Wayne Neddermeyer - Mayor in Chair Priscilla Arens - Clerk Wayne Neddermeyer, Robert Franklin, Arthur Theis dad Donald Des Lauriers present. Ray Kempf representing the North Star Marina, Inc. appeared with regard to the special use permit. Moved by Robert Franklin that we pass the Resolution 72-15 as follows: A RESOLUTION GRANTING A VARIANCE FOR THE RENTAL OF STORAGE AREA FOR BOATS AND MARINE MOTORS. WHEREAS, the Village Council for the Village of Medina had on September 5, 1972, received a request from the North Star Marina, Inc., owner of the Southwest 1/4 of114Touthwest 4 of Section 21, Township 118, Ranie 23, to use the farm buildings located on said property for the purpose of offering rental storage for baste and marine equipment; and WHEREAS, UPON AN examination of the zoning relating to the property, it has been determined that the zoning is Residential -Agri ultural (R-A); and WHERAS, the use to which the property is to be placed is temporary in nature in that said use would terminte at the end of fifteen years; and WHEREAS, said use be permitted with respect to the farm buildings presently existing on said property and an additional building not to exceed 20,000 square feet; and WHEREAS, no nuisance shall be created by using said property for said purpose with respect to noise, smoke and traffic; and WHEREAS, the use of said buildings for the storage of bows and marine equipment and making minor repairs therein of same, is limited only to these uses and does not include sales, sales lots and show rooms, all storage is to be done within the buildings, and no commercial signs shall be established advertising said use; and WHEREAS, the spirit of the Medina Village zoning ordinance shall be observed, public safety and welfare secured and substantial justice be done. NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MEDINA, MINNESOTA: That pursuant to the Medina Village zoning ordinance, Section 29 (b) (2), the Village Council hereby grants to North Star Marina, Inc. a variance permit as to the use of said buildings as follows: 1. The right to use the presently existing farm buildings on the property heretofore legally described, and one additional building of generally same type of construction not to exceed 20,OOO.square feet, for the purpose of lental storage space for boats and marine equipment and for the repair of same. 2. This variance is for a period of fifteen years fromthe date of passe& of this resolution, and if the use is discontinued not a transfer by North Spar Marina, Inc. of said property during this period of this granted use, the property shall revert to its designated use under R-A zoning. 3. No nuisance shall be created by using said property for said purpose with respect to noise, smoke and traffic. 4. The use of said buildings for the storage of boats and marine equipment and making minor repairs therein of same, is limited onl* to these uses and does not include sales, sales lots, show rooms, and all storage is to be done within the buildings, and no commercial signs shall be established advertising said use. 5. The spirit of the Medina Village zoning ordinance shall be observed, public safety and welfare secured and substantial justice be done; with the understanding that the North Star Marina, Inc. will have it recorded with the abstract.
