HomeMy Public PortalAbout89-040 (03-07-89)RESOLUTION NO. 89-40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ESTABLISHING CRITERIA FOR DETER- MINING WHAT CONSTITUTES A SUBSTANTIAL CHANGE TO ACTIVITIES FUNDED THROUGH THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM WHEREAS, the City of Lynwood is an entitlement grantee eligible for funding under Title I of the Housing and Community Development Act of 1974 (Act); and WHEREAS, in order to receive CDBG funding under the Act, the City is required to submit a Statement of Objectives and Projected Use of Funds which identify all CDBG funded activities to be under taken in a given grant year; and WHEREAS, the activities described in the final Statement may be modified from time to time provided that citizens are given an opportunity to review and comment on substantial changes; and WHEREAS, •CDBG program regulations at 24CFR 570.305 require entitlement grantees to develop criteria to determine what constitutes a substantial change for the purpose of informing affected citizens. ~ NOW, THEREFORE, the City Council of the City of Lynwood does hereby find, order, determine and resolve as follows: SECTION 1. The following criteria is hereby established to provide guidance in determining what constitutes a substantial change to an activity identified in the CDBG final Statement of Objectives and Projected Use of Funds: 1. Changes in the location of an activity from that described in the final statement, if the location of the activity falls outside of the original census tract designation. 2. Changes in the funding amount of an activity that exceeds $50,000 (plus or minus) per modification. 3. Changes in the beneficiaries of an activity where the beneficiaries are expected to be less than 100$ low/mod income persons. However, in no case shall an activity qualified under the low/mod benefit objective serve less than 60$ low/mod income persons consistent with the time period specified in the applicable statement of objectives. 4. Changes in the scope of work which increase or delete the items of work to be performed by more than 50~ or materially ~ changes the product or desired outcome without affeccting the funding amount. If any of the above conditins are present, City staff is to follow the citizen participation requirements outlines in the Community Development Block Grant Regulations at 24CFR 570.305 (9/88). ooMU~' o rC~~ °~aa. i(+~ . ._.. .
