Sica, 7:30 P.M., Municipal court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday, January 18, 1996. JANUARY 18, 1996 REGULJlR ~1EETINr: JANUARY 18, 1996 Upon individual roll call vote, the following ROLL were noted present: CALL Mayor Councilmember " " " " " Peter J. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor Peter J. Sica. The Clerk stated that on January 12, 1996, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News & Tribune, The Star Ledger was posted on the Bulletin Board. Upon MMS&C, by Councilmembers Semenza and O'Brien and unanimous affirmative vote of the full membership present, the minutes of December 27, 1995 were approved as transcribed and engrossed by the Clerk. This was the night advertised to receive bids for the Communitor at Dorothy st. Pump station and the Mayor called for all bids. Upon MMS&C, by Councilmembers Semenza and Bialowarczuk and unanimous affirmative vote of the full membership present, the Clerk was directed to open and read aloud all bids received which were as follows: 1 Bidder ~ Bid Price P & H Construction BB 255 Margaret King Ave. POB 305 Ringwood, N. CERTIFICATE - PTL. HUCHKO Mayor sica presented a certificate to Patrolman Huchko for his efforts in getting free painting and letter for the police cars. ORDINANCE #96-1 VACATING EASEr1ENT ORDINANCE #96-1 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held February 1, 1996, upon MMS&C, by councilmembers Semenza and Bialowarczuk. FI RST READING Upon individual roll call vote, councilmembers Bialowarczuk, Failace, Fazekas, O'Brien and Semenza voted in the affirmative. councilmember Feingold Abstained. ORDINANCE #96-1 "VACATING EASEMENT OF LOT 6, BLOCK 208 KNOWN AS 178 PERSHING AVENUE" ORDINANCE #95-61 VACATING BOROUGH PROPERTY The Clerk stated that ordinance #95-61 was introduced and passed upon First Reading at a Regular Meeting of the Borough council of the Borough of carteret held on December 7, 1995. It was duly published in The Home News Tribune on December 12, 1995 with notice that it will be considered for final passage after public Hearing to be held on January 18, 1996 at approximatelY 7: 30 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. COMMENTS Borough Attorney Hedesh said that it would be appropriate at this point to hold the public hearing, but then to table passage of this Ordinance. Today, he got a letter from the attorney who handles the land sale, who sent him a coy of a letter from the attorney who at that point in time handled the foreclosure of this property. There's a question on whether the.. (inaudible)...whO foreclosed this property removed all liens. Somebody is saying there's a lien. 2 It's his gut reaction that, and the reaction of the other two Counsel, that the person got notice of the lien and never responded and now is saying they didn't know anything. The file was not readily available at 3:00 this afternoon by that attorney. We should have the public hearing and table passage. If the person was served then any rights to the property is absolved. If he wasn't served or if it wasn't recorded, then that's a whole other issue. Upon MMS&C, by Councilmembers Semenza and Bialowarczuk and unanimous affirmative vote of the full membership present, the Mayor declared the Public Hearing to be open: There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Semenza and 0' Brien and unanimous affirmative vote of the full membership present. A copy of each resolution was placed upon the table for public review prior to the meeting in accordance with the Rules of Council and upon MMS&C, by Councilmembers O'Brien and Semenza and unanimous affirmative vote of the full membership present, the meeting was opened for public input on all resolutions. 3 There being no comments or objections to the Resolutions, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Semenza and Bialowarczuk and unanimous affirmative vote of the full membership present. RESOLUTION #96-25 was introduced by the Mayor and was referred to the Council for action. Councilmember Failace asked that this resolution be tabled. He said that there is more information that is needed. He understands that this is supposed to be 5-1/2 percent, which is less than Mr. Wanskus, but now they are asking for a fixed rate. If the project is at two million dollars, 7-1/2 percent will be $142,000.00. This is only for the first phase. 7 Mayor Sica said that's....(inaudible)....of the water. That's different. He does the testing of the water. This phase is only 5-1/2 percent. The Mayor said that they can table it if they want, but that this is why we have Agenda meetings. Councilmember Failace said that he understands that. They were told a couple of things at the Agenda Meeting and they can still formulate some questions after the Agenda meeting and he did. Councilmember O'Brien second the motion. Upon individual roll call vote, Councilmembers Failace, Fazekas and O'Brien voted in the affirmative. councilmembers Bialowarczuk, Feingold and Semenza voted No. Mayor Sica voted No to break the tie. COMMENTS Councilmember Fazekas apologized and said that he just hasn't had time to review this resolution and that's why he would also like to table it for further discussion. He said that he is not against it. He wants to see this project, as others, succeed in Carteret. councilmember O'Brien said that he would like to review the contract that Mr. Valetutto submitted. ADOPTED Upon MMS&C, by Councilmembers Semenza and Bialowarczuk RESOLUTION #96-25 "PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES - AJV ENGINEER- ING" was adopted. Upon individual roll call vote Councilmembers Bialowarczuk, Feingold and Semenza voted in the affirmative. Councilmembers Failace, Fazekas and O'Brien voted No. Mayor Sica voted Yes to break the tie. AGENDA AMENDED The Mayor asked for a motion to amend the Agenda and open the meeting to the public on Resolution #96-26. Councilmember Failace made the motion. councilmember Bialowarczuk second the motion. Upon individual roll call vote, Councilmembers Bialowarczuk, Failace, Fazekas, Feingold, 0' Brien and Semenza voted in the affirmative. OPEN TO PUBLIC CLOSED The Mayor asked if anyone in the audience wished to speak on Resolution #96-26. There were no comments from the public present and upon MMS&C, by Councilmembers Semenza and Bialowarczuk and unanimous affirmative vote of the full membership present, the meeting was closed to the public. 8 RESOLUTION #96-26 was referred to the council for action. REPORTS- DEPARTMENTS The Clerk stated that she was in receipt of the following reports: Clerk's Report December 1995; To Treasurer, $1,555.00. Fire - November 1995. Inspection of Buildings - December 1995; Total Estimates Cost of Construction, $2,040,378.00; To Treasurer, $8,094.00. Office for the Disabled - Annual 1995. Upon MMS&C, by Councilmembers Semenza and O'Brien and unanimous affirmative vote of the full membership present, all reports were ordered to be received and placed on file. STANDING COMMITTEES BUILDINGS AND GROUNDS: Committee Chairman O'Brien thanked Ted Surick and the guys for the good job with snow removal. He thanked the Parks Department men and Ray Tobias for doing a good job at Borough Hall cleaning away as much snow as possible. Ray has been doing basic maintenance around there. He will sit down with Ray Tobias and Patrick DeBlasio within the next two weeks to review their targets for this year. He reported Progress. 10 FINANCE AND ADMINISTRATION: Committee Chairman Failace reported that he sat down with Patrick DeBlasio. They have the wheels in motion for the budget. They will be meeting next Tuesday with the Department Heads to review the budget requests. He hopes that they can put together a good budget this year. FIRE: Committee Chairman Fazekas reported that this past sunday they had the swearing in of the new 1996 officers, but he was unable to attend it. He apologized to the firefighters for that and congratulated Chief Douglas Packard, Assistant Chief Scott pine, Assistant chief John Schon, captain Michael Bucsak, Captain Samuel Carrico, Jr., Lt. Carl George, Lt. Anthony Abello, 1st Lt. Robert McMickle and new firefighters Michael Allen and Brendon Rhodes. He thanked the firefighters for their work this past week. They had approximately forty-five calls in eighteen days. In addition, he's been reviewing the budget and becoming familiarized with the organization of the Fire Department, as well as the union and volunteers. PARKS AND RECREATION/SHADE TREE COMMISSION: Committee Chairman Bialowarczuk commended the Parks Department for working hand-in-hand with Streets and Roads the last two weeks. Ted Surick did a tremendous job cleaning the roads and the parking lots. She had the opportunity to plow during the snow storm. When you are sitting home you look at it one way, but when you're actually out there you get a whole different view of just how big Carteret is. They did a tremendous job. She reported Progress. POLICE: Committee Chairman Feingold said that he thanked Officer Huchko personally, but he'd like to thank him publicly for all of the things he's down with the lettering of the vehicles. Also, he is a fine policeman. As many people know, he is one of our most active police officers on the force. He does a really fine job out there on the streets. 11 He reported that he had a meeting with Chief Sica and some of the top brass of the police Department last week, a two hour meeting. They delved into some of the things that they are planning on putting into place this year and things that have been taking place in the past, to focus in on the positive things that are going on. He is sure that most of them are aware that they have the community police in force taking care of the Federal Highway Patrol. It's a foot patrol that is funded by HUD and is administered by the Borough. We handle the payroll from a grant that we get from HUD. That we do a lot to generally deter crime that takes place around some of our housing areas, particularly Herman Gardens and the other HUD funded housing projects that we have in Carteret. Also, we are in the process of actively seeking to educate the children from grade Kindergarten on up, as to the problems associated with drug and alcohol abuse. JANUARY 18, 1996 STANDING COMMITTEES CON'T. JANUARY 18, 1996 STANDING COMMITTEES CON' 1. That is one of the best things that we can do to get them while they're young and educate them so they don't fall into the perils of that problem. We also have the DARE program which most people are familiar with. That works in conjunction with the High School SADD group. All of these things help our community relations as well as educate the citizens of Carteret and the students and it's fantastic. A lot of towns attempt to do it but he thinks that our town is one that really succeeds in the process. He commended the Chief and the officers involved in those programs. He reported Progress. PUBLIC WORKS: Committee Chairman Semenza reported that as everyone knows we had a blizzard. At the last three or four meetings he reminded the public, as did the Mayor, that with winter coming we are going to get snow and vehicles must be kept off of the streets. They open the streets for emergency equipment only. That's their first purpose. During the height of the storm, the Mayor had to take one of his tandem trucks and lead the ambulance to Rahway Hospital. What we still need is more cooperation from the public. We did not get it. Most people left their cars and there was plenty of time and warning on TV that a major storm was going to hit. They didn't predict a possible four to six inches. They were predicting two to three feet. There was plenty of time. People have driveways and yet left two or three cars on the street. It hampered their clean up and opening of streets for emergency personnel. All we want is a little more cooperation. Mr. Surick and the department, along with our other two departments, Municipal Garage and Parks Department, did a great job. Our town was cleaner than Woodbridge or Rahway and was definately opened faster for emergency equipment. He asked that the people please keep their vehicles off the street for major snowfalls. At the last Agenda Meeting he made a recommendation to the Mayor and Council for alternate street parking. It will need a lot of work because it's not something that we can implement overnight. If we have parking on one side and people use their driveways properly, we could go down these streets, open them up first for emergency vehicles and clean them to the curb on one side. You dig your car out the next day, you move it over and we clean the other side and then we are ready for another storm. 12 Thank God we didn't get that storm that Friday when they said a possible ten more inches or we would have been in trouble. Cars were completely blocking the street. The Hill section was atrocious. It wasn't because of our plows. We received about four-hundred fifty phone calls with people crying that we plowed them in. Where were we going to put the snow? Their purpose was to open the street for emergency equipment. Then the next day they come back to widen the street if they could. They have to do what is right like other towns and follow a plowing procedure. He complimented Ted Surick and the emergency forces. Chief sica and the police Department did an excellent job with a disaster like that. The First Aid did a great job. The Fire Department must have had one-hundred calls during that stretch. They did a fantastic job. There was another fire today, a working structure fire on Warren street which' again, the Fire Department handled great. Councilmember Semenza said that a pumper came in today from Avenel. It tried to make a turn and cars were parked on the corner and the pumper scraped it. We have to have more cooperation. Years ago, people took a lot of pride in cleaning out the hydrants if it was anywhere in site of your house. That hydrant could save your house, your lives and your neighbor's lives. He said that he doesn't expect an elderly person to do it, but there are enough young people around. He reported Progress. councilmember Semenza added that they plowed the snow with our own equipment and the use of the Mayor's equipment. The only thing is, they definately need another loader to help with the snow removal process. It could also be used in the Park. He reported Progress. Mayor Sica said that he looked at specs today for a loader. We're going to rent one from a dealer and then, if we like it, we'll purchase it, provided he's the low bidder. We're going to order it tomorrow and hopefully, get it within a week. Borough Attorney Hedesh asked for someone to fax him the information tomorrow before the order is made. 13 MUNICIPAL GARAGE SERVICES: commi ttee Chairman Failace thanked Ted surick, vic Kazio, the Municipal Garage and the guys that were there all night and the following day trying to keep the trucks running and to keep the air filters from freezing up. Teddy had to drive to Elizabeth to get parts the next day. It was not easy. It was the first job that he and Jack had as council and it was rough. They went out on the trucks, too. He said that he spoke to vic about his needs for the year and he will sit down with him and go through his budget. He reported Progress. MAYOR'S COMMENTS Mayor Sica thanked everybody for the job they did with the snow removal. Some people in this town are just terrible and don't realize what kind of effort they put in out there plowing the snow. It wasn't five or six inches of snow, it was over thirty inches of snow. The snow drifted on Beverly Street, over five feet high. People have to realize that we have to keep the streets open. They have to go around and around because no piece of equipment is capable of pushing two and three feet of snow. Then you get the people that shovel their sidewalks and driveways in the height of the snow storm and when the plow comes back they throw their shovels at them. There was never a Beverly Street in Carteret. We paved it last August. The snow didn't stop falling when they got twenty calls to plow Beverly Street. That was not a priority street that was going to get plowed on Tuesday morning. We had to make sure that we got our thoroughfares, streets where people live opened up in case there was a fire, an accident, a heart attack or an ambulance call. That's just the way it is. He said that he heard on TV from Giuliani and pataki say what a great job they did in New York and the Governor say what a gret job they did in New Jersey. Remember one thing, the New Jersey Turnpike was shut down. That's easier plowing snow on the New Jersey Turnpike than it is in the City of Carteret. The Garden state Parkway was shut down and that was easier to plow. They didn't have to worry about people coming out of side streets or hitting cars or anything like that. It's just straight ahead. They don't have to worry about manholes, curbs, driveways or crazy people throwing shovels at you. Route #1 and all of the major highways were shut down. The bridge crossing over West Carteret to Rahway never once during the snowstorm was shut down. He said that he thinks that it was the cleanest bridge in the State of New Jersey. 14 .~' :'," All of those people said that they did such a great job, but all he knows is that Roosevelt Avenue, the Industrial Road, Washington Avenue and the major bridge that separates carteret from the hospitals was not shut down. They couldn't go to Amboy Hospital, they had to go to Rahway Hospital. He said that he did escort a little girl that got hurt all the way to Rahway Hospital, plowing the snow for the ambulance to get there. He said that he put in thirty-one hours behind one of his tandems himself and didn't charge the city one penny. His loaders were used anytime there was a difficulty in the city of Carteret, where one of our plows got stuck, his loaders went out and pulled them out. Sophie Cherepon said that something definately has to be done about alternate side of the street parking. There was an emergency call on Oak street, the day after the storm nobody had cleaned the walks. The people had to get out of their vehicles and walk in the snow to get to the house to help. They really did a commendable thing to help someone. She said that you can't force people to park in their driveways but maybe we have to start towing cars away. Mayor Sica stated that the Volunteer Firemen actually went out and started shoveling out the fire hydrants allover town, years ago people used to do that, if for no other reason, but to protect their own houses. People just don't care. 15 Bernadette Brown, Fitch street, said that three men dug out and no plow could get down the road. They had to get a loader which didn't come until 9:00 P.M.. On the block there is a baby with a heart monitor. She said that she took video of what she saw. The loader could not get down the street and had to call the cops. They didn't give the guys a ticket, but just told them to move their cars. There should be a $100.00 fine to teach these people a lesson. On any day on Fitch Street you can only come in one way. If there was a fire, they would have never made it on either side because of the snow. She suggested that the street be made a one way street. They should not park at that end of Fitch Street because if there is an emergency on any dead end street, the ambulance would never get down. JANUARY 18, 19Q6 M'A~QR 1~ COMMENTS CON'T. PUBLIC nISClISSION- 5 MINUTE LIMIT JANUARY 18, 1996 PUBLI C DISCUSSION CON' 1. Mayor Sica said that contingencies were made. He has three big loaders and the city has one. He has a police radio on him all of the time, twenty-four hours a day. If there was a problem where they couldn't get through, then one of his loaders or the city loader would have been dispatched to that scene to get them through. They worked around the clock, but there are contingencies. Madalene Nichols, 64 Dorothy street, said that she is a new resident to this community and in response to the comments about snow, the municipality she moved from is still snowed under. Carteret has something to be proud of. She said that she purchased a brand new home and she has problems with it. She's written to the Mayor, the Assemblymen, the Governor, (inaudible) , . . . . . the Real Estate Commission. Her furnace died. She said she wrote a letter to the Mayor. Mayor Sica said that he never received a letter. Mrs. Nichols said that she was in contact with Mr. DeFrancesco as of April 1994. Mr. Nagy came out and looked at the house and showed her some things that she wasn't even aware of. There is a leak in her water line, five gallons a week. Mayor Sica asked who built the house. Mrs. Nichols said that she doesn't want to say it pubicly. Mayor Sica said if she will give him a copy of her letter, he will find out who built her house and they will either fix everything they did there or we'll take his license away and he'll never build another thing in Carteret. Mrs. Nichols said that she has been in contact with her homeowner's insurance, but they are not the best company in the world because they were written up in the Wall Street Journal last year. Mrs. Nichols added that she has also been in contact with Congressman Bob Menendez because she intends to go to Congress, if necessary, to make sure that this doesn't happen to another homebuilder. She said that she has water pouring through her walls. The builder drilled holes, but he drilled them above the slab level. 16 ."'>;' She doesn't know if there are drains in that slab. The sump pump has never worked since she's been there and she's had flooding. When Mr. Nagy came he said that the french drains were never cleaned out and that may have contributed to the flooding. Ini tially , the water would come in around..... (inaudible) ...the cinder blocks, but now it goes all of the way up to the ceiling. Her water lines on the outside are hanging off. She has an air vent that is just sitting there without any support. Mayor Sica said that he will because they had to get a occupancy. check on this certificate of Mrs. Nichols added that the only one that helped her was Assemblyman Oros by telling her to come to this meeting.
