Sica, 7:30 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday, March 7, 1996. REGULAR ~1EETHIG ~!\RCH 7, 199F Upon individual roll call vote, the following were noted present: ROLL CALL Mayor Councilmember " " " " Peter J. Sica Deborah Bialowarczuk James Failace William Feingold James O'Brien Sam R. Semenza Noted absent was Councilmember Jack Fazekas. Also noted present was Borough Attorney Robert A. Hedesh. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor Peter J. Sica. PRAYER, PLEDGE OF ALLEGIANCE The Clerk stated that on March 1, 1996, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News & Tribune, The Star Ledger and posted on the Bulletin Board. STATEMENT OF MEETING Upon MMS&C, by Councilmembers Semenza and O'Brien and unanimous affirmative vote of the five members present, the minutes of February 1 and 8, 1996 were approved as transcribed and engrossed by the Clerk. APPROVAL OF ~1INUTES At this time, upon MMS&C, by Councilmembers Semenza and O'Brien and unanimous affirmative vote of the five (5) members present, the Public Hearing on the 1996 Local Municipal Budget was opened to the public. PUBLI C HEARING - 1996 LOCAL ~1UNICIP!\.L BUDGET 1 There being no comments from the audience present, upon MMS&C, by Councilmembers Semenza and O'Brien and unanimous affirmative vote of the five members present, the Public Hearing on the 1996 Local Municipal Budget was closed. CLOSEfJ MARCH 7, 1996 MAYOR Mayor Sica asked for a motion to hold the budget. We cannot adopt the budget at this time. We don't know what the state Aid will be. We've applied for $600,000.00 in state Aid and until such time as we know whether we're going to get it or not, we are advised by the Tax collector not to adopt the budget. MOTI ON TO HOLD Councilmember Semenza made a motion to hold the budget. Upon individual roll call vote, councilmembers Bialowarczuk, Failace, Feingold, O'Brien and Semenza voted in the affirmative. councilmember Fazekas was noted Absent. BIDS - SPORTS RECREATION FACILITY COMMENTS This was the night advertised to receive bids for the Sports Recreation Facility and the Mayor called for all bids. Mayor Sica asked for a motion to hold and return all of the bids on the sports Facility until March 21, 1996. Borough Attorney Hedesh stated that they don't need to be returned. Mayor sica said that he thinks they should be returned because if somebody says we opened them, then what do we do? Borough Attorney Hedesh said that they would have to prove that they opened them. Under the law.... (inaudible). Mayor sica asked for a motion to have the purchasing Dept. call up each person who submitted a bid for the sports Facility and if they want them returned, we'll return them. If not, we'll hold them until March 21, 1996. BOrough Attorney Hedesh stated that the purchasing Agent must notify each person who submitted a bid or bid package. It must be done by regular, certified mail to notify them of the change. It has to be done in writing according to the Statute. 2 MOTI ON TO HOLD Councilmember Semenza made a motion to hold the bids on the Sports Facility, pending a letter from the purchasing Agent to the bidders. · ~1ARCH 7, 1996 Councilmember Bialowarczuk second the motion. Councilmembers Bialowarczuk, Failace, Feingold, O'Brien and Semenza voted in the affirmative. Councilmember Fazekas was noted absent. r10TION TO HOLD CON'T. An unidentified contractor complained that he drove two hours to get here. He asked what the purpose of this was. COMMENTS The Mayor said that so many people asked for bids... . The man asked why they weren't faxed something this morning. The Mayor told him to wait a minute or to withdraw his bid if he wants. The man said that there is a lot of time put into bids. Mayor Sica said that he understands that and there are a lot more people who want to bid it. We cannot in good conscience open these bids because we didn't have enough. The man said that it is understandable, but said that it is not like it's seventy degrees and sunny. Mayor Sica said that they feel bad about it, but if he wants his bid back, they'll give it back. At this point, several bidders complained at once. Mayor Sica said that we anticipated twenty bids. We had requests for 23, 24, 25 bids. We didn't have enough to give them all out. In interest of fairness to everybody, we're going to hold the bids until the 21st of March. An unidentified bidder asked what the Mayor meant by hold the bids until March 21st. The Mayor explained that we'll either hold it or give it back and they can bring it back on March 21st. We can hold it here unopened. An unidentified bidder asked if they are supposed to be notified within seventy-two hours legally, if the bid date is being changed. Mayor Sica said that they are being notified now. 3 Borough Attorney Hedesh said that ten days notice is needed for any modifications. MARCH 7, 1996 COMMENTS CON'T. Mayor sica asked if it will change their bids. Some bidders said yes, now that they knoW there's five bidders. The Mayor said that we will give the bids back then. He said that there are a lot more than five bids here, there are thirteen. An unidentified bidder asked what the resolution was for holding it. Mayor sica again said that we did not have enough specifications or bid packages to give some people that came in as late as Monday, we're going to hold it and give them packages. At this point, several of the bidders present, took back their bids. An unidentified bidder asked if there was a reason why they weren't notified. Mayor sica explained that they tried to get the bid specifications to the other people that wanted them. If we could have gotten them to them on time, we might have opened them tonight. unfortunately, we were not successful in getting them to them on time. So, it's not fair to the other people. An unidentified bidder said that the specifications state that within forty- eight hours you cannot pick up any specifications or bid packages, forty- eight hours before the bid. The Mayor said that he understands that. He said that he is a contractor too and that he runs into that all of the time. A bidder complained that this is unfair to them. 4 Mayor sica said that it will be unfair if we opened his bid and then accepted other bids. MARCH 7, 199F An unidentified bidder said that it's putting them against more competition. COMMENTS CON'T. At this point, several of the bidders complained. An unidentified bidder said that obviously, they knew about this today. COMMENTS councilmember o'Brien asked how many parcels are being appraised. Mayor Sica said there are about eleven, but two are commercial pieces. They are more than $350.00. Councilmember o'Brien asked if any other appraisals would do it cheaper. Borough Attorney Hedesh said that Art Gross has been doing appraisals in the Borough of Carteret since he can remember. He is familiar with the Borough and has done the tax appeals and everything else. Anyone else that would come in would have to do a comparison. He's always been cooperative. The attorney noted that the resolution should not read $350.00 per parcel. It should be per the contract. Councilmember Semenza thanked Angelo Valelutto for coming in on an emergency like that. He did an excellent job while our Engineer was away. Mayor Sica said that the preliminary report indicates that there was a problem with the design and construction of that sewer when it was originally put in. We are going to file suit against the engineering firm that authorized the change orders. There was a change order issued to put in the plastic pipe versus the concrete pipe. The specifications from the pipe manufacturer clearly indicates how it had to be installed and it was not installed properly. Councilmember Failace asked if the company was out of business. 13 Mayor Sica said that the company is out of business, but the engineering company that allowed it to be done isn't. There was nothing wrong with the pipe. If it was installed properly, there probably would have never been a problem. It is a plastic pipe and you have to have uniform compaction all around the pipe. You can't have all of the weight on the top of the pipe and the sides void, otherwise the pipe would make shift. That's exactly what happened. The same fill that was dug out of the hole was put right back on top of that pipe instead of putting selected fill on there like concrete recycling material, sand or gravel. That clearly crushed that pipe. We're probably going to be able to recoup all of that money and get the rest of the pipe done properly. That's because of Angelo Valetutto being on the job. He's an independent engineer and his report will clearly show that it was wrong and installed improperly. The manufacturer's data reports show how it should have been put in and it was not put in that way, so we've got a good case. Councilmember Failace asked what year that was done. Mayor sica said 1987 or 1988. It was the sewer separation program. Councilmember Fazekas was noted absent. COMMENTS Mayor Sica said that Eugene Deutsch was the Vice President of Amax. When Amax closed down, he spoke to him about what can be done with it. This was back in 1985 or 1986. Gene had a vision about tearing the smelter down and cleaning it up and building what we now know as "Port carteret". In that area, we have White Rose Food that now employs over 500 people, D B Brown that employs over 275 people, Direct container Lines, Garden State Paper and Fritz Company. In that particular area we probably have close to 1,000 people working. It's the only industrial site of that size in the State of New Jersey that is being cleaned up and is being developed into a prosperous tax ratable for the city of Carteret. As late as yesterday, he and the Mayor's Aide, Mr. Orlando, spent the whole day with a company that's looking to come to Carteret and possibly within three years, build a building in excess of one million square feet and possibly hiring 500 people. We have other businesses that are looking to operate out of the Port carteret area. There's a strong possiblity that because of Mr. Deutsch's effort, another big refrigerator company would be built down there of about 120,000. square feet, with new people operating it and putting people to work. He said that he thinks that the ci ty of Carteret owes Gene Deutsch a debt of gratitude. He really is concerned about the City of Carteret and works an unlimited amount of time just trying to get things done. 16 Mr. Deutsch was very instrumental in getting us qualified as an enterprise zone community. In years gone by, prior to 1984 and 1985, Mr. Deutsch was a Deputy Commissioner of the Department of Community Affairs in Trenton, so he knows a lot of people in Trenton. Whenever there is a problem, he sure gets on the telephone and opens the door down there for him to go down there and talk to someone. Again, he personally wants to thank Gene. The reason why we're doing this today is, that Mr. Deutsch is in Florida and had a heart problem and had a bypass. He is doing fine and hopefully, he'll be back in the area within the next month. Even as sick as he is, he still continues to work along with his office on a day-to-day basis from his bed in Florida. Mr. Deutsch was one of the first ones to come up with the idea of a ferry service from Carteret and was very instrumental in setting up the meetings with N.Y. Waterways. It's people like that, that make Carteret move forward. Before RESOLUTION #96-77 was introduced, Mayor Sica proposed the name of William Kolibas, Jr.. RESOLUTION #96-77 was so introduced and was referred to the Council for action. She stayed at the Borough Garage and made radio contact with every single truck out there that was plowing the road. BUILDING AND GROUNDS: Committee Chairman O'Brien reported that Patrick DeBlasio is in the process of getting some quotes on running a new electric line to Borough Hall and for putting new carpets in for the first floor of Borough Hall. The back office carpets are being held down with duct tape. Mr. Parmar has received and reviewed various items for proposals to fix the cracks in the front steps of Borough Hall. He will present his idea to the Borough council; hopefully at the next agenda. Ray Tobias is doing his usual good job. He reported Progress. FINANCE AND ADMINISTRATION: Committee Chairman Failace reported that he spent a lot of hours with Patrick DeBlasio in the last two or three weeks in reference to the budget and some ideas of what they can do. He sat with the Mayor and Sam Semenza in the beginning of the week and went over quite a few to do. He will ask the Finance Committee to meet with him to discuss their idea and what he discussed with Patrick and get back to them with the Mayor to see if we can get this budget down to where it should be. REPORTS - DEPARTMENTS STAND ING Cm1~nTTEES MARCH 7, 1996 STANDING COMMITTEES CON'T. Fire superintendent Greenberg presented a plaque to the Mayor for "Heroism" for February 13, 1996 where he was able to take three people out of a burning building and go back and search for more people. The people of carteret and the Fire Department owe the Mayor a debt of gratitude. Councilmember Semenza presented a Certificate of Merit to the Mayor from the Council and told him that they are very proud of him. Mayor Sica said that more than him, the Fire Department deserves a debt of gratitude for what they did that day. councilmember Semenza said that the Fire Department deserves credit. They always do a great job in Carteret. It's people like the gentleman from Chrome a couple of weeks ago, people like Mayor sica and other residents that go out of their way to help to save a life or a property, is above and beyond what their duty is as a citizen in Carteret. This is what a town needs to be a great town and they appreciate it, as the Fire Department. PARKS AND RECREATION: Committee Chairman Bialowarczuk reported that at the last council Meeting she brought up about people dumping along Carteret Park along Carteret Avenue. This past week, Mr. Kolibas has advised her that several summonses were given out for illegal dumping. Some of the fines could go as high as $500.00. She reported that a week ago, the Recreation commission had its first meeting for this year. There are plans for another Soap Box Derby, Halloween Parade and the concerts in the park. They are also looking at a few new things. As the weeks go on, she will let them know what they are. They also have plans right now on renovating a few things in Chrome Park. There are renovations to do in all of the parks, but that is where they're going to start. They are also going to schedule two weeks or so from now, the softball meetings. She reported Progress. POLICE: Committee Chairman Feingold reported that he received his monthly report from the police Chief. 20 crime is now down in Carteret. It's down in all areas, but most specifically in burglaries to cars, homes, and that's good to see. A while ago there were a rash of buglaries. Our police officers are fine generally and specifically. There presence is a great deterrent to crimes. It's good to see that summonses are being written for the traffic offenders. He reported Progress. PUBLIC WORKS: Committee Chairman Semenza reported that under Streets and Roads, Mr. Surick and his department have done a wonderful job as far as snow clean-up. Hopefully, we won't have to use them in that category anymore. Under Recycling, Sally Mesler is doing a good job with the program. Under the Sewer Department, we started our catch basin clean-outs. They are going to continue with that now that the weather is starting to break a little. Hopefully, they will get cooperation from the public on that. councilmember Semenza noted that a couple of weeks they put a directive out to all departments pertaining to any loss or damage to equipment. He said that once again, unfortunately, another piece of equipment was damaged in our police Department. He would like to know if we are going to go ahead as far as bringing it before a three man board to look into the situation. Mayor Sica said that he is aSking the Chief of police to give him a complete report on how that happened and why it happened. That condition was there for eight hours. We will find out how a cop car had that problem. Councilmember Semenza reported progress. MUNICIPAL GARAGE SERVICES: Failace reported Progress. Recent studies indicate that workers over fifty (50) are productive and cost-effective employees. Older employees have a lower turnover rate and a lower rate of absenteeism. In many instances, the retaining of older employees to meet the changing needs in the workplace can reduce recruitment and training costs; and WHEREAS, many older New Jerseyans seeking employment have job ready skills, excellent leadership abilities and demonstrate a strong work ethic. Orlando 12/31/98 12/31/97 Class 4 Eric Chubenko 23 Mayor Sica stated that the way to improve the ci ty of Carteret is not to go out looking for problems. The way to improve the city of Carteret is to do something constructive, to become active and help out in various ways. Mr. Orlando served on the Planning Board for fifteen years and in the fifteen years that Mr. Orlando served on the planning Board, most of the time as the Chairman, he cannot recall one decision by that board being overturned by either the council or the Courts of the State of New Jersey. He doesn't recall one person coming back complaining that they were treated unfairly. Mr. Orlando was on the Planning Board long before he became the Mayor's Aide and did one heck of a job. Because of a technicality in the law, making him a Class 2 from a Class 4, some people sought to have him removed. Other people, like Leo Colicchio, realized what an effort Mr. Orlando makes for this community, and like Mr. Greenberg, who just left. Mr. Greenberg offered to step down in order for Mr. Orlando to stay on the Planning Board because he felt the wealth of experience and knowledge that Mr. Orlando had and the dedication to this community was worth keeping him on. Unfortunately, some other people didn't think of it that way. Most of the time, the other people are the people that sit back and make trouble and never try to solve any problems or offer to volunteer for anything. MARCH 7, 19Q6 PROCLAMATION CON'T. APPOINTMENTS PLANNING BOARD COMMENTS MARCH 7, 1996 COMMENTS Last year, even though sick, Mr. Orlando was at the Christmas Tree Lighting Ceremony, making hot chocolate and passing it out to the kids so they wouldn't be cold, passing out toys to the kids. Mr. Orlando was at the Halloween Parade cooking hot dogs. He said that he cannot believe that people want so much to hurt other people, that they would stoop to anything to do these kinds of things. He said that he thinks that the Democratic party in carteret has sunk to an all time low. They did this to Mr. Orlando, but look what they did to Mr. o'Brien. It's a disgrace. A man without a country. PUBLI C DISCUSSION - 5 MINUTE LIMIT upon MMS&C, by councilmembers Semenza and Bialowarczuk and unanimous affirmative vote of the five (5) members present, the meeting was opened to the public. An unidentified woman from McKinley Avenue complained about an abandoned house that is a danger to the neighborhood, vagrants and drunks hang out there. Mayor Sica said that it is tough to go in on private property, unless we can demonstrate a serious hazzard. Because of complaints he received today, he issued an order to board that house up completely. We will move in court to condemn the house and tear it down, if necessary, or sell it. Unfortunately, there is only so much we can do when it comes to private property. It was sold by Lydicker to his daughter who abandoned it. It takes a long time before the city gets possession of it, two or three years. If you don't pay taxes, we put a tax lien on it. We still don't have any right to do anything to that house. The second year the tax lien stays on it. Then, only after the second year can we move to take ownership. It's unfortunate, but that's the way it is, but because of the complaints he's received, now he can consider that a health hazzard and a nuisance, which he's done and he's instructed Mr. Kolibas to board that whole house up. He will instruct the police Department that anyone caught on or near that house should be arrested on the spot. That's the best we can do. 211 The woman said that she worried. about fire. c;··. Mayor Sica said that our hands are somewhat tied, but it's good that she came here and it's on the records. Kathy Dean complained that the owner of the house had moved and rented it to undesirables. Mayor Sica instructed the Borough Attorney to look into what can be done besides just boarding it up, if there is some way that we can get an emeregency declaration from the court to do something. Maybe the house can be rehabilitated. Barring that, if necessary, we'll knock it down. Borough Attorney Hedesh told the women that if the police ask them anything they should be cooperative.
