CITY OF TEMPLE CITY
APRIL 7, 197q
INITIATION;
1. Mayor Harker called the regular meeting of the City Council to
order at 7:30 p.m.
• The invocation was given by the Reverend Walter Fennel, Temple
City Church of Christ, 5272 N. Reno, Temple City.
The Pledge of Allegiance to the Flag was led by Mayor Harker.
ROLL CALL:
PRESENT: Councilmen- Beckley, Merritt, Harker
ABSENT: Councilmen - Briggs, Tyrell
ALSO PRESENT: City Manager Koski, City Attorney Martin,
Assistant City Manager Recupero, Planning Director
Dragicevich, Director of Public Works Pizzorno,
Traffic Engineer Envall.
Councilman Beckley moved to excuse the absences of both Council-
men Briggs and Tyrell for business reasons, seconded by
Councilman Merritt and carried.
APPROVAL_ OF MINUTES:
Councilman Merritt moved to approve the minutes of March 17,
1970, meeting, as mailed, seconded by Councilman Beckley and
carried.'
UNFINISHED BUSINESS:
6. RESOLUTION No. 70 -998: A Resolution of the City Council of
the City of Temple City granting a Conditional Use Permit -
Mr. and`Mrs. Mario Consentino, 5604 N. Rosemead (Kennel).
In accordance with previous action of the Council, City
Attorney'Martin presented Resolution No. 70 -998 entitled,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
GRANTING PA CONDITIONAL USE PERMIT WITH CONDITIONS AND
REVERSING RESOLUTION NO, 70 -370PC (CASE NO, 70 -308).
Councilman Merritt moved to adopt, seconded by Councilman
Beckley and carried.
7. ORDINANCE No. 70 -306: 2nd read. Repealing Ordinance
No. 69 -2$P (Natural Resources).
City Attorney Martin presented Ordinance No. 70 -306 entitled,
AN ORDINANCE OF THE CITY OF TEMPLE CITY DECLARING ORDINANCE
69 -288 TO BE VOID AND REPEALING THE SAME, for second reading.
Councilman Beckley moved to waive further reading and adopt
by title only, seconded by Councilman Merritt and carried.
8. ORDINANCE No. 70 -307: 2nd read. Amending Section 9202 (33)
of the Temple City Municipal Code Relating to Natural Resources.
City Attorney Martin presented Ordinance No. 70 -307 entitled,
AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 9202
(33) OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO NATURAL
RESOURCES, for second reading. Councilman Merritt moved to
waive further reading and adopt, seconded by Mayor Harker
and carried.

NEW BUSINESS:
9. RESOLUTION No. 70 -999: Ordering Canvass of General Municipal
Election to be made by City Clerk.
City Attorney Martin advised that this city, as all general
law cities, will hold a councilmanic election on Tuesday,
April 14, 1970, and presented Resolution No. 70 -999 entitled,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORNIA, ORDERING THE CANVASS OF THE GENERAL MUNICIPAL
ELECTION TO BE HELD ON THE 14th DAY OF APRIL, 1970, TO BE
MADE BY THE CITY CLERK OF THE CITY OF TEMPLE CITY. Council-
man Beckley moved to adopt, seconded by Councilman Merritt
and carried.
10. APPEAL BY APPLICANT: Re. Conditional Use Permit No. 69 -307
to build and operate a drive -in restaurant at northeast
corner of Golden West and Las Tunas (Velma D. Riggle, owner).
Planning Director Dragicevich advised that Public Hearing
had been held on the request for a conditional use permit
to build and operate a drive -in restaurant at 9803 E. Las
Tunas Drive, on January 13 and March 10, 1970, and on
March 10 the Planning Commission, by a split vote, had
adopted Resolution No. 70- 373PC, denying the request. He
advised that all exhibits were available for Council con-
sideration if they wished to review the matter this evening.
Councilman Beckley stated that since the request had been
denied by a split vote of the Planning Commission, and since
all councilmen were not present this evening, it was his
recommendation to set a Public Hearing for the matter on
April 21, 1970, at 7 :30 p.m. in the Council Chambers of the
City Hall, and so moved. Councilman Merritt concurred with
the recommendation, seconding the motion, which was so
ordered,
11. INSPECTION FEES FOR AVIARIES: Establish $10 fee, pursuant to
Ordinance No. 69 -293, Re: permit for more than 12 birds.
City Manager Koski advised that pursuant to Ordinance No.
69 -293, with respect to permit for aviaries containing more
than 12 birds, that it was recommended that a one -time
fee of $10 be established to cover field inspection and
paper work, and that staff be authorized to handle and issue
such permits. Mayor Harker presumed that subsequent
inspections would be made on complaint, which was affirmed
by the City Manager. Councilman Merritt moved to approve
the permit fee of $10, as outlined by the City Manager, with
staff authorized to handle and issue permits, seconded by
Councilman Beckley and carried.
12. TRAFFIC COMMISSION RECOMMENDATIONS - Meeting of April 1, 1970.
LOWER AZUSA ROAD, south side - east and west of Rowland.
Traffic Engineer Envall advised that the Traffic Commission
recommended placement of two directional arrows on the south
side of Lower Azusa Road, approximately 50' east and 50'
west of Rowland, to alleviate site hazard. Councilman
Beckley moved to approve, seconded by Mayor Harker and carried.
13.)SET PUBLIC HEARINGS: Chapter 27 Proceedings for Curb, Gutter
14.)and Driveway Approach - KAUFFMAN AVENUE, west side, Garibaldi
to Longden, and east side, Garibaldi to 1000 feet northerly.

Councilman Merritt moved to set Public Hearing for Tuesday,
April 21, 1970, in the Council Chambers of the City Hall,
for street improvements under Chapter 27 Proceedings for
curb, gutter and driveway approach, KAUFFMAN AVENUE, west
side, Garibaldi to Longden, and east side, Garibaldi to
1000 feet northerly, seconded by Councilman Beckley
and carried.
15. SET PUBLIC HEARING: ASSESSMENTS - Chapter 27, Curb, Gutter
and Driveway Approach - HALIFAX AVENUE, east side, Freer
to Olive,
Councilman Beckley moved to set public hearing for assess-
ments, Halifax Avenue, east side, Freer to Olive, for
Tuesday, April 21, 1970, at 7:30 p.m, in the Council
Chambers of the City Hall, seconded by Mayor Harker and
carried.
16. PROPOSED CONTRACT FOR ENGINEERING SERVICES: Krelle & Lewis,
Engineers - Live Oak Park Extension.
City Manager Koski advised that as a follow -up of Parks and
Recreation Commission recommendation wherein certain work
was recommended for development of Live Oak Park; and that
a proposal for engineering services in connection with
irrigation system and turf installation had been received
from the engineering firm of Krelle & Lewis, with maximum
cost for services at $3500. He advised that funds for
completion of the project were available in accounts 8182
and 8183 in the Parks portion of the budget. Councilman
Merritt moved to approve the agreement with Krelle & Lewis,
Engineers, for engineering services in connection with
landscaping and sprinkler system of the Live Oak Park
expansion, and to authorize the Mayor and City Clerk to
sign on behalf of the City, and to transfer necessary funds
from account 8182 to 8183 as outlined by the City Manager,
and to amend the adopted budget accordingly. The motion was
seconded by Councilman Beckley and carried.
17. AMENDMENT TO SERVICE CONTRACT - James T. Peglau.
Assistant City Manager Recupero presented an amendment to
service contract negotiated with James To Peglau and Associates,
entered into November 1, 1969, to increase the monthly fee
from $735 per month to $776 per month, effective March 1, 1970.
Councilman Beckley moved to approve the amendment to service
contract as outlined, and to authorize the Mayor and City Clerk
to sign, seconded by Councilman Merritt and carried.
18. RESOLUTION No. 70 -1000: Appointment of Temporary Personnel.
City Manager Koski presented Resolution No. 70 -1000, A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING TEMPORARY PERSONNEL. Councilman Beckley moved
to adopt, seconded by Mayor Harker and carried.
19. RESOLUTION No, 70 -1001: WARRANTS & DEMANDS - Demand Nos.
1729 through 1834, in the amount of $57,806.87.
Councilman Merritt moved to adopt Resolution No, 70 -1001,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $57,806.87, DEMAND
NOS, 1729 THROUGH 1834. Councilman Beckley seconded the
motion which was so ordered.

20. COMMUNICATIONS:
FAMILY BILLIARD CENTER - CAMELLIA FAMILY BILLIARDS,
City Manager Koski presented a communication from Mr. Ami
L. Partlow, owner, Camellia Family Billiards, requesting
change in hours from midnight to 2 a.m. He advised that
periodic reports from the Sheriff's Department had in-
dicated only one incident in November of 1969, and that
adequate supervision was being provided. He advised that
the Sheriff's Department had indicated they could see no
problem in extending the hours, and that it was the
Recommendation of staff to allow the additional time,
subject to periodic review and change should any problems
develop. Councilman Beckley moved to approve the request
of the Camellia Family Billiards, to extend operating hours
to 2 a.m., on an as.. needed basis, Sunday through Thursday,
in addition to Friday and Saturday nights already allowed,
subject to review by the Council in the event any problems
arise. Councilman Merritt seconded the motion which was so
ordered. Councilman Merritt stated that he would like to
remind Mr. Partlow that during the week we have the matter
of residents in close proximity'which will require his
close supervision of adjacent parking areas and the
conduct of patrons. He advised that it was with con-
siderable reluctance that he added his approval, but that
he felt it was worth a trial, particularly since the Sheriff's
reports were most favorable, Mayor Harker advised Mr. Partlow
that the Council was expressing their confidence in him
in extending the hours at the present time, and sincerely
hope it will not create any problems.
21. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
Mrs, Rose Stolack, 4904 Kauffman Avenue, addressed the
Council, as she has in the past, relative to vibrations
she feels in her home, and what the City can do to assist
hero Councilman Beckley inquired if she had checked to
determine if it was the water pipes which can vibrate
when they build up pressure. He recommended another build-
ing inspection, inside the building, if necessary. Council-
man Merritt advised that he had visited the premises that
day, and that while the cracks inside the home appeared to
be normal, those in the patio area were somewhat larger than
most, but not unusual.
Mr. E. Mackay, 9660 La Rosa, advised that he lived in the
same area, and that he had had trouble with his water pipes
causing vibrations when the pressure builds up, which is
caused by faulty valves, but that he was able to eliminate
the vibration by turning on the cold water faucet.
Mrs. Paula Kugler :-Bogarad, 10232 La Rosa, presented newspaper
clippings concerning vibrations, and inquired why something
had not been done. Councilman Beckley advised that the
matter referred to had received satisfactory attention.
Mrs. Bogarad expressed concern for Mrs. Stolack and stated
that she believed Mrs. Stolack had a very real problem.
Mrs. Shirley Fradella, 4846, Kauffman, stated that she too
has felt vibrations in her home, but that she is not as
concerned with them as are the Stolacks. She advised that
in her home it is a bathroom window that rattles.

Mayor Harker received a communication dated April 6, 1970,
from Mr. and Mrs. T. V. Hamilton, 4905 Kauffman Avenue,
stating that they had been invited by a neighbor to join
in a protest to the Temple City Council regarding vibration
and excessive noise in the 4900 block of Kauffman Avenue,
however, that they did not wish to participate in the protest
since they personally had experienced no such vibrations or
abnormal noise of any kind, and that they were opposed to
any such protest or complaint.
Lt. Luis Acevedo, Temple City Sheriff Station, advised that
under his supervision, calls from Mrs. Stolack had been
answered by deputies, and that for a period of two weeks
nightly checks had been made and that no vibrations were
detected. He stated that on one occasion, a vibration
attributed to the heating unit was observed, and that
upon unplugging the unit, the vibrations ceased. He
advised that there was no criminal aspect to the case.
Assistant City Manager Recupero presented a report outlining
the numerous times assistance had been provided to Mrs. Stolack
by staff members, Sheriff's Department Personnel, Engineering
Department and utility companies, since October 1969, in an
attempt to solve her problem. He advised that certain
instruments could be utilized by professional persons to pro-
vide vibration readings, at a cost of $18,50 per hour, with
a minimum of 4 hours. Mrs. Stolack was reluctant to consent
to absorbing the costs that may be involved, however Mayor
Harker advised her that there may be some charges should the
service be utilized. She was advised to see if the vibrations
would stop by turning on the faucets the next time she should
feel the vibrations.
22, MATTERS FROM CITY OFFICIALS:
A. GROUNDS MAINTENANCE AGREEMENT- 1970 -71: Assistant City
Manager Recupero advised that since 1966 the City has
entered into an agreement wherein the City provides grounds
maintenance services for County grounds adjacent to the City
Hall and Library. He advised that the fee established for
1970 -71 was $696, an increase of $36 over the prior year,
and that the proposed agreement had been approved by the City
Attorney. Councilman Beckley moved to approve the agreement
as submitted, and to authorize the Mayor and City Clerk to
sign, seconded by Councilman Merritt and carried.
B. PAINTING LIVE OAK PARK BUILDING AND APPROVAL FOR TRANSFER
OF FUNDS: City Manager Koski advised that in securing in-
formal bids for budget purposes on painting the main building
at Live Oak Park, it was found that because of a present slump
in the painting industry that it would be economically
advantageous to authorize the work to be completed immediately.
He explained that the project would involve an expenditure of
$1,989, for which the major portion was available in account
No, 8123 - Parks, however that it would be necessary to
transfer an amount of $400 from Account No. 1823 - General
Government Buildings to do the work. Councilman Merritt moved
to approve the transfer of funds in the amount of $400 from
Account 1823 to Account 8123, and to authorize the expenditure
of $1,989 for painting the Live Oak Park Building as outlined
by the City Manager. The motion was seconded by Councilman
Beckley and carried.

C. YOUTH COMMISSION ACTIVITIES: Assistant City Manager
Recupero presented final draft of Youth Commission Question-
naire which was to be distributed to the youth of the
community through the schools in the near future. Council-
man Merritt inquired of Arnold Gaffrey, Youth Commission Chairman,
present in the audience, how the distribution would be accomplished.
Commissioner Gaffrey advised that it now appeared that they
would be distributed approximately April 14, and that distribution
at the high school would be through the English classes which
would reach approximately 95% of the students, and that the
remainder would be reached in some other manner. He advised
that distribution to Oak Avenue Junior High and the parochial
schools was yet to be arranged.
D. JUSTIFICATION OF PURCHASE - Tire Chains: City Manager Koski
presented a report as to the use of tire chains which had been
included on the warrant resolution of the previous council
meeting, He advised that the chains were purchased by the
Recreation Department to be used on the van in the interest of
safety on snow trips, approximately 3 times yearly.
E. LAW ENFORCEMENT CONTRACT COSTS - SHERIFF'S DEPARTMENT:
City Manager Koski reported he attended the meeting of the County
Board of Supervisors this morning and the Board of Supervisors,
acting on the recommendation of the Chief Administrative Officer
of the County, had increased the rate from $139,000 to $230,000
per 24 -hour unit for Sheriff's services, to be effective July 1,
1970. He advised that the differential between $139,000 (re-
adjusted by recent increase of 11% to $154,000) to $230,000
will be placed in impound, pending results of study through a
Federal Grant, the results of which study would be available
in March 1971. At that time, when a final price would be
determined, if the cost is less than $230,000 there would be
a rebate, and if more then the new rate from July 1, 1971
would reflect that increase. He advised that there would be
further staff investigation and meetings with the Sheriff's
Department to reevaluate our present level of service.
F. SOUTHERN CALIFORNIA PLANNING CONGRESS - November Meeting:
City Manager Koski advised that the City of Temple City had
been asked to host the November meeting of the Southern California
Planning Congress, which involves no cost to the City but that
we would be required to take care of the arrangements. It was
considered that participation by the City is desirable and it
was concurred in by the Council that the City host the November
meeting as discussed.
23. ADJOURNMENT:
Councilman Beckley moved to adjourn to a Study Session at
8:53 p.m., seconded by Councilman Merritt and carried.
The next regular meeting of the City Council will be held on
Tuesday, April 21, 1970, at 7:30 p.m. in the Council Chambers
of the City Hall, 5938 N. Kauffman Avenue
