Present: Mayor Thomas Anderson; Councilm.embers, Sarah Lutz, Wilfred Scherer, William Reiser; Clerk -Treasurer, Donna Roehl; Engineers, Skip McCombs, Paul Pearson; Attorney, Richard Schleifer Absent: Thomas Crosby 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss Medina Morningside easements 2. MEDINA MORNINGSIDE BOND BIDS Phil Chenoweth explained the work that is involved in securing a bond rating from Moody's and criteria used to raise or lower ratings. Medina's rating of Baa-1 is an improvement from the Baa received in 1975. The following bids were received: Piper, Jaffray & Hopwood, Inc. Interest rate, 11.4899 First National Bank of St. Paul  11.8525 Juran & Mhody, Inc.; Dain Bosworth, Inc. " 11.785 Thomas Anderson suggested that action on the bids be delayed until easements had been discussed. 3. MEDINA MORNINGSIDE EASEMENTS Richard Schieffer explained that the Albin Thies and Thomas Carroll easements had been negotiated and checks had been written to be approved by Council. Regarding the Fred Keller easement he stated that Mr. Keller has offered the easement for $18,500, $3000 of which is to be paid in cash and $15,500 to be paid to him and held until the property is developed and paid back to Medina at $500 per lot. The $15,500 could be assessed against the property but deferred until the property is developed. He stated that the other alternative would be to condemn the easement which takes some time during which the PCA will not give approval to proceed with the project. He explained procedure and costs involved in condemnation. Skip McCombs explained that the contractor could work around such a delay; that he planned to work in streets until ground freezes and in other areas after freeze-up. Mr. Keller stated that he wanted 8 connections to sewer and water brought to the property; that he had approximately 16 acres and the amount to would be repaid to Medina in proportion as the property developed. Thomas Anderson asked if it would be a problem for Medina to assess property and not be in a posistion to provide the service. Richard Schieffer stated that this could be considered a trunk sewer benefit. Mr. Keller stated that he would agree to hold Medina harmless as he would be seeking the sewer connections. Sarah Lutz stated that Mr. Keller should pay one-half of the legal fees. Thomas Anderson stated that a compromise should be made regarding payment due to the fact that the city would be paying approximately $1000 for construction of the 8 conn- ections and to bring the water line to the property; plus attorney fees for preparation of the agreement. Mr. Keller stated that $13,000 plus $3000 would be agreeable. Motion by Lutz, seconded by Scherer to direct the attorney to prepare an agreement be- tween the city and Fred Keller for $16,000; $3000, of which, is payable at this time, $13,000 to be paid and het ;r ^^r w, assessed against the property and paid back to the city proportionately when, if and how the property is developed. Motion declared carried Motion by Reiser, seconded by Scherer to hold a special meeting on Friday, October 2, 1981 at 5:00 P.M. to consider and approve the agreement with Mr. Keller for easement. Motion declared carried Motion by Reiser, seconded by Scherer to pay Albin and Arlene Thies .500. for ease- ment and Thomas and Carol Anne Carroll $200 for easement in connection with Medina Morningside sewer installation. Motion declared carried 4. BOND SAL Motion by Lutz, seconded by Scherer to adopt Resolution 81-47, approving sale of Medina Morningside improvement bonds to Piper, Jaffray and Hopwood at 11.4899, net inter4st cost to be $462,468.75.
