COUNCIL MINUTES

The Council of Hal Harbour Village met Saturday,
September 12, 1964 at 9:'10 A.M. at the Village Hall.
Present.: !Messrs. Beatty, Bart. and White
Absent: Messrs. Faulkner and Sanders.
Also present were W. H. Webb, Village Manager;
Mary T. Wetterer, Village Clerk; and Thomas h. Anderson,
Village Attorney.
In the absence of Mnyor Faulkner the meeting was

Mr. Webb read a .letter Crom the Balmoral Hotel in
which they requested permission to renew the contract of GnIf
American Land C-mpany for operation of a real estate orrice
in the hotel. After discussion on motion of Mr. White,
seconded by Mr. Beatty and unanimously voted permission was
granted for one year upon payment of the designated license
fees.
Due to a court decision out 'awing the res;ricti.on
of construction during the seasonal months, an amendment was
presented to our Noise Ordinance. On motion of Mr. White,
seconders by Mr. Beatty and voted
ORDINANCE NO. 1.06
was unanimously adopted.
Mr. Webb read a letter from Harland Bartholomew
and Associates in reply to our inquiry regarding the business
section property due to the fact that the parcel had never
been zoned professionally. After discussion. of the cost and
factors involved, Mr. Anderson sug ested that if the plans
submitted by the Whi tmans were in agreement with our present
zoning regulations, then we wouldn't need a professional opinion.
However, he said that: he thought the Village Manager should tell
Mr. Whitman that the village is considering an outside opinion
on height, etc. and if he wished to submit plans, they would be
taken into consideration.
Mr. Hart explained that the Community National. Bank
needed Resolutions in order for us to set up our accounts for
the operation of our new Sewer System. Thereupon, on motion
of' Mr. Beatty, seconded by Mr. White and unanimously voted,
the Resolution was adopted and Mr. Webb er Mr. Faulkner were
authorized to sign the checks.

Mr. Webb pointed out that the 1963-64 budget is in
balance at 88% spent, but that as usual transfers are needed
between the departments. After consideration on motion of
Mr. Beatty, seconded by Mr. White, and unanimously voted,
the Village Manager was authorized to transfer the amounts
needed in accordance with Section 44 of the Village Charter,
as follows: From Dept. 01-$440; 03P-$975; 05-$4990. To
Dept. 02-$910; 03F-$440; 06-$700; 07-$4355.
Mr. Webb then explained that our accounting
method does not provide for allocating inspectors fees
over the budgeted amount. He asked that the Council trans-
fer the amounts needed to pay the Electrical, Plumbing and
Air Conditioning Inspectors from the Revenue derived from
these permits. After discussion on motion of Mr. Beatty,
seconded by Mr. White, it was unanimously voted to transfer
the amount due to Inspectors from the Revenue accounts.
The Village Clerk submitted a request from Miami
Springs asking that we petition the State Legislature to
publish the name of juvenile offenders. The Council agreed
to table this for next month until an opinion could be ob-
tained from the Dade County Association of Chiefs of Police.
North Miami Beach asked that we inform the
county to proceed with the 17 service areas. Mr. White
moved that the Village Manager write the City of North
Miami Beach stating that Bal Harbour Village was not in
favor of turning over some of the services indicated to
Metro. The motion was seconded by Mr. Beatty and unani-
mously adopted.
The Council decided to take no action on the
petition of Attorney Richard H.M.Swan to inform Congress
that we are opposed to any delay in reapportionment.
Mr. Webb informed the Council that he had ap-
pointed Richard Creelman as Building Inspector about a
year ago and he would like to have the wording in our
Zoning Ordinance changed from Building Inspector to
Village Manager for the enforcement of the Ordinance.
On motion of Mr. Beatty, seconded by Mr. White and
unanimously voted, Mr. Anderson was instructed to prepare
such an amendment.

Due to unestimated Building Permit revenues
received this year, the Village will have Surplus Funds
and the Village Manager said he would like to expend

some of this to repave our side of 96th Street, to match
Surfside as soon as the Construction work is finished.
On motion of Mr. White, seconded by Mr. Beatty, it was
unanimously voted to allow the Village Manager to expend
some of our surplus funds for this repaving, but to clear
the cost with the Councilmen by phone for confirmation
later,
Mr. Webb said that he would like the Council to
also consider expenditures from sur:,Lus for re -landscaping
later in the year to replace the trees and shrubs lost in
the hurricane. The Council decided to take no action at
this time.
The Village Manager also reported that he and
Mayor Faulkner had been attending the meetings of the Hal.
Harbour Resorts, Inc. and the Association was having some
very attractive brochures made of the Bal Harbour area.
He suggested that inasmuch as the Village could not make
a donation to the organization, perhaps we could purchase
brochures for about $.1,000. The Council tabled this for
full Council action.
There being no further business before the meeting
on motion or Mr. White, seconded by Mr. Beatty, the meeting
was adjourned.
