No. 04-267 Date of Adoption August 26 , 2004 ACCEPTING SOLE SUPERVISION OF PROPERTY DIVIDED BY MUNICIPAL BOUNDARY WITH WOODBRIDGE TOWNSHIP WHEREAS, the municipal boundary line between the Borough of Carteret and the Township of Woodbridge, both in Middlesex County, New Jersey divides a certain parcel shown as Block 273, Lot 12 on the Tax Map of the Borough of Carteret, known as 3 Roosevelt A venue, and which is the location of "Charles Pub and Pizzeria" (the "Property"); WHEREAS, Section 40A:13-l9 of the New Jersey Statutes authorizes two municipalities which share jurisdiction of a single parcel to agree, by resolution, which municipality shall have sole supervision of such parcel; WHEREAS, the Borough of Carteret has adopted a redevelopment plan and designated a redeveloper to carry out a redevelopment project for land which includes the Property; and WHEREAS, the Borough of Carteret has requested the sole supervision of the Property including the right and obligation to oversee the site plan process for the Property, notwithstanding that a portion of the Property is located in Woodbridge Township. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Carteret, Middlesex County, New Jersey, that the use, supervision and control of the entirety of the Property be vested in the Borough of Carteret, notwithstanding that a portion of the Property is situate in Woodbridge Township. BE IT FURTHER RESOLVED that the Council hereby directs the Planning Board to include and consider the entirety of the Property in any application before the Planning Board which includes the portion of the Property that is situate in the Borough of Carteret. BE IT FURTHER RESOLVED THAT duly executed copies of this resolution shall be transmitted to the Planning Board and file in the office of the Borough Clerk. Pelzman Woodbridge Township 1 Main Street, Woodbridge, NJ 07095 Re: Lower Roosevelt Avenue Redevelopment Plan", Carteret Dear Mayor Pelzman: This finn is special redevelopment council to the Borough of Carteret ("Borough"). As you may know the Borough designated certain properties in the Chrome area of the Borough as a redevelopment area and adopted the Lower Roosevelt Avenue Redevelopment Plan to govern the redevelopment of such properties. One of the properties is bisected by the municipal boundary between the Borough. and Woodbridge Township. That property, lot 12, block 273, is located at 3 Roosevelt Avenue and is the location of "Charles Pub and Pizzeria" (the "Property"). We understand that Mayor Reiman has spoken with you about this Property. Pursuant to NJ .S.A. 40A: 13-19 two municipalities can agree, by resolution passed by both municipalities, which municipality should have sole supervision of a property that is bisected by the municipal boundary. I have attached a fonn of resolution that should be adopted by Woodbridge Township in which Woodbridge would agree that the Property should be governed solely by the Borough. The Borough has already included the Property in a redevelopment area, designated a redeveloper and will oversee a síte plan application for the redevelopment project that includes the Property. Please have the attached resolution adopted by the Woodbridge Township Council at the next available Council meeting and kindly forward an approved copy to me.
