The notice of this meeting is not considered final until 24 hours prior to the meeting and may be further modified if 24 hours’ notice is impossible or impractical for good cause. In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state laws, all public hearings and meetings held or sponsored by the City of Riverdale, Iowa, will be accessible to individuals with disabilities. Persons requiring auxiliary aids and services should contact City Hall at (563) 355-2511 five days prior to the hearing or meeting to advise of their anticipated attendance. The requirement that an Ordinance be read three times before passage may be waived by council upon an affirmative vote of four (4) of the five (5) council members. The public is advised to take note of this process and be prepared to speak either for or against any ordinance at the time of the first reading. Per Chapter 21 of the Iowa Code, more specifically described in sections 21.3 and 21.8, a member of the Council may attend the meeting either in-person or by electronic means, as defined in said sections. 1. The operations manager additionally performs work related to the management, oversight, planning and implementation of the City’s code of ordinances. Work includes but is not limited to; code enforcement, inspections, permits, policy development, coordination with contracted building inspectors, board of adjustment meetings and planning and zoning meetings. This position will serve as a supervisor over work performed by part time or contracted staff. Position may be required to attend council meetings. Responsible for the oversight of all the City’s outside activities; including but not limited to installation, repair, and maintenance of the sanitary sewer collection system, storm sewer collection system, roadways, sidewalks, City owned parks and other properties and maintenance of City rights of way. This position coordinates with outsourced contractors preforming work for the City. Position is expected to be able to serve as a Competent Person (per OSHA rules), and be skilled in supervising and decision-making. The Operations Manager follows prescribed policies and procedures and must be skilled in decision-making and generally work well with limited supervision. Performs all other duties as assigned. ESSENTIAL FUNCTIONS AND DUTIES: Determine and prioritizes work plans and coordinates personnel, equipment and materials to accomplish results in a safe and efficient manner. Coordinates with City Clerk on all pertinent matters. Coordinates the locating and documenting of sewers, streets and other necessary information. Must have a thorough knowledge of equipment and manpower necessary to perform tasks in sewer, street, parks, and related work areas, including knowledge of all pieces of equipment used by City crews and how to operate this equipment safely. Responsible for keeping all City vehicles, equipment, tools, building and grounds in clean, safe and in good working condition as needed. Must have strong knowledge of street repairs & maintenance, parks maintenance, and sanitary sewer and storm sewer collection systems. Must be able to skillfully operate maintenance equipment. Must be able to obtain any required sewer certifications from the State of Iowa within a reasonable period of time from hire, and maintain these certifications throughout employment. Must be insurable by the City’s insurance company, able to pass a thorough background check, and a pre- employment drug screen and physical. The Council shall appoint by majority vote a City Clerk to serve at the discretion of the Council. The Clerk shall receive such compensation as established by resolution of the Council. When the City Administrator position in Chapter 22 is a full-time appointment, the Clerk position may be combined with the Administrator position and compensation set by the City Council for the Administrator will include compensation for the Clerk duties as well. (Code of Iowa, Sec. 372.13[3]) (Ord. 2020-01 – Apr. 22 Supp.) 18.02 POWERS AND DUTIES: GENERAL. The Clerk or, in the Clerk’s absence or inability to act, or as delegated to the Deputy Clerk has the powers and duties as provided in this chapter, this Code of Ordinances, and the law. (Ord. 2020-01 – Apr. 22 Supp.) 18.03 PUBLICATION OF MINUTES. Within fifteen (15) days following a regular or special meeting, the Clerk shall cause the minutes of the proceedings thereof to be published. Such publication shall include a list of all claims allowed and a summary of all receipts and shall show the gross amount of the claims. (Code of Iowa, Sec. 372.13[6]) 18.04 RECORDING MEASURES. The Clerk shall promptly record each measure considered by the Council and record a statement with the measure, where applicable, indicating whether the Mayor signed, vetoed or took no action on the measure, and whether the measure was repassed after the Mayor ’s veto. (Code of Iowa, Sec. 380.7[1 & 2]) 18.05 OTHER PUBLICATIONS. The Clerk shall cause to be published all ordinances, enactments, proceedings and official notices requiring publication as follows: 1. Time. If notice of an election, hearing, or other official action is required by this Code of Ordinances or law, the notice must be published at least once, not less than four (4) or more than twenty (20) days before the date of the election, hearing, or other action, unless otherwise provided by law. (Code of Iowa, Sec. 362.3[1]) 2. Manner of Publication. A. A publication required by this Code of Ordinances or law must be in a newspaper published at least once weekly and having general circulation in the City, except that since the City has no newspaper published within its corporate limits, publications of ordinances and amendments may be made by posting in three public places which have been permanently designated by ordinance. (Code of Iowa, Sec. 362.3[2]) B. The three public places where ordinances and amendments may be published by posting are designated as follows: On the bulletin board located on the north wall of Riverdale City Hall located at 110 Manor Drive, Riverdale, Iowa In Kiosk located in Volunteer Square Park located off Windsor Drive (side facing Windsor Drive) In Kiosk located in Van Gundy Park located in Haven’s Acres off of S. Kensington Street. The Clerk is hereby directed to post promptly such ordinances and amendments, and to leave them so posted for not less than ten (10) days after the first date of posting. It is unlawful for any person other than the City Clerk to remove any such posted ordinance or amendment. Unauthorized removal of the posted ordinance or amendment prior to the completion of the ten days shall not affect the validity of said ordinance or amendment. The Clerk shall note the first date of such posting on the official copy of the ordinance and in the official ordinance book immediately following the ordinance. (Code of Iowa, Sec. 362.3[2]) C. The City Clerk, at the discretion of the Mayor, may cause an additional unofficial posting of ordinances and amendments on the City of Riverdale website at riverdaleia.org. The posting of ordinances and amendments on the City website is discretionary. The posting of, or failure to post, ordinances and amendments on the City website shall not affect the validity of the ordinance or amendment. (Section 18.05 – Ord. 2020-01 – Apr. 22 Supp.) 18.06 AUTHENTICATION. The Clerk shall authenticate all measures except motions with the Clerk’s signature, certifying the time and manner of publication when required. (Code of Iowa, Sec. 380.7[4]) 18.07 CERTIFY MEASURES. The Clerk shall certify all measures establishing any zoning district, building lines, or fire limits and a plat showing the district, lines, or limits to the recorder of the County containing the affected parts of the City. (Code of Iowa, Sec. 380.11) 18.08 RECORDS. The Clerk shall maintain the specified City records in the following manner: 1. Ordinances and Codes. Maintain copies of all effective City ordinances and codes for public use. (Code of Iowa, Sec. 380.7[5]) 2. Custody. Have custody and be responsible for the safekeeping of all writings or documents in which the City is a party in interest unless otherwise specifically directed by law or ordinance. (Code of Iowa, Sec. 372.13[4]) 3. Maintenance. Maintain all City records and documents, or accurate reproductions, for at least five (5) years except that ordinances, resolutions, Council proceedings, records and documents, or accurate reproductions, relating to the issuance, cancellation, transfer, redemption or replacement of public bonds or obligations shall be kept for at least eleven (11) years following the final maturity of the bonds or obligations. Ordinances, resolutions, Council proceedings, records and documents, or accurate reproductions, relating to real property transactions shall be maintained permanently. (Code of Iowa, Sec. 372.13[3 and 5]) 4. Provide Copy. Furnish upon request to any municipal officer a copy of any record, paper or public document under the Clerk’s control when it may be necessary to such officer in the discharge of such officer ’s duty; furnish a copy to any citizen when requested upon payment of the fee set by Council resolution; under the direction of the Mayor or other authorized officer, affix the seal of the City to those public documents or instruments which by ordinance and Code of Ordinances are required to be attested by the affixing of the seal. (Code of Iowa, Sec. 372.13[4 and 5] and 380.7[5]) 5. Filing of Communications. Keep and file all communications and petitions directed to the Council or to the City generally. The Clerk shall endorse thereon the action of the Council taken upon matters considered in such communications and petitions. (Code of Iowa, Sec. 372.13[4]) 18.09 ATTENDANCE AT MEETINGS. The Clerk shall attend all regular and special Council meetings and, at the direction of the Council, the Clerk shall attend meetings of committees, boards, and commissions. The Clerk shall record and preserve a correct record of the proceedings of such meetings. (Code of Iowa, Sec. 372.13[4]) 18.10 ISSUE LICENSES AND PERMITS. The Clerk shall issue or revoke licenses and permits when authorized by this Code of Ordinances, and keep a record of licenses and permits issued which shall show date of issuance, license or permit number, official receipt number, name of person to whom issued, term of license or permit and purpose for which issued. (Code of Iowa, Sec. 372.13[4]) 18.11 NOTIFY APPOINTEES. The Clerk shall inform all persons appointed by the Mayor or Council to offices in the City government of their position and the time at which they shall assume the duties of their office. (Code of Iowa, Sec. 372.13[4]) 18.12 ELECTIONS. The Clerk shall perform the duties relating to elections in accordance with Chapter 376 of the Code of Iowa. 18.13 CITY SEAL. The City seal is in the custody of the Clerk and shall be attached by the Clerk to all transcripts, orders and certificates which it may be necessary or proper to authenticate. The City seal is circular in form, in the center of which are the words “RIVERDALE, IOWA” and around the margin the words “CITY SEAL.” 18.14 DEPUTY CITY CLERK. 1. Appointment. The Mayor or City Administrator in the case of a full-time Administrator may appoint, subject to Council approval, a Deputy City Clerk to serve at the discretion of the Mayor. 2. Compensation. If appointed, the Deputy City Clerk is paid such compensation as specified by resolution of the Council. 3. Duties. The duties of the Deputy City Clerk are as follows: A. Learn and implement the processes and policies of the City. B. Assist the City Clerk in management of documents and management of City business. C. Be present during vacation periods of the City Clerk. D. Assist the City Clerk in the performance of the duties of City Clerk. E. Perform such other duties as designated by the Mayor and/or City Clerk from time to time. City clerks must handle a wide range of city business particularly in smaller communities, often working long hours to en- sure their local government runs smoothly. It is crucial for mayors and council members to recruit, identify, train and keep a well -qualified and able person for this position. Doing so can be a long-term investment in the organization. This chapter discusses the various duties and roles of the city clerk in Iowa. Included is information on some basics of being a city clerk, required duties such as pub- lishing notices, and guidance on handling public inter- action and citizen requests. Krell, Clerk Date: July 19, 2023 Subject: Filling Council Vacancy As you know, Kevin Adams resigned his Council position on July 11, 2023. The Council needs to consider its approach for filling this vacancy. Under Iowa Law, the Council need s to initiate action within 60 days. The choices are (1) appoint someone to fill the vacancy; or (2) call for a special election to fill the seat. If the council makes an appointment, that person would serve through the end of this year, with the term ending on January 1, 2024, and the seat would be on the ballot in the November 2023 election, which also happens to be the same time the seat would normally be up for election. This appointment could end up being shortened if the City called a special election on a different issue prior to November 2023. In that case, the seat would also have to be on the ballot. Also, citizens could theoretically petition for a special election if they do not agree with the decision to appoint to fill the vacancy at this time. In order to appoint the position, the City would need to publish a notice in the newspaper and then vote at a future meeting to determine the person to be appointed to the position. If the Council calls for a special election, or a petition forces it, this will present several thousands of dollars in cost to the City. The City would be required to hold a special election no later than Tuesday, October 3, 2023. Appointing to fill the vacancy is the most common route. In the meeting packet, I have provided the information necessary to move forward with appointing to fill the vacancy, but the Council could certainly choose to call for a special election if that is preferred. It's my opinion that the Council operates best when all seats are filled, and it's in our best interest to proceed with due speed to fill the vacancy. It is our understanding that the borrowing will be in the approximate principal amount of $200,000, and that a local bank will be chosen to serve as lender on this local bank private placement. As Bond Counsel, it is our responsibility to provide legal representation to the City with respect to the authorization of the issuance of the Note. In serving as Bond Counsel, we will prepare appropriate resolutions, notices, agreements and closing certificates, consult with the lender, and undertake such additional duties as we deem necessary to help the City through this transaction. At closing of the Note issue, assuming the proper conditions are in place, we will deliver our opinion that: (1) the Note is a valid and binding general obligation of the City; and (2) the interest paid on the Note will be excluded from gross income for federal income tax purposes. In performing our services as Bond Counsel, our sole client in this matter will be the City of Riverdale. We will not represent any other party in this financing and it is mutually understood that the services to be provided by us as described herein are solely for the benefit of the City. Based upon: (i) our current understanding of the terms, structure, size and schedule of the financing, (ii) the duties we will undertake, (iii) the time we anticipate devoting to the project, and (iv) the responsibilities we assume, we estimate that our fees and expenses for serving as Bond Counsel will be $4,000. We typically bill for our services after closing of the Note issue, but we reserve the right to bill for the value of our time invested in the representation if closing has not occurred by November 1, 2023. NOW THERE FOR IT BE RESOLVED that: Section 1. In the case where a piece of City-owned equipment or property is recommended for sale, City staff will prepare a brief description of the item, along with age, number of years in City custody (if known), and the approximate market value. If the equipment or property is recommended for disposal or donation, this will be noted. Section 2. City staff may bring a listing of such equipment or property to the City Council from time to time prior to sale or disposal. City Council shall act on these requests via prompt approval of the consent agenda. Section 3. Following City Council action, City staff shall see that the equipment or property is placed for public bids on a surplus government auction website, and/or is offered for public sale on-site, for an appropriate length of time. Staff will advise City Council on a periodic basis when sales are made via this method, including the amount of the sale for each item. Sale proceeds for street purposes shall be deposited in the Road Use Tax Fund, for sewer purposes in the Sewer Fund, for fire department purposes in the Public Safety fund, and for all other purposes in the General Fund. Cleaning up Accounts Payable: I am still correcting some things in Accounts Payable with duplicate vendors, duplicate invoices, etc. This will be completed soon. Election Materials: I have reviewed and familiarized myself with the election material. Normal/ Other Tasks: Accounts payable/cutting checks, assisting residents with any needs they bring to my attention, room rentals, working on the newsletter, disassembling council packets after the meeting, and other tasks delegated to me. The owner will be moving it. - Delt with another complaint on a trailer parked on Linda Lane by out lot a - Look at the storm water in tank at circle and Fieldcrest. The ground is settling down. Didn’t appear to have any soil that I can see. I will get with Chris Cooper and have him look at the same location. - Met with the owner of 309 Ann about erosion control issues. They will be contacting a contractor to fix the issues.
