New Business/Public Hearings Case No. P19010 — 700 Block of Sardonyx Drive, Rezoning from RS -2 to C-2 and Comprehensive Plan Amendment. Request filed Ryan Prenger, property owner, for the rezoning of 7.42 acres from RS -2 Single Family Residential to C-2 General Commercial and an associated amendment to the Development Plan Map of the Comprehensive Plan. The property consists of Reserve Tract A of proposed Prenger Ridge Subdivision and is located approximately 160 feet west of the future extension of Sardonyx Drive, located in the City of Jefferson, Cole County, Missouri (Central Missouri Professional Services, Consultant). Case No. P19011 — Sardonyx Drive, Final Subdivision Plat of Prenger Ridge Subdivision. Request filed by Ryan Prenger, property owner, for a Final Subdivision Plat for 23.90 acres consisting of 35 Single Family Residential lots. The property is zoned RS -2, RS -1 Single Family Residential and C-2 General Commercial and is located on the North end of Sardonyx Drive and is described as part of the Northeast quarter of the Southwest quarter of section 10, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri (Central Missouri Professional Services, Consultant). Chairman Jordan explained that both cases will be presented together since they pertain to the same property. Rezoning from RS -2 to C-2 Mr. Zollinger described the proposal and explained that the entire property is zoned RS -2 Single Family Residential except for Reserved Tract B which is zoned C-2 General Commercial. He stated that the Comprehensive Plan Map shows a portion of Reserved Tract A as commercial. Mr. Zollinger explained that the current zoning of the property has commercial bordering the property line. He stated that the purpose of the rezoning is to rezone the entirety of Reserved Tract A to commercial for the possible future expansion of commercial development along South Ten Mile Drive. Mr. Zollinger explained that due to the way that the property is laid out it would be difficult to access that portion of the property from the proposed subdivision. Mr. Patrick Kremer, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding this request and explained that Reserve Tract A is proposed to be rezoned from RS -2 to C-2. He stated that the property has been previously undeveloped and sits just south of the commercial properties adjacent to Missouri Boulevard. Mr. Kramer explained that the rezoning of the property would provide additional space for expansion of redevelopment of the commercial properties along Missouri Boulevard. He stated that the properties further to the south have been developed as single family residences so we are matching the character of that development. Mr. Kremer explained that Reserved Tract A would be considered unusable as a residential lot due to its difficult terrain. He stated that the decision was made to downsize a portion of these lots and rezone them as commercial. Mr. Kremer explained that the intent of the rezoning is to present the more intensive zoning district to future property owners in the subdivision. In result, future property owners in the subdivision know upfront that Reserve Tract A could be developed commercially and the property owners of Reserve Tract A can adjust as needed in the future. He stated that the plan calls out a 50 foot natural bufferyard in the back of the proposed residential development. Minutes/Jefferson City Planning & Zoning Commission Page 3 March 14, 2019 Final Subdivision Plat Mr. Zollinger described the proposal and explained that the current zoning for the entire property is zoned RS -2 Single Family Residential, as well as, a portion of the property that is involved in the subdivision plat is zoned C-2 General Commercial. He stated that the Preliminary and Sketch Subdivision Plat of Prenger Ridge Subdivision was approved at the December 13, 2018 Planning and Zoning Commission meeting. Mr. Zollinger explained that the sketch plat shows future connectivity with Sardonyx Drive wrapping back to Weathered Hill and down to West Edgewood Drive. He stated that the Preliminary Plat shows 35 single family residential lots. Mr. Zollinger explained that the property was divided to be developed in a way that works with the land. He stated that what is remaining is Reserved Tract A which is the subject of the rezoning and Reserved Tract B which is currently zoned C-2. Mr. Patrick Kremer, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding this request and explained that the final subdivision plat shows the extension of Sardonyx Drive ending in a cul-de-sac bulb to allow for future expansion. He stated that right-of-way extension as shown along Lot 19 would allow for future connectivity to neighboring property. Mr. Kremer explained that the intent of the sketch plat is to eventually extend Sardonyx Drive back to Emerald Lane and ultimately back to West Edgewood Drive. He stated that there is no intent to connect Sardonyx Drive to South Ten Mile Drive, doing so would make Sardonyx Drive a cut though to an already congested intersection. Mr. Kremer explained that any deviation to the sketch plat approved in December 2018 would have to come back to the Planning and Zoning Commission for approval. He stated that the end of Sardonyx Drive ends in the RS -2 zoning district and Tract B is currently zoned C-2. Mr. Kramer explained that in order to make that connection to South Ten Mile Drive a case would have to be presented again to the Planning and Zoning Commission and City Council. He stated that Sardonyx Drive will allow parking on one side of the street and sidewalks are proposed along the east side of the street. Mr. Kremer explained that the majority of stormwater would be directed to the west to the existing Diamonds Subdivision detention basin. He stated that the remainder of the stormwater will be directed to the east to a privately maintained detention basin. Mr. Kremer distributed visuals depicting the area to be rezoned; the sketch preliminary plat; and the final subdivision plat. Mr. Barron clarified that commercial property cannot obtain access from a residential street. He explained that the Consultant referenced on the Final Subdivision Plat that they are establishing a bufferyard that is greater than what is required for the residential portion. Mr. Barron explained the Consultants plans for stormwater detention. Mr. Ryan Prenger, Applicant, 3925 Autumn Woods Lane, spoke in favor of this request and explained that they will put in place stricter restrictions than what currently exists. He stated that homes will have a higher square footage requirement than the surrounding residential homes. Mr. Prenger explained that currently the street is a dead end. He stated that the new street will end in a cul-de-sac which will make it easier for large vehicles to turn around. Mr. Prenger explained that they will build a significant curve in the road to slow down traffic. No one spoke in opposition to this request. The following individuals spoke neither in favor or opposition to this request: Les Fortenberry, 921 Garnet Point, explained that his lot is where the existing pond dam breech comes out. In big rain events he gets more than 8 inches of water coming over the top of the culvert. He inquired of a way to prevent over topping from that basin. Mr. Ron Taube, 925 Sardonyx Drive, explained that the city owned retention basin is at capacity. He inquired of what steps are being taken to make sure that the excess stormwater is being dealt with. Ms. Maureen Rucker, 937 Sardonyx Drive, expressed concerns of what will happen to the wildlife living in this area when the new development is constructed. Minutes/Jefferson City Planning & Zoning Commission Page 4 March 14, 2019 Mr. Dewayne Rucker, 937 Sardonyx Drive, inquired of the timeframe for the future connection to West Edgewood Drive. Correspondence expressing concerns was received from the following individuals: Ron Taube, 925 Sardonyx Drive Steve & Leah Hynes, 905 Sardonyx Drive Mr. Wade addressed the concerns about stormwater and explained that in regards to the eastern basin, the comments that staff returned to the Consultant would be to place a type of rock blanket on the lower side of the basin outlet for erosion control. As far as over topping of the basin, the plans call for an erosion control type blanket to be placed over the top of the dam structure in order to make sure that the proposed turf is reinforced. As far as the existing basin to the west in the Diamonds Subdivision, the lower flow pipe that goes through that basin is a 24 inch pipe. We want to further constrict that pipe in order to make the detention basin more frequent in regards to the lower storms and to address the amount of water coming off of the new basin. Mr. Barron explained that there are no immediate plans and no timeline for future extension of Sardonyx Drive. The reason it is shown to be constructed as a cul-de-sac is to provide for a permanent turn around until such a future date allows for connectivity. In regards to wildlife, there are notes on the grading portion of the plan that shows only the minimum amount of trees being removed in order to clear the portion of the land where the houses will be built. The rear portion of the lots will remain wooded and not remove trees where it is not necessary. That would result in a significant portion of the property remaining wooded. Mr. Patrick Kremer, Central Missouri Professional Services, 2500 E. McCarty Street, concurred with staff's comments and explanations. Mr. Zollinger gave the Planning Division staff report. Mr. Wade gave the Engineering Division staff report. INDUSTRIAL DR ST MARYS BLVD' L Jefferson City Planning & Zoning Commission April 11, 2019 Case No. P19014 City Staff Zoning Code Text Amendment Pertaining to Medical Marijuana Facilities. Planning Division Staff Summary Proposed Medical Marijuana Zoning Code Amendment 04/11/19 Staff Comments: Missouri voters approved Constitutional Amendment 2, in November of 2018, allowing marijuana to be cultivated, processed, and sold for medical purposes. The Missouri Department of Health and Senior Services are tasked with implementing the provisions of Amendment 2, including licensing, certification, and regulation of medical marijuana facilities. Medical Marijuana Facilities are establishments that cultivate, dispense, manufacture, and test medical marijuana. Local municipalities may enact land use regulations dealing with the location of such facilities. In order to incorporate medical marijuana into the City's zoning code, Planning Division Staff are going to execute the code amendment in two parts, (1) establish land use regulations for the cultivating, processing, and testing facilities (2) establish land use regulations for the retail facility. Amendment 2 Highlights: Medical Marijuana Facilities are divided into four types, in accordance with the Missouri Constitution, as follows: 1. Medical Marijuana Cultivation Facility — an establishment that farms, stores, transports, and sells medical marijuana. 2. Medical Marijuana Testing Facility — an establishment that acquires, tests, certifies, and transports medical marijuana. 3. Medical Marijuana -Infused Products Manufacturing Facility — an establishment that specializes in marijuana -infused products, for example oils, edible products, and waxes. 4. Medical Marijuana Dispensary Facility — a medical marijuana retail establishment. The Missouri Department of Health and Senior Services proposes that new Medical Marijuana Facilities shall not be within 1,000 feet of any then -existing secondary or elementary school, child day care center, or church. Local municipalities can reduce or eliminate the 1,000 foot separation requirement. Analysis With the intention of integrating medical marijuana uses into the Jefferson City zoning code slowly, this code amendment only refers to the Medical Marijuana Cultivation Facility, Medical Marijuana Testing Facility, and Medical Marijuana -Infused Products Manufacturing Facility. The code amendment would differentiate between these three different types of use but apply the same specific use standards to each of them. A Medical Marijuana Testing Facility, Medical Marijuana -Infused Products Manufacturing Facility, and Medical Marijuana Cultivation Facility are proposed to be listed as a "Permitted Use" in the M-1 Light Industrial and M-2 General Industrial districts. A Medical Marijuana Testing Facility, Medical Marijuana - Infused Products Manufacturing Facility, and Medical Marijuana Cultivation Facility would be listed as "Prohibited" in all other districts. The Medical Marijuana Facilities listed above are largely industrial in character, with production and wholesale services being provided. In the M-1 Light Industrial and M-2 General Industrial districts, the following uses are permitted, Industrial Manufacturing and Production - Industrial Processing Industrial Distribution Thus, M-1 Light Industrial and M-2 General Industrial zoning districts are appropriate zoning designations for a Medical Marijuana Testing Facility, Medical Marijuana -Infused Products Manufacturing Facility, and Medical Marijuana Cultivation Facility. Staff recommends specific use standards that align with the Missouri Department of Health and Senior Services 1,000 foot separation between Medical Marijuana Facilities and elementary or secondary schools, child day care centers, or churches. The definitions drafted for this code amendment would define, and support the definitions, for the four types of medical marijuana facilities allowed by right in Article XVI of the Missouri Constitution. Staff would bring a second zoning code text amendment to incorporate the retail component, Medical Marijuana Dispensary Facility, at a later date. Form of Motion Motion for approval of the zoning code text amendment pertaining to Medical Marijuana Facilities as presented by staff. BILL NO. SPONSORED BY ORDINANCE NO. Request filed by F&F Development, property owner, for a Preliminary and Final Subdivision Plat of 7.47 acres consisting of 7 commercial lots. The property is zoned C-2 General Commercial and is located at the Southwest corner of the intersection of Missouri Blvd and Highway 50/63 and is described as part of Inlots Nos. 657, 658,661 and 662, Jefferson City, Cole County, Missouri ( Central Missouri Professional Services, consultant). Description of Proposal This proposal is for the approval of the Preliminary and Final Subdivision Plat of Jefferson Landing Subdivision (Consisting of 7.47 acres). The property is zoned C-2 General Commercial. Subdividing the property is part of the effort to redevelop the Old Saint Marys Hospital site. Preliminary and Final Plat The preliminary and final Subdivision Plat details the lot layout of the proposed Jefferson Landing Subdivision. Acreage: The total size of the subdivision is 7.47 acres. Number of Lots: In total there are 7 Lots. Two lots will have existing buildings on them. One lot will be used specifically for a driveway to access the rest of the development. Four lots will be used for new developable lots. Lot Sizes: Each varies in size from the smallest being 0.78 acres and the largest being 1.66 acres. Every lot has required street frontage except for lot # 6. Streets: No new streets will be created with the subdivision. Sidewalks: Sidewalks exist along the frontage of Bolivar Street and Missouri Blvd. A development agreement is currently in place to connect the sidewalk from the intersection of Missouri Blvd and Bolivar Street to the sidewalk along the south side of Bolivar Street. Utilities: All lots are shown with access to water lines, sanitary sewer lines, electric lines, and telephone lines, and gas. Notable Lots: Lot 4 will be used as a driveway to provide access to the development. Lot 6 does not have street frontage and would require a variance from Zoning Code. The creation of Lot 1 and Lot 7 with an existing building on Lot 7 would require a rear setback variance. A Board of Adjustment Case has been filed for both variances and will be heard at the Board of Adjustment meeting on May 14`x', 2019. Plat Name: The plat is named Jefferson Landing. The name of Jefferson Landing is strongly associated with historical events and the early history of the City of Jefferson. Historically Jefferson landing is located adjacent to the Missouri River at the end of Jefferson Street between the Missouri State Capital Building and the Governor's Mansion. Staff Recommendation The Preliminary and Final Subdivision Plat meets the requirements for subdivision plats as outlined within the Subdivision Code. The applicant will need to acquire variances for Lot 6 to vary the requirement for street frontage and for Lot 7 for a rear setback variance. The Subdivision has no connection with the Historic Jefferson Landing site. Staff recommends approval of the plat documents subject to: 1. Approval from the Board of Adjustment for the two variances. 2. Changing the name of the two plats to preserve the name of a historic area of the city. 3. Correction of minor technical details identified by city staff. Form of Motion Approval of the Preliminary and Final Subdivision Plat of Jefferson Landing subject to: 1. Approval from the Board of Adjustment for the two variances. 2. Changing the name of the two plats to preserve the name of a historic area of the city and comments and technical corrections of the Planning and Engineering Divisions.
