An ABC Hearing was held on Thursday, September 26, 1996,6:30
P.M., Council Offices, Municipal Building, 61 Cooke Avenue,
Carteret, New Jersey.
The following were noted present:
Mayor Peter 1. Sica
Councilmember Deborah Bialowarczuk
" " Jack Fazekas
" " William Feingold
" " James O'Brien
" " John Vesey
Noted absent was Councilman James Failace.
Also noted present was Borough Attorney Robert A. Hedesh and
Detective Ron Bennett.
Also noted present was Emil Such, Jr. and Attorney Robert Longhi.
The Clerk stated that on September 20, 1996, in compliance with the
Open Public Meetings Act, a notice of tonight's meeting was mailed
to The Home News & Tribune, The Star Ledger and posted on the
bulletin board.
The Clerk stated that the purpose of the meeting was to hold a hearing
concerning Such's, Inc.
Due to a malfunction of the tape recorder, the beginning of the
meeting was not taped and was transcribed by the Clerk's notes.
Mayor Sica stated that the charges were selling to a minor.
Attorney Hedesh recommended that the Council take no action. He
explained that it would just be repetitious and would inhibit the
program by the Police Department to stop underage drinking and not
be in the spirit of what is being accomplished by the county and the
bar in Carteret. The Counsel acknowledges the fact that they will
continue participating in this program and based on that representation
ITom Counsel the matter should be marked as null and void. The bar
is not pleading guilty. They are not pleading not guilty. They will be
issued a verbal warning at this point to resolve the matter.
Mayor Sica said that he agrees with Ronnie, the culprit, the kid, he
said that he never showed him a license. It is highly unlikely that the
bartender would know that he had a fictitious license on him. He
testified to the fact that he had it and the cops did find it. Again, as
Attorney Hedesh said, Such's is one of the only taverns in town that
is cooperating with the SUDS elimination program. He said that he
happens to live fairly close to Such's and he knows that they run a
tight ship. He said that he also recommends that Council take no
action at this time and just a verbal understanding from Such's that
they'll be more careful in the future. He asked for someone to put that
in the form of a motion.
Councilman Vesey made a motion that they take no action.
Councilmember Bialowarczuk second the motion. Upon individual

noted absent.
ADJOURNED
There being no further business or discussion, upon MMS&C, by
Councilmen Fazekas and Vesey and unanimous affirmative vote of the
five (5) members present, the meeting adjourned at approximately
6:45 P.M.
