The Regular Meeting of the Mayor and Council of
the Borough of Carteret was called to order by
Mayor Peter J. sica, 7:30 P.M., Municipal
Court/Policy Facility, 230 Roosevelt Avenue,
Carteret, New Jersey on Thursday, February 1,
1996.

The meeting was opened with a minute of silent
prayer and the pledge of allegiance led by Mayor
Peter J. Sica. The Mayor asked everyone to say
a prayer for the Mayor's Aide who is in the
hospital.

RESOLUTIONS
A copy of each resolution was placed upon
the table for public review prior to the
meeting in accordance with the Rules of
Council and upon MMS&C, by councilmembers
Semenza and O'Brien and unanimous
affirmative vote of the full membership
present, the meeting was opened for
public input on all resolutions.
Jim Mancuso referred to Resolution #96-42
and said that he was at the Agenda
Meeting the other night when
Councilmember Failace wanted to put his
name on for the zoning Board and the
Mayor said that he'd like to talk to Jim
in private. He felt that anything should
have been discussed in front of him.
Some information was passed on to Mr.
Failace. One of the things was that when
he was the commissioner of Housing he
rarely showed up at meetings. He said
that he has a letter from the Director of
Housing showing that he missed one
meeting because of the flu because he had
gone to California on three days of his
own, on a housing meeting. When he got
back he was sick. Also, it was said that
he didn't do too much down there. He
said that he has the minutes of every
meeting he was in. He implemented
eighteen-nineteen different procedures.
He said that he bought a book that shows
how to get grants, which cost Hoboken
$20,000.00, and he got a copy for
the Mayor and Mrs. Hudson. He said
that he spent six months going over
the maintenance program down there.
He said that he resents remarks
about him behind his back. It was
also said that he just quit, because
he was dissatisfied. His letter to
the Mayor and council dated November
20th says that he had to quit due to
his work schedule as a police officer.

He said that he went through the records down
there and two of the Commissioners missed eight
out of twelve meetings and nine out of twelve
meetings. They went after them and they
resigned. When his hours were changed, he didn't
want to become one of those Commissioners in name
only. He said that he spent a lot of time down
there especially when Recycling began. Whether
his name is put up or not, he feels that he
wanted to do something for his town. If this is
the way that this town is run, by defaming
people's reputations, then he doesn't want to be
on any committee. He said that he has started a
watch group consisting of a few lawyers,
engineers and some other people. Anyone in the
City or on the Council is welcome to attend the
meetings. They are non-political, but the City
will know they're around.

councilmember Semenza said that we
already have this piece of equipment and
it's doing a great job. Mr. Kolibas is
using it for the trees that he's cut down
recently. It's also worked in the Park's
Department in other categories. We're
probably going to need it tonight and
tomorrow if it snows. It will be an
asset to the Borough.

Mayor Sica said that the only reason that
Mr. Carmichael wasn't put on in January
was that he never got notice that he

The Clerk stated that she was in receipt
of a Resolution from the Township of
Piscataway and the city of South Amboy
concerning opposition to the proposed
Land Use Regulatory Reform Act.

The Clerk stated that she was in receipt of a
resolution from the Borough of Metuchen
requesting the state Legislature to examine
alternate methods of funding schools that do not
rely on aggressive property tax.

BUILDING & GROUNDS: Committee Chairman O'Brien
reported that Ray Tobias is doing his regular
good job at Borough Hall. Around January 1st or
2nd we purchased a new snow blower. The old one
was over ten years old. A new safety valve was
replaced on the boiler by Universal Oil. The
pump on the boiler went and was replaced but it
didn't cost the Borough anything because it was
already under warranty. He said that he informed
Mr. Parmar when he came back from his vacation to
start searching out estimates for paving the
parking lot. Once the weather gets nice, someone
will need a job and hopefully we'll get a good
price. He also told Parmar to sit down with Ray
and Patrick DeBlasio about the work needed on the
front steps, in regards to waterproofing and to
prepare specifications by the end of February.
He reported Progress.
FINANCE & ADMINISTRATION: Committee Chairman
Failace reported that the Mayor and Council have
met with department heads over the last few weeks
in reference to the 1996 Budget. We've made some
headway but there's still a lot of work to do.
It's going along fine. He reported Progress.
Mayor Sica thanked the Council and everybody that
sat in at those budget hearings the other night.
It's not an easy job to build a budget,
especially this year. It's going to take some
sacrifice on a lot of people's parts. Hopefully,
it will not necessitate any layoffs.

FIRE: Committee Chairman Fazekas reported that
he has been going over the Fire Department budget
with Superintendent Greenberg. In addition, he
had a discussion with Mr. Greenberg concerning
the schools. A directive was issued that all
schools be inspected on a daily basis concerning
fire exits and work areas to make sure that
they're clear of debris and obstructions to
ensure the safety of the children.

PARKS & RECREATION: Committee Chairman
Bialowarczuk reported that due to the
construction at the schools at this time,
the men's night basketball league is on
hold until the main entrance of the
Lincoln School is cleared. The grade
school girl's basketball programs have
been moved to Columbus School on
Saturday's. As soon as they know what is
what with the men's league, they will
make sure everybody knows about it. She
reported that any organization can have
something put on the bulletin board by
Shop-Rite. All they have to do is call
the Parks Department and ask for Mr.
Kolibas. She reported Progress.
Mayor Sica said that material will be
dumped by ci vic Center Park. Dauman
Industries was good enough to donate all
of the mulch necessary to make top soil.
He said that he donated all of the sand
that is necessary and they're in the
process of hauling in the sand and the
mulch and mixing it together to make a
real good topsoil so we can top the Pop
Warner Field rather than have glass and
rocks and everything else sticking up.
We're going to have six-eight inches of
pure top soil with no stones or anything
else in it. The unfortunate thing is
that some people that live in that
neighborhood just abused everybody. They
threatened the people working on the job,
put their cars in the middle of the
street because they didn't want us to put
the dirt over there. It's just
ridiculous. The same people parked a
boat on City property for a year and
nobody bothered those people. We're
going to build that park whether they
like it or not.
POLICE: Committee Chairman Feingold said
that last week he spoke about our
community policing programs, the Federal
Housing Patrol and the Crime Prevention
unit. The third program he'd like to
talk about briefly under community
policing is Municipal Alliance. We just
adopted the resolution authorizing the
Mayor to execute that contract which is
funded by a grant from the State of New
Jersey. The Municipal Alliance is in the
process of setting up domestic violence
crisis units which will fund and oversee
the Carteret Police Department Domestic
Violence unit and incidents in Carteret.

Domestic violence doesn't only cover husbands and
wives, it covers basically any co-habitants
including parents and children, boyfriends and
girlfriends and people under the same roof which
are covered under the ruling of the domestic
violence statute. That is a laudible task that
they are undertaking to attempt to allay some of
the problems associated with domestic violence in
our community. The Alliance also sponsors other
programs and information is available. The
Juvenile Aid Bureau is doing a fine job in
connection with conducting burglar surveys for
all Senior citizen homes as well as working with
the DARE unit to promote child safety and bicycle
safety and other various safety programs in the
community. The Juvenile Officers should be
commended as well. He reported Progress.
PUBLIC WORKS: Committee Chairman Semenza
reported that under sewage he thanked the people
of Carteret for being patient. Most people got
through the problem. We had a tremendous melt-
down from that heavy snow we had, added to the
torrential rain. Between the two of them, we had
some of the worst flooding. Carteret wasn't the
only town. Other towns had it just as bad, if
not worse. We didn't have as many~plaints as
we usually have. People understand that when you
have that much snow on the ground and a melt down
and rain at the same time, you're going to have
problems. The Sewer Department worked right
through it. The Fire Department was out there,
the Police, Emergency Management, helping people
who were stranded. Once again, they did a fine
job.

Councilmember Semenza reported that under Streets
and Roads, we are up again tomorrow for a major
snowfall. There's a possibility of eight inches
to a foot. We're going to do the same thing we
did the last time. We're going to clean the
roads and the snow is going to get pushed to the
side. Unfortunately, the people will have to
clean their driveways or aprons more than once.
We have to make room for emergency vehicles.
During the last snowfall, one of his men was
accused by Mr. Menzoff and Mr. Comba of
deliberately blocking in their aprons. If you
took a survey around this town, you'd find more
than ten people that the people had to do their
aprons at least two or three times due to the
plowing. We all had to shovel more than once.
Nothing was done deliberately by the Street's and
Road's Department. It's their job to go out, Mr.
Surick tells the men to go out after the snow and
start widening the roads. This is the only way
it can be handled. The Governing Body has talked
about possibly coming up with an idea of maybe
going to one side parking in certain areas.

They're going to work on that to see if
they can alleviate some of the problems
with our narrow streets in the Hill
Section and some other parts of town.
They will do everything possible to
cooperate and try to assist the people of
Carteret. He said that they have to have
cooperation. The men that are out there
have a job and trying to do it so that
emergency equipment can get down every
street in town and protect lives and
property in this town. We will not
tolerate it and if they have to they will
ask the police to arrest people if they
continue to abuse our equipment and our
manpower. He reported Progress.

Mayor Sica said that people just don't
realize that you can't push all of the
snow at one time. It's over thirty
inches of snow. On Beverly Street we had
seven foot snow drifts. You can't push
this kind of snow at one time. You have
to keep going around and around,
especially on a small narrow street. If
they ever tried to push ten or twelve
inches of snow on John street,
Christopher Street, Charles Street or
Leffert Street, they'd smash every car on
that street. Plus, they'd never be able
to get through. On top of that, years
ago, you were lucky if there was one car
to a family. Most people took the bus.
Today everybody has a car, two, three,
four cars in front of a one family in
front of one house. It doesn't leave
much room to put anything. The best one
he heard was that they should lift the
plow up at every driveway. The people
just have to cooperate. As he said at
that last meeting, Carteret was the best
plowed town in the State of New Jersey
as far as he is concerned. We never once
shut Washington Avenue or Roosevelt
Avenue down. We had a contingency to get
a f ire truck or ambulance any where we
wanted it. On Monday, Governor Whitman
declared a state of Emergency and no cars
were supposed to be on the streets. If
you looked at Carteret, you would have
thought it was the Fourth of July.
Everybody that was off work decided that
they were going to go sightseeing. If
that ever happens again, we're going to
have everybody on the street arrested.
The abuse that they have to take is not
worth it. He said that he would not have
taken the abuse that Ted Surick took.
One guy actually went out there and hit
the truck with a shovel.

Mayor Sica said that we had a major sewer
collapse on Blanchard Street. It was a twenty-
four inch PVC pipe. They've done some research
work on that and found out that the pipe was put
in, in 1987 by LAD Construction who is now
bankrupt. The Engineering firm that did the job
happened to be T & M. We happened to request all
of their data on it. We found when we exposed
the pipe, that we considered it to be poor
workmanship. By virtue of a letter today, T & M
and even the manufacturer of the pipe was put on
notice that we are going to look into it and that
there's a possibility of a lawsuit to recoup any
losses we've had. This pipe is three-hundred
feet long. We've had to replace twenty some feet
of it. We are using the TV camera on the rest of
the pipe to see if there are any other parts
where it may be buckling or bowing and possibly
collapse. We will pursue it and everbody is on
notice.

COMMENTS
Committee Chairman Semenza said that under
Streets and Roads, he and the Mayor at the last
Council Meeting, requested that all of the people
in town that have a fire hydrant either in front
of their house or to the side of their house,
please get back to the old way and go out there
and knock the snow off. It's important for our
f iref ighter' s to be able to see the hydrants.
They will appreciate any help they could get. It
will help the Fire Department to do the job
they're supposed to do.
MUNICIPAL GARAGE SERVICES: Committee Chairman
Failace reported that he agreed with the Mayor
regarding what Carteret looked like after the
last snow storm. We were 100% better than any of
the towns he saw. It was a real team effort and
was exemplary, the way the Roads, parks's
Department and Municipal Garage did what they
did. Councilmember Semenza told him that Streets
and Roads and the Municipal Garage are ready for
tomorrow. The equipment is ready. We have a new
front loader and he thinks that things will go
well. He reported that he has a meeting with Sam
and Jimmy after this to discuss a couple of
problems down at the garage. There is a leak in
the roof that has to be looked at. He reported
Progress.

Mayor Sica reported that the mall project is
moving along well. There have been meetings held
at the DEP already. Yesterday, we were privy to
get conceptual drawings of what it will look
like. He showed them to the Council. If anybody
would like to see them, they will be in the
Mayor's office tomorrow. From the comments from
the Council, it really looks good. That's moving
along well.

"JERUSALEM 3000"
WHEREAS, in 1996 the City of Jerusalem
will commemorate its Trimillennium,
marking the 3,000th anniversay since King
David made Jerusalem the eternal capital
of the Jewish nation; and
WHEREAS, for the past 3,000 years, the
city of Jerusalem has been a site of
pilgrimage and a source of inspiration to
artists and visionaries, calling forth
religious longing and artistic creativity
in all ages and in all continents around
the globe; and
WHEREAS, the Trimillennium will offer an
opportunity to support the efforts of the
city of Jerusalem to preserve and protect
its unique historic and religious
character while developing it as a modern
city for the benefit of all its residents
and its many visitors; and
WHEREAS, the Trimillennium will offer an
opportunity to give expression to the
firm commitment of the City of Jerusalem
to keep the city a place where all people
are welcome to freely practice their
faith's and visit the shrines holy to
their religions; and
WHEREAS, the united States Conference of
Mayors, as one of the major sponsors of
the Jerusalem Conference of Mayors, has
sent delegations of American Mayors to
the past 15 conferences;
NOW, THEREFORE, I, PETER J. SICA, MAYOR
OR THE BOROUGH OF CARTERET do hereby

and urge my fellow Mayors to initiate
such special projects as naming a square,
street or playground after Jerusalem,

FEBRUARY 5 - 9, 1996
WHEREAS, February 5 - 9, 1996 has been declared
BUCKLE UP AMERICA WEEK!; and
WHEREAS, motor vehicle crashes are the greatest
single cause of death in the united states for
every age from 5 to 32 years old; and
WHEREAS, the lives of 5,344 front seat occupants
over four years old were saved by safety belts in
1993; and over 139,000 serious injuries were
prevented; and
WHEREAS, lap/shoulder belts, when used, reduce
the risk of fatal injury to front seat passenger
car occupants by 45% and the risk of serious
injury by 55%, and in light trucks these risks
are reduced even more, by 60 and 65%; and
WHEREAS, alcohol-related fatalities peak during
the summer driving season; and
WHEREAS, one of the best defenses against the
drunk or drugged driver is the use of safety
belts combined with air bags or child safety
seats;
WHEREAS, those drivers who use their safety belts
only on long trips or highway driving should know
that three out of four crashes occur within 25
miles of home; and
WHEREAS, 48 states, the District of Columbia,
Puerto Rico and the U. S. Territories have
enacted safety belt use laws, and all 50 states,
the District of columbia, Puerto Rico and the
Territories have enacted laws requiring the use
of child passenger restraint systems;
WHEREAS, through continued public awareness,
education and enforcement of safety belt laws to
increase usage, death and serious injury can be
significantly reduced;

WHEREAS, BUCKLE UP AMERICA WEEK provides
communities and organizations an opportunity to
join together to work toward increasing the
correct use of safety belts and child safety
seats by focusing public attention on the life-

O'Brien and unanimous affirmative vote of
the full membership present, the meeting
was opened to the public.
stanley Gutowski said that he recently
completed a course on municipal
government with Mr. Failace and Mr.
Fazekas and part of their class was about
Zoning and Planning Boards. He said that
he came across something that he wants to
bring to their attention and that is that
a Class 4 member of a Planning Board
cannot be an employee of the Borough. As
far as he can see, we have two employees
of the Borough of Carteret serving on the
Planning Board. He asks that they either
resign their positions or that the Mayor
remove them. The two are the Mayor's
Aide, Mr. Orlando and William Kobibas,
Jr. who is now working for Streets and
Roads.
Mayor Sica said that the Borough Attorney
will research it and see what it is all
about.
Mr. Gutowski said that it is a state
statute and is also in our Code, 16025.
