HomeMy Public PortalAbout84-008 (02-01-84)RESOLUTION N0. 84-8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO CONDUCT A HEARING CONCERNING A PUBLIC NUISANCE AT 121'23 LONG BEACH BOULEVARD, LYNWOOD, CALIFORNIA FOLLOWS: THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVES AS WHEREAS, Section Z1-17 of the City Code (hereinafter referred to as the "Code") of the City of Lynwood (hereinafter referred =to as the "City") provides that whenever the City Council of the City of Lynwood (hereinafter referred to as the "City Council") finds, based upon the recommendation of certain city officials, that any premises within the City may be maintained in a manner constituting a nuisance, the City Council shall by resolution declare its intent to conduct a public hearing to ascertain whether the same constitutes a public .nuisance the abatement of which is appropriate under the police power of the City; and WHEREAS, the City Building Inspector has determined that a building located at 12123 Long Beach Boulevard (Assessor's Parcel No. 6168-O11-036) in the City of Lynwood, whose owner is Roberto Nava, has been maintained in such a condition as to be detrimental to the public health, safety and general welfare of the community, is in such a state as to cause detrimental effect upon nearby property, is maintained in such a manner as to be materially detrimental to proximal properties and improvements, and is so out of harmony or conformity with the maintenance standards of adjacent properties as to cause substantial diminutionof the enjoyment, use, or property values of adjacent properties; NOW, THEREFORE, the City Council does hereby resolve, order and determine as follows: Section 1. The City Council hereby adheres to the recommendation of the City Building Inspector and declares its intent to conduct a public hearing concerning maintenance of the building•loca.ted at 12123 Long Beach Boulevard, Lynwood, California (Assessor's Parcel No. 6168-O11-036) as a public nuisance, the abatement of which is appropriate under the police powers of the City. Section 2. The aforementioned building is currently in a structurally unsound state, as evidenced by structural cracking, weakened joints, weakened walls, and in general unsound condition due to its age and fire damage. Section 3. The methods of abatement which will be considered at a subsequent hearing are comprised of rehabilitation, repair or demolition of the aforementioned building. Section 4. Said hearing shall be conducted on February 13, 1984 at the hour of 5:00 o'clock p. m., in the Council Chamber of City Hall, 11330 Bullis Road, Lynwood, California. Section 5. The City Clerk of the City of Lynwood is hereby ordered to serve upon Roberto Nava, the owner of the aforementioned building, a certified copy of this resolution, and a notice of the time and place of the hearing to be held before the City Council, by registered or certified mail, at Roberto Nova's last known address. Section 6. The City Clerk is hereby also ordered to cause to be con- spicuously posted at 12123 Long Beach Boulevard in the City of Lynwood, a certi- fied copy of this resolution and a notice ofthe time, and place of the hearing before the City Council concerning the subject property.
