RESOLUPION OF 'IFIE CITY COULVCIL OF 'If~ CITY
OF LYNWOOD DETERMINING THAT THE ~NSTRUCPION OF
CERTAIIQ PUBLIC FACILITIES IS OF BENEFIT 'I1~ THE
LYNWOOD REDEVELOPMQ~IT PRCUECI' AREA '~A~~ AND
DETERMINING 'II]AT THERE ARE IQO OTF~R REASpNABLE
MEANS OF FINANCING SAID PUBLIC IMPROVII~fE[VTS.
WHEREAS, the Lynwood Redevelopment Agency (the "Agency")
is authorized to carxy out the redevelo~nent of the Redevelopment Project
Area "A" (the "Project"); and
WHEREAS, the Redevelopment Plan for the Project authorizes
and directs the Agency to pay all or part of the value of the acr3uisition
and construction of public improvements, which are en~rated in materials
referenced in the Redevelopment Plan and which include the construction of
water and sewer facilities within the Project Area; and
Wf~REAS, the Agency desires to contribute toward the construction
of such improvements and facilities in connection with the Sorrento Group
cormiercial develoFxrent located at the northeast corner of Atlantic Avenue
and Imperial Higt~way and to approve an Owner Participation Agreanent
between the Pgency and the Developer; and
' WE~REAS, California Health and Safety Code Section 33445
provides that the redevelo~nt agency may, with the consent of the
legislative bocly, pay all or part of the value of public buildings,
facilities, structures or other improvements upon a finding that such
public improvements are of benefit to the Project Area or the imnediate
neighborhood in which the Project is located and that there is no other
reasonable means of financing such public improvecrents available for the
conmunity; and
NOW, THEREFORE, the City Council of the City of Lynwood dces
hereby resolve as follows:
Section 1. The City Council hereby deterntiines that the
construction of improvesnents described in the Owner Participation Agreetrient
will be of benefit to the Project Area and the surrounding area neighborhoocl
in which the Project is located.
Section 2. The City Council further deterntiines that there are
no other reasonable means of financing the construction of such improvements
without having the Agency pay all or part of the value of such construction.
Section 3. The City CoLmcil consents to the execution by the
Agency of the Agreement, and the payment by the Agency of a portion of
the cost of such iurq~rovements as defined in and pursuant to such Pgreement.
' This Resolution does not constitute authorization for the expenditure of
City funds.
