HomeMy Public PortalAboutResolutions-2014-175RESOLUTION NO. 2014-175 RESOLUTION AUTHORIZING THE TIFFIN CITY COUNCIL TO APPROVE THE CITY ADMINISTRATOR/ CLERK AND MAYOR TO NEGOTIATE A RAILROAD CROSSING AGREEMENT WITH THE IOWA INTERSTATE RAILROAD WHEREAS, the City of Tiffin recognizes the importance of having an agreement in place with the Iowa Interstate Railroad for a new pedestrian and motor vehicle crossing of the railroad in conjunction with Trail Phase 5. WHEREAS, the City of Tiffin recognizes Iowa Interstate Railroad has already presented some general terms as a starting point regarding future discussions on different trail options. ➢ Brown Street crossing is closed and removed. ➢ A new public street and trail crossing is constructed on the west side of the City Park, south off of Kimberlite Street. ➢ City pays for crossing, installation and maintenance. ➢ City pays for installation and maintenance of crossing signals and gates. ➢ City agrees to provide access to all property currently served by the Brown Street crossing, if any other than City. ➢ City agrees to carry insurance to cover the crossing. ➢ Street shall continue to dead end between tracks and Clear Creek, changing street to a through street will require additional licensing. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TIFFIN, IOWA, that City Administrator/ Clerk and Mayor are hereby authorized to proceed with negotiating any additional terms for the crossing with Iowa Interstate Railroad. On the 10th day of December, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Resolution No. 2014-175, and made a motion for approval.
