HomeMy Public PortalAboutORD15999BILL NO. 2019-092 SPONSORED BY Councilwoman Wiseman ORDINANCE NO. 15c AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, SUBMITTING AN AMENDMENT TO THE CHARTER OF THE CITY OF JEFFERSON RELATING TO RESIDENCY REQUIREMENTS FOR THE CITY ADMINISTRATOR, CITY CLERK, AND CITY COUNSELOR TO A VOTE OF THE CITIZENS OF THE CITY OF JEFFERSON. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Article III (The Council) of the Charter of the City of Jefferson, Subsection 3.6 (City Clerk), shall by amended by amending the last sentence of Section 3.8 to read as follows: The city clerk shall be a resident of the city= provided that residency within the ci limits must be established within one hundred eighty days of the first day of employment with the City, which may be extended ll a single additional one hundred eighty day period upon a majority vote of the council. Section 2. Article V (City Administrator) of the Charter of the City of Jefferson, Subsection 5.1 (City Administrator) shall by amended by adding a new subsection (e), to read as follows: 111 Residency. The ci administrator shall be a resident of the ci provided that residency, within the ci limits must be established within one hundred eighty days of the first day of employment with the City, which may be extended b a single additional one hundred eighty day period upon a majority vote of the council. Section 3. Article VI (Administrative Organization and Personnel System) of the Charter of the City of Jefferson, Section 6.5 (City Counselor), subparagraph (a) shall by amended by amending last sentence of subsection (a) to read as follows: The person appointed shall serve for an indefinite term and shall be a resident of the city, provided that residency within the ci limits must be established within one hundred eighty days of the first day of employment with the City, which may be extended b a single additional one hundred eighty day period upon a majority vote of the council. Section 4. The amendments as set forth in Sections 1, 2, and 3 shall be submitted to the qualified voters of the City of Jefferson, Missouri, for their approval, at the election to be held on the 7th day of April, 2020, at the places designated by the Election Authority for said election and the ballot shall be in substantially the following form: Editor's Note: Deleted text is shown thus. PROPOSITION B Shall the Charter of the City of Jefferson be amended to require the city clerk, city administrator, and city counselor to be residents of the City of Jefferson, provided that such residency must be established within one hundred eighty days of initial employment, subject to a one-time extension, as provided in Ordinance No. /5'161`1 passed and approved by the City Council on January 21, 2020. The Mayor and City Clerk shall prepare and execute the form of the Notice of said Election and shall transmit the same to the Election Authority for the City of Jefferson, Missouri and request said election be conducted by law. Section 6. If a majority of the qualified voters voting at said election shall vote in favor of the approval of this ordinance, then the same shall be binding in full force and effect from and after such approval. Section 7. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, as such holdings shall not affect the validity of the remaining portion thereof. Section 8. This Ordinance shall be in full force and effect from and after the date of its passage and approval.
