HomeMy Public PortalAbout1996/12/19 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor Peter 1. Sica, 7:30 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday, December 19, 1996. Upon individual roll call vote, the following were noted present: Councilmember Deborah Bialowarczuk James Failace Jack Fazekas William Feingold James O'Brien John 1. Vesey, Jr. " " " " " Also noted present was Borough Attorney Robert A. Hedesh. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor Peter 1. Sica. The Clerk stated that on December 13, 1996, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News & Tribune, The Star Ledger and posted on the bulletin board. Upon MMS&C, by Councilmembers Vesey and Fazekas and unanimous affirmative vote of the full Council present, the minutes of November 19, 1996 were approved as transcribed and engrossed by the Clerk. The Mayor presented Certificates for the Carteret High School Football Team to Mr. Walter Niemiec. Mayor Sica said that they are the State Champs and have done a great job. 1 DECEMBER 19, 1996 COUNCIL MEETING ROLL CALL PRAYER, PLEÅ’E OF ALLEGIANCE STATil1ENT OF MEETING NOTICE MINUTES FOR APPROVAL CERTIFICATES OF ~1ERIT - CHS Football Team State Champions DECEHBER 19, 1996 St,¡earing - In Ceremony - police Sergeants Mayor Sica swore in the following Police Sergeants: Sergeant Nicholas Mirandi Sergeant Andrew Tarrant Sergeant Dennis McFadden Sergeant Gary Guiliano Mayor Sica added that these four people will be a credit to the Carteret Police Department in a supervisory position. When a Police Officer goes out and takes time to educate himself and makes himself quality material and passes a test, that all by itself deserves recognition. These four guys passed the test and they do a great job. In 1983 he said that he made a statement that he doesn't care if everybody becomes a Sergeant or Lieutenant, as long as they're willing to continue to work to better themselves because by bettering themselves they better this community, then he supports making them superior officers so that they can get better pay. That's a credit to these gentlemen that they did that. If any one of those four gentlemen see a kid fall through the ice in Carteret Park or answer a call from some person who is sick or answer a bank robbery they will not wait for a patrolman. They are going to get out there and do their job. Whether they are Sergeants, Patrolmen or Lieutenants or Chiefs of Police, it makes no difference. They are out there doing a job for the citizens of Carteret and he stands behind them 100%. ORDINANCE #96-33 Vacating Portion of Virginia Avenue ORDINANCE #96-33 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held January 16, 1997, upon MMS&C, by Councilmembers Vesey and O'Brien. ORDINANCE #96-34 "AMENDING CODE OF THE BOROUGH OF CARTERET CHAPTER 4 ADMINISTRATION OF GOVERNMENT ARTICLE 1, SECTION 4-4 ENTITLED "ORGANIZATION OF BOROUGH GOVERNMENT" Councilmember Failace asked what this is, noting that he did not see it at the Agenda Meeting? Borough Attorney Hedesh explained that the State told us that we had to pass a resolution naming the people on the Urban Enterprise Zone. The Clerk told him that this board was never included in the section of boards and commissions. This is only house cleaning. The Clerk stated that Ordinance #96-29 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough of Carteret held on December 5, 1996. It was duly published in The Home News & Tribune on December 10, 1996 with notice that it will be considered for final passage after Public Hearing to be held on December 19, 1996 at approximately 7:30 P.M.. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. It was duly published in The Home News & Tribune on December 10,1996 with notice that it will be considered for final passage after Public Hearing to be held on December 19, 1996 at approximately 7:30 P.M.. Public Hearing Upon MMS&C, by Councilmembers Vesey and Fazekas and unanimous affirmative vote of the full Council present, the Mayor declared the Public Hearing to be open: ST ANLEY GUTOWSKI asked what Mr. Ferguson's hours are currently and if there are any set hours? Mayor Sica said that there are no set hours but he probably puts in 35 hours a week with this particular job. Mr. Gutowski asked if his hours will expand, questioning how they can expand if he is full time already. {~ The Mayor explained that his hours right now are less than twenty (20). Mr. Gutowski asked ifhe is saying that his hours will go from twenty (20) to thirty-five (35)? The Mayor Stated that it fluctuates. Some days he's there a whole lot longer than he has to be because he has meeting with insurance carriers and is negotiating insurance policies. Mr. Gutowski stated that he remembers recently that Mr. Ferguson was offered another position with the Borough working with the Urban Enterprise Zone. He turned that position down because he didn't want the extra work or whatever. He asked why this is different? Mayor Sica said that he did not turn it down because he didn't want the extra work. He felt that it would not coincide with what he was doing, dealing with the insurances and people that he is trying to get into the City of Carteret. By doing this he will actually be doing the same thing but as the Mayor's Aide. Mr. Gutowski questioned if he will basically be a full-time employee? Mayor Sica said that he makes his own hours because there are not set hours. He does a great job. Because ofMr. Ferguson alone, last year we saved over $100,000.00. The Council knows that. They've all sat down with Mr. Ferguson and they know what kind of a job he does. A good many of the industries have located in Carteret because ofMr. Ferguson's expertise and his pleasant personality. There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Vesey and Bialowarczuk and unanimous affirmative vote of the full Council present. Upon MMS&C, by Councilmembers Vesey and Bialowarczuk ORDINANCE #96-30 "AN ORDINANCE TO AMEND ORDINANCE #71-9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" was finally adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, Feingold and Vesey voted in the affirmative. Councilmembers Failace, Fazekas and O'Brien voted no. Public Hearing Upon MMS&C, by Councilmembers Vesey and O'Brien and unanimous affirmative vote of the full Council present, the Mayor declared the Public Hearing to be open:. SOPHIE CHEREPON asked for an explanation of the Ordinance. Mayor Sica explained that some people arbitrarily rake their leaves in the curb and let them go on the neighbor's property or let them go down the sewers. Then the catch basins have to be cleaned two times a year because of all of the debris that goes down there. The people just can't take them and throw them on the street anymore especially if you take for example Carteret Avenue. It causes havoc and it really is a fire hazard. You will not be allowed to blow the leaves or rake the leaves out on a curb anymore. They're going to have to bag them just like everybody else does. Sophie Cherepon said that she thought that it always was a law. Mayor Sica noted that it was what we tried to make the law but we didn't have it as a law. Now, we're going to have it as law and if you do it, you're going to get fined. Mrs. Cherepon said that they always clean their catch basins. The Mayor added that the people that do a good job are actually punished because the guy next door doesn't care arId throws the leaves out on the street and it goes in your yard. Adopted Upon MMS&C, by Councilmembers Vesey and Bialowarczuk ORDINANCE #96-31 "AMENDING CODE OF THE BOROUGH OF CARTERET CHAPTER 202, ENTITLED "RECYCLING PROGRÅl\1" 6 was finally adopted. Weare getting something that's worth in excess of three-quarters of a million dollars for $140,000.00. Upon individual roll call vote, Councilmembers Bialowarczuk, Failace, Fazekas, Feingold, O'Brien and Vesey voted in the affirmative to amend the agenda. A copy of each resolution was placed upon the table for public review prior to the meeting in accordance with the Rules of Council and upon MMS&C, by Councilmembers Vesey and O'Brien and unanimous affirmative vote of the full Council present, the meeting was opened for public input on all resolutions. ST AN GUTOWSKI asked what kind of surplus is being sold, referring to Resolution #96-346? Mayor Sica said that we have some piece of junk. The Clerk added that there are two stoves. The Mayor said that he doesn't know why we aren't selling the salt spreaders. We have been updating our plow equipment and we can sell the old pieces. Borough Attorney Hedesh suggested that this resolution be tabled because it really should have a list of items that will be put up for sale. Upon MMS&C, by Councilmembers Vesey and Bialowarczuk RESOLUTION #96-352 "APPOINTING GEORGE CARPENTER PROVISIONAL SUPERVISOR IN THE STREETS & ROADS DEPARTMENT" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, Feingold and Vesey voted in the affirmative. Councilmembers Failace, Fazekas and O'Brien voted no. Mayor Sica voted yes to break the tie. Councilmember Failace asked why this is needed? Councilmember Vesey said that they need another man. The position is there. Councilmember Failace said that when Ted Surick is out Mr. Carpenter does his job and gets paid. Councilmember Vesey said that this is different. Councilmember Failace asked what the increase is? Councilmember Vesey said that he doesn't have the breakdown in front of him. Councilmember Failace asked the Clerk what the hourly rate is? The Clerk said that it is $19.11 per hour. Councilmember Failace noted that it is going from $16.30 to $19.11, approximately $6,000.00. The overtime this year plus that salary would put him about $5,000.00 or $6,000.00 above the Superintendent of the Department. Do we have to raise the Superintendent next? Councilmember Vesey said that the Superintendent was on the clock. He chose salary. Councilmember Failace said that we are going to burden the people with another $7,000.00 to $8,000.00 in salary when it's not necessary. He said that he absolutely votes no because they're throwing $5,000.00 here, $7,000.00 there, $10,000.00 there and it becomes a point or a half of a point and a point and a half of your taxes next year. 12 Councilmember Fazekas asked what the percentage of the salary increase is? The Mayor noted that he wasn't at the last Agenda Meeting and these qu.estions should have been asked then. r.~,.,.:.",:".-:---......._. Councilmember Failace said that he asked and then was asked if he personally wanted a promotion. Of course, he does, but the company won't do it. Councilmember Vesey asked if this should be discussed m Closed Session? Councilmember Failace said that he won't bring any more out. The questions were asked at the Agenda Meeting. Mayor Sica said that if the questions were answered at the Agenda Meeting they should vote their consciences. Councilmember Failace added that the people have to understand what's happening. It's another $7,000.00 or $8,000.00 that we're adding an it's absolutely not necessary. Now the guy's going to make more than the Superintendent of the Department and that's ridiculous. Mayor Sica asked the Borough Attorney if he becomes a provisional Supervisor, is he assuming the job ofMr. Surick? Borough Attorney Hedesh said no. The title used to be Foreman and it was changed to Supervisor. Mr. Surick is the Superintendent and Mr. Carpenter would then be a lower level Supervisor. Mayor Sica noted that if he is working in Mr. Surick's position as a Supervisor, then he would not be entitled to overtime. He would only be entitled to only what Mr. Surick would get while he was that Supervisor. Borough Attorney Hedesh disagreed and said that he would not be entitled to what would be Mr. Surick's hourly payor his base pay because that's why you have a Supervisor. When Ms. Barney is out, the Deputy should not be getting her salary. Mayor Sica said that she does. She is assuming all of the duties and she gets the exact same thing. She wouldn't get overtime. She would just get the same salary. If Mr. Carpenter is doing Mr. Surick's job in his absence and overtime comes up, he has to forego the overtime because he's dong the Supervisor's job. When he's doing overtime work aside from being a Supervisor then of course he should get the overtime. Borough Attorney Hedesh noted that what this Ordinance would effectively do is make him a Supervisor, five days a week, 24 hours a day, whatever. His title will be Supervisor. The question is if the Superintendent is not there. Mayor Sica said that then he wouldn't get overtime. Councilmember Fazekas asked if he get the base pay of the Superintendent? 13 Borough Attorney Hedesh said that he would still be entitled to the overtime as a member of the union. He is covered under the bargaining unit contract even though he fulfills that higher position. DECÐ1BER 19, 1996 Cor:men ts Con't. DECÐ1BER 19, 1996 Comments Con't. Mayor Sica said that then they better think about this. You can't in good conscience have a provisional making more than the Supervisor. That, in good conscience, should not be. Borough Attorney Hedesh noted that he is a provisional because there is not a certified list. He would be the #2 person in the department. That #3 person would get whatever the salary ordinance is. Mayor Sica said that he has not problem with that. Borough Attorney Hedesh said that he would still be covered under a bargaining unit. The Mayor said that the problem he has is when he is working the Supervisory capacity, for instance, a snow storm. They work 24 hours. Mr. Surick works 12 hours and goes home. Mr. Carpenter assumes the position and works the next 12 hours. The Borough Attorney said that as a member of the bargaining unit he would still be entitled to overtime. The Mayor noted that some correction has to be made here. An unidentified voice asked to discuss this further. The Borough Attorney advised that you could only discuss this in Closed Session if you are discussing a personnel matter unique to the individual not unique to the position. Their questions relate to the position not to the individual. It's not Closed Session. Mayor Sica said that this has to be addressed because you can't have someone doing one job for one price and have another guy getting paid additional money for it. The Borough Attorney said that is has always been his interpretation of Civil Service rules that the purpose of having a Deputy or having a second in line is so you don't need an acting Superintendent or you don't need an acting Borough Clerk. That person assumes the duties. The equivalent would be a Vice President. The person stays at his rate, that's why you have someone. If you didn't then you wouldn't need anybody as #2. You could always appoint your senior worker and make him an Acting Superintendent and put him in charge as the situation that may occur down the park because you don't have your first or second person there. Councilmember Fazekas asked if this is only because it's salaried and not hourly? The Borough Attorney said that it wouldn't make a difference. If they asked for an opinion off the cuff, he would say that the Superintendent cannot be hourly and would not be able to incur overtime because he's an N.L. 14 appointment. He is a Superintendent. Councilmember Fazekas asked according to Civil Service what happens when the Borough Clerk is not there? The Borough Attorney explained that then thePeputy Clerk would take her place, have the authority to take her place, but the salary would stay as Deputy Clerk. That's the purpose of having a #2 person. Councilmember Fazekas asked the Clerk if that is how it is? The Clerk said no. Borough Attorney Hedesh said that if it isn't then somebody should address that issue. The Mayor said that we've got Pandora's Box open now. Should we open it further or close it all up, including the Deputy Clerk? Borough Attorney Hedesh explained that anytime you appoint a #2 person, you've already appointed someone. It's very similar to a Sergeant. He doesn't get paid when he's Supervisor because a Lieutenant is out. He doesn't get paid as a Lieutenant. He still gets paid as a Sergeant. Councilmember Vesey said that George Carpenter wouldn't have to be paid Superintendent's rate if the Superintendent worked 12 hours and went home. The only time he'd get the pay would be when the man is out either on vacation or sick. Borough Attorney Hedesh noted that a Superintendent of that department is a department head. He is listed under Civil Service as an N.L. employee, meaning that he would not necessarily be entitled to overtime. That's why you have these department heads and it incurs certain compensatory time. You can't get compensatory time and overtime. If he was asked for a quick opinion, he would contend that we probably could not pay a Supervisor an hourly rate. They have to be based on a salary. He said that he was not asked this prior so he does not have that cite in front of him. The question raised as far as the Supervisor has nothing to do with whether the Superintendent is on an hourly rate or a straight salary rate. There's no bearing on that. The question is, does this person, once they become a Supervisor, do they automatically become the pay of a Superintendent. His position is why would you have a #2 person in charge if you need to always pay him a Superintendent's rate. You wouldn't need a #2 person. Whether it's this department, the Parks Department, the Clerk's Department, the Treasurer, the Assistant Treasurer, whatever. That's why you have a level of authority that goes up with someone being #2 in charge. Mayor Sica said that he will look into the situation of the Deputy Clerk and the Clerk and put a stop to that too. 15 Borough Attorney Hedesh said that in effect, if you would take that position, it would be economically feasible to have a Department Head and all lower workers. You'd probably have to classify people into different levels because of their skills, but not any skill that would require a supervisory capacity. If you give them supervisory capacity, that's already establishing a chain of command. There's a difference in Civil Service between a higher classification and a chain of command. A higher classification may be like a mechanic who has different skills but doesn't have any supervisory capacity. DECEt1BER 19, 1996 Comments Can't. DECÐ1BER 19, 1996 Comments Con' t. RESOLUTION #96-353 Appointing Members - UEZ Advisory Committee Amended Councilmember Failace said that we have some that are hourly and some that are salary. Mayor Sica noted that you can't have a supervisor that is hourly. Councilmember Failace said that we have it. Borough Attorney Hedesh stated that he would certainly be able to give them a more coherent opinion if he had the question prior so that he could have cite ready for them. He is telling them what he knows. The Mayor said this would be looked up before anybody gets paid. The Borough Attorney explained that in effect, what they've done is just appoint Mr. Carpenter into a position. There is a salary ordinance already in place for that position. The questions that are being asked are more policy questions. He doesn't know if he's hearing anybody say that we don't need a #2 person in that department. Maybe Councilmember Failace is saying that, he's not sure. Mayor Sica said that he thinks that everybody agrees that they need a #2 person in that department, but it's going to be distributed fairly. He said that he will review all of the secondary people, in every single department. He will make recommendations to the Council of where we've got to clean this thing up. Councilmember Vesey said that he wanted to do that. He didn't want to bring it at the rate it's at but he was told by the lawyer that he had to go with the top rate. Borough Attorney Hedesh said that they have to go with the rate established by ordinance. He asked for a copy of what the Mayor will review and he will submit a written opinion with a little more exact detail than he's just given to them. RESOLUTION #96-353 was introduced by the Mayor and was referred to the Council for action. Borough Attorney Hedesh, for the record, asked the Council to amend the resolution to remove the name of John W. Spoganetz. The Mayor said that he is not a member. He quit. The Borough Attorney said that is why he can't be appointed. He never wanted to serve. Upon MMS&C ,by Councilmembers Vesey and Bialowarczuk, the name of John W. Spoganetz was removed from the resolution. We established it by resolution. What has happened though, is that the voting members are really voting members of the Economic Development Corporation, not this. We have a corporate package. The corporate package has to vote on the by-laws. Councilmember Feingold questioned whether he could vote on this or not because he is a member of the Urban Enterprise Zone Advisory Committee. Councilmember Fazekas said that he is a member also. Mayor Sica said that they are not getting paid. Borough Attorney Hedesh explained that they don't obtain any enumeration. That's what they did. He told Councilmember Fazekas that he could have very easily called somebody. Councilmember Bialowarczuk, Feingold and Vesey asked him about it. He said that he talked to anybody that asked him about it and told them it was a zero increase and gave them whatever it was. Councilmember Fazekas said that the thing about the zero increase is they can make that up in the next year, so that doesn't phase him. A zero increase....you can double it next year. He said that he is not questioning that. All he wants to do is look at the contract. It's not to be given to him there. He questioned if the other members knew that this was coming here tonight. Mayor Sica said that they have a committee and it should have been reported to the rest of the Council. When he was asked questions about it, he told them about it. Councilmember Failace added that no one said on Tuesday night that they were voting on it on Thursday. The Mayor disagreed. Borough Attorney Hedesh agreed with the Mayor and said that there was a big thing that they were going to get it to him that night so that it could pass. In as much as the contract calls for certified funds and because the Ordinance was obviously passed tonight, they would not be able to get the funds certified by tomorrow. Consequently, he could not disburse them. They revised that in that checks have been made out to CoreState in the amount of $131,978.74 and to the Montgomery Group which is a real estate commission of $8,400.00 out of disbursements of the funds. The balance of funds in regards to title work, costs, etc. is then being put into a trust account and will be disbursed after the non-certified check clears. For the record, that amount is not being paid to his firm. It is an escrow account into his trust account and disbursed thereof. Councilmember Feingold questioned the name of United Counties. Borough Attorney Hedesh said that there is no more United Counties. CoreState is the successor. Councilmember Feingold noted that the resolution read United Counties. The Borough Attorney asked for a motion to amend Ordinance #96-32. The title is actually in United Counties Trust Company. That is why the Ordinance reads as such, but Councilmember Feingold is right and it should be cleared 22 up. The seller is now CoreState Bank of New Jersey which is the successor to United Counties. It should be amended from CoreState of New Jersey, Successor to United Counties Trust Company. The Clerk stated that she was in receipt of a Resolution from the Township of Edison supporting passage oflegislation amending Municipal Land Use Law to permit off-site traffic impact and impact upon student population to be considered in granting site-plans and sub-division applications. He reported progress. 23 The Mayor noted that we will have to look into the feasibility of increasing the janitor in the Borough Hall from Part-time to Full-time because of the purchase of the bank and moving the Board of Health to the Municipal Building. FINANCE & ADMINISTRATION: Committee Chairperson Failace reported that he spoke with Patrick DeBlasio. Our tax collection is still behind. It's not because of the efforts ofthe Tax Department. They sent out personalized letters to the larger tax owers. We are behind about .84%. Not only did these people get an interest of 18%,but on top of that there's a 6% penalty that we get December 31 st. The department has worked very hard to try to get this money and he' sure they are continuing. He reported progress. FIRE: Committee Chairperson Fazekas reported that they had their monthly Fire Committee Meeting. They are going to have a communications board put up in the Fire Department where at least State mandated regulations can be posted so that every man knows what the requirements are. We will also have a list of schedules and classes with a list to sign up for those classes so that everybody can have an equal opportunity. He reported that on February 15, 1997, for St. Valentine's Day, they will hold a charitable event, a dinner dance for the M.D.A.. He will provide more information on that. That information will also be available on the Internet. In addition, there are annual contests for arts and those pictures will be on the Internet. You could look at the Internet and find out who the winners are in each group and who participated in the drawings. We do have winners and those names will also be posted. The Mayor suggested that the event on February 15, 1997 be coordinated with Mr.LePree from the Post Office. POLICE: Committee Chairperson Feingold congratulated the four Police Sergeants. We had some vandalism in the park with the holiday tree. When something like that happens in Carteret, graffiti, vandalism, whoever the perpetrators are, are doing nothing but victimizing themselves. They are part of the community and acts like that bring everyone down including themselves. He said that he doesn't understand that type of behavior and he doesn't think anyone does. We have to do something to prevent it. He urged anyone with information concerning that to come forward. Committee Chairperson Feingold stated that he received the monthly report and we had an all time high in burglaries this month.....(inaudible)....United States. We had twenty (20) reported burglaries, up six (6) from last month. It's important that the residents be mindful of the possibility of forceful entry into their homes and make every effort to secure their homes. Committee Chairperson Feingold reported that the Traffic Bureau is doing a fine job this month thanks to the efforts of Dennis McFadden and Patrolmen Makwinski and Huchko. The amount of summonses issued around the schools is a reflection that it's now a lot safer for our students....(inaudible)... to and rrom school. He reported a lot of progress in the Police Department. 24 DECEt1BER 19, 1996 PARKS & RECREATION: Committee Chairperson Bialowarczuk reported that they had the Christmas Tree Lighting two weeks or so ago and had a great turn out. The kids had a good time. The Recreation Commission did a nice job on it. A day or two following that someone set a garbage pail on fire and pushed it under the overhang of the Hot House. A week later, someone tried to pull the wires to the lighting on the Hot House. Yesterday, someone cut the wires to the lights on the tree. The guys in the Parks Department are short-handed. Mike Bucsak is working as the Superintendent now while Mr. Kolibas is away. They have other things that need to get done. There was another incident in Grant Avenue Park, someone used a car to try to kill geese with and they tore up the entire outfield of the park. It's terrible and it has to be stopped. There is a woman in the Hot House during the week until 8:00 P.M., some nights 7:00 P.M.. The incidents occur after she's gone. She and Willie have talked about it and they will try to alleviate the problem by having Police Officers in and out of the park at night. Standing Committees Con't. Committee Chairperson Bialowarczuk congratulated the winners of the Home Lighting Contest. In town this year there is an enormous amount of people putting lights on. This is the most she's seen in years. Beverly Hedesh did an excellent job. She wished everyone a happy, safe and healthy holiday and reported progress. PUBLIC WORKS: Committee Chairperson Vesey reported he had a death in the family and didn't spend that much time with Public Works. He reported progress. MUNICIPAL GARAGE SERVICES: Committee Chairperson Failace reported that they would like to have the cherry picker sent to Pennsylvania to see if it could be refurbished and what it would cost to do that. We have approximately 8,000 miles on it and that may be the way to go instead of spending the money to buy a new one. He noted that this is the first that he's heard about the park incidents and it's a shame. Beverly Hedesh spent a lot oftime and did a great job on the Recreation Committee. The last couple of years, the Council tried to enhance activities for the children. It's a shame that this kind of thing happens. Committee Chairperson Failace said that he thinks that we made a mistake tonight with this provisional. We should not have done that. Maybe we did open Pandora's Box. Instead of closing the box right away, we ought to go through it a little deeper and find out where we are. It might be a heck of a savings for the City of Carteret. He reported progress. DECEMBER 19, 1996 t1ayor Mayor Sica thanked Beverly Hedesh who did a great job on the Recreation Commission. He can sympathize with everyone abut the damage that was done to the lighting in the park, etc., etc. For many years he decorated his house with 15,000 lights and people came from miles around to see it. The unfortunate situation was two years in a row, people stole figurines and damaged things. It wasn't that he didn't want to continue to light his house up. He totally enjoyed that, but he was not going to allow that to continue to happen so he just eliminated doing the house. That's terrible, but if that's what's going to happen in the City of Carteret then we will have to look into stopping doing it. That's terrible when the majority of the people have to suffer for the sins of a few. He can't believe that someone could ride around killing the geese with their car and not one neighbor called up about it. Councilmember Bialowarczuk said that they were caught. They got stuck in the mud. The Mayor noted that we will make them and their parents and the insurance company for the car pay for the damage they did to it. He asked every citizen in Carteret to be on the look out for these kids that are doing these kinds of things. Let's start punishing them to the fullest extent of the law and then maybe we can still have these things. Aside from the work that people like Beverly Hedesh and Debbie Bialowarczuk do and the work that goes into putting these things on, people totally enjoy it. It's a shame when this happens. Let's really start putting an effort into trying to catch these culprits. SOPHIE CHEREPON said that today she smelled smoke. It wasn't from her house, but ffom outside. She reported it to the Police Dispatcher that there may be a fire on the turnpike or in West Carteret. It was overpowering. She called the Dispatcher again and was told that it was a transformer that was on fire. She took a ride and found out that it was coming from the glass company. She called the D.E.P. and Middlesex County. The Middlesex County Health Department came to her home an hour later and then went to check the smell. The County came back and reported that it was 30% pollution. Later, she returned with a from and said she was wrong about it. She said that she couldn't see the smoke and to call back in the morning, noting that it was not 30%. Mrs. Cherepon asked her how she deducted that and was told that she used her nose to monitor. She questioned if Middlesex County had meters to monitor and was told no. Mrs. Cherepon stated that she knows that they have meters and that she was going to the next Freeholder's Meeting and ask them what they are doing with our money. Borough Attorney Hedesh said that they have to have a Closed Session to discuss a grievance. RESOLUTION #96-362 was introduced by the Mayor and was referred to the Council for action.
