Ms. Nanoski gave a short demonstration of the Comprehensive Plan. The commission broke

site parking lot. The property is located 500 feet south of the intersection of West Truman Blvd and
Masonic Court and is described as Lot 4 of the Smith Place Addition Subdivision (Central Missouri

Nature of Request
The property consists of 2.02 acres of vacant/undeveloped property. The applicant is proposing to
construct a 100 space Off -Site Parking Lot to address the current parking needs of their primary property
located at 3225 West Truman Blvd.

Staff Analysis
Parking: The 100 space parking lot will be employee parking.
Landscaping: The landscaping will follow the requirements of the Jefferson City Zoning Code
requirements and will provide a minimum 35% of shade for the total parking area.
Lighting: No lighting details have been provided. Staff recommends that the site adheres to the lighting
allowances for the C -O district.
Signage: No signage is proposed other than parking lot directional signs.
Sidewalk: Sidewalk is proposed along Masonic Court to the property being served by the proposed
parking lot.
Greenway Trail: A portion of the property would be undisturbed for a potential expansion of Greenway
Trail. Greenway Trail will not be constructed at this time.
Future Uses:
Future uses of the property will be limited to the uses allowed by the C -O zoning district which include
professional office buildings, ATMs, banks or insurance institutions etc.
Staff Recommendation:
With the proposed sidewalk connecting the proposed parking lot to the site of service, the plan meets the

ENGINEERING STAFF RECOMMENDATION- Engineering Staff supports approval of this request.
Existing Infrastructure
• Most infrastructure exists for this development.
- An existing storm water system drains through the property.
-A creek area exists on the southern portion of the property.
-An existing sanitary sewer main traverses the property.
- Utilities exist to serve this property.
- Access to this site is from Masonic Court.
Site Improvements
• Storm Water Drainage/Quality
- A Hydrodynamic Separator is proposed to accommodate storm water quality for the site.
- Erosion and sediment control will be needed with the final plan.
• Sanitary Sewer
A sanitary sewer main traverses the property.
• Street Access/ Parking
Access to the site will be from Masonic Court.
- Sight distance for the driveway is not a concern since accessing a cul-de-sac.
- On-street parking is not a concern since additional off-site, off-street parking is being provided.
• Sidewalk/ Greenway
A sidewalk is proposed along the frontage of the neighboring property to provide pedestrian
connection from the off-site parking lot to the office building site.
An area for a future greenway has been reserved near the riparian corridor of the creek to the south
of the proposed parking lot.

Facilities exist in the vicinity.
-Existing utilities and any needed improvements/ utility services are to be shown on the final
plan.
• Street Lights and Fire Hydrants-
-The property owner may want to consider adding a street light at the cul-de-sac of Masonic

to Medical Marijuana Dispensary Facilities

Proposed Medical Marijuana Zoning Code Amendment — Dispensary Facilities

Staff Comments:
Missouri voters approved Constitutional Amendment 2, in November of 2018, allowing marijuana to be
cultivated, processed, and sold for medical purposes. The Missouri Department of Health and Senior
Services are tasked with implementing the provisions of Amendment 2, including licensing, certification,
and regulation of medical marijuana facilities. Medical Marijuana Facilities are establishments that
cultivate, dispense, manufacture, and test medical marijuana. Local municipalities may enact land use
regulations dealing with the location of such facilities. Planning Division Staff have executed the code
amendment in two parts; (1) establish land use regulations for the cultivating, processing, and testing
facilities, which was approved by City Council on May 20th, and, (2) establish land use regulations for the
retail facility, which is the subject of this report.
Amendment 2 Highlights:
Medical Marijuana Facilities are divided into four types, in accordance with the Missouri Constitution, as
follows:
1.
Medical Marijuana Cultivation Facility — an establishment that farms, stores, transports, and
sells medical marijuana.
2. Medical Marijuana Testing Facility — an establishment that acquires, tests, certifies, and
transports medical marijuana.
3. Medical Marijuana -Infused Products Manufacturing Facility — an establishment that
specializes in marijuana -infused products, for example oils, edible products, and waxes.
4. Medical Marijuana Dispensary Facility — a medical marijuana retail establishment.
The Missouri Department of Health and Senior Services proposes that new Medical Marijuana Facilities
shall not be within 1,000 feet of any then -existing secondary or elementary school, child day care center,
or church. Local municipalities can reduce or eliminate the 1,000 foot separation requirement.
Analysis
This code amendment refers to the retail component of medical marijuana facilities. A Medical
Marijuana Dispensary Facility is proposed to be listed as a "Permitted Use" in the C-2 General
Commercial zoning district. A Medical Marijuana Dispensary Facility would be listed as "Prohibited" in all
other districts.
The Medical Marijuana Dispensary Facility is commercial in character, with retail sales and services being
provided. In the C-2 General Commercial, the following uses are permitted,
- General Retail (including retail establishments such as pharmacies, liquor stores, and tobacco
shops)
Personal Services
- Health Care Facilities
As a retail establishment focusing on dispensing a medical product, the C-2 district appears to be
appropriate for the medical marijuana dispensary facility use.
Staff recommends specific use standards that align with the Missouri Department of Health and Senior
Services 1,000 foot separation between Medical Marijuana Dispensary Facilities and elementary or
secondary schools, child day care centers, or churches.

AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 35,
THE ZONING CODE, PERTAINING TO MEDICAL MARIJUANA DISPENSARY FACILITIES.
WHEREAS, Amendment 2 to the Missouri Constitution, approved by the voters of the State of Missouri
on November 6, 2018, legalized the cultivation, processing, possession, sale, and use
of marijuana for medical purposes, and
WHEREAS, consistent with Amendment 2, the regulations on medical marijuana facilities contained
herein are found to be reasonably time, place, and manner restrictions and are not
unduly burdensome to the operation of medical marijuana facilities, and
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning code text
amendments have in all matters been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. Sec. 35-28 (Matrices of permitted, conditional and special exception use
land uses and classification of uses not listed) Exhibit 35-28 (Land Uses Authorized in Zoning
Districts), is amended as follows:

Section 2. Sec. 35-41.B (Specific Use Standards) is hereby amended pertaining to
Medical Marijuana Facilities as follows:
36. Medical Marijuana Facilities
a. Location.
(1) Medical Marijuana Dispensary Facility, Medical Marijuana
Cultivation Facility, Medical Marijuana -Infused Products
Manufacturing Facility, and Medical Marijuana Testing Facility
may be authorized in the districts specified by Exhibit 35-28
Land Use Matrix.
b. Specific Provisions. Medical Marijuana Facilities shall adhere to the
following:
(1) No new Medical Marijuana Dispensary Facility, Medical
Marijuana Cultivation Facility, Medical Marijuana -Infused
Products Manufacturing Facility, or Medical Marijuana Testing
Facility shall be located within one thousand feet (1,000 ft) of
any then -existing elementary or secondary school, child day
care center, or church.
(a) For freestanding Medical Marijuana Facilities, distance
shall be measured from the facility's external wall

closest in proximity to the property line of the
elementary or secondary school, child day care center,
or church.
(b) For Medical Marijuana Facilities that occupy an
individual suite or unit within a multi-unit structure,
distance shall be measured from the facility's entrance
or exit closest in proximity to the property line of the
elementary or secondary school, child day care center,
or church.
(c) Measurements shall be made along the shortest path
between the demarcation points that can be traveled by
foot.
(2) Any Medical Marijuana Facility licensed by the Missouri
Department of Health and Senior Services must comply with
State requirements, regulations, and procedures necessary for
implementation and enforcement.
Section 3. This ordinance shall be in full force and effect from and after its passage
and approval.
