A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY GRANTING CONDITIONAL
USE PERMIT 83 -692 AND VARIANCE 83 -694 AND
ENVIRONMENTAL IMPACT REPORT FOR THE SANTA
ANITA CONVALESCENT HOSPITAL AND RETIREMENT
CENTER
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE:
SECTION 1. Based upon a public hearing and appeal, the
City Council does hereby confirm and readopt Resolution 83- 1086PC
of the Planning Commission, a copy of which is attached hereto
and incorporated herein.
SECTION 2. There shall be added to Section 3 of said Planning
Commission Resolution, condition no. 29, reading as follows:
"29. That root pruning of trees and replacement of sidewalk along
the 5300 block of Gracewood, in front of the hospital, shall be
provided as necessary per the approval of the Planning Director."
SECTION 3. The City Clerk shall certify to the adoption of
this Resolution.

A RESOLUTION OF TILE PLANNING COMMISSION OF TIIE
CITY OF TEMPLE CITY GRANTING CUP #83 -692 AND
VARIANCE #83 -694 FOR THE SANTA ANITA CONVALESCENT
HOSPITAL AND RETIREMENT CEiITER
The Planning Commission of the -City of Temple City does resolve:
SECTION 1. Based upon a public hearing, the Planning Commission
finds:
a) That the Draft EIR is amended in accordance with the public hearing
(as shown in the minutes) and as so amended is adequate and final.
b) As to the variance:
1) There are exceptional or extraordinary circumstances or
conditions applicable to the property involved or to the
intended use of such property, which do not generally apply
to other properties in the same zone, specifically, this is
a unique use of property in this area and repeated surveys
of the existing parking lots show them to be substantially
under - utilized.
2) Such variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property similarly situated but which is denied to the
property in question. If the variance is denied the applicant
will be unable to develop the property any further by either
the addition of beds to the convalescent hospital or the
construction of additional rooms on the retirement center.
The granting of the variance will not be materially detrimental
to the public welfare or injurious to the adjacent property as
there is now considerably more parking available than is needed.
Even after all construction is completed there will be approxi-
mately 75 to 10fspaces in excess of the needs of this
institution.
4) There are special circumstances as provided in Section 65906
of the California Government Code.
c) As to the CUP:
1) The site for the proposed use is adequate in size, shape,
topography and circumstances.
2) The site has sufficient access to streets and highways,
adequate in width and pavement type to carry the quantity
and quality of traffic generated by the proposed use.
3)' The proposed use will not have an adverse effect upon the use,
enjoyment or valuation of adjacent property or upon the public
welfare.
SECTION 2. According, a variance and CUP are granted to permit:
a) Increase hospital capacity without -new construction by 24 beds.
b) New construction at the retirement center for a one story 50 bed
addition- .which with the 100 bed existing capacity (reduced from 110) will
total 150 beds.

c) Reduce parking from 249 spaces to 228.
SECTION 3. Said approvals are subject to the following conditions:
1) Development shall take place substantially as shown on submitted
plot plans, floor plans, elevations and landscape plans.
2) Except as modified by zone variances, all applicable zoning
ordinance requirements shall be met.
3) Prior to commencement of any construction, final construction plans
shall be submitted to the Planning Department for review and approval, and
such plans shall conform to all applicable City ordinances and resolutions.
4) That applicant has represented that the grants herein meet the
applicants ultimate plea, accordingly, there shall be no additional beds
added to either the convalescent hospital or retirement center, even if all
beds are or are not being utilized; the maximum bed count of the convalescent
hospital is therefore set at 391 beds and the retirement center at 150 beds.
5)' The variance shall be valid only if the conditional use permit is
also approved.
6) That all utility facilities shall be placed underground.
7) That all landscape areas adjacent to parking and circulation areas
shall be enclosed by a raised 6" concrete curb or low wall. All planters
adjacent to the street right -of -way shall be constructed per specifications
of the Public Works Department.
8) That no outside open storage of any kind shall be permitted on the
site.
9) That this permit shall expire when the use for.which it is granted
is voluntarily discontinued for a period of 180 consecutive days or more.
10) That, once constructed, all improvements shall be maintained in
accordance with the approved plans.
11) That amended landscape and irrigation plans shall be submitted to
the Planning Department for review and approval and said plans shall be
prepared by a State licensed landscape architect.
12) That trash enclosure(s) shall be provided and maintained of a size
and location as approved by the Planning Director. Said trash storage
area(s) shall be enclosed with a solid wall of sufficient height to
adequately and aesthetically screen the area and shall include a solid
gate. The trash storage area(s) shall be maintained in good repair at all
times.
13)" That any mechanical and /or electrical equipment, including solar
panels, to be located on the roof of the structure or "pad" mounted on the
site, shall be shown on the site plan and elevation plans, and shall be
screened in a manner as approved by the Planning Director.
14) ThatAo final inspection or occupancy permit shall be granted until
all construction is completed and all improvements and landscaping are
installed in accordance with the plans approved and the conditions required
by the Planning Commission and /or City.
15) '-An approval granted by the Planning Commission does not constitute
a permit or authorization to begin any construction. An appropriate permit,
issued by the County Building Department, must be acquired prior to moving,
demolishing, or constructing any building or structure within the City.

16) That, wherever parking areas are adjacent to proposed landscaped
areas, an additional 2 -1/2 ft. of landscape area and 6" concrete curb shall
be provided in place of wheel stops. Areas not being used for parking,
pedestrian or vehicular circulation areas shall be landscaped.
17) That all landscaping shall, at all times, be maintained in conformance
with the approved landscape plan and in a manner acceptable to the Planning
Director.
18) That a lighting plan shall be submitted to the Planning Director for
review and approval prior to issuance of building permits. Lighting shall
be directed so as not to shine into adjacent residential areas.
19) That, during construction, traffic control and pedestrian protection
shall be provided in accordance with requirements of the City and Los
Angeles County Building Department.
20) That, during demolition and construction, noise shall be controlled
by limiting work on the.site from 7:30 a.m. to 4:30 p.m. and by requiring
all trucks and motorized equipment to have properly operating mufflers.
21) That noise shall be maintained within the limits of the City's
Noise Ordinance and applicants submitted air conditioner letter.
22) That sprinklers and hoses will be utilized during construction to
minimize dust emanating from the site.
23) That employees of the hospital shall park on -site and a visitor
parking area shall be established in a convenient location so as to encourage .
on -site parking.by visitors to the facility.
24) That the surface of all parking areas shall be maintained in an
adequate state of repair at all times subject to the satisfaction of the
.Planning Director.
25) That, within 30 days hereof, the applicant shall file written acceptance
of the conditions stated herein on forms provided by the Planning Department.
26). That, unless the construction of the facility is commenced not later
than twelve (12) months after this approval is granted, and is diligently
pursued thereafter, the approval will automatically become null and void.
27) That all requirements of any law, ordinance or regulation of the State,
City of Temple City, and any other governmental entity shall be met.
28) That this approval is subject to the applicant paying all fees and
assessments to the City of Temple City as required by ordinance and /or
resolution:
SECTION 3. The Secretary shall certify to the adoption of this Resolution.
