Amendment. Request filed Missouri American Water Co., property owner, for the rezoning of 8.49 acres

Mr. Lester requested a correction to the spelling of Pastor Shaun Johnson, Bibleway Community
Church, 900 Monroe Street. The correct spelling is Pastor Shaunacy Johnson.
Ms. Cotten moved and Mr. Lester seconded to approve the Regular Meeting Minutes of
November 8, 2018 as corrected. The motion passed 7-0 with the following votes:

Case No. P18029 - 1101 E Capitol Ave, Rezoning from M-1 to PUD and Preliminary PUD
Plan. Request filed by Delong Properties, property owner, and Raymond Latocki, applicant, for a
rezoning of 8.43 acres from M-1 Light Industrial to PUD Planned Unit Development and a
Preliminary PUD Plan to renovate the International Shoe Company building and site as a mixed
use development of Residential and Commercial uses including a restaurant, apartments,
haunted house, mini golf and office space. The property is located on the north side of East
Capitol Avenue 1800 feet east of Lafayette Street and is described as part of Outlots Nos. 44 and
45, in the City of Jefferson Missouri.
Mr. Zollinger described the proposal and explained that portion one of the proposed request
consists of rezoning the subject property from M-1 Light Industrial to PUD Planned Unit
Development. He stated that the second portion of the proposed request is a Preliminary PUD Plan
to renovate the International Shoe Company building and site a as mix of residential and
commercial uses including, a restaurant, office space, apartments, haunted house, event space,
and mini golf. Mr. Zollinger explained that the plan is proposed to be implemented over 3 phases,
renovating the different levels and outdoor space throughout the phases. He stated that Phase 1
would consist of renovations to the 1st, 4th and 5th floors; Phase 2 would consist of renovations to
the 2nd and 3`d floors as well as an outdoor haunted walkway; and the third and final phase would
mainly consist of outdoor recreational facilities located primarily to the rear of the property. Mr.
Zollinger explained that sidewalks are to be constructed along the entire frontage of the property.
Mr. Zollinger explained that the parking requirements for the proposed uses would be 232 parking
stalls based on zoning code requirements. He stated that the proposed site plan currently has 195
paved parking stalls with gravel overflow parking for up to 70 additional vehicles.
Mr. Raymond Latocki, Ellen Kimray Productions LLC, 2629 SW 180th Terrace, Beaverton, OR,
spoke regarding this request and explained that he has 18 years of experience in the entertainment
industry. He stated that he likes to do things that are different that brings people in to have fun. Mr.
Latocki explained that the proposed development would consist of an outdoor mini -golf, escape
room games, corporate events, private parties, etc. He stated that we want to bring in not only local
residents but those that live outside of Jefferson City. He stated that hours of operation during the
week would be from 12:00 p.m. to 9:00 p.m. and from 12:00 p.m. to 11:00 p.m. on weekends. Mr.
Latocki explained that they are looking at a new concept of flex office space for someone that is
younger and cannot afford typical office space. He stated that flex office space offers a simpler,
smaller office space with workable areas and a conference room.
Mr. Kevin Thoenen, 1233 Ashbury Way, spoke regarding this request and explained that a two
bedroom, two bathroom loft/penthouse suite located on the 5th floor would be approximately $1,000
per month. He stated that a studio or two bedroom apartment would be approximately $700 to $800
per month.

Those speaking in favor voiced the following comments:
• This is something exciting for Jefferson City and very worthwhile. The proposed development
will have a positive impact on the MSP Redevelopment.
• Excited about the potential this will bring to the East Side.
• Not a lot of family fun things to do in Jefferson City. The subject property is the perfect place
for this development.
Mr. Paul Samson, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request and commented that he is excited about being a part of this proposed
development. Mr. Samson spoke about the existing detention basin and explained that the
stormwater basin was put in place by the State of Missouri when the State of Missouri Health Lab
was built. He stated that it is not the responsibility of the developer to fix the existing stormwater
system.
Mr. Larry Kolb, 741 Turnberry Drive spoke regarding this request and explained that he
represents the DeLong Family. He stated that they have been looking for a buyer for the subject
property for five years. Mr. Kolb explained that the developer is prepared to do what it takes to
make this development a success.

7. Other New Business
Case No. P18028 — Sardonyx Drive, Preliminary and Sketch Subdivision Plat of Prenger
Ridge Subdivision. Request filed by Joe Scheppers, property owner, and Ryan Prenger,
applicant for the following:
1. Preliminary Subdivision Plat for 23.98 acres consisting of 35 Single Family Residential
lots.
2. Sketch Subdivision Plat for 71.07 acres consisting of a total of 61 Tots showing the future
road network of Sardonyx Drive, Weatherhill Road and Emerald Lane.
The property is zoned RS-2,RS-1 Single Family Residential and PUD Planned Unit Development
is located on the North end of Sardonyx Drive and is described as part of the Northeast quarter of
the Southwest quarter of section 10, Township 44 North, Range 12 West, in the City of Jefferson,
Cole County, Missouri (Central Missouri Professional Services, consultant).
Mr. Zollinger described the proposal and explained that this proposal is for the approval of a
Preliminary Plat for Prenger Ridge Subdivision consisting of 23.98 acres. He stated that the
property is zoned RS -2 and RS -1 Single Family Residential and C-2 General Commercial and is
intended to be developed as a single family residential subdivision as an extension of Sardonyx
Drive with a Sketch Subdivision Plat showing the future road network of Sardonyx Drive,
Weatherhill Road and Emerald Lane. Mr. Zollinger explained that this preliminary plat would consist
of 35 lots.
Mr. Paul Samson, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request. Mr. Samson distributed the following visuals: (1) Preliminary Plat for Prenger
Ridge Subdivision; (2) Sketch Preliminary Plat; and (3) Stormwater Plan. Mr. Samson explained
that Mr. Joe Scheppers owns approximately 70 acres in the vicinity of the subject property and has
an agreement with Mr. Ryan Prenger to purchase approximately 24 acres to extend the subdivision
from Sardonyx Drive. He stated that the intent of the Sketch Plat is future plans would be for
Sardonyx Drive to not connect to South Ten Mile Drive but to circle back around to the south and tie
back into the Diamond Ridge, West Edgewood Drive area. Mr. Samson explained that Mr.
Scheppers lives on the east side of the property and has no intention to proceed with any further
development. He stated that part of the property that Mr. Prenger is purchasing is the northern most
property and is currently zoned C-2. Mr. Samson explained that the intent is to leave the C-2 zoned
property as is for the time being. He stated that all utilities exist on the site. Mr. Samson commented
that he does not agree with staff recommendation for a stormwater detention basin on both the east
and west side. He stated that they propose to use the existing stormwater detention basin that has
no water quality benefits. Mr. Samson explained that they propose to make modifications to the
existing stormwater detention basin outlet so that we would provide the water quality benefit for an
equivalent number of houses and roadways that will be constructed in this subdivision extension on
the west side of the basin.
Mr. Barron explained that he conferred with the Law Department before making a statement. The
stormwater requirements of the City Code are contained in Chapter 31, Stormwater Management.
The subdivision regulations are contained in Chapter 33 Subdivision Code. The Planning and
Zoning Commission does not have the authority to approve any reductions or deviations from the
requirements of Chapter 31. The Applicant needs to work within that section of the City Code.
Mr. Paul Samson, Central Missouri Professional Services, 2500 E. McCarty Street, made a
comment to Mr. Barron's reference to Chapter 31. He commented that he does not believe there is
a specific requirement for stormwater detention to be installed in every development in Chapter 31.
Mr. Samson explained that stormwater detention is typically looked at by staff on a case by case
basis. He stated that we are asking to not include the stipulation that the stormwater detention
basin be installed on the east side and let city staff and the developer work through that process on
the final plans. Mr. Samson explained that we intend to comply with all requirements of Chapter 31
including stormwater quality. He stated that we plan on taking impervious area that currently does
not have any water quality benefit and detaining and treating that water in lieu of the 16 or 17
houses that are on the east side of the basin.
Mr. Barron recommended a removal of the notes on the plat regarding stormwater management.

Mr. Paul Samson, Central Missouri Professional Services, 2500 E. McCarty Street, stated that
agrees to take the stormwater notes off of the plat. Compliance with Chapter 31 is assumed by
approval of the plat and there is no need for additional verbage to state that. We are not asking for
a variance to Chapter 31.
No one spoke in opposition to this request and no correspondence was received.
Mr. Wade gave the Engineering Division staff report. Mr. Zollinger gave the Planning Division
staff report.
Mr. Yarnell moved and Mr. Lester seconded to approve the Prenger Ridge Preliminary Plat and
the associated Sketch Subdivision Plat, subject to comments and technical corrections of the
Planning and Engineering Divisions and subject to the notes being removed with regard to
stormwater detention and stormwater quality from the preliminary plat. The motion passed 7-0 with
the following votes:

8. Other Business

Mr. Barron reported that the following items were recently passed by the City Council:

• 3410 Shermans Hollow, Preliminary PUD Plan. Mr. Barron reported that this bill was
reconsidered and passed at the December 3, 2018 City Council Meeting.

Nature of Request
This rezoning and comprehensive plan amendment request is for a property consisting of 8.49 acres currently
zoned PUD. The purpose of the request is to facilitate the future redevelopment of the property for Missouri
American Water Co. to relocate their existing office and operations facility.
Zoning History
The property was annexed into the city on May 16, 1967. At the time the city's industrial businesses were
developing along industrial drive. The 1968 Zoning map designated the area as local commercial and light
industrial. In 2003 and 2004 the property was part of the Cherry Creek development. The property was rezoned
from M-1 to RA -2 High Density Residential. In 2012 the property was rezoned from RA -2 to PUD. Although
the property has been rezoned a couple of different times and has been part of development plans it has
remained undeveloped.

Comprehensive Plan Amendment:
While the Development Plan Map of the Comprehensive Plan calls for this property to be Medium Density
Residential, this was a result of the several rezonings in the early 2000's to accommodate a growing housing
market. The proposed amendment to the Development Plan Map of the Comprehensive Plan would allow the
property to return to its historical designation and to be rezoned for a more compatible use. Staff Recommends
approval of the request to amend the Development Plan Map of the Comprehensive Plan to show the property
as Industrial.
Rezoning Request
The requested Industrial zoning would be a benefit to the area and allow for the property to be developed in a
manner similar to neighboring properties. Staff recommends approval of the request to rezone the property
from PUD to M-1 Light Industrial.

A. The existing zoning was in error at the time of adoption. Explain.
The existing zoning is not in error.
B. There has been a change in character in the area due to installation of public facilities, other zone changes, new
growth trends, neighborhood deterioration, or development transitions. Explain the change and be specific on which
public facilities, other zone changes, new growth trends, neighborhood deterioration, or development transitions that
effected the change.
The property has undergone several zoning changes over the last 15 years due to changes in anticipated development. The property
was originally zoned M-1. In the early 2000's the property was rezoned to RA -2 to accomidate the construction of an apartment
complex. After partial completion, the apartment development went bankrupt. After being liquidated, the property was purchased
by the current property owner to construct residential duplexes and was rezoned to PUD. The current owner, having decided the
duplex concept would not provide the necessary return on investment has entered into a contract with Missouri American Water
Co. to purchase the property in order to construct a new office and maintenance headquarters facility
C. There is a community need for the proposed rezoning.
(i.) What will the proposed zoning be?
The proposed zoning will be M-1
(ii.) Why does the community need this zoning?
Missouri American Water Co. is proposing to relocate their existing office and operations facility to this location in
order to facilitate the expansion of water treatment processes. The treatment process expansion is needed to update
aging equipment and provide more reliable water service to Jefferson City.
D. The proposed change is consistent with, and in furtherance of, the implementation of the goals and policies of the
Comprehensive Plan, other adopted plans, and the policies, intents and requirements of this Ordinance and other
City regulations and guidelines.
The proposed change is consistant with City plans, regulations and guidelines. The property has been zoned M-1 in the past
and has adjacent M-1 zoning located to the south, and C-2 zoning located to the west. Missouri American has an existing water
tower and storage area located to the west of the property.

E. The proposed zoning is compatible with the zoning and uses of property nearby.

F. Public and community facilities, which may include, but are not limited to, sanitary and storm sewers, water,
electrical service, police and fire protection, schools, parks and recreation facilities, roads, libraries, and solid waste
collection and disposal, are available and adequate to serve uses authorized under the proposed zoning. List public
and community facilities available on the site.
Access to the site is provided from Hoover Road. All utilities including water, electric, telephone, and natural gas are available.
Stormwater detention is already provided for the site. Provisions for water quality treatment will be determined during site
plan development.
G. A traffic impact analysis has been provided to indicate the potential number of new trips generated and provisions
are provided to mitigate impacts of high traffic -generating projects. (See Section 35-60.Traffic impact Analysis
regarding vehicle trip thresholds and traffic impact analysis requirements)
The nature of the development will not require a traffic impact analysis.
H. Authorized uses shall not adversely affect the capacity or safety of the street network in the vicinity of the property.
(1.) Describe the proposed use.
Missouri American Water office & operations facility.
(ii.) Will the proposed use adversely affect the capacity or safety of the street network in the vicinity of the
property? Why/why not?
The proposed use will not adversely affect the capacity of the street network. Hoover Road was constructed for industrial
use and is not currently heavly used. The traffic generated by the facility will generally consist of office and operations
staff, construction equipment and occasional materials deliveries.
I. Potential environmental impacts (e.g., excessive storm water runoff, water pollution, air pollution, noise pollution,
excessive lighting, or other environmental harms) of authorized uses shall be mitigated. List any potential
environmental impacts and how they will be mitigated.
Stormwater detention is provided by an existing detention basin located northwest of the site. Chemicals will be stored indoors,
vehicles will be stored under roof. There may be mateials stockpiles such as aggregates and soils exposed to runoff. During the site
plan design, Best Management Practices will be implemented to prevent runoff into the stormwater system.
J. There is an adequate supply of land available in the subject area and the surrounding community to accommodate
the zoning and community needs.
The existing Missouri American Water office and maintenace facility is located on approximately 2.5 acres. The proposed 8.5
acre site will provide suitable space for the operation as well as space for required buffer yards to surrounding residential uses.
K. Benefits shall be derived by the community or area proposed to be rezoned. List the benefits of the proposed
rezoning.
The community will benefit from a new, more efficient office and operations facility for the local water utility. The
office and operations relocation will provide needed space for water treatement process upgrades.

A. Whether there was error in the original Comprehensive Plan adoption in that the Planning and Zoning
Commission failed to take into account then existing facts, projections or trends that were reasonably foreseeable to
exist in the future. Explain.
The property was shown as Industrial when the Comprehensive Plan was adopted. In the early 2000's
it was changed to High Density Residential to support an apartment complex that was never
completed.
B. Whether events subsequent to the Comprehensive Plan adoption have invalidated the Commission's original
premises and findings made upon plan adoption. Explain.
Since the previously proposed apartment complex was abandoned, the property has remained vacant.
Missouri American Water Co. has purchased the property and plans to construct a new Office and
Operations facility to replace the existing facility on West High St.
C. Whether the change is consistent with the goals, objectives and policies of the Plan. List compatible goals,
objectives, and policies with page numbers.
The relocation of the existing Office and Operations facility to this site will allow Missouri American Water Co. to
update and expand the capacity of water treatement facility which serves a large portion of Jefferson City. This is
consistant with the following Comprehensive Plan Goals listed on Page 155 of the Comprehensive Plan:
"Promote and protect public health, safety, and welfare of the City residents"
"Protect and enhance local economic climate"
"Efficiently provide for essential public services and utilities"
D. Whether events subsequent to the Comprehensive Plan adoption have changed the character and/or condition of
the area so as to make the application acceptable. Explain and add any links or supporting materials such pictures,
data, or reports to this application.
Since the last amendment to the Comprehensive Plan in the early 2000's more industrial & commercial uses have been
constructed in the area including, expansion of Federal Recycling, construction of a new Fire Station, and construction of a new
Missouri American Water Co. storage tower.

plans. Explain.
The change is needed due to the proposed rezoning from RA -2 to M-1.
F. Whether public and community facilities, such as utilities, sanitary and storm sewers, water, police and fire
protection, schools, parks and recreational facilities, roads, libraries, solid waste collection and disposal, and others
are adequate to serve development for the type and scope suggested by the proposed zone. If utilities are not avail-
able, can they be extended reasonably? List public and community facilities available, or facilities that could be

Roads and utilities including water, electric, sanitary sewer, natural gas, and telecomunications area available or will be
extended to serve the site. Utilities were extended to serve the apartment complex. This use is a less intense use than the
apartments therefore the existing utilities will be more than adequate.
G. Whether there is an adequate supply of land available in the subject area and the surrounding community to
accommodate the zoning and community needs.

located on the South side of E. McCarty Street 250 feet west of the intersection of Lafayette Street and

Nature of Request
The property owners wish to operate a short term rental. The use of a residence as a short term rental must
be approved for a Special Exception Permit and comply with Section 35-41.B.35 of the Jefferson City
Code.
Staff Analysis
Number of Guests and Rooms:
The applicants are requesting a special exception permit for the Short Term rental of an existing single
family residence. Section 35-41.B.35.b(3)(a) states a maximum of five unrelated persons or any number
of persons related by blood, marriage or adoption shall be permitted as lodging guests.
Signage: There are no plans to install signage on the property. Although Section 34-41.B.35.b(4) allows
for maximum of one square foot sign which must be attached to the structure and shall not be lighted for
short term rentals, because the property's location in the School Street Local Historic District, any
signage would need be approved by the Historic Preservation Committee.
Parking: No additional parking spaces are required to accommodate the change in use.

Case No. P19003 - 1500 Timber Trail, Special Exception Permit. Request Filed by Julie Glaser,
property owner, for a Special Exception Permit to operate a Short Term Rental. The property is located on
the north east side of the intersection of Timber Trail and Timber lane and is described as part of the
northeast quarter of the southeast quarter of section 14, Township 44 North, Range 12 West, in the City of
Jefferson, Missouri.
Nature of Request
The property owner wishes to operate a short term rental. The use of a residence as a short term rental
must be approved for a Special Exception Permit and comply with Section 35-41.B.35 of the Jefferson
City Code.
Staff Analysis
Number of Guests and Rooms:
The applicants are requesting a special exception permit for the Short Term rental of an existing single
family residence and a lodging Room. Section 35-41.B.35.b(3)(a) states a maximum of five unrelated
persons or any number of persons related by blood, marriage or adoption shall be permitted as lodging
guests for the entire residence. Section 35-41.B.35.b (3)(b) states that a maximum of one rental space may
be rented to guest, multiple rentals within the same residence is not permitted. A maximum of 4 people
shall be permitted as guests. Permitting both will allow the applicant flexibility in their operation of a
short term rental.
Signage: There are no plans to install signage on the property.
Parking: No additional parking spaces are required to accommodate the change in use.
