Sica at 7:30 P.M. in the Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Tuesday, November 19, 1996. COUNCIL t1EETING Upon individual roll call vote, the following were noted present: ROLL CALL " Deborah Bialowarczuk James Failace William Feingold James O'Brien John J. Vesey, Jr. Councilmember " " " Noted absent was Councilmember Jack Fazekas. Also noted absent was Borough Attorney Robert A. Hedesh. Also noted present was Sy Juman, Esq. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor Peter J. Sica. PRAYER, PLEI:X;E OF ALLEGIANCE The Clerk stated that on November 14, 1996, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News & Tribune, The Star Ledger and posted on the bulletin board. SlATfl1ENT OF MEETING NOTICE This was the night advertised to receive bids for an Adult Passenger Bus and the Mayor called for all bids. Upon MMS&C, by Councilmembers Vesey and Bialowarczuk and unanimous affirmative vote of the five (5) Councilmembers present, the Clerk was directed to open and read aloud all bids received which were as follows BIDS Adult Passenger Bus BIDDER 1. ORDINANCE #96-26 "AN ORDINANCE AMENDING CHAPTER 182 OF THE CODE OF THE BOROUGH OF CARTERET, ADDING SECTION 182-9.1 ENTITLED "PARK AND RECREATIONAL FEES" ORDINANCE #96-27 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held December 5, 1996, upon MMS&C, by Councilmembers Vesey and Bialowarczuk. Upon individual roll call vote, Councilmembers Bialowarczuk, Failace, Feingold, O'Brien and Vesey voted in the affirmative for the adoption. Councilmember Fazekas was noted absent. ORDINANCE #96-27 "AMENDING CHAPTER 4 OF THE CODE OF THE BOROUGH OF CARTERET ENTITLED "ADMINISTRATION AND GOVERNMENT" ORDINANCE #96-28 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held December 5, 1996, upon MMS&C, by Councilmembers Feingold and Bialowarczuk. Upon individual roll call vote, Councilmembers Bialowarczuk, Feingold and Vesey voted in the afiì.rmative. Councilmembers Failace and O'Brien voted no. Councilmember Fazekas was noted absent. ORDINANCE #96-28 "AMENDING CODE OF THE BOROUGH OF CARTERET SECTION 42.1, ENTITLED" POLICE DEPARTMENT" 2 NOVEMBER 19, 1996 Councilmember Failace asked if this could be tabled. At the Agenda Meeting it wasn't discussed to change the ordinance from nine to twelve. It was only told that this would be replacements. We should discuss this before we do this. He made a motion to table the Ordinance. Motion to Table - Fails Councilmember O'Brien second the motion. Upon individual roll call vote, Councilmembers Failace and O'Brien voted in the affirmative. Councilmembers Bialowarczuk, Feingold and Vesey voted no. Councilmember Failace explained that he thinks we have to look at this a little bit more closely. We have fift:y-one (51) members on the Police Force. Of the fifty-one (51) members, eight (8) are Sergeants, six (6) are Lieutenants, two (2) are Captains, two (2) are Deputy Chiefs and the Chief. If we add four (4) more Sergeants.... our rank of the Police Department is now 45% versus patrol. We are sitting one Sergeant for every 2.33 patrol. He said that he's checked with other towns to see where they're at. Woodbridge's rank is 24%, one Sergeant for every six patrol. South Amboy is very close to that. At this point, we have to look at it. He understands that we are short one and we should put one on. He said that he really doesn't think that we should change this ordinance right now. Upon Voting Councilmember O'Brien said that he agrees to put the one on as a replacement, but no increasing it to twelve. The Clerk stated that Ordinance #96-25 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough ofCarteret held on November 7,1996. It was duly published in The Home News & Tribune on November 12, 1996 with notice that it will be considered for final passage after Public Hearing to be held on November 19, 1996 at approximately 7:30 P.M.. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. ORDINANCE #96-25 Loitering Upon MMS&C, by Councilmembers Vesey and Bialowarczuk and unanimous affirmative vote of the five (5) Councilmembers present, the Mayor declared the Public Hearing to be open. Public Hearing There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Vesey and Bialowarczuk and unanimous affirmative vote of the five (5) Councilmembers present. Councilmember Failace noted that at the Agenda Meeting, Borough Attorney Hedesh said that he would get a breakdown first, before the resolution was put on. Mayor Sica said that he will tell us what cases still have to be fought. It's $125.00 per hour. If any time we want to pull out we can. Ifwe don't go to Tax Court we lose automatically. Councilmember Failace said that at the Agenda Meeting it was stated that it would not go to developers. He said that he would like to see the words changed a little bit where it says "private property owners" to "excluding any and all units owned by a developer. Otherwise he would like it tabled. He stated that he has a problem with the term "private property owner". If someone buys property in Carteret, are they private property owners? Mayor Sica said that is a developer. This is a person who has one house. Attorney Juman said that the Mayor is correct. It goes to a single residence. RESOLUTION #96-319 was introduced by the Mayor and was referred to the Council for action. Upon IvIMS&C, by Councilmembers Bialowarczuk and Vesey RESOLUTION #96-319 "APPOINTING ACTING POLICE SERGEANTS" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, Feingold and Vesey voted in the affirmative. Councilmembers Failace and O'Brien voted no. Councilmember Fazekas was noted absent. o o Councilmember Failace noted that he doesn't understand how this can be put on ahead of the Ordinance. Councilmember O'Brien said that the letter from Attorney Hedesh said that this should be held. Mayor Sica noted that he doesn't care what the letter from Attorney Hedesh says. Councilmember O'Brien asked if we could amend the resolution to only appoint the top person. Mayor Sica said that the Council has to amend it. Councilmember Failace noted that he is not against any of these officers. They are fine people and deserving of the position, but he feels that this should not be done. Councilmember O'Brien said that he would like to see the first one get on right now but not increasing it to twelve. Upon MMS&C, by Councilmembers O'Brien and Vesey and unanimous affirmative vote of the five (5) Councilmembers present, the meeting was opened to the public on Resolution #96-320. An unidentified person asked what the resolution was about? Mayor Sica explained that they are appointing Michael Bucsak as the Acting Temporary Supervisor in the Parks. Mr. Stark has had a serious stroke and is not at work. Mr. Kolibas will be going on vacation for a month and we need someone there in charge. Mr. Bucsak did an excellent job in the summertime when Mr. Stark got sick. The Clerk stated that she was in receipt of an application from St. Joseph's H.S.A. concerning amending Raffle License #1414A by changing the dates and prizes. Upon MMS&C, by Councilmembers Vesey and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, it was ordered to be approved. The Clerk stated that she was in receipt of an application from the Carteret High School Band Parents Association concerning amending Raffle License #1418A by adding a date. Upon MMS&C, by Councilmembers Vesey and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, it was ordered to be approved. 10 NOVEMBER 19, 1996 The Clerk stated that she was in receipt of a communication £rom the Borough of Shrewsbury concerning opposing an up-land site and containment island for the disposition of dredge spoils. Upon MMS&C, by Councilmembers Vesey and O'Brien and unanimous affirmative vote of the five (S) Councilmembers present, it was ordered to be received and placed on file. CO~1~1UN ICATION Township of Shrewsbury The Clerk stated that she was in receipt of the following reports: REPORTS Departments Inspection of Buildings - October 1996; Total Estimated Cost of Construction, $1,194,284.00; To Treasurer, $16,117.00. Treasurer - October 1996 Welfare - October 1996. BUILDINGS & GROUNDS: Committee Chairperson O'Brien reported that he spoke with Mr. Tobias earlier today and about 7S% of the electrical upgrade is done. There is a new computer desk in the Tax Office. Yesterday there was a problem with a transformer out on a pole so PSE&G came down. Ray Tobias is doing his usual great job. He reported progress. Standing Committees FINANCE & ADMINISTRATION: Committee Chairperson Failace reported that Mr. DeBlasio has either sent out or prepared a letter to send out to the departments to do some estimates on the 1996 numbers and we can do a pro bono for 1997. He is away at the League of Municipalities right now. Tax collection is behind 2% this year and at this point, the end of October. That doesn't sound like much but it is $S94,000.00. The good news is that he expects to collect that money by the end of the year. He reported progress. FIRE: In the absence of Committee Chairperson Fazekas, Committee Member Vesey reported progress. 1 PARKS & RECREATION: Committee Chairperson Bialowarczuk reported that the 2nd Annual Christmas Tree Lighting is scheduled for December 7, 1996 at 6:00 P.M.. Mr. Kolibas has everything set pretty much to go. Last year's event was really nice and probably this year will be even better. They have already taken care of the Girl's Winter Basketball Program. There are 86 girls already signed up. It's a Saturday program. For the last two years they've tried and they've finally pretty much have gotten it straightened out with Mr. Molarz, to run a Boy's Basketball Camp. It's important because a lot of the boys that don't get on the teams are in 7th and 8th grades and they don't get to play basketball and it's not fair. They go out of town to Woodbridge or some where else. They should be kept in town. They have allotted the money and have taken care of it. She reported progress. NoviltnER 1. 9, 1996 Standing Committees Can't. t1ayor POLICE: Committee Chairperson Feingold reported that he received and reviewed the monthly report rrom the Chief for October. He is pleased to see that crime, particularly assaults, are down this month compared to last month. The Patrol Division, all of the officers, are doing a fine job to deter crime. It's apparent to him that the Traffic Division is really dong a fine job headed up by Dennis McFadden. Two hundred sixty-five (265) summonses were issued. Those aren't numbers just for the sake of numbers. Those are observed violations that will stick. Secondly, the enforcement around Columbus School is way down rrom 63 summonses to 30 summonses this month, so apparently they're doing a fine job around the schools. The Traffic Bureau is just generally doing a great job. Committee Chairperson Feingold said that he thinks that these four police appointments were made on performance, not politics. He is proud to vote for Mr. Mirandi, Mr. Tarrant, Mr. McFadden and Mr. Guiliano. He has personally ridden with them and he has seen what they've done first hand. His vote was based solely on their ability. They've shown their ability to lead. Dennis McFadden with the Traffic Bureau and all of the others have impressed him. That's why he voted as he did. This isn't Woodbridge or South Amboy, this is Carteret. There is a dire need for these particular individuals to take the place of Sergeants in our community. He reported progress. PUBLIC WORKS~ Committee Chairperson Vesey reported that Mr. Biel was on vacation. Everything is running fine. The leaves are being picked up. At the next Agenda Meeting we have to talk about getting something on the books about leaves in the street. There is a big problem with them going down the sewers. There is nothing on the books right now. He reported progress. MUNICIPAL GARAGE SERVICES: Committee Chairperson Failace said that he knows that this is not South Amboy or Woodbridge. He knows this is Carteret and he knows that the taxpayers in Carteret have been burdened for a long time with a lot of dollars and a lot of high taxes. To him, this looks like a perfect example of a lame duck administration doing exactly what it chooses to do, burdening the tax payers. He reported progress. MAYOR: Mayor Sica said that Councilmember Failace can call it a lame duck, but he calls it a police department that's doing a job. Councilmember Failace said that he thinks that it is a good police department. Mayor Sica said that we have a police department that's now come full circle and knows that they've got to get out there and do a job. For instance, although everybody is against giving tax help to give people affordable houses up there, he defies anyone to look at the record under police calls and how they've gone down in the Hill Section. That's part of having a good police department. He said that he doesn't care if we had to make everybody a Sergeant. Once you get five years in the police force you have no where to go unless you go up in rank. 12 ,/"'-" '---...-.~--. Mayor Sica said as long as you're doing the job and you're making it safe on the streets for the people in Carteret, then you should be compensated accordingly. If a cop is willing to go out, educate himself, take the test and pass it and we can give him a few extra dollars and a little bit more responsibility and the initiative to go out and educate himself a little bit more to become a Lieutenant, then that's what we should do. That 's what the taxpayers in the City of Carteret have got to look at. The Mayor said that the bank building on Cooke Avenue has been closed and it's up for sale. It was on the market for $500,000.00. That building will be an ideal building for the City of Carteret to purchase and utilize for out total Finance Department and our Sewer Collection Department. They have drive-up windows there. If we were to purchase that building, then we could close the Health Department building and tear it down and make our parking lot larger. We could utilize the downstairs of City Hall for an expanded Health Facility. Everything downstairs could be moved over to the bank building. The downstairs of City Hall is barrier free, so people can go to health clinics. He said that he was contacted by the people of CoreState Bank and although it is on the market for $500,000.00, the City ofCarteret can pick it up for $150,000.00. That is a great buy. As you recall, we got $100,000.00 from the Bellemeade Corporation. That money was put into an Escrow Account to be earmarked for such a purchase as a bank building. We have some surplus money in the Sewerage Department. We can take some of that money and purchase that building for $150,000.00. He stated that he is not locked in to that $150,000.00 yet. They are going back and forth with counter offers. If he can get it for a little bit less, hopefully, he will. He will recommend to the Council at the next Agenda Meeting to enter into an agreement to purchase the bank. 13 NOVEMBER 19, 1996 Mayor Con't.
