A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD OVERRULING PROTESTING AND ORDfiRING THE
LEVYING OF ANNUAL ASSESSMENTS FOR THE EXISTING
LYNWOOD LANDSCAPE MAINTENANCE DISTRICT FOR
FISCAL YEAR 1987-88.
' WI~REAS, the City Council of the City of I.ynwood did, on
the 7th day of April, 1987, adopt its Resolution No. 87-40
proposing the annual assessment for the Landscape Maintenance
District and directing the Director of Public Works/City Engineer to
prepare a report in connection therewith, and
WHEREAS, the Director of Public Works/City Engineer did,
on the 19th day of May, 1987, submit a report in relation to said
District pursuant to the provisions of the "Landscape and Lighting
Act of 1972" (Part 2 of Division 15 of the Streets and Highways Code
of the State of California), and
Wf~REAS, the City Council did, on the 19th day of May,
1987, adopt a Resolution No. 87-67 approving the Engineer's Report
herein mentioned and declaring its intention to levy and collect
assessments within said District and fixing the time and place for a
hearing on the matter of said District.
WHEREAS, evidence has been received as to the publication
and posting of notice o£ said hearing in the time, form and manner
required by law;
' NOW, THEREFORE, the City Council of the City of Lynwood
DOES HEREBY FIND, DfiTERMINE, ORDER AND RESOLVB as follows:
Section 1. Each and all of the recitals set forth
hereinabove are true and correct.
Section 2_ The protests submitted, if any, do not
represent property owners owning more than 50 percent of the area of
assessable lands within said district, and said protests are hereby
overruled.
Section 3_ That this City Council hereby confirms the
diagram and sets the assessment at $1.24 per foot of front footage
for each lot. The adoption of the Resolution shall constitute the
levying of the assessments in connection therewith for Fiscal Year
1987-88.
Section 4_ The City Cierk is hereby authorized and
directed to forewith file a certified copy of said diagram and
assessment with the County Auditor.
Section 5_ The City Clerk is hereby further authorized
and directed to file a statement as described in the Government Code
Section 54900 and following with the County Assessor i~ediately
after the adoption of this resolution.
, Section_6_ This resolution shall take effect i~nediately
upon its adoption.
