The Regular Meeting of the Mayor and Council of
the Borough of Carteret was called to order by
Mayor Peter J. Sica, 7:30 P.M., Municipal
Court/Police Facility, 230 Roosevelt Avenue,
Carteret, New Jersey on Thursday, April 18, 1996.

compliance with the Open Public Meetings Act, a
notice of tonight's meeting was sent to The Home
News & Tribune, The Star Ledger and posted on the
Bulletin Board.

CHORNOBYL REMEMBRANCE WEEK
APRIL 22 - 26, 1996
WHEREAS, on April 26, 1996, the world community
will observe the tenth anniversary of the
Chornobyl nuclear disaster, of which hundreds of
thousands of victims, including countless
children, are still suffering the effects; and
WHEREAS, the catastrophe of Chornobyl gravely
jeopardized the well-being of the people of
Ukraine and neighboring nations and had
devastating environmental and health effects, as
demonstrated by the genetic damage to unborn
generations of children; and
WHEREAS, the Chornobyl disaster was the direct
outgrowth of a system that neglected and degraded
the dignity and rights of the individual;

WHEREAS, with the explosion and fire at
the nuclear power plant on April 26,
1986, Ukraine's tragedy was transformed
to one of international dimensions,
resulting in a need for humanitarian aid
from countries worldwide; and
WHEREAS, continued assistance from world
health and nuclear energy organizations
must not be lessened, since the evil
effects of radiation know no boundaries
or time limits; and
WHEREAS, the world community has an
obligation to fully investigage the
effects of Chornobyl and assist Ukraine
with the monumental economic burden of
the transition to alternative energy
sources; and
WHEREAS, the nightmare of waters, lands
and living creatures laid waste by
nuclear radiation should never again
occur on the face of the earth.
NOW, THEREFORE, I, PETER J. SICA, MAYOR

CHORNOBYL REMEMBRANCE WEEK
I urge the nations of the world, all
humanitarian organizations and agencies,
and in particular, the people of the
United States to observe this week with
appropriate ceremonies and activities,
and in so doing to rededicate ourselves
to the principles of freedom and justice
by which mankind will endure.
Upon MMS&C, by councilmembers Semenza and
o'Brien and unanimous affirmative vote of
the full membership present, the minutes
of March 21, 1996 were approved as
transcribed and engrossed by the Clerk.

Mayor Sica stated that they helped to apprehend
a murderer in the Borough of Carteret. He
thanked the officers.

The Clerk stated that Ordinance #96-10
was introduced and passed upon First
Reading at a Regular Meeting of the
Borough council of the Borough of cart~et
held on April 2, 1996. It was duly
published in The Home News & Tribune on
April 6, 1996 with notice that it will be
considered for final passage after public
Hearing to be held on April 18, 1996 at
approximately 7:30 P.M.. The Ordinance
was posted on the bulletin board and
copies were made available to the general
public and according to law, she read the
ordinance by title.

Upon MMS&C, by councilmembers Semenza and
Bialowarczuk and unanimous affirmative
vote of the full membership present, the
Mayor declared the public Hearing to be

COMMENTS
councilmember Failace stated that last
week he spoke to Patrick DeBlasio about
this and he has somewhat of a problem
with going over in our capital
Improvement Account. It will cost an
extra $100,000.00 that we'll have to add
to the budget. He knows that the Mayor
spoke about selling properties. If that
doesn't come through then the burden
comes down to them.

Mayor Sica said that then we bite the
bullet.
Councilmember Failace questioned if the buildings
can be scaled down.
Mayor Sica said that they are going to do that.
He explained that if you look at the
specifications it says raised metal roof. That
building has been designed to either have a
raised metal roof or shingles. He can say to put
a shingle roof on at 1/2 of the cost. That's
only if we scale things back. Why should we do
landscaping if we can do it with our own people?
There are a lot of ways we can cut it. If we get
$100,000.00 from the sale of the land, it's
Carteret's money and if you have to pay
$100,000.00, it's Carteret's money. Either way,
it is the City of Carteret's money. It doesn't
matter if we are successful in selling the land
and we will be, because we already have the price
and a person willing to buy it. We've already
saved $30,000.00 on the bid for the lights and
site work but the bid still shows $134,000.00.
Councilmember Failace stated that he is certainly
not against the facility, he knows that we need
it, but he has to vote No.
Councilmember O'Brien asked why we can't first
scale it back closer to amount we bonded for.
Mayor Sica said that we can't do that. He asked
if any of the Councilmembers looked at the
drawings. It's a building that will fit all of
our needs and if you want that kind of building
you have to pay for it.

that, but we went out for $500,000.00...
Mayor Sica said that Councilmember Failace is
playing pOlitics. We established a number of
$500,000.00. If it came in less, it would cost
us less, if it came in more, it would cost us
more. We all knew that. We knew that if we had
to adjust it, we would. We put more money into
Capital Improvements and we issued a temporary
bond until we sell the land.

A copy of each resolution was placed upon
the table for public review prior to the
meeting in accordance with the Rules of
council and upon MMS&C, by Councilmembers
o'Brien and Semenza and unanimous
affirmative vote of the full membership
present, the meeting was opened for
public input on all resolutions.
Harriet Leone referred to Resolution #96-
112, Renewal of License for Carteret
Mobile Park. She said that she feels
that before this license is approved, the
propane tanks from 1994, 1995 and now
1996 should be moved off-of Blair Road.
Before they were small tanks and now they
have big enormous ones. She said that
she has spoken to Richard Greenberg and
to the Mayor and nothing is being done.

Mayor Sica said that he will ask the council to
hold the Resolution until they can sit down with
the owners of the Mobile Park and have those
tanks removed.

The Mayor explained that it is a pump that the
bearings seized up on. We've pulled the shaft,
examined the bearings and we have the
manufacturer coming down to look at it. It's
eight years old. They are guaranteed for a year
and we got eight years out of it. We're going to
rebuild the shaft and put an oversized bearing in
it. We're going to put extra grease cups in it
so we can grease it more often and hopefully, it
will hold.

Mayor Sica stated that the school guards took a
favorable stance to help the taxpayers of
Carteret. They elected not to take a raise this
year. The only thing they're going to get is the
same prescription plan that was offered to
everybody else. They did not take a raise. The
City of Carteret owes them a debt of gratitude.

Mayor sica voted Yes to break the tie.
Borough Attorney Hedesh noted for the
record that they received a phone call
objection from the second bidder. He
reviewed the bid. There are two bid
sheets. One bid sheet had the amount of
$573,447.66. That was the amount that
was read publicly. He said that he and
the Clerk reviewed the tape of that
meeting this morning. On the second bid
sheet, which was like a general cover
sheet, the bidder put the amount of
$473,447.66. He made a $100,000.00
mistake on the cover sheet. They
calculated all of the items in the bid
and the total is $573,447.66. He reviewed
the bid and finds it to be in order. The
bid is $573,447.66. Either way, it would
have been the lowest bidder of the
project. He finds no problem in awarding
that bid.

COMMENTS
Councilmember Failace said that he spoke
with vic Kazio about hiring someone down
there on a temporary basis. He does not
know this gentleman and doesn't have an
objection, but he thought that it would
be better if Vic actually interviewed the
person or persons before they approve it.
It should be up to him if the credentials
are right, not them.
councilmember Semenza said that he spoke
with Mr. Kazio and he is in dire need of
a mechanic. He said that he needed
someone immediately. He said that he
told Mr. Kazio to write a letter and that
is the letter Councilmember Failace
received. Mr. Kazio, at no time, told
him that he wanted to interview. He was
very concerned about putting someone on
immediately. He said that he knows Jim
Brown and he has the qualifications. He
is a very qualified mechanic. It will be
a shame to lose someone like this when we
have to fill a position. This position
that Steve Moylan had is a pretty
important position. It's very important
to put this man on and fill this position
so that we don't fall back on emergency
equipment.

Mayor Sica stated that as it sits right
now, they don't have people to fix the
bus. They can't take the people for
meals because they don't have a bus.

councilmember Failace stated that he is not
against hiring.
The Mayor said that we are putting Mr. Brown on
as a temporary employee. If he doesn't work out,
we can get rid of him.
Mayor sica asked if there was anyone in the
audience that wished to speak on Resolution #96-

COMMENTS
Mayor Sica noted that Saturday was the
Li ttle League's opening Day. We must
have the largest Little League Girl's
Cheering, Girl's Softball and T-ball of
any town in Middlesex County. That is a
testimony to why we have such a good
program and then we hire young adults to
administer the umpiring and everything
else.
PAYMENT
OF

Bialowarczuk, all bills appearing on the
prepared list, properly audited and
signed, were ordered to be paid. Upon
individual roll call vote, councilmembers
Bialowarczuk, Feingold and Semenza voted
in the affirmative. Councilmembers
Failace, Fazekas and O'Brien voted No on
#96-0l38, AJV Engineering and yes on all
other bills.

The Clerk stated that she was in receipt of an

License.
Upon MMS&C, by councilmembers Semenza and o'Brien

resolution from Monroe Township requesting the
State Legislature examine an auernate method of
funding schools that does not rely on Regressive
Property Tax.

BUILDINGS & GROUNDS: Committee Chairman
o'Brien reported that the parking lot
should be able to be paved within the
next few weeks. Their next target is to
re-do the front steps which hopefully,
Parmar will have the specifications ready
for. Pat DeBlasio, Ray Tobias and Tony
Neibert are preparing specifications in
order to get quotes on the upgrading of
the electricity in Borough Hall. Ray
Tobias is also in the process of cleaning
up the front office underneath the steps.
Once we get the steps repaired and the
flooding in that office ends, we can use
it as a central location for computer
equipment for the Borough. within the
next two weeks they will be carpeting the
offices on the first floor. Ray is also
in the process of doing some landscaping
around Borough Hall. He is keeping up
with the cleaning and doing his usual
wonderful job. He reported Progress.
FINANCE & ADMINISTRATION: Committee
Chairman Failace reported that he spoke
with Patrick DeBlasio this past week. We
received our discretionary aid of
$400,000.00 which, is not a loss. It's
exactly what we got last year and that's
pretty good. We didn't lose anything on
it. It brings our tax burden increase
down. We will have a meeting with the
Mayor and Council to see if we can rehash
the rest of this and finalize the budget.
He reported Progress.
FIRE: Committee Chairman Fazekas stated
that being that this is councilmember
Semenza's last Council Meeting, on behalf
of the Fire Department, he thanked him
for the job he has done.
PARKS & RECREATION: Committee Chairman
Bialowarczuk said that she had reported
at the last meeting that a partial
shipment of trees carne in. We have to
replant more than six-hundred trees.
Seventy-five ash trees have already been
done. The flowering pear wiTI be in in
the next week or so. She said that she
did receive some phone calls and she
asked everyone to be patient. She and
Mr. Kolibas have had several meetings in
regards to repairs of the equipment in
the parks and the playgrounds. In
Shorecrest Park, new trees are planted.

They plan on putting new playgrðund equipment in
the park. Cornell Park in West Carteret will get
new blacktop for the basketball court. They have
plans to put new equipment in the Grant Avenue
Park playground. There are more plans in the
works and she'll make everyone aware of them as
she goes along. The glidder swings in Carteret
Park were damaged and new ones were ordered which
should be in within the next few weeks. The
Recreation commission is in the process of
finalizing the spring and summer concert
schedule. The date chosen for the Soap Box Derby
is July 13, 1996. Forms should be sent to the
schools prior to the end of the school year and
it will also be advertised so that everyone will
know about it.

CON'T.
Councilmember Bialowarczuk said that she finds
what happened up here tonight with the Sports
Complex, appauling. The sports people are in
dire straights for a building. They need this
building. If anyone knows anything about the
Mayor, it is that he runs things cost efficient.
He'll save money. Why they don't understand
that, is beyond her. It is politics, pure and
simple. When you don't want a sports complex for
500 or 600 kids in this town and you don't want
to take care of the riverfront which they've been
trying to do for the last year, it sickens her.
People should start paying attention to what is
going on up there because it'll probably get
worse. They'll probably vote down the new
library next.
POLICE: Committee Chairman Feingold
congratulated Lt. Auker, Sgt. Talalai, Police
Officers Thomas Stroka, John Rivers, James
Connolly, James Csirnbok and George Denton for the
apprehension of that murder suspect. It's a word
to the criminals out there that they can't seek
refuge in the Borough of Carteret. They will be
flushed out. These officers put us at ease that
they are out there looking for dangerous
criminals and not just driving around in cars
like some people allege that they do. The most
important fact is that they put this person into
custody without incident and that nobody was
hurt.

Councilmember Feingold reported that he had the
opportunity to ride with Officer Guiliano Tuesday
night from 5:00 P.M. to 9:00 P.M.. That is
something that every pOlice commissioner should
do because it's nothing like on television. Just
by his presence in the Chrome section, crime is
deterred. He should be commended as well.
People often ask him why we need all of these
police officers when crime is so low in Carteret,
but that is why crime is low, because we have all
of these fine police officers in Carteret,
deterring crime.

PUBLIC WORKS: Committee Chairman Semenza
reported that under Streets and Road,
they are in the process of filling
potholes. He told the audience that if
anyone sees any that are dangerous, to
call Mr. Surick at the Borough Garage.
Every town experienced this because of
the bad winter.
Committee Chairman Semenza reported that
our Recylcing Department is still within
the top ten of the county which is
something we can be very proud of. Sally
Mesler is still doing a good job.
Committee Chairman Semenza reported that
under Sewer Department, Mr. Biel is
continuing to clean the catch basins.
They almost made the cycle, which is good
for this time of year. Hopefully, maybe
we can get another cycle in on the
cleaning of catch basins before the heavy
leaf season.
Councilmember Semenza reminded this
Council that six years ago, until now,
he's been telling the Council that no
matter what, when it comes to politics,
if you want to play politics, or if
poli tical things corne up, it's okay to
play politics when it involves the hiring
of a person, doing a favor for your
party...that's something else. When it
comes to something that's going to
benefit the whole community; they are not
Democrats or Republicans, they're Council
people working for the people of
Carteret. It's importatnt that they
stick together on important issues and
make the right decisions on what is good.
Put politics aside. He said that even
though he's only served QI'I the Council
with the new Democratic Councilmen for
six months, he wishes Jimmy (O'Brien) and
them the best. He's enjoyed their
company and knows that they'll do a good
job once everyone calms down. He told
councilmember's Bialowarczuk and Feingold
that it has been a pleasure to serve with
them. They are both very excellent
Council people. Bobby Hedesh is a great
attorney that he's served with for three
years. He said that he appreciates
everything he's done. He told Kathy
Barney that she is doing a wonderful job.
He said that he can't say enough about
Mayor Sica. He is definately, as far as
he is concerned, the best Mayor this town
had had. He thanked the people of
Carteret for giving him the opportunity
to sit up there.

MUNICIPAL GARAGE SERVICES: C6mmittee Chairman
Failace reported that they all know about the
accident in the garage with Mr. Moylan. He spoke
to Mr. Kazio yesterday and he said that Mr.
Moylan is certainly doing better but that he
still has a long way to go. He asked everyone to
keep Mr. Moylan in their prayers. He said that
he hopes that we can help out any way we can.
Maybe our prayers will help out the most. We are
evidently hiring a mechanic in the garage and he
is not against that. He spoke to vic and just
thought that he should be the one to interview.
He is not against it.

Councilmember Failace said that in reference to
the Sports Facility, you could call it politics
or whatever you want, he said previously to the
Mayor that he would put his record against
anybody in Carteret with the kids in this town.
For the last sixteen years he's coached Little
League, Girl's Softball, coached Pop Warner
Football and teaches CCD at st. Joseph's and he
works with the Carteret Specials. He said that
he is not against the Sports Facility. If Mrs.
Bialowarczuk says that he is and that she thinks
this is horrible, she's absolutely wrong.
without going into a tirade, he is asking if it
can be scaled down. We do not need to spend as
much money.
Mayor Sica thanked Sam Semenza for the six years
he put in on the Council. He put thirty years in
as a Volunteer Fireman in the city of Carteret.
He said that he doesn't know of a better
volunteer fireman or a better municipal
Councilman than Sam Semenza. Part of Sam
Semenza's problems today is because of his
dedication to this town. He went far and above
what he was supposed to do as a Councilman in
this town to make it a better place for everybody
in this room and in this town. That's probably
part of his problem. He said that he knows Sam
Semenza since they played Little League ball
together. They've gone through Carteret
Recreation, Carteret High School and lived in the
same town together all of their lives. He said
that he knows where Sam Semenza'a heart will be
from today on, it'll be in the City of Carteret.
He predicts that Sam Semenza will be back here
because Carteret needs people like Sam Semenza.
He told Councilmember Semenza that he will always
be here for him. He doesn't consider him a
Councilmember, he considers him a dear friend of
his.

Mayor Sica noted that they have had the
Recreation bids for a couple of weeks. They've
had plans and specifications. They could have
discussed this and scaled it back before. Now
they wait until the eleventh hour, the eleventh
day in the eleventh month to do something. We
saved money because we got donations. We
got mulch donated by Dauman Pallet for free.

We got sand donated by SD&G for free. We
got meadow life donated by the county for
free and we made our own topsoil. We
saved almost $30,000.00 making our own
topsoil. The fields are leveled down and
the fields are starting to take shape
because his bulldozer did it for free.
He said that he will not compromise that
building. If we change it now, it has to
be rebid. We should have taken an
intelligent approach and look at it as we
build things, maybe, we could chisel some
more stuff and get donations from people
to do other things. He told
councilmember Failace not to tell him
what he did for the city of carteret, but
to tell him what he'll do while he's
sitting up there in authority to do
something that's good for every taxpayer
in this town and for every kid. Everyone
had the plans and nobody complained about
it. Last Thursday it was brought up at
the Agenda Meeting.
Mayor Sica stated that he spent his time
today researching the Kin Buc Lawsuit.
We have no reason to be in that lawsuit
because we never put one ounce of garbage
or anything in Kin Buc. He got Mr.
Hedesh to get on that case so that he
could send a letter to those lawyers
saying that if they continue to put us in
that lawsuit when we've never put one
ounce of garbage or one ounce of
chemicals in the Kin Buc Landfill, we
will file suit against them because they
have embarked on a frivilous lawsuit
against the Borough of Carteret and
probably all of those other towns. He
said that he will send a personal letter
to all of those other towns and if he can
get enough of those towns to attest to
the fact that they never put anything in
the Kin Buc Landfill, then he will sue
the insurance company that is suing us,
as a frivolous action. They think that
by naming all of these little towns, that
the towns are going to rollover. The
complaint says that they are willing to
settle. They think that our insurance
company will give them $5,000.00 and
it'll go away. We're not going to give
them five cents. We're going to reverse
it and sue them.

on the Industrial Road.
Mayor Sica said that they are looking to the
State of New Jersey who paid for the Industrial
Road to see if their bond still holds true. If
not, we will have to fix it. Unfortunately, we
will patch it but they are not making the
blacktop yet. As soon as we get blacktop, we're
going to fix it.
Mrs. Leone complained about once
recycling of magazines and mail, noting
your pickup date falls on a holiday, you
wait another month.

has a lot to be picked up, they can call for a
special pickup .
Margaret Mekilo, 34 So. Whittier Street
complained that she has to pay to have her
sidewalk fixed because the inspectors never told
her neighbor at 107 Pulaski Avenue to put their
pipe underneath their sidewalk. She is getting
all of the water over on her new sidewalk.
Mayor Sica said that this is the first that he's
heard about this and he will look at it tomorrow.
Mrs. Mekilo said that her bill is $570.00 for the
two inspectors and she's doing their job.
Mayor Sica told her that he sees on the pictures
what she is talking about, that the drain leader
is not there.
Mrs. Mekilo said that the inspectors should have
told her neighbor to put the pipe under the
ground.
Mayor Sica said that the pipe doesn't have to be
put underground.

Mayor sica questioned if it was a new
sidewalk.
Mrs. Mekilo stated that her sidewalk was
new but complained that her neighbor's
water should not be going down to her
property.
An unidentified man said that there was a
drain that carne down the side of the
building and had an elbow. There is a
flange that shoots out and goes onto the
grass. The water comes off of the grass
and there is a small pitch and it runs
over to their property. Their front
sidewalk to their home is all flooded.
Then it goes down their driveway, which
in turn, also eroded some of the sediment
under their sidewalk.
Mayor Sica told Mrs. Mekilo that he will
go there tomorrow to look at it.
