A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD APPROVING THE PROPOSED AMENDMENT TO THE
SCOPE OF SERVICES FOR THE SECTION 108 LOAN AND
AUTHORIZING STAFF TO PROCEED TO PROCESS THE
AMENDMENT WITH THE U.S. DEPARTMENT OF HOUSING
AND URBAN DEVELOPMENT

WHEREAS, on March 1, 1989, the City of Lynwood executed a
Grant Agreement for a Section 108 Loan in the amount of
$1,500,000 with the Department of Housing and Urban Development
(HUD), indicating that the loan would be utilized for the purpose
of eliminating slums and blighted condition by acquiring
properties in the City's redevelopment area for resale to
developers; and
WHEREAS, at the time of the City's execution of the Grant
Agreement with HUD, no specific projects for the Section 108 Loan
proceeds had been identified and thus the funds were not
utilized; and
WHEREAS, in said period the City's needs for the use of
Section 108 Loan funds have changed; and
WHEREAS, the proposed projects for utilization of Section
108 Loan funds are now specifically identified to be; (1)
Clearance, demolition, site preparation, installation of
utilities and public improvements for the Lynwood
Community/Transit center; (2) Rehabilitation of City owned
facilities (city park and old library); (3) Site preparation and
reconstruction of City owned streets; and (4) Interest payments
on Section 108 Loan; and
WHEREAS, before the City can proceed to utilize Section 108
Loan funds for proposed projects, an amendment identifying the
change in the scope of services for the use of funds must be
submitted and approved by HUD; and
WHEREAS, the proposed amendment to the scope of services
complies with Section 570.701 (Loan Guarantees) of the Federal
Register for the Department of Housing and Urban Development (53
FR 34437; published; September 6, 1988).
NOW, THEREFORE, the City Council of the City of Lynwood does
hereby find, determine, order and resolve as follows:
SECTION 1. The City Council authorizes the City Manager or
his designee to obtain the signatures required for Section 108
Loan certifications which are part of the amendment.
SECTION 2. The City Council hereby approves the amendment
to the scope of services for the Section 108 Loan and authorizes
and directs the City Manager or his designee to submit the
subject amendment to HUD.
SECTION 3. This resolution shall become effective
immediately upon its adoption.
