancl
\OW, THEREFOR~, the Cit,; Coi;ncil of the City of
Lpnwood does hereby resolve as foLlo~as:
Sectio~~ 1: The City~ Council hereby cleterrnines that
t.he construction of water facilities improvemen~s describec in Y,he
First Amendment. w9 ll be of ber:efit to the Projert Area and the
surronnding area nei~riborhocd in cchich the Projec't is located.
~ection 2: The Cit3 Council furt.ha~i determines t.:at
' t.here ai•e no other reasonabLe means of financing the reconstr~ucticn
of such improvment.s faithout having the 9gency pa,y all or part of
the value of such constructior..
Section 3: The Cityr Council consents to the
execution by the Agency of the Agreement, aud the payment by the
Agency of a portion of the cost of such improvements as de_°ined in
arid pursuant to such A,~reement. 'Phis reso.Lu`ion does not constitu~te
authorization for the e~penditure of Cit:,y funds.
