HomeMy Public PortalAboutResolution 84-2292 Approval of Conditional Use Permit 70-317 Burger King Children Play AreaRESOLUTION NO. 84 -2292 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING MODIFICATION TO CONDITIONAL USE PERMIT 70 -317 FOR THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. By its Resolution No. 84- 1127PC, the Planning Com- mission of this City has heretofore approved modification of CUP 70 -317 to authorize the existing Burger King at 5541 Rosemead Boulevard to add a children's play area facility to its present operations. Said action by the Planning Commission was appealed and duly heard by the City Council at a public hearing. SECTION 2. The City Council does hereby confirm each and every one of the findings, decisions, and conditions of the Planning Commis- sion as set forth in Resolution 84- 1127PC, and incorporated herein by reference. SECTION 3. The following additional conditions are attached to said approval: 7. The wrought -iron fence and pilasters at the north and north- easterly corner of the play area shall be reinforced to prevent hazard in the manner and means required by the City Building Department. 8 Because the amount of increased business (and thus Rosemead Boulevard traffic turns) to be generated by this development is not now known, the City Council expressly reserves continu- ing jurisdiction over this approval in order to attach addi- tional conditions relating to traffic flow (ingress and egress) to the business activities on said premises, for a period of 10 years, with the owner to pay for and accept such traffic devices. 9 Before using this approval in any way, the owner shall sign its approval and acceptance of the conditions of this approval in such form as shall be required by the City Attorney. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
