Those in attendance were 'Mayor Minor C. Lile; Robert Becklund, Dr. Melvin Freeman, Juzmita Loder, Carson Wheeler and Jeanne 11'hiting, Councilpersons. Also in attendance were Lorraine Diede, Clerk/Treasurer, Officer Jarbeau of the Medina Police Department and residents in attendance were Dr. Kauth and Gary Foote. The meeting was called to order by the Mayor. The minutes of the previous council meetin s of December 13, 1977 and January 10, l9 were approved as presented, upon motion by Robert Becklund, seconded by Carson Wheeler and passed unaninously. Juanita Loder was sworn into office :for a 4--year term as councilwoman by the Clerk, Lorraine Diede. Police Re ort. Officer Jarbeau presented a report on the activities of the Medina Police Department for the month of January. Boat Patrol Resort. A report received. from King County for the month of December 1977 was reviewed. Gary Foote - property at 9228 X. E. 37th Place and 2roperty to the west - Lot 3, Top of Yarrow #2� Mr. Foote reviewed with the Council the proposed construction of a house to the west of his property. These properties are within Plat of Topr of Yarrow IQ which carries special covenants. Mr. Foote wished to inform the Council of the Tact t at the owners constructing the home west of his property were not following the covenants until his involvement and it appears now that the owners are willing to comply to his -satisfaction:—. Mr. Foote brought to the Council's attention another problem in that area - the draina e of surface water off the properties onto N.E.38th St. He related how the excavation dug or the foundation for Lot 3 was let out onto N.E. 38th St. He questioned whether it was handled properly - what involvement the Town Engineer plays in the control of surface water drainage - and becausn-of- 66 'uncompldted. construction of N. E. 38th St. - the inability to handle drainage water sufficiently. Discussion took place in regard to insufficient Town funding to bring this street up tc standard through the years - the hope that the Bond issue last November would have been approved by the voters, etc. Mr. Foote was advised that the Town has this matter before them and is looking for solutions at the earliest possible time. Presentation from "Citizen's S ecial. Finance Committee" for financial. support to prevent propose _1NOAA development at Sand Point. A letter was read soliciting finds to assist in legal pursuits regarding the proposed NOAA development at Sand Point. 'The minutes of February 3, 1978 meeting held by a group of residents bordering the -above-mentioned street in regard to an "Underground Utility Plan";were presented to.1the:Council. Discussion took place. It was acknowledged that approval of the Town would --be by means of a request for a permit through our Town Engineer and. Building Official, Allan Newbill. Lorraine Diede stated she had obtained answersto the questions asked in Paragraph 93 of Page 2 of the minutes presented. 1. What.lega.l;steps are to be taken, if any? Our attorney pointed out that every_.pr.operty.-located: within•.the area to be served should be included in the plan Tt was also noted that a building permit from our Town Eng. F Bldg. Official be obtained. 2. Where would the Town tolerate the ditching? Allan Newbill advised that lines can be placed in the right of way but not .in the travelled portion. Dr. Kauth and the other residents were congratulated by the Mayor and Council for foresight of involving themselves in this plan. Status of proposal to make Points Drive East - one may east. Attention was addressed to a letter received from Carl Pollard regarding the injury received by his daughter by a car at N.H.34th St. and Points Drive around 9 A. M. the end of January 1978. he Mayor Lile referred to a letter/directed to the Council of the City of Kirkland proposing that the portion of Points Drive that lies within the Town of Yarrow Point and the Town of Clyde hill be utilized as a local access road only by blocking the west bound lane at the Town limits of Kirkland and Yarrow Point. The result would be that the service road that lies within the City of Kirkland be eastbound only. It was requested that this proposal be considered at the City of Kirkland's council meeting of February Gth. Mayor Lile stated that he and a number of residents of Points Drive East were in attendance and that the Council of Kirkland considered their request and stated that they wished to make a study of other alternatives on the matter and would advise as soon as that had been accomplished. Juanita Loder stated she is one of those people who would like to keep the road open and asked if there was any way we could put a tinie.counter on how many people are actually using that road to bypass the freeway. She pointed out that if cars went on the freeway and existed off at 92nd Avenue, thereby alleviating the problem an Points Drive east of 92nd, the problem would still occur on Points :Drive west of 92nd. Discussed how flyer stop pick=up.area..would.!.eventually. het! the:-childte'n•:off 'the street. Mrs. Loder. pointed otit different obstacles along Points Drive east that requited children walk on the travelled portion of the road. Discussion took place in regard to removing.those obstacles and placing lines on street for crossing locations. Presentation from Metro re"Areaw-ide Water ali Plan" and request for representa- tive from our Council Acknowledgement was made by Mayor, Council and Clerk of receipt of a letter from Neil Peterson, Executive Director of Metro, regarding their attempt to achieve a formal understanding and acceptance of the Areawide Water 2uality Plan by 7/1/78. They requested that the Council designate a member to work directly with their department to coordinate such acceptance with our 'Town. Dr. Freeman offered to be the Town's representative and Robert Becklund stated he would assist him. Letter from Dr. Bergner regarding 1978 Seattle KinE County Health Services Asieement. Dr. Bergner inquired into the status of said agreement and requested that the signed contract be forwarded to him as soon as possible. MayorLile stated that he would contact Mr. Rose, City Manager of Mercer Island, who has contacted us in regard to pursuing a revision in the method of determining charges for said services. of Letter from J. "I1iis matter will be further pursued upon receipt of a manual prepared by UftS Company and further information from the Town of Hunts Point. Letter from Department of Planning __ King Counter - regarding f_I_� C. Development Block Grant Funds - - The letter referred to the fact that the Town of Yarrow Point has withdrawn from the Urban County Block Grant Consortium for the program year beginning 7/l/78. This letter asked whether or not Yarrow Point is interested in attempting to develop an eligible project to utilize the $9490.00 in unallocated population .funds from the first three program years, still being held in reserve. Robert Becklund stated he would contact Peter Shepherd and attempt to obtain a declaration of what these funds could be used for within our Town. Public Notice from Corps of Army Engineers re General Permit A general permit eliminates the need for processing permit annlicatons for activities which are substantially similar in nature, cause only miniimal, adverse cumulative Page 4 Council meeting minutes of February'14, 1978 proposed effect on the quality of the human environment. The/general permit for certain work in Lake Washington will require separate state and. local approvals and/or permits. After discussion, the Cotmcil requested that our Buildin Official and Engineer, Allan Newbill, advise the Council in writing of his opinion regarding the objections he may or -ma not have in re ard to the ro osed General Permit under Department of The Anry Public Notice #071-OYB-1-004141 Street Bond Issue Committee Report After discussion, it was determined that the committee report at the next -council meeting if we should resubmit the bond issue on streets and if so, at what election. Clerk's Report Lorraine Diede reported that Don Frederickson of our :insurance agency - Fred S. James and Co. - advised shortly after the last council meeting that he had obtained another $500,000.00 worth of -liability insurance for our Town - if council approved. Prior to this meeting Mr. Frederickson called and stated that the company had withdrawn their offer. Status of light standards on Yarrow Point side of Points Drive,.:. Puget Power has advised the Town office that the order for the light poles has been on order at Weyerhauser for sometime. They will pursue Status of Legal action on N. E.r36th St. Mr. Austin has advised that he has requested an extension of time on the filing of Appellant's Opening Brief - said extension to March 15th granted. State Unemployment Insurance Prozram All units of :local governments are required to become part of this program effective 1/1/78. There are 2 methodsof unemployment insurance payments.The Town may take their choice between Cl) Local Government Tax of 1.25% for 1978 of the gross amount of payroll paid quarterly or (2) Payment in lieu of contributions. After discussion, the council by motion determined that the Town of Yarrow Poing Would pay on the local government tax basis. C©iitract with the City of Medina for Police Protection for 1978 After review, this contract was approved, signed and forwarded to the City of Medina. Contract with_KinE Count for=waters atrol services for 1978 After review, this contract was approved, signed and forwarded to King County. Treasurer's Report The financial status of the Town of Yarrow Point was presented in report form to the Council.
