Ziemba, Sr. Rr)LL CALL 1995 COI't:C Il Upon individual roll call, the following were noted present: Mayor Councilmember " " " " Also noted present was Borough Attorney Robert A. Hedesh. BUILDING AND GROUNDS: Committee Chairman O'Brien reported that in the past year they did a few things around Borough Hall. We installed a walkway ramp in front of Borough Hall. We planted new shrubs. We made renovations in various offices. We moved the Building Inspection Department upstairs into the old Council Chambers and made their old office the Engineer's office. Ray repaired the Borough Hall roof and gutters. He did some other general maintenance work. He repaired the crack on the building exterior. His work eliminated a lot of flooding that was going on inside of Borough Hall 1i'¡henever it rained. He recently repaired the boiler on the first floor and he repaired the benches in front of the building. They also have a few things they want to look at for next year, including the Borough Hall parking lot, updating the electrical and heating overhaul and work on the front steps of Borough Hall. He reported Progress. PEPORTS OF 1995 ST AND HlG Cm~t1]TTEES FINANCE AND ADMINISTRATION: Committee Chairman Semenza reported that conditions as bad as they were in 1995, they lives within their budget. That's the best they could do with the type of situation they were in. He reported Progress. 1 JANUARY 1, 1996 STANDING CGr1MITTEES CON'T. ~'I'!t FIRE: Committee Chairman Feingold congratulated Fire Superintendent Greenberg who is in attendance today, as well as Chief Wawrzynski, for a job well job. He thanked the volunteer and career firemen. There was a trailer fire today. He congratulated them on a fantastic job at the Amoco fire, which thanks to their good work, a big disaster was averted. Also there was a house fire on Pulaski Avenue where they did a fantastic job protecting and saving lives there. Many members of the Fire Department received commendations at a prior Council Meeting. He congratulated them on the open houses that they had at the Fire Department. It was fantastic for the children. There were many events there for the children and residents of Carteret to see the workings of the firehouse take place. Before he was involved with the Fire Department, he was the Volunteer Attorney. He knew then all that the Fire Department, both paid and volunteer, do for the residents of the Borough of Carteret. Now after being the Commissioner, he can see first hand exactly what they do for our town and for other towns, as well, with the mutual aid that they're involved in. Together they comprise a means to protect life and property in the Borough of Carteret. We all owe them a debt of gratitude. He reported Progress. PARKS & RECREATION: Committee Chairman Bialowarczuk reported that this past year has been a really good year. Working with Mr. Kolibas was a pleasure. They accomplished a lot of things, not herself alone, but all of the people she worked with. This year they established a Recreation Commission and with the help of all of these people on the commission, Beverly Hedesh, Cathy Meyers, Georgia Barron, Eva Kushner, Michael Bucsak, Carlos Quinones and A. Robert Bialowarczuk, they brought back a lot of old things that were important not just to her, but to them growing up in town. Those who are her age and have children, have good memories and they want to make sure that their kids have it. Her children are a little bit older, but it's good for the younger kids in town to care about their town as much as she does and the people they've worked for. They also put in a lighted fountain in Carteret Park dedicated to Officer Kiraly. 2 She doesn't think there is a finer person to dedicate something to. He did a wonderful job for the town. They ordered new equipment in the Parks. There's a lot of new things they plan to do this year. She said that she was really and truly proud to work with all of the Council up there this year. She reported Progress. POLICE: Commi ttee Chairman Feingold congratulated Chief Sica for working very well wi th him and also all of the members of the police force .....a job well done this past year. He said that what distinguishes our police department from other police departments, is that they're successful in establishing positive community relations. Many departments try but aren't as successful as the Carteret Police Department. They do that by the DARE program, putting on a Rag-A-Muffin Parade, presentations to scout groups, a fishing derby and just general visibility of the officers in the groups in Carteret, such as the Elks, the Knights and the Rotary Club. In those capacities they do a lot for the residents in Carteret. One thing that comes to mind that they did this year was the fund raiser for Rebecca Howland who is a very sick young girl faced with catastrophic medical bills. The police officers got together and had a fund raiser together with the Elks to help defray some of the astronomical medical bills. Presently, morale is high and crime is low. The streets are safe. Our neighborhoods are safe. The public's perception of our force is positive. He is asking that they keep up the good work. He reported Progress. PUBLIC WORKS: Committee Chairman Semenza thanked Mr. Surick, Mr. Biel, Mr. Kazio and Sally Mesler. They are the department heads. Ms. Mesler handles recycling and our recycling program has developed into Number 4 in the County which is excellent. Of course, it is a tribute to the people of Carteret themselves for doing a fine job in cooperating with the Recycling Program. Not always is everybody happy with things, but unfortunately, we have to do this in order to keep up with the County and State's codes. 3 Committee Chairman Semenza reported that under Sewage, Mr. Biel has done an excellent job. We've had less flooding than we had in the past due to the job he's done on our catch basins in town. He thinks that he is running the department well. There's progress there. Mr. Kazio has done a good job at the Municipal Garage, as good a job as he can do with the type of equipment that he has. Hopefully, we can upgrade that equipment in the future year. JANUARY 1, 1996 STA.~If1ING CO"~1ITTEES cnN'T. JAr~Ul-\RY 1, 1996 STANDING COMMITTEES CON'T. He reported that as far as Mr. Surick, he takes a lot of abuse at the Borough Garage because he is the one in charge of the snow plowing and everything else. Nobody's happy, with the snow plow. They try to do a good job. They have to move the snow off the streets to allow emergency vehicles to pass. Some people complain because they shovel their aprons out and unfortunately, they get plowed back in. He even complained about that. But it's something they have to do. Some people tell them to plow it back into the middle of the road which, of course, they can't do. These departments heads take a lot of abuse but they do serve the public well. He thanked them and reported Progress. CERTIFICATE - KAPLAN F AtlIL Y Mayor Sica said that unfortunately, we lost a citizen in 1995 that contributed so much to Carteret. We can never replace a person like that. He stated that he is talking about Sam Kaplan. He said that he is sure that everyone in the room knew Sam Kaplin. If they didn't they couldn't have lived in Carteret very long. Mr. Kaplan has been a dedicated person to the Fire Department, the First Aid , the city itself, for so many years....all of the churches. It goes without saying, the contributions that he's done for the Ci ty of Carteret. Mr. Kaplan happened to have some paintings in his office that are quite rare. They were painted by a local artist Mr. Weber, who is present here. The Kaplan family would like to donate or loan a painting to city Hall. Personally, he thinks that the painting is invaluable. He presented Herbert and Susan Kaplan with a certificate and they officially donated the painting to Carteret. Herbert Kaplan said that many years ago in Carteret there was an unusual business of importing exotic wood, teak, and ebony. They were located right across the street from Columbus School. That business no longer exists but fortunately, a painting was made in its time. That painting hung in his father's law office for years. ~. ..-~-'- Now that he's gone, his sister Susan and he dedicated that the right place, the appropriate place for this beautiful painting is here in Carteret. It should be owned by the people of Carteret and they are donating it. There is a memorial plaque that says it is the I. T. Williams Lumbermill at Carteret, New Jersey, Artist Julius Weber, presented to the people of Carteret in memory of Samuel Kaplan, Esq. who dedicated his sixty-four (64) year professional career to serve in this community and it says it was given by them on this date. He called on Julius Weber to uncover the picture and to explain it. Julius Weber uncovered the painting and said that he spent sixteen (16) years right after high school in 1955.. ..He went there not knowing of. . . . (inaudible) . . . sixteen years in this plan when he realized the history of this plant which had horses and blacksmith shops. It was the largest mill on the east coast, importing foreign and domestic mahogony's from allover the world. They manufactured for Steinway piano, and Baldwin piano, casket companies, furniture companies, Chris Craft boats and Century boats. He realized that he better start recording these scenes in Carteret which he believes that he painted quite a bit, more or less, of the history of Carteret. He said that Sam Kaplan saw the painting, but he didn't want to give it up. Then he said that it will be in a public place which was his office. This is the first time they will have the painting, in a second galery in honor of him. Mayor Sica said that the wheels that were used to pull the logs out of the river which were brought to the mill were pulled out by mules and horses. They would pull the logs out of the river and..... (inaudible) off the boat, in the early 1900's, dray it shore and the mules would pull it and put it on the big wheels and take it to the mill. Those wheels are in the Smithsonian Institute. When Icabod T. Williams shut down, the Smithsonian Institute wanted those wheels. The wheels that were used are actually in there. 5 Councilmember Ziemba thanked the people of Carteret for their support for letting him serve them for the past four years as a Councilman. The Council must listen to the people because they are the ones who put them there and they are the ones that can get out of here. When he was elected, he was sworn in twice, one year to an unexpired term and the three year term. JANIIARY 1, 1996 KAPLAN FAMILY CON'T. COUNCIL"Et1ßER lm'BA JANUARY 1, 1996 COUNCILMEMBER ZIEMBA CON'T. He said that he always voted for what was good for the Borough of Carteret and the people, no matter who brought it up, Republican's or Democrat's or whoever. He stated that he would like to say one more thing in closing that sticks and stones will break his bones but names will never hurt him. COUNCI U1EMBER STIGLIC Councilmember Stiglic thanked the Council and the citizens of Carteret for allowing him to serve this last year as a replacement. He hopes that he's done the job to everybody's expectations. OATHS OF OFFICE ADMINISTERED Kathleen M. administered following: Barney, Municipal Clerk, the Oath of Office to the Councilmember James Failace Councilmember Jack Fazekas " Deborah Bialowarczuk James Failace Jack Fazekas William Feingold James O'Brien Sam Semenza ROLL CALL 1996 BOROUGH COUNCIL Councilmember " " " " STATEMENT OF MEETI NG NOTICE The Clerk stated that on December 21, 1995, in full compliance with the Open Public Meetings Act, a notice of today's meeting was sent to The Home News and Tribune, The Star Ledger and posted on the bulletin board. Notice was also published in both newspapers on December 27, 1995. 6 The invocation was given by Father Edward Puleo of st. Joseph's Church. The meeting was opened with a minute of Silent Prayer and the Pledge of Allegiance led by Mayor Peter J. Sica. 7 Mayor Sica wished everybody a happy and prosperous New Year. It has to be better than 1995 for him. He said that he would like to take this time to reflect on what happened in 1995 in the Borough of Carteret. As you know, we were faced with many dilemmas in the early part of the year. There was practically no money left in surplus. We were facing a tremendous tax hike. We were saddled by labor contracts that were exorbitant, we couldn't do anything about it, but fortunately we held our own. There was a slight tax increase. What can we do about this? We had to go out and find new ways to bring in sources of income to the City of Carteret. That, we did. We were successful in becoming an Enterprise Zone. Becoming an Enterprise Zone, we've allowed to amass some monies in Trenton, in excess of $150,000.00 at the present time, that can be used in the City of Carteret to develop it. With some innovations, we can use it for a lot of things. We hope to start the beginning of 1996, some serious engineering and negotiations with the City of Woodbridge to complete the second phase of our Industrial Road. This can be used for that. We intend to do some major renovations at the turnpike. Some of this money can be used for that. That 3% sales tax comes back to the City of Carteret every year for the next twenty years. That money can be continually used to progress the City of Carteret. When we get that second phase of the Industrial Road, around the Chrome area, it will be a major improvement to the town itself. If you look at the Hill, there already is a major improvement going on there. New housing is being built with the aid of private contractors. We were successful in getting money from Cranbury and from Readington, New Jersey. We should start rece i ving that money at the beginning 0 f thi s year. Unfortunately, rumors have it that we've already gotten and spent the money. We haven't gotten one penny. Everything that was done so far was done by private people with private capital. Yes we've given some tax incentives to do that. In order to move the City of Carteret forward, you have to do that. JANUARY 1, 1996 INVOCATION PRAYER, PLEnGE OF ALLEGIANCE ~'AYnR' S ~'ESSAGE FOR 1996 JANUARY 1, 1996 MAYOR'S t1ESSAGE CON' 1. In addition to that, we have to expand our industrial base, where we can put people back to work. In doing that, yes maybe we have to give up tax money for a short term and give companies incentives to come to Carteret. Yes, we did do that. Again, some people think that's wrong. We are an old industrial town that has to be developed. We have to gi ve people incentives to come here to put our people back to work. Some of the very same people that complain about it are people that are working there. That's ridiculous. We have to stop this baloney and politics and move forward. The Mayor continued to note that we were successful in attracting a major corporation that's going to come to the City of Carteret and build a huge Mega Mall. If we did attract someone to take over our old landfill, the city of Carteret will be strapped with a five to ten million dollar bill to close that landfill. That will come out of the taxpayers pockets. The City of Carteret cannot afford that. By working with this large company and bringing in the proposed Mega Mall, we will put a minimum of 1,000 people to work building it, a possibility of 3,000 permanent jobs to the taxpayers of the City of Carteret. Yet, we again had to give up some tax incentives. This is the law of the state of New Jersey. There was a law passed in Trenton called 1760. Fortunately, he read that and made contact with these people. That law says that if you can get someone to build on top of an old landfill, you are allowed to give them tax incentives. We're not just giving them tax incentives, they're going to pay taxes, but in the interim, it will be a graduated tax from zero to 100% over the course of years. In the interim, we get 3% of every sale that's made in the shopping center. IKEA in Elizabeth has the same particular deal. They paid to the City of Elizabeth last year, in 3% sales tax based on $105 million dollars worth of business, $3.1 million dollars of sales tax went to the City of Elizabeth for one store. 8 Contrary to what the city of Elizabeth is doing, they're now going to build a super mall similar to what we want to do, but they're going to place upon the storekeepers a 3% franchise tax to pay for some of the improvements. We're not going to do that in the city of Carteret. The company that we have that's going to do this is paying for it out of their pocket. We're going to sit down with the turnpike this year and revamp the entrance and exit of the turnpike because of the mall coming in. We will have a direct access off of the turnpike in to the mall and onto our Industrial Road, eliminating the need to go down to the light and make a left to come into the Ci ty of Carteret. There will be maj or improvements made to that intersection possibly a t no cost to the City of Carteret. Maybe we won't even have to use our Urban Enterprise Zone money to do that. That's what is going to move the City of Carteret forward. 9 Mayor Sica stated that in 1995 they embarked on an ambitious plan to try to improve various things in the City of Carteret. We purchased five acres of land from the Mobil Foundation. The land was on the market for $650,000.00.. Through some hard negotiations, we got it down to $275,000.00. That's a tremendous buy for the people of the city of Carteret. We are going to build a library there anda community center that can be used by the seniors in the daytime. We'll have a community center that's equipped for 500 or 600 people so we don't have to have a day group and a night group. We're embarking on a project to revamp Civic Center Park to build a clubhouse and a recreation type facility for the girl's softball, Pop Warner, the Little League and the Cheerleaders. All in one building with a recreation type hall where they can practice and go to classes and stuff like that. We intend to turn the old Senior Citizen Center into a youth center that can be open every day from 3:00 -9:00 at night. These are all ambitious projects. We intend to get our waterfront development going. Yes, we are having some problems in Trenton, but we'll make enough trouble in Trenton that the problems will go away in 1996. We want to develop that into a major marina. We can fix the dock and put a park in there and they can't stop us from doing that, but that's not what is going to make Carteret move ahead. We want to put a marina in there where people pay to park their boats. Of course, the people of Carteret will pay a lot less than the guys from out of town. We will have a marina that will help pay for whatever other monies will be necessary to make this a major park and marina to be used by future generations in the City of Carteret. JANUARY 1, 1996 MAYOR'S t1ESSAGE CON'T. JANUARY 1, 1996 MAYOR'S MESSAGE CON' 1. . Mayor Sica said that we revamped many things. We were successful in reducing our insurance costs and that is what helped to give us some surplus this year, unlike last year when we were left with virtually no surplus at all. We've now been successful in having surplus again. That's not to mean that we may not have a slight tax increase next year. We've asked the Borough employees to work with us. The past Council and he is sure that the future Council, the two new members, are going to work hand in hand to keep raises in the City of Carteret to a bare minimum, or zero, if at all possible. The private sector has been stripped of their ability to pay for public employees. At one time, nobody wanted jobs working for the Cities, States, County Government or the Federal Government. They didn't pay a lot. Now, it's just the opposite. They pay a lot. It's the rest that don't pay. They're going to ask the School Board this year to take a hard look at negotiations, because again, the private citizen's don't have the ability to pay like they've had in the past. We've lost the company's like IT Williams, that paid a lot of dollars. U. S. Metals, Reichold Chemicals, Agrico, Benjamin Moore and Foster Wheeler. They've all moved out of the City of Carteret. They didn't move anywhere else, they closed everything down. This government has to take a hard look at where we're going in this country. We cannot continue to shut everything down in this country and make it foreign. The youth of this country cannot fulfill the American dream of having a decent place to live, having a car, raising a couple of kids and sending them to school, making a better life for their kids on $ 6.00 an hour McDonald's job. That's all we are building in this country today, McDonald's, Kentucky Fried Chicken, Burger King, Burger Express, TGI Friday's and Jose Tej a's. This country has got to start looking to the future, as does the City of Carteret. He is constantly in touch with various industries that want to come to Carteret. One company would build a building bigger than Whi te Rose and employ 400 or 500 people. He's been working eight months with this company trying to get them here. We have some new ones that will be announced in the next couple of month's, that are coming to Carteret. 1n ----". The City Mayor Sica added that in 1995 some people deserve a little more recognition that they got here today. One of them happens to be Councilmember Bialowarczuk and Beverly Hedesh and the Recreation Committee. For years, all he's heard is that there is nothing to do for the kids. This was the biggest Ethnic Day in the history of Carteret. We had a Soap Box Derby. I f the people of Carteret would see the enthusiasm of those kids, it was amazing. We had a Halloween parade. He said that he thinks that the last time we had a Halloween parade was in 1975 when his horse ran away. We had a Christmas tree lighting ceremony in the park this year. Every child got a toy and hot chocolate. These are the kinds of things that are necessary in Carteret. He asked the audience to give Councilmember Bialowarczuk and that Committee a round of applause. The beautiful part of it is, they lived within their budget. A lot of it was done with volunteers and senior citizens. Those are the kinds of things that have to move Carteret forward. If this new Council works together these things can continue to happen. He said that he is always available to every member of this Council, whether they be Republican or Democrat. He said that this is not a fun job and that they take a lot of abuse from a lot of people. If they can refrain from abusing one another, they'll be a lot better off. If they put politics aside from today on and do what is right for the community, we can move forward. , 11 The Mayor spoke about trying the put the sewer user fee in years ago and how the Council running for office at that time didn't want to do it. When he ran they put it in and he got re-elected so he guesses it wasn't so wrong. In 1983, the prior Council proposed to build a sewer pump station of 35 million gallons. He went to court to block it and got it knocked down, cutting the cost in half. Then, they instituted the sewer user fee and they've been successful in collecting that fee every year and amassing reserve money so that they could continue to upgrade the sewer system in Carteret and still much more has to be done. Last year alone, because of the revamping that they did, they cut their expense from the Middlesex County utilities Authority. We were successful in saving a minimum of $125,000.00. That money goes right back into sewer surplus. With that, we are going to fix some of the sewers in W. Carteret this year. JANUARY 1, 1996 '1A YOR '$ MESSAGE CON 'T. JANUARY 1, 1996 M,~YOR' S MESS^GE CON' 1. We will complete the Beverly Street project and that is the way to move Carteret forward, watching our pennies. It doesn't sound like a lot of money when you say you're paying two cents a gallon to treat the sewage but when you are treating two or three million gallons every day more than you're suppossed to, those pennies add up. We were successful last year in saving $125,000.00. That's what we have to do. He said that he is sure that with the new Council, if they work together these things will continue and they will continue to move Carteret forward. These projects that we desperately need, the new library, new schools, new road proj ects, new sewer proj ects, the attracting of new industries will continue and Carteret will move forward. Mayor Sica said he thinks that they had a very successful year in 1995. They will try to hold the line on taxes in 1996. The work being done now to stabilize the taxes doesn't happen overnight. The new industries will start paying and then they will be able to move ourselves foward. If there are no disagreements on the shopping center, someday, they'll be able to sit there and say that it was a good move. Some projects were proposed years ago and never went through and it cost us millions of dollars in ratables that could have been used to build a new school, the library, the sewers and roads, youth center and the parks. The Council did not have the foresight for years and those projects didn't happen. These projects will happen. NmUNATION - 1996 COUNCIL PRESIDENT Mayor Sica asked for a motion to nominate a Council President. Upon MMS&C, by Councilmembers Feingold and Bialowarczuk, Sam Semenza was nominated. Upon individual roll call vote, Councilmembers Bialowarczuk, Feingold and Semenza voted in the affirmative. Councilmembers Failace, Fazekas and O'Brien voted No. MAYOR B RE^KS TIE Mayor Sica voted in the affirmative to break the tie. 12 Mayor Sica asked for a motion to adopt the 1996 Rules of Council with an addition to Article V, Standing Committees, Section 3. He asked for an additional committee called Municipal Garage. Upon individual roll call vote, Councilmembers Bialowarczuk, Failace, Fazekas, Feingold, O'Brien and Semenza voted in the affirmative. 1996 RULES OF COUNCIL ON THE FOLLOWING PAGES 13 .. 1996 RULES OF THE BOROUGH COUNCIL ßOROUGH OF CARTlmlCT ARTICLE I The deliberations of the Council shall be governed by "Robert's Rules of Order". ARTICLE II MA YOR SECTION I. The Mayor shall preside over the deliberations of the Council and shall conduct the meetings thereof lie/she shall see that the laws of the State and the ordinances of the Borough are faithfiJlly executed and followed. lie/she shall recommend to the Council such ordinances, resolutions or actions that he/she shall deem necessmy or expedient and in the best interest and the welfare of the Borough. He/she shall maintain peace and good order and have power to suppress all tumultuous assemblies in the Borough. The Mayor shall oversee the daily departmental and agency responsibility of the Borough. In his absence this duty shall be assumed by the Council President. (See R.S. 40:87 et seq. and 40:88-1). SECTION 2. lie/she shall, on all occasions preserve the strictest order deconnTI, and he/she shall cause the removal of all persons who interrupt the orderly proceedings of the Council. SECTION 3. I-Ie/she shall decide all questions of order subject to an appeal to the Council. SECTION 4. In the absence of the Mayor, or if h~/she is unable to perform his/her duties, the Council President (or, in his/her inability to act, the Coì.\ncilmember having the longest term as such in consecutive years) shall act as Mayor, as provided by Statute. (See R.S.40:88-3). ARTICLE III BOROUGH CLERK SECTION I. The Clerk shall perform the duties enjoined upon him/her by revised Statutes of New Jersey and these By-Laws (See R.S. 4087-54 et seq.). 14 SECTION 2. He/she shall keep the minutes and ordinance books properly and fully indexed and shall perform all the duties usually devolving upon such otlìcer; and in addition, such other duties or services as the Mayor or Council may direct. SECTION 3. He/she and/or the Deputy or Assistant Clerk shall be the liaison otlìcer between the Civil Service Commission and the Borough of Carteret. .""" ARTICLE IV MEETINGS SECTION 1. The Council shall hold an annual meeting on January First at Twelve O'CLOCK Noon, or, during the lìrst seven days of January in any year (See R.S. 40:88-1). SECTION 2. That at the aforesaid meeting the Council shalllìx the time and place for holding regular meetings during the ensuing year, which time and place shall be the lìrst and third Thursday of the month, with the exception of July and August, which time shall be the third Thursday of the month, 7:30 P.M., at the Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. In the event ofa holiday the meeting shall be held on the Tuesday of the same week. The public shall receive due notice of the meetings pursuant to the "Open Public Meetings Act". SECTION 3. At the annual meeting, the Council will elect one of its members as Council President to serve for the calendar year. (See R.S. 40:88-2 and 3) SECTION 4. The Mayor shall, when necessary, call special meetings of the Council, in case of his neglect or refÌJsal, and four members of the Council may call such meetings at such time and place in such Borough as they may designate, and in all cases of special meetings reasonable advance notice considered to be of forty-eight hours except in case of emergency shall be given in person to all members of the Council, or left at their place of residence. (See R.S. 40:28-24). SECTION 5. On the Thursday preceding every regular Council Meeting, the Council shall meet at the Council Offices àt 7:00 P.M.. This shall be known as the official Agenda Meeting. At this meeting the agenda of that week's regular Council Meeting shall be planned. Resolutions, ordinances or other items of business being prpposed by a Standing Committee or member of the Council shall be considered by the whole Council. If the majority of the Council agrees to put the proposal on the agenda for the business meeting, it shall then be turned over to the Borough Attorney to be put in its proper legal form. The Council shall be polled in alphabetic order to determine if any new business will be proposed and the nature of its subject mÛler. Any business not placed on the agenda shall be out of order and prohibited. Where, however, the majority of the Council present at a reb'ular, special or adjourned meeting of the Council approve the matter not previously listed on the agenda, such matter may then be considered. The public shall receive due notice of the agenda meetings pursuant to the "Open Public Meetings Act" Discussion at the agenda meetings shall be limited to those invited to participate by the Mayor and Council. SECTION 6. A quorum shall be provided by the Revised Statutes of New Jersey, viz.; three Council members and the Mayor, and in the absence of the Mayor, four Councilmembers (See R.S. 4088-1). 15 SECTION 7. Ifno quol1lm be present at any meeting, those assembled shall have the power and are hereby authorized to set a new meeting date, and then adjourn. SECTION 8. The following order of business shall be observed viz.: 1. Call the roll 2. Moment of silent prayer 3. Pledge of Allegiance 4. Approval of minutes 5. Introduction of Ordinances 6. Public Portion on Resolutions 7. Introduction of Resolutions 8. Payment of Bills 9. Presentation of communications, petition, etc. 10. Reports of committees and department heads II. Greeting of public and invitation of discussion 12. Adjournment SECTION 9. The public shall be anòrded the opportunity to speak on the contents of the proposed resolutions. The public shall not be allowed to address the Council while they are taking action on the resolutions. No one may be allowed more than five (5) minutes when addressing the Council. SECTION 10. Reports of commillees shall be presented by alphabetic order of the members of Council. SECTION It. During the last public discussion portion of a Council Meeting, each person recognized by the Chair shall be permitted to discuss matters of public concern at said meeting limiting their speaking to five (5) minutes per person. SECTION 12. The aforesaid order of business at any meeting may be changed by a majority vote of the members of the Council present at such meeting. SECTION 13. Except as othelw.ise required by the Statutes, or specially provided in the By-Laws. all action of the Council shall be by a majority vote of those present. SECTION 14. Upon demand of one member of the e6uncil, or when ordered by the Mayor, or when directed by Statute, a roll call vote shall be taken and the yeas and nays entered in the minutes of the meeting. AHTICLE V STANDING COMMITTEES SI~CTION 1. The Mayor shall name all connnillees with such appointment subject to the concurrence of a majority of the Council. The Mayor shall see that all matters referred to the committees are acted upon and reported promptly. Should a majority of the Council not concur in the appointment by the Mayor of any Councilmembers to any committee, a majority of the members of said Council are hereby empowered to make such appointment. 16 SECTION 2. The following Standing Committees of the Council conslstmg of three Councilmembers, with the first named Councilmember to act as Chairperson shall be proposed at the annual Meeting, viz.: I. Buildings and Grounds 2. Finance and Administration 3. Fire 4. Parks and Recrealion/Shade Tree Commission 5. Police 6. Public Works Committee members shall meet and/or consult dnring the lìrst and fuurth weeks of each month as tbe need arises in order to conduct their respective committee business. They also shall coordinate their common efforts, so as to adhere to requirements of all local Ordinances and Resolutions, as well as purchasing practices and procedures for the benefit of the Borough. Each Councilmember shall be a member of at least one committee, and will be a committee head of at least one committee, as an obligation of his council duties. Failnre of a Councilpersonto assume these responsibilities may result in appropriate action by the Council as a whole, e.g., withholding of pay and benefits. SECTION 3. In addition to other responsibilities, the Standing Committees shall perform the following functions: I. DEPARTMENT OF BUILDINGS AND GROUNDS: This committee shall be responsible for the.proper maintenance and janitorial service of the Borough Hall. 2. FINANCE AND ADMINISTRATION: The primary function of this committee is to assist the Mayor and Council in the preparation of the annual budget to be prepared on or beIDre February 15, of each year as well as providing assistance for the proper coordination of purchasing flll1ctions and needs of the departments and agencies which the Standing Committee of the Borough represents. This committee shall be responsible for the personnel and equipment of the offices of the Borough Clerk, Assessor, Collection-Treasurer, Buil'::lng Inspector, Department of Welfare, Engineer, Auditor and Attorney. In addition, the Chairperson of this Committee shall also serve on the Welfare Board. 3. FIRE: This Committee shall be responsible for the personnel and equipment of the Fire Department, including all fire houses. 17 4. PARKS AND RECREATION/SHADE TREE COMMISSION: This Committee shall be responsible fDr the personnel and equipment of the parks, playgrounds, senior citizens' transportation and all recreation activities. This Committee shall also be responsible for the implementation and administration of the Shade Tree Program. · 5 POLICE: This Committee shall be responsible tòr the personnel and equipment of the Police Department and facility. 6. PUBLIC WORKS: This Committee shall be responsible for the personnel and equipment of the Streets and Roads Department. Municipal Garage Services. Recycling Department, Sewerage Department, including street cleaning and the borough dump. 7. MUNICIPAL GARAGE SERVICES: This Committee shall also be responsible for the maintenance and repair of all municipal vehicles, including but not limited to. Police vehicles, Fire vehicles, Park vehicles, Sanitation vehicles, Sewage vehicles and purchasing of parts for said vehicles; and further shall be responsible for the maintenance of the Borough Garage SECTION 4. Standing Committees are appointed to expedite and facilitate the work of the Council, but only within statutory, Borough Ordinance and Rules of Council limits as the entire Council is held responsible for any or all of its acts. SECTION 5. A Standing Committee shall: I. Plan, study and control within budgetary and statutory limitations; carryon the routine activities for which it has primary responsibility. 2. Perform such acts as may be assigned to it by the CounciL 3. Report and make recommendation to the Council regarding its responsibilities and activities. SECTION 6. The Mayor shall nøt: I. Make promises or commitments to anyone which directly or by inference bind the CounciL 2. Act in such manner or make decisions which set a precedent or violate established Council policy. 3. Expend any money whatsoever, except with the approval of the CounciL SECTION 7. Special committees shall be appointed for purposes other than those included in the duties of the Standing Committees by a majority vote of the CounciL SECTION 8. The Chairperson of each Standing or Special Committee shall be prepared to report to the Council at each regular meeting on the pHncipal activities and achievements of his/her Committee. 18 SECTION 9. All department heads in charge of Direct Supervision of Borough Employees, shall prepare and submit a monthly report on his/her department activities and achievements and a report on the conduct of his/her employees including sick leave, overtime and attendance. The report is to be submitted to the Department Chairperson and the Clerk for proper filing. ARTICLE VI BILLS, CLAIMS & VOIJCIIERS SECTION 1. All bills, vouchers, or claims against the Borough shall be in writing and certified by the vendor, Rilly itemized and on such forms as the Borough shall promulgate for that purpose through the Finance Department. As required by Statute, said forms shall be sworn to by the claimant before submission for approval and payment, vedfying that the work or materials have been supplied, or services rendered, to the Borough, in accordance with specifications, plans or order. Borough Ordinance #45- J, et seq., sets forth the specific procedures in connection with bills, claims and vouchers, and the requirements thereto. SECTION 2. Pursuant to the Borough's Purchasing Agent Ordinance, Resolution #89-300 and other formerly adopted resolutions of Council and State Statute, no vendor's request for payment, supplies or services rendered shall be honored unless properly completed. No Borough Officer, Official, Agency Head or any other Borough employee, may purchase any article, item, material, service or equipment for use by the Borough, except in accordance with the provisions contained in Borough Ordinance 45-1, et seq. - Purchasing Agent SECTION 3. The route of purchasing requisitions, purchase orders, vouchers, bills or claims to be paid by the Borough shall be in accordance with the Purchasing Agent Ordinance 45-1, et seq., which shall govern all purchasing within the Borough, and shall be the sole guide, subject to requirements of State Statute The Finance Department, having confirmed compliance with the provisions of the Purchasing Ordinance, shall refer all verified bills, claims and vouchers recommended for payment to the Council. The Finance Department shall prepare a list of the total amount of the individual vouchers approved by each committee, and subsequently recommend for payment by the Financing Committee, according to budgetary appropriations. The Finance Department shall keep an accurate nll1ning total as to any appropriation for payment of any particular account or accounts, or for any particular services or supplies, so as to be available to provide this information readily. The Finance Department shall alÅ¡¿; maintain costs and/or a voucher trail as to all vouchers which have been paid and shall be paid. Authorization to draw checks and pay the amount of the approved vouchers by the Council members shall be made by formal resolution of the Council, in compliance with applicable State Statute. The Chief Finance Officer may delegate the above duties/fill1ctions but in all cases shall be responsible f1Jr compliance. SECTION 4. Corresponding vouchcrs, invoices, or bills shall accompany all checks drawn in payment thereof, when the said checks are presented to the Chief Financial Officer, Mayor and Borough Clerk for original and/or mecbanical signatures. 19 SECTION 5. All bills, vouchers, invoices and paychecks shall be filed in a safe place in the Finance Department Office. ARTICLE VII AMENDMENTS SECTION 1. The Mayor and any member of the Council may propose amendments to these By-Laws, at any regular meeting or adjourned regular meeting. SECTION 2. The proposed amendment shall be considered for adoption at the next regular or adjourned regular meeting of the Council, after its introduction. The proposed amendment shall be adopted by a majority vote of the Governing Body present at the meeting and sball become effective immediately ARTICLE VIII ADOPTION AND TlmM SECTION I. The By-Laws shall be adopted by a resolution of Council concurred in by a majority of the Members of Council. The By-Laws shall become effective immediately after adoption and shall remain in effect for no longer than December 31 st of the calendar year in which the By-Laws were adopted. ARTICLE IX SECTION 1. Any Borough Employee violating any of these mles sball be subjected to disciplinary proceedings and may be suspended or removed. ARTICLE X The Borough Engineer, Borough Attorney, Borough Collector-Treasurer, Borough Auditor and Chief of Police shall submit the following written reports to the Mayor and to the members of Council: 1. A monthly report summarizing the progress of all matters being handled or worked upon by each. This is a monthly "Progress Report" to be submitted prior to the first meeting of the next month. (;) 2. Project or Case Report - Reports that will give in detail all facts about the projects or cases completed by either or both the Borough Attorney, Borough Engineer, B'Jrough Auditor and Chief of Police, to be presented before the meeting next following the completion of the case or project. 3. Special Reports - To deal with any special information the Borough Council may need to be informed on any new case or project of either the Attorney, Engineer, Collector-Treasurer, or Auditor. To be presented as soon as needed and requested by majority vote of Borough Council. 4. Year End Reports - These will summarize work for the year by the Borough Attorney, Borough Engineer, Borough Auditor and Chief of Police. They will be presented to the Mayor and Councilmembers prior to the first regular meeting of the Council in the next succeeding year. They will serve to acquaint new officials with prior and continuing activities of the Borough Attorney. When he first became Mayor we were making $30,000.00 a year on investments because we had one bank and the bank gave us what they wanted to. The second year that he was Mayor, we made $440,000.00 in interest by shuffling the money around. Councilmember Feingold congratulated the two new members of the Council. He is sure that they will do their best. It's been a quick year for him. It's gone very smoothly. Judging from what they've begun this first year, the second and third years should be very fruitful under the leadership of our Mayor. He thanked him. It's been an honor to serve the residents of Carteret. Ihis coming year will be better than the last year. He thanked everyone and wished everyone a Happy New Year. Councilmember Fazekas said that there are a lot of people he'd like to thank, but there's just too many and he already did that. He said that he'd like to single out one person in his life that's been with him twenty-two (22) years, his wife Ellen. He thanked her for making his life what it is now. He thanked his children, Danielle and J. P.. He stated that he is here, he's ready and let's go. Councilmember Bialowarczuk congratulated Jack and Jim and said that she is looking forward to another good year. She said that a lot of comments that she's gotten during the year were people asking her if this drives her crazy. She said no and thanks to the Mayor, Sam and Bobby, she got the answers to questions she had. She said that it was fun and that she enjoyed this first year. She is looking forward to this next year. She wished everyone a Happy, Healthy, New Year. 29 Councilmember Semenza welcomed Jack and Jim. They will be a credit to not only this Council, but to the town. He's known them a long time and they will do well. As the Mayor said before, we're going to try to work as a team. Of course, everyone heard one side vote and the other side vote. He guarantees that this is strictly the political end of committees and everything else. He really believes that the Council, when it comes down to working for what's right for the citizens of Carteret, will work together as a team. He wished everyone a Healthy, Happy New Year. He hopes that this Council will work as a team for Carteret. JANUARY 1, 1 q9fi CONFI RMEO REMARKS - BOROUGH COUNCILMEMBERS JANUARY 1, 1996 REMARKS - BOROUGH COUNCILMEMBERS CON' 1. MAYQR'S COMMENTS James Failace said that there are three things in his life that are very important to him, his church, his family and this town that he lives in. He thanked Father Puleo, his pastor at St. Joseph's for accepting the invitation to do the invocation. He said that it was beautiful and he thanked him. To his wife and children, through all of his years of involvement in Carteret and all of the burdens and hardships he put on his family, never once did they waiver in their support of him. He always tells them he loves them, but he doesn't tell them thank you. He thanked his mom and dad, sister, brother-in-law and mother- in-law for being there and sharing this very special day with him. To the citizens of Carteret, he said that he is exci ted and proud to represent them up there on the Council. He takes very seriously the responsibility they've given him. He and Jack both enrolled, at their own expense, and are currently going to a class on municipal government at Rutger's University to help them do the best job they can to represent them. He said that he hopes that the Council Meetings are as crowded as it is today because it is their job to represent the people. He'd like them to be there to tell him whether he is doing something wrong. When he is doing something right, they can tell him that too, he'd appreciate it. He said that he wants to make Carteret a better place. We all do. He wants to make Carteret a place that people are moving into, not moving out of. He thanked everyone for their support and wished everyone a Happy, Healthy, New Year. Councilmember O'Brien congratußted Jim and Jack for winning. He knows, as Mr. Semenza says, that they will obtain the cooperation of the Council when it comes to the betterment of Carteret. He wished everyone a Happy and Healthy New Year and long life. Mayor Sica welcomed the two new Councilmembers, Jack Fazekas and Jim Failace. He is sure that they have the interest of Carteret at heart today. 30 JANUARY 1, 1996 31 ."".~ He just hopes that it works that way for the next 365 days and that we can move this town forward. He thanked his wife and his family and kids for the support they've given him. Starting this year, he's in his 19th year in office. He said that it's about nineteen too long. His wife and kids have supported him all nineteen years and he thinks that it is great and he wants to thank them. He said that 1995 has been a very fruitful year for the city of Carteret and 1996, with the cooperation of everybody, could move Carteret even further ahead. We can get back to the Carteret that used to be. We can get back to all.cif those recreation acti vi ties. We can also get back to putting people to work and to attracting decent industries into the City of Carteret that are going to employ people and pay a decent wage. We have to get back to improving a lot of things that have been neglected for a lot of years. We have a library that goes back to the turn of the century and schools that go back to the 1800's. If we don't continue to move Carteret forward, we're going to fall to the wayside. We would not be a thriving community. When we can get the Governor to come here and cut the ribbon on a major industry and get involved in doing these projects we're trying to do, that shows that old industrial towns like Carteret have a future in this country. The only thing that remains to be done is that the City of Carteret continues to do that and set an example for other towns, not only in New Jersey, but in the country. As he said many times on television, its the little Borough's of Carteret that have made the United States of America such a great country. It's these small towns that took the brunt of all the wars that were ever fought by this country, by manufacturing the copper, the o~l, the fertilizers, the cloth and the machinery parts for everything. This part of the country has made the country great and for too long, the rest of the country has turned their back on the little Borough's like Carteret and the state of New Jersey and the thirteen original colonies that made this country so great. We worry more in this country about the spotted owls in Oregon and the people killing one another in Bosnia than we worry about the ghetto's in New Jersey. We have to stop this. We have to sit back and re-think our thinking. We have to get the industrial might of this country going again in this country and prospering this country. Thus, when we get back on the right track, then we'll worry about the rest of the world. Again, the little Borough of Carteret can be a forerunner in that by building a better future.
