ORDINANCE NUMBER 577
AN ORDINANCE OF THE CITY OF RANCHO MIRAGE, CALIFORNIA, AMENDING
CHAPTER 5, LAND DEVELOPMENT REGULATIONS PERMITTED USES MATRIX OF
THE HIGHWAY 111 WEST SPECIFIC PLAN. SPECIFICALLY, THE AMENDMENTS
MODIFY THE PERMITTED USES MATRICES AND THE DETERMINATION OF USE
SECTIONS.
The City Council of the City of Rancho Mirage ordains as
follows:
SECTION 1: Exhibit "A" (attached hereto and incorporated
herein) is a collection of the amended pages of the approved
Highway 111 West Specific Plan which indicates all of the modified
language that is to be inserted in both documents.
SECTION 2: The Specific Plan Amendment is consistent with
Section 65500 of the California Government Code and with the
adopted City of Rancho Mirage General Plan.
SECTION 3: CEQA. The passage of this Ordinance constitutes a
project according to the California Environmental Quality Act
(CEQA). An environmental analysis, documentation and action known
as Environmental Assessment case ~ EA930016 was performed pursuant
to CEQA Guidelines and State Statutes. The City Council has found
the project will not have a significant affect on the environment
and a Negative Declaration will be filed.
SECTION 4: Severability. If any section, subsection, sen-
tence, clause or phrase of this ordinance is for any reason held to
be invalid or unconstitutional by the decision of a court of compe-
tent jurisdiction, such decision shall not affect the validity of
the remaining portions of the ordinance. The City Council of the
City of Rancho Mirage hereby declares that it would have passed
this ordinance, and each section, subsection, clause, sentence or
phrase thereof, irrespective of the fact that anyone or more other
sections, subsections, clauses, sentences or phrases may be declar-
ed invalid or unconstitutional.
SECTION 5: Savings Clause. Neither the adoption of this or-
dinance nor the repeal of any other ordinance of this City shall in
any manner affect the prosecution for violations of the ordinances,
which violations were committed prior to the effective date here-
of, nor be construed as a waiver of any license or penalty or the
penal provisions application to any violation thereof. The provi-
sions of this ordinance, insofar as they are substantially the same
as ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.

SECTION 6: The City Clerk shall certify to the passage here-
of, and cause it to be posted as required by law. This Ordinance
shall take effect on the 30th day following the date of its
adoption.

Determination of Use
Whenever a use has not specifically been listed as being a
permitted use in a particular use district classification afld
it io an alloycd uoc in ilny ethcr uoc diotrict 'Within thc
ci ty, it shall be the duty of the community Development
Director to determine if said use is (1) consistent with the
intent of the use district and (2) the said use is compatible
wi th other listed permitted uses. Any person aggrieved by the
determination may appeal that decision to the City Council.
Base Districts
Depicted in Exhibit 25 are the Land Use Districts and existing
parcel configurations. The Exhibit establishes the official
boundaries of the planning districts, or base district, to
which the Permitted Uses, Building Regulations and standards
Table 3 below.
