HomeMy Public PortalAboutORD15998BILL NO. 2019-091 SPONSORED BY Councilwoman Wiseman ORDINANCE NO. /5 /' AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, SUBMITTING AN AMENDMENT TO THE CHARTER OF THE CITY OF JEFFERSON RELATING TO PROHIBITIONS AND INCOMPATIBLE OFFICES TO A VOTE OF THE CITIZENS OF THE CITY OF JEFFERSON. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Article XII (General Provisions), Section 12.2 (Prohibitions) of the Charter of the City of Jefferson is hereby amended by adding new Subsections (c) and (d) thereto to read as follows: No former councilmember or mayor shall hold am compensated appointive City office or City employment until two years after the expiration of the term for which such councilmember or mayor was elected. Incompatible Offices. No councilmember or mayor shall be a publicly elected member of the governing body of political subdivision of the State of Missouri, nor a member of the General Assembly of the State of Missouri, nor hold any statewide elective office of the State of Missouri. These offices are deemed to be incompatible and the acceptance l a councilmember or mayor of any such incompatible office shall be deemed a voluntary resignation of such person's City office and no further action or process shall be necessary to render such City office vacant. Neither the city administrator or ci clerk, nor department director or member of the Parks and Recreation Commission shall be a publicly elected member of the governing body of an political subdivision of the State of Missouri, nor a member of the General Assembly of the State of Missouri, nor hold any statewide elective office of the State of Missouri. No public office shall be deemed to be incompatible with a City office when the holder of a City office is serving in a public office in their capacity as a City office holder. Section 2. The amendment as set forth in Section 1 shall be submitted to the qualified voters of the City of Jefferson, Missouri, for their approval, at the election to be held on the 7th day of April, 2020, at the places designated by the Election Authority for said election and the ballot shall be in substantially the following form: Editor' Note: Deleted text is shown thus. PROPOSITION D Shall Section 12.2 of Article XII (General Provisions) of the Charter of the City of Jefferson be amended to prohibit former councilmembers or mayors from holding any compensated appointive City office or City employment until two years after leaving office and to prohibit the mayor, councilmembers, park and recreation commission members, the city administrator, city clerk, and department directors from holding certain publicly elected offices within other political subdivisions or the State of Missouri, as provided in Ordinance No. i59°$ passed and approved by the City Council on January 21, 2020? [ ] YES [] NO If you are in favor of the question, place an "X" in the box opposite "Yes". If you are opposed to the question, place an "X" in the box opposite "No". Section 3. The Mayor and City Clerk shall prepare and execute the form of the Notice of said Election and shall transmit the same to the Election Authority for the City of Jefferson, Missouri and request said election be conducted by law. Section 4. If a majority of the qualified voters voting at said election shall vote in favor of the approval of this ordinance, then the same shall be binding in full force and effect from and after such approval. Section 5. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, as such holdings shall not affect the validity of the remaining portion thereof. Section 6. This Ordinance shall be in full force and effect from and after the date of its passage and approval.
