MEDINA CITY COUNCIL MEETING MINUTES OF SEPTEMBER 20, 1994
The City Council of Medina, Minnesota met in regular session on
September 20, 1994 at 7:30 p.m. in the City Hall Council Chambers
with Mayor Anne Theis presiding.

1. ADOPTION OF THE AGENDA
Moved by Mayor Theis, seconded by Zietlow, to adopt the agenda with
the following additions:
A. Gordon Henderson Request for Vacation of Brook Street
B. LMC's "Action Alert" Regarding Stormwater Regulations
Motion passed unanimously.
2. CONSENT AGENDA
Moved by Zietlow, seconded by Ferris, to approve the consent
agenda, as follows:
A. Resolution No. 94-62, "Resolution Granting a Conditional Use
Permit to Thomas Lundell for a Third Accessory Building"
B. Resolution No. 94-63, "Resolution Declaring the City has
Adequate Reserves to Cover Bonded Indebtedness in 1995"
C. Approval of 180-Day Time Extension for Lundgren Bros.
Construction, Inc. to File Final Plat of Foxberry Farms
Motion passed unanimously.
3. MINUTES
Moved by Mayor Theis, seconded by Zietlow, to approve the minutes
of the regular meeting of September 6, 1994, as submitted.
Motion passed unanimously.
4. HIGHWAY 18 & 55 PROPERTIES - PRIVATE DEVELOPMENT AGREEMENT
Moved by Ferris, seconded by Zietlow, to adopt Resolution No. 94-
64, "Resolution Regarding Contract for Private Development By and
Between the City of Medina, Minnesota and Highway 18 & 55
Properties."
Ayes: Ferris, Zietlow and Mayor Theis. Nays: None.
Resolution No. 94-64 adopted on a 3-aye and 0-nay vote.
5. LONG LAKE FIRE CONTRACT
The City of Long Lake requested that Medina approve the extension
of the Fire Service Contract for the years 1995, 1996 and 1997.
Medina's share of Long Lake's three-year budget proposal --based on
8.07% of 1994 market values --was $10,104 in 1995, $10,508 in 1996,
and $10,928 in 1997.

Phil Zietlow said the Long Lake Fire Department was doing an
excellent job of trying to keep the costs down. He recommended
the Council approve the three-year extension.
Moved by Zietlow, seconded by Mayor Theis, to approve the extension
of the "Agreement and Contract for Fire Protection" with the City
of Long Lake for the years 1995, 1996 and 1997. Motion passed
unanimously.
6. STEVE SCHERER EMPLOYMENT STATUS
Jim Dillman said Steve Scherer had completed his six-month
probationary period in the Public Works Department and he
recommended that Scherer be granted regular full-time status, with
a pay increase from Step 4 to Step 5.
Moved by Mayor Theis, seconded by Zietlow, to accept Public Works
Director Jim Dillman's recommendation that Steve Scherer be granted
regular, full-time status with a pay increase from Step 4 to Step
5. Motion passed unanimously.
7. PURCHASE OF SEWAGE FLOW METER
Jim Dillman asked for authorization to purchase a sewage flow meter
for the Hamel sewer system. Dillman said it was the City's
responsibility to monitor flows from the new rural industrial
connection. He recommended that the City purchase an ISCO 4200
Series bubbler system at a cost of $5,075. Dillman said the unit
would also be used for "inflow" and "infiltration" studies of
individual homes and to get accurate sewage flows from Baker Park.
Moved by Zietlow, seconded by Ferris, to approve the purchase of a
flow meter at a cost of $5,075. Motion passed unanimously.
8. MEDINA MORNINGSIDE WATER SYSTEM
Jim Dillman asked for authorization to negotiate with the City of
Orono for the purchase of two used pressure tanks and electrical
controls to upgrade the Medina Morningside water system. Dillman
said two new tanks would cost around $17,000.
Moved by Mayor Theis, seconded by Zietlow, to authorize Jim Dillman
to enter into dollar negotiations with the City Orono for the
purchase of two used pressure tanks and electrical controls.
Motion passed unanimously.
9. HEPATITIS B VACCINATIONS FOR PUBLIC WORKS CREW
Jim Dillman said the City should offer the Hepatitis B vaccinations
to the public works crew because of their exposure to the disease
when working around sewage.
The Council directed Dillman to offer the vaccinations to each
public works employee.
10. GORDON HENDERSON - REQUEST FOR VACATION OF BROOK STREET
Mayor Theis said Gordon Henderson's neighbor to the south of his
property was encroaching upon the road easement --shown as Brook

Street --toward Henderson's property. Theis recommended that the
Park Commission look at incorporating the road right-of-way into a
trail system.
11. LMC'S "ACTION ALERT REGARDING STORMWATER REGULATIONS
The City received an "Action Alert" from the League of Minnesota
Cities (LMC) warning cities of costly stormwater regulations that
cities under 100,000 would have to comply with if Congress did not
extend a moratorium or reauthorize the Clean Water Act.
Mayor Theis directed Jeff Karlson to write a letter to
Congressional representatives insisting that they act to revise the
stormwater management program before adjournment or to extend the
current moratorium until the full Clean Water Act can be
reauthorized.
12. PAYMENT OF BILLS
Moved by Mayor Theis, seconded by Zietlow, to approve payment of
Order Check Numbers 13691-13731 for $185,670.87 and Payroll Check
Numbers 14057-14070 for $11,493.99. Motion passed unanimously.
13. ADJOURNMENT
Moved by Mayor Theis, seconded by Ferris, to adjourn the meeting at
8:17 p.m. Motion passed unanimously.
