Present: Messrs: Beatty, Faulkner, Sanders and White Absent: Mr. Hart Also present were Willard H. Wehb, Village Manager; Mary T. Wetterer, Vi.11.ago Clerk; and Thomas H. .Anderson, Village Attorney.On motion of Mr. ,Sanders, seconded by Mr, kite, the w4ilsn mlge tgs.dthe previous meeting' of Soot nml-,nr 1, 1')ON were approved a� Mr. Stanley Whitman appeared before the Council to ask for a variance in the business section to allow a 17 foot project- ion of a building under the proposed double deck parking area in the 100 foot set -back area. Mr. Webb said Mr. Anderson would have to advise the Council if a public hearing would have to be held if the Council gives this their approval. Mr. Anderson said that a hearing would not be necessary as the Council at the Julv 31, 1962. public hearing had allowed n double deck parking area to project 50 feet into this area and the building would be nndernnnth this. After considera- tion Mr. White moved that when plans and working drawings in accordance with the ordinance are properly submitted for a permit, that the permit will be granted notwithstanding the projection in the set -back area, as shown on the sketch Mr. Whitman has submitted to the Council, the building; structure should not exceed 17 feet into the set -back area and the canopy not to exceed 50 feet into the set -hack area. The set -back area will have surrounding it on that side the wall that was shown on the rendering and submitted to the Council. The motion was seconded by Mr. Sanders and unanimously voted. An Ordinance to amend the Zoning Ordinance to set the Council up as the Board of Appeals was submitted, as discussed at the previous meeting, and on motion of Mr. Beatty, seconded by Mr. Sanders and unanimously voted ORDINANCE NO. 107 was passed by the Council. Mr. Webb read to the Council a .letter from Mr. Sol Tanlin of the Harbour House requesting permission to solicit Leases from certain types of businesses and professional men for oper- ation in the Harbour House South. He said these operations were for the convenience and exclusive use of their tenants and were mainly subsidized by their corporation. Mr. Webb explained that the Council must interpret the Zoning Ordinance to determine what: would be called "incident to the operntion". October 24, 1964 189 He explained that if these businesses were allowed then we - could properly license them. After consideration of the list, namely ---Beauty Salon, Restaurant, Cocktail Lounge, Sundries, Stock Brokerage Office, Gift Items, Beach and Pool Accessories, Doctor and Dentist, Mr. Beatty moved that they be permitted to operate. The motion was seconded by Mr. White and unanimously voted. Mr. Taplin then discussed with the Council the. possibility of leasing Lot 1 Block 8A and erecting a tennis court and putting green. Mr. Webb explained that this lot is zoned for an Apart- ment House only and in addition to our Zoning requirements the owner of the lot would have to take this matter up with the Board of the Bal Harbour Club for changing any use, due to the existing deed restrictions. The Council then considered applications for Taxi and Limousine Permits. On motion of Mr. White, seconded by Mr. Sanders and unanimously voted,. the following permits were granted: Morse Taxi and Baggage, Inc. 16; No`rth Beach Yellow Cab 15; Surf Cab 15; and Red Top Sedan Service1 limousine permit. Mr. Anderson read to the Council an.. Ordinance setting up a license fee for Southern Bell Telephone and Telegraph Company under their franchise. This license consists of one percent- of billings forserviceeffective with the license year ending October 31, 1964. He explained that the Town of Surfside had passed such an ordinance and it was now in.liti- gation. After discussion as to the advisability of. enforcing the ordinance at this time it was decided to passthe ordinance now and if the Surfside case is decided against the Town, our ordinance could be repealed. Thereupon motion of'Mr. Beatty, seconded by Mr. Sanders ORDINANCE NO. 108 AN ORDINANCE LEVYING AN ANNUAL LICENSE, OCCUPATIONAL, INSPECTION AND FRANCHISE TAX OR FEE ON TELEPHONE. COMPANIES DOING BUSINESS IN DAL HARBOUR, IN THE AMOUNT OF ONE PER CENT OF BILLINGS, AS DES- CRIBED HEREIN, AND PROVIDING THE EFFECT- IVE DATE HEREOF: REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH: PRESCRIBED PENALTIES FOR VIOLATION OF THE PROVISIONS - HEREOF; AND, DECLARING AN EMERGENCY TO EXIST. was unanimously adopted. The Village Manager was instructed to send the Southern Bell Telephone and Telegraph Company a copy of the ordinance and inform them that we would not enforce this ordinance until the Surfside decision. The Village Clerk explained that Albert Enterprises, Inc. were going to apply for a Liquor License for Harbour House South and that the principals were the same as those on the license granted to Bal Harbour Towers, Inc. She explained October 24, 1964 190 that the forms had not been returned in time for this meeting, but they had asked that the Council consider this application so they could proceed with obtaining their State License. On motion of Mr. Beatty, seconded by Mr. White and unanimously voted the application was granted contingent on n check of the principals when the application is formally submitted. Mr. Webb told the Council that our five-year Sewer Con- tract with the City of Miami Beach was expiring and that he and Jay Roth had met with the City Manager of Miami Beach. It was the decision of the City of Miami Beach that our con- tract would be renewed at an advanced fee of $4,787.00 which would allow us to pump 150O gallons per minute through their system. The contract will be considered by the City of Miami Beach Council at a meeting this week and he asked that the Council authorize the signing of this contract when presented. Mr. Sanders moved, seconded by Mr. White and unanimously approved that Mr. Webb or Mr. Faulkner be authorized to accept this contract when presented. Mr. Faulkner presented a Resolution asking that Metro give serious consideration to the ,juvenile delinquency problem. RESOLUTION NO. 1.23 was passed on motion of Mr. Sanders, seconded by Mr. White and unanimously voted. Mr. Webb said he had obtained a nuote on additional prem- iums to insure the Village against False Arrest, detention or imprisonment, or malicious prosecution, libel, slander or de- famation of character, invasion of privacy, wrongful evirtion or wrongful entry, in the amount of $176.00 with the exception of false arrest. This would have to be placed with Lloyds for a 850O.00 minimum nremitun. Mr. Andersen exnlnined that this has become a serious situation as the Courts have ruled against municipal immunity in some recent cases and thought the Village should .sernrn this nrntertion. He said Miami Shores had re- cently become insured. On rnotion of Mr. White, seconded by Mr. Sanders and unanimously voted the Village Manager was authorized to check further into this matter and place the insurance as he saw fit the premiums not to exceed $676.0O. The Village Manager read a letter from Rai Harbour Resorts, Inc. in which they petitioned the Counetl to allow a.11 bars in the Village to remain open until five o'clock A. M. on January 1st. Inasmuch as all the members of the group were in favor of this, on motion of Mr. White, seconded by Mr. Sanders and unanimously voted, Mr. Anderson was. instructed to prenare an amendment to Ordinance No. 6 incorporating the change in hours. Mayor Faulkner said he would like the Council to consider adopting the Sister City program. After discussion it was de- rided that information would he obtained on this program and discussed at the next meeting. October 24, 1964 191 The Council were then handed their salaries of $1.00 for the fiscal year ending September 30, 1964. There being no forther business before the meeting on motion of Mr. Beatty, seconded by Mr. White, the meeting was adjourned. Mayor ATTEST: i G4GGC.CLE VILLA • COUNCIL MINUTES NOVEMBER 28, 1964 The Council of Bal Harbour Village met on,Saturday, November 28, 1964 at 9:30 A. M. in the Village Hall. Present: Messrs: Beatty, Hari, Sanders and White. Absent: Mr. Fred Faulkner. Also present were W. H. Webb, Village Manager; Mary T. Wetterer, Village Clerk and Thomas H. Anderson, Village Attorney. 4- In the absence of Mayor Faulkner, the meeting was con- ducted by Assistant Mayor Hart. ` On`motion of Mr. Sanders, seconded by Mr.`White, the minutes of the previous meeting of`October 24, 1964 were approved as submitted. Mr. Webb briefed the'members on the "Sister City" Program stating it would be done on a people to people program and would have to be sponsored by a civic organiza- tion, i.e. Rotary Club or Kiwanis'Club. The civic organiza- tion approaches the city asking for their cooperation. A11 work is done through the Washington office and they would help in selecting the foreign city. This item was tabled until the next meeting with Mr. Faulkner in attendance. The Village Manager informed the Council that he had discussed the matter regarding the publishing of names of juveniles for certain offenses with the Dade County Chiefls November 28, 1964
