No. 04-272 Date of Adoption A11g1~t 7(\, 2004 AUTHORIZING SUPPLY AGREEMENT WITH THE TURNPIKE RECYCLING CENTER WHEREAS, the Borough desires to enter into a Supply Agreement with Turnpike Recycling Center for co-mingled recyclable materials NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret that the Supply Agreement with the Turnpike Recycling Center for co-mingled recyclable materials, copy of which is attached hereto and made a part hereof is hereby approved. BE IT FURTHER RESOLVED the Mayor is hereby authorized to execute said Supply Agreement and the appropriate Borough Officials are hereby authorized and directed to implement said agreement. MESLER _ßE~ 08/26/2004 THU 14:45 FAX [4J 002/002 Supply Agreement This Supply Agreement is by and between Turnpike Rceyding Center (TRC) a New Jersey corporation with a principal place of business at 1000 :Port Carteret Drive, Carteret, NJ and the supplier Town of Carterct, with a principal place of business at 64 Cooke Avenue Carteret, NJ shall become effective on September 1, 2004 through the period ending August 31, 2007_ From and after the date of this Agreement and until this Agreement expires, TRC shall accept all Recyclable Material delivered or caused to be delivered by Town of Cartcret to the Facility during the Receiving Times.; (Monday through Friday, 7am to 4:30 pm). This agrec:ment shall include delivery of recyclable materials such as bottles, cans and plastic containers, excluding solid waste, special waste, volatile, or toxic material provided by Supplier to Turnpike Recycling Center. Supplier acknowledges and agrees that all recyclable materials delivered to Turnpike Recycling Center become the property of Turnpike Recycling Center once accepted. Turnpike Recycling Center reserves the right to reject loads of recyclable materials in which the contamination is above specified acceptable levels_ Supplier will be notified about rejected loads and will have the opportunity to inspect on sitc. Turnpike Recycling Center is responsible for providing Supplier with a monthly detailed report showing truck number, date, time, and weight. PRICING Town of Carteret shall pay $5.00 per ton for this material delivered to Turnpike Recycling Center fOT the entire length of this agreement_ Turnpike Recycling Center agrecs that this Supply Agreement may be terminated oIÙY with cause upon 30 days notice by certified mail. Neither party hercto shall be liable for its failure to perform hereunder due to contingencies beyond its reasonable control including, but not limited to strikes, riots, fires, or acts of God.
