Purpose and Findings. Ae Truckee's Unique Environment. The purpose of this initiative is to protect valuable open space resources of the Town of Truckee, to provide a greenbelt corridor in thc viewsheds along State Route 89, Interstate 80 and the proposed State Route 267 bypass in Truckee, and to preserve the unique small town character of the Town. Truckee's dramatic setting and unspoiled vistas are key factors in attracting visitors and residents to the area. The natural resources of Truckee, which include vast pine forests, pristine riparian areas, and extensive wildlife habitat, are essential to the Town's unmistakable character, yet these resources are presently vulnerable to harm as a result of inappropriate development. Preservation of Valuable Open Space. The alpine character of Truckee and the quality of life of its residents depend on the retention of open space areas that provide significant environmental, aesthetic and recreational benefit to the community. In order to ensure that these areas are not inappropriately converted to urban uses, this initiative readopts and reatTmns, through the year 2020, the Town of Truckee General Plan's existing designations for open space lands. In addition, the initiative establishes important new policies for an area of approximately 800 acres located on either side of State Route 89 North, designated as "Planned Community 2" in the Town's General Plan; these policies protect the area's open space resource values by reducing commercial development and eliminating the hotel and golf course contemplated by the existing General Plan. Ce A Threat to Historic Truckee. In protecting Truckee's valuable natural resources, this initiative also protects the existing commercial areas in the Town's vibrant historic community. Prior experience in the United States demonstrates that when commercial areas are developed on the outer fringes of a community, there is significant decay in thc vitality and economic viability of previously existing commercial centers. Although this phenomenon is now well recognized by urban planners and economists alike, thc Town of Truckee General Plan, if not amended, would allow the development of 175,000 square feet of regional/local commercial and office uses outside of existing commercial centers, on the Planned Community 2 site along State Route 89 North, and contemplates additional commercial development on that site in the future. In addition, the existing General Plan policies allow 300 acres of commercial recreation uses on the Planned Community 2 site. Protecting Historic Truckee. This initiative amends the General Plan policies for Planned Community 2 to provide for limited amounts of neighborhood-serving commercial uses, to Town Ordinance 97-06 Page 2 exclude large-scale commemial development, and to specify that permitted recreational uses must be passive, such as skiing, biking, equestrian and hiking trails, rather than commercial recreation. At the same time, the initiative preserves the General Plan's existing policies allowing residential development on the Planned Community 2 site, as well as public services such as necessary schools, libraries and fire stations. Existing Resource Conservation/Open Space Policies. The existing Land Use Element of the Town of Truckee General Plan sets forth the following standards regarding allowable land uses on lands designated at "Resource Conservation/Open Space" and "National Forest- Resource Conservation/Open Space": Land Uses Allowed: Land uses allowed under this designation are open space uses such as forestry, ranching, mining, wildlife management, open space uses such as bikeways, trails, and access to the Truckee River and other public areas, and single family residential development, where appropriate. Existing Open Space Recreation Policies. The existing Land Use Element of the Town of Truckee Gencrai Pan sets forth the following standards regarding allowable land uses on lands designated as "Open Space Recreation" and "National Forest-Open Space Recreation": Land Uses Allowed: Land uses allowed under this designation are recreational uses that are compatible with the natural surroundings, such as skiing, camping, golfing, horseback riding, and clustered residential or lodging uses. Effect of This Initiative. This initiative ensures that open space lands within Truckee retain their rural character, and that the viability of the Town's historic community will not be undermined by the approval of inappropriate large-scale commercial development in outlying areas. Accordingly, the initiative specifies that until December 31, 2020, the general plan provisions recited in findings E and F above and critical new general plan policies adopted by this initiative may be changed only by a vote of the people. In addition, the initiative provides that any lands designated "Resource Conservation/Open Space," "Open Space Recreation," "National Forest-Resource Conservation/Open Space," '`National Forest-Open Space Recreation," or "Planned Community 2" on the Town of Truckee General Plan Land Use Plan map adopted February 15, 1996, as amended through May 2, 1997, will remain so designated until December 31, 2020, unless the land is redesignated to another land use category by vote of the people, or by the Town Council pursuant to the procedures set forth in the initiative. Exhibit A attached to this initiative is a reduced copy of the Land Use Plan map modified to show the area affected by this initiative. Town Ordinance 97-06 Page 3 Section 2. General Plan Amendment Existing General Plan Policies. The Truckee Mountain Area Protection Initiative hereby reaffirms and readopts, until December 31, 2020, the following provisions of the existing General Plan: All land use designations of "Resource Conservation/Open Space" (RC/OS), "Open Space Recreation" (OSR), "National Forest-Resource Conservation/Open Space" (NF-RC/OS), ~National Forest-Open Space Recreation" (NF-OSR), and "Planned Community-2" (PC-2) on the Land Use Plan map of the Town of Truckee General Plan, adopted February 15, 1996 as amended through May 12, 1997 and described in finding G of this initiative. The "Land Use Designations" policies establishing "Land Uses Allowed" for lands designated as "Resource Conservation/Open Space" (RC/OS), "Open Space Recreation" (OSR), "National Forest-Resource Conservation/Open Space" (NF- RC/OS), and "National Forest-Open Space Recreation" (NF-OSR) as set forth in the Land Use Element of the Town of Truckee General Plan, adopted Febnmry 15, 1996 as amended through May 12, 1997 and set forth in their entirety in findings E and F of this initiative. General Plan Land Use Element Text Amendments. The Land Use Element of the Town of Truckee General Plan adopted February 15, 1996 as amended through May 12, 1997 is hereby amended as indicated below. Text to be inserted into the General Plan is indicated in bold italic type while text to be stricken is present in ~ type; text in standard type currently appears in the General Plan and is reaffirmed and readopted unchanged by this initiative. All references to the "General Plan" refer to the Town of Truckee General Plan dated February 15, 1996 as amended through May 12, 1997. Amend the "Density and Intensity" policy appearing on page 39 of the General Plan for lands designated as "Resource Conservation/Open Space" as follows: Density and Intensity: One housing unit is allowed on an existing or future legal lot. Zone districts to implement this category should recognize the need to place sensitive lands in more restrictive open space zoning, accommodate mining in mineral resource areas, and to protect forestry and open space recreation uses. Amend the UDensity and Intensity" policy appearing on page 40 of the General Plan for lands designated as "Open Space Recreation" as set forth below. The text of Land Town Ordinance 97-06 Page 4 Use Policies 7.1 and 7.2 (referenced in the amendment below) is attached hereto as part of Exhibit B, for informational purposes. Density and Intensity: Residential uses will be allowed at a a~ ~ density of one housing unit per ten acres. Residential uses will be required to be clustered in small defined areas to preserve open space. In determining the density ofa project, density shall be based on the average density for the project as a whole. Zone districts to implement this category should accommodate recreational development with necessary support services, and protect open space values. Residential and recreational development such as campgrounds, resort ranches, etc. will be allowed with a requirement that approval of any such project preserve 90% of the land area on the subject parcels in Open Space. Creation of new lots shall be conditioned on approval of a development plan demonstrating that residential uses on the new lots will be clustered in a manner conforming to Land Use policies 7.1 and 7.2, and that at least 90% of the land area will be preserved in Open Space. Amend the text in the second paragraph on page 45 of the General Plan describing Planned Community 2 as set forth below. The text of Land Use Policy 4.3 (referenced in the amendment below) is attached hereto as part of Exhibit B, for informational purposes. Planned Community 2 consists of approximately 800 undeveloped acres located on either side of State Ronte 89 North. The Specific Plan for this site shall accommodate a mix of the following land uses: residential, passive recreational, ~mm~-ela~, ~.~ public services ~ and other neighborhood services pursuant to Land Use Policy 4.3 (provided, however, that the total amount of neighborhood commercial uses, including telecenters, is limited to 25,0000 square feet). Amend the text on page 45 of the General Plan describing the "Land Uses Allowed" in Planned Community 2 as follows: PC-2: This designation allows mixed use of the following land uses: ~mm,t~-e~, residential, ~n~ passive recreational, public services ~ and other neighborhood servicespursuant to Land Use Policy 4.3 (provided, however, that the total amount of neighborhood Town Ordinance 97-06 Page 5 commercial uses, including telecenters, is limited to 25,000 square feet). Amend the text on page 46 of the General Plan describing the "Density and Intensity" of permitted land uses in Planned Community 2 as follows: PC-2: The following assumptions shown in Table 2.4 were used for Planned Community 2 in calculating General Plan buildout. The amount of acreage to be designated for various uses is a guideline except that the acreage to be designated for residential development is a maximum. The amount of development allowed (housing units and square fee of non-residential development) is a maximum. Neighborhood commercial uses, including telecenters, shall be intermixed with Residential and Public Service users. Amend or, where no amendments are show, reaffim~ and readopt policies on pages 58 and 59 of the General Plan guiding development of the Specific Plan for Planned Community 2 (PC-2) as follows: PC-2 Policy 1 Preserve existing natural features and wildlife habitat. PC-2 Policy 2 Preserve open space corridors connecting to adjacent open space lands to protect wildlife habitat. PC-2 Policy 3 The planned community shall be sited, oriented and massed to provide for maximum exposure to winter sun and protection from wind and temperature extremes. PC-2 Policy 4 Landscaping shall complement and be a component of the existing native ecosystem. PC-2 Policy 5 Maintain open space characteristics in the viewsheds along State Route 89 and Interstate 80. Establish a minimum 300-foot scenic setback between development and the roadway edges of State Route 89, Interstate 80, and the proposed State Route 267 bypass. Native plants shall be used to landscape the development area edge to ensure that new development is screened from view from State Route 89, Interstate 80 and existing residential areas and neighborhood services. Town Ordinance 97-06 Page 7 PC-2 Policy 6 In order to preserve the site ~ resource and scenic values, the site shall be developed as a residential community with complementary passive recreational uses and neighborhood services. PC-2 Policy 7 Provide amenities such as,~v..~^T~' vv-~v, ....... ~:'ag :~5!e: cross country ski tra//s ~ hiking/biking trails reereat:'er~..2 :e~.e:, ar.~ h~.e! equestrian trails and other passive recreational opportunities. PC-2 Policy 8 Residential uses shall be clustered. Up to 600 residential units may be constructed. Apaxi~ent units, if constructed, shall be sited near neighborhood commercial uses and transit. Lnte~erse~ ':A+~ effice ~': ~:~' ....... :~ u:e: '~n ......... Affordable housing shall be provided in addition to market rate housing. The number of affordable units shall be equal to twenty percent of the number of market rate units. All residential units and related uses other than access roads shall be constructed on no more than 175 acres, with development clustered in defined areas consistent with Land Use Policies 7.1 and 7.2. Additional units and density may be allowed to the extent necessary to comply with State laws requiring density bonuses for projects including housing for seniors or for lower or very low income households. PC-2 Policy 9 Neighborhood-Serving gretall shopping areas shall be designed at a pedestrian scale, incorporating pathways, courtyards and other activity nodes, and a mix of shopping, offices, residences, and services. Large single building forms and large masses of pavement are not considered consistent with this policy. Public services and facilities shall be sited and designed to conform with these policies and to avoid impacts to sensitive resources. Neighborhood commercial uses shall not be sited south of Prosser Dam Road on the east side of State Route 89. PC-2 Policy 10 Architecture shall be consistent with the Town of Truckee Design Guidelines. PC-2 Poficy 11 Parking areas shall be screened. Parking shall be provided in scattered small lots or located to the rear of buildings. Town Ordinance 97-06 Page 8 ~ PC-2 Policy 12 Incorporate pedestrian/eques~an/bicycle/ski trails into project design to provide access through the entire project area, connecting onsite and offsite shopping and service areas with residential and recreational areas. Trails shall be open to the public. PCo2 Policy 13 Provide pedestrian/bicycle/cross-coun~ ski links to the downtown area and connecting with trails on adjacent properties. Provide equestrian trails linking with existing trails on adjacent properties. PC-2 Policy 14 If the PC-2 specific Plan calls for phased development, t~e PC-2 Specific Plan shall provide a reasonable balance of residential, ~ ~-m~, neighborhood services, and recreational land uses in each phase. The following text is added immediately following Land Use Policy 8.2 on page 54 of the General Plan: Land Use Goal 9 Protect the public and private open space and recreational resources of the Town of Truckee. Land Use Policy 9.1 Until December 31, 2020 the General Plan policies governing allowable uses and permissible density and intensity of uses on lands designated ~Resource Conservation/Open Spacer (RC/)S), ~Open Space Recreation~ (OSR), '~Vational Forest-Resource Conservation/Open Space ~ (NF-RC/OS), ~National Forest-Open Space Recreation , (NF-OSR), and ~Planned Community 2" (PC-2), and General Plan policies PC-2 Policy 1 through PC-2 Policy 14, shall not be amended to allow additional land uses or increased densities or intensities of uses unless such amendment is approved by vote of the people; the policies governing these land use designations may be amended by the Town Council, however, to Town Ordinance 97-06 Page 9 2. limit the allowable uses or reduce the permissible density and intensity of uses. AH lands designated ~Resource Conservation/Open Space' (RC/OS), 'Open Space Recreation' (OSR), ~National Forest- Resource Conservation Open Space' (NF-RC/OS), "National Forest-Open Space Recreation' (NF-OSR), and ~lanned Community 2" (PC-2) by the Town of Truckee General Plan adopted February 15, 1996 and amendments thereto through May 12, 1997 shall remain so designated until December 31, 2020, unless said land is redesignated to another general plan land use category by vote of the people, or redesignated by the Town Council pursuant to the procedures set forth in subsections 3, 4, 5, or 6, below. Prior to adopting a General Plan amendment required for a redesignation pursuant to subsections 3 and 4, the Town Council shah hold at least one noticed public hearing on the proposed amendment for the purpose of receiving testimony and evidence from the applicant and the public. This hearing shall be in addition to any other public hearings regularly required for a General Plan amendment~ Land designated by the Town of Truckee General Plan as 'Resource Conservation/Open Space' (RC/OS), "Open Space Recreation ' (OSR), ~Vational Forest-Resource Conservation Open Space' (NF-RC/OS), or ~National Forest-Open Space Recreation ' (NF-OSR) may be redesignated to another land use category by the Town Council if either: The redesignation is adopted in connection with adoption of the initial Town of Truckee zoning map implementing the General Plan; is found by the Town Council to be necessary in order to protect significant viewshed, wildlife habitat, or other environmentally sensitive lands; and would: adjust the boundary between lands designated us RC/OS (or NF-RC?OS) and lands designated us OSR (or NF-OSR); or adjust the boundary between lands designated us RC/OS, OSR, RC/OS-NF, or OSR-NF and other land use designations, provided that there is no reduction in the Town Ordinance 97-06 Page 10 ~ amount of land designated as RC/OS, OSR, RC/OS-NF, or OSR-NF. In connection with the adoption of the initial Town of Truckee zoning map implementing the General Plan, existing lots of records as of May 12, 1997 or lots shown on unexpired tentative subdivision maps approved prior to May 12, 1997 within the RC/OS, OSR, RC/OS-NF, or OSR-NF designations that are smaller than the minimum lot size for their land use designations may be redesignated to a single family residential land use designation, provided that no subdivision of such lots (other than in conformance with a tentative subdivision map approved prior to May 12, 1997) may be allowed. The redesignation is adopted in connection with approval of a specific project and is found by the Town Council to be necessary in order to protect significant viewshed, wildlife habitat, or other environmentally sensitive lands, and would adjust the boundary between lands designated as RC?OS, OSR, RC/OS-NF, or OSR-NF and other land use designations, provided that there is no reduction in the amount of land designated as RC?OS, OSR, RC/OS-NF, or OSR-NF; or To modify the land use designation from RC/OS or OSR to Public to allow relocation of the State of California Agricultural Inspection Station in a location adjacent to the existing State of California weigh station that the Town Council finds will benefit the citizens of the Town. Land designated by the Town of Truckee General Plan us *Resource Conservation/Open Space* (RC/OS), ~lpen Space Recreation* (OSR), "National Forest-Resource Conservation Open Space n (NF-RC/OS), "National Forest- Open Space Recreation~ (NF-OSR), or ~Planned Community 2" (PC-2) may be redesignated to another land use category by the Town Council if each of the following conditions is satisfied: Town Ordinance 97-06 Page 11 The Town Council makes a finding bused on substantial evidence in the record that the application of subsection 2 of this policy would constitute an unconstitutional taking of the landowner ~ property; and In permitting redesignation, the Town Council allows additional land uses only to the minimum extent necessary to avoid said unconstitutional taking of the landowner~ property, and protects to the maximum extent possible the integrity of open space areus, viewsheds and residential neighborhoods in the vicinity. Lands designated as ~National Forest-Resource Conservation/Open Space' (NF-RC/OS) may be redesignated to ~esource Conservation/Open Space' (RC/OS) and lands designated as ~National Forest-Open Space Recreation * (NF-OSR) may be redesignated to ~Open Space Recreation # (OSR) by the Town Council if it finds that the land has entered private ownership. Lands designated as "Open Space Recreation' (OSR) or ~Resource Conservation/Open Space' (RC/OS) may be given the additional designation of ~National Forest'(NF) by the Town Council if it finds the land has entered federal ownership. Conforming Amendments. In light of the General Plan amendments set forth above, the Land Use Element, Housing Element, and Circulation Element of the Town of Truckee General Plan adopted February 15, 1996 as amended through May 12, 1997 are hereby amended as set forth below in order to promote internal consistency among the various elements of the General Plan. Text to be inserted into the General Plan is indicated in bold italic type, while text to be stricken is presented in ~ type; text in standard type currently appears in the General Plan and remains unchanged by this initiative. All references to the "General Plan" refer to the Town of Truckee General Plan dated February 15, 1996 and amended through May 12, 1997. The language adopted in the following amendments may be further amended as appropriate without a vote of the people in the course of future updates and revisions to the General Plan. Amend Table 1.2 of the Land Use element, the "General Plan Policy Implementation Matrix," appearing on page I 1 of the General Plan, to delete the number "8.2" from the last line of the last column of the row describing "PC-2 Policies.~ A copy of the Town Ordinance 97-06 Page 12 relevant portion of existing Table 1.2 is attached hereto as Exhibit C, for informational purposes. Amend the fourth and fifth paragraphs of the Land Use Element's discussion of Land Use Designations, appearing on pages 38-39 of the General Plan, as follows: Densities and intensities for all land use categories other than 'Resource Conservation/Open Spacer (RC/OS), 'Open Space Recreation ' (OSR), ~Vational Forest-Resource Conservation/Open Space' (NF-RC/OS), and ~Vational Forest-Open Space Recreation # (NF-OSR) reflect an average for the entire Town. For example, where a Residential land use category has a density of 1 unit per acre, individual projects or zoning on individual parcels may be at a higher or lower density, while all land uses within that category Town-wide will average 1 unit per acre. For intensity, for example, where the intensity is an average of 0.20 Floor Area Ration (FAR), an individual project may have a higher or lower FAR (for instance a two story building Downtown with a FAR of 2), while the average Town-wide would be 0.20. On lands designated as OSR, density shall be determined bused on the average density of a project as a whole. For example, 10 units could be developed on 10 acres of land designated as OSR as long us at least 90 acres of land designated as OSR are preserved as permanent open space us part of the development project; the preserved open space may be a part of the developed parcel(s) or may be a parcel or parcels elsewhere in the OSR designation. Zoning will be applied to implement the General Plan Land Use designations and to identify appropriate densities and intensities in specific areas. Higher densities and intensities will be allowed on lands with fewer environmental constraints; available services such as sewer, public water, and public roads; and lands closer to or in existing developed areas, such as infill properties. Lower densities and intensifies will be designated on lands which have environmental constraints such as steep slopes and wetlands; lands which are served by wells and septic systems; and lands which are further fxom the existing developed core of Town. Zoning densities on OSR lands shall not exceed 1 unit per 10 acres; however, higher densities may be permitted where the project includes permanent preservation of open space on another OSR parcel such that overall density for the project does not exceed I unit per 10 acres. Amend Table 2.5 of the Land Use Element, "Projected Growth and General Plan Buildout,' appearing on page 48 of the General Plan, to replace the numbers "5,675" Town Ordinance 97-06 Page 13 and "12,460" in the last two lines of the last column of Table 2.5 with the numbers u5,525" and "11,707," respectively. A copy of existing Table 2.5 is attached hereto as Exhibit D, for informational purposes. Amend the first paragraph of Land Use Policy 3.2 on page 49 of the General Plan as follows" Land Use Policy 3.2 Work with applicable special districts to develop a program allowing transfer of rights to service from areas designated Resource Conservation/Open Space or Open Space Recreation to areas designated Residential, High Density Residential, Commercial, Industrial, Tahoe Donner Planned Community, Planned Community 1, or Planned Community 3. Amend the second paragraph of the Housing Element's discussion of General Plan Land Use Designations, appearing on page 134 of the General Plan, as follows: The Land Use Element sets forth the residential land use designations. The density ranges for each land use designation used to calculate housing at buildout are listed in Table 7.33. A total of !5,97~° 16,028 acres are designated to allow residential development. Using a wide range of densities to accommodate a variety of housing types, as well as clustering in environmentally sensitive areas, the General Plan provides for the potential development of 17,700 housing units. The ranges provided for each land use classification represent the average within each classification. Amend the text in the first paragraph of the discussion of "Environmental and Infrastructure Conslraints' on page 140 of the General Plan in the Housing Element as follows: Development of new housing in Truckee will primarily take place in in-fill areas and areas adjacent to existing development. The Town intends to limit the amount and location of residential development in these areas and encourage clustering to protect the natural environment and potentially reduce the cost of housing. Town Ordinance 97-06 Page 14 Amend the second paragraph of the Housing Element's discussion of Residential Land Resources, appearing at page 143 of the General Plan, as follows: The Land Use Element of the General Plan designates the lands determined to be suitable for residential development. Public services are either currently available or planned to be extended to these sites. A total of ~°,27~. 8,324 acres have been designated for residential development. Residential development is also permitted, in conjunction with other land uses, in an additional 7,704 acres. Within the !5,972 16,028 acres which allow some degree of residential development, a total of 17,700 dwelling units can be accommodated. Amend Table A.1 in Appendix A to the General Plan, "Truckee General Plan Buildout Estimate Land Uses By Acres Housing Units, Population and Employment," appearing at page 157 of the General Plan, to (a) replace the numbers "4003'' and "8004" in the last two columns in the row labeled "PC-2" with the numbers ~25" and "47" respectively and Co) replace the numbers "6,728" and "12,460" in the last two columns in the row labeled "TOTAL GENERAL PLAN BUILDOUT" with the numbers ~6,353" and "11,707", respectively. A copy of existing Table A.1 is attached hereto as Exhibit E, for informational purposes. Amend Table A.2 in Appendix A to the General Plan, "Truckee General Plan Low Growth Alternative Buildout Estimate Land Uses By Acres, Housing Units, Population and Employment," appearing at page 158 of the General Plan, to (a) replace the numbers "1753" and "3504'' in the last two columns in the row labeled PC- 2 with the numbers ~25" and u$2", respectively and (b) replace the numbers u6,177" and "11,560" in the last two columns in the row labeled "TOTAL GENERAL PLAN BUILDOUT" with the numbers "6,027" and "11,262", respectively. A copy of existing Table A.2 is attached hereto as Exhibit F, for infom,ational purposes. Section 3: Implementation Effective Date. Upon the effective date of this initiative, the provisions of Section 2 of the initiative are hereby inserted into the Town of Truckee General Plan as an amendment thereof, except that if the four amendments of the mandatory elements of the general plan permitted by State law for any given calendar year have already been utiliZed in the calendar year in which the initiative becomes effective, this general plan amendment shall be the first amendment inserted in the Town's General Plan on January 1 of the next year. At such time as this general plan amendment is inserted in the Town of Truckee General Plan, any provisions of the Town of Truckee Zoning Ordinance, as reflected in the ordinance itself or the Town of Truckee Zoning Map, inconsistent with this general plan amendment shall not be enforced. Town Ordinance 97-06 Page 15 Project Approvals. Upon the effective date of this initiative, the Town, and its depaxtments, boards, commissions, officers and employees, shall not grant, or by inaction allow to be approved by operation of law, any general plan amendment, rezoning, specific plan, tentative or final subdivision map, conditional use permit, building permit or any other ministerial or discretionary entitlement, which is inconsistent with this initiative. Nothing in this initiative shall be construed to prohibit the Town from complying with State laws requiring density bonuses and/or other incentives for projects including housing for seniors or for lower or very low income households. Section 4. Exemptions for Certain Projects. This initiative shall not apply to any development project that has obtained as of the effective date of the initiative a vested right pursuant to State law. Section 5. Severability. If any portion of this initiative is declared invalid by a court, the remaining portions are to be considered valid. Section 6. Competing Initiatives. In the event that there are any competing initiatives on the same ballot with this initiative that purport to address the same subject matter as this initiative, the following rules shall apply. If more than one such initiative passes, then both initiatives shall go into effect except to the extent that particular provisions of one initiative are in direct, irreconcilable conflict with particular provisions of another initiative. In that event, as to those conflicting provisions only, the provisions of the initiative which received the most votes shall prevail. Section 7. Amendment or Repeal. Except as specifically provided herein, this initiative may be amended or repealed only by the voters of the Town of Truckee at a Town election.
