AUTHORIZING IMPLEMENTATION OF MERIT SYSTEM
BOARD ORDER. RE: DAVID CSIMBOK
WHEREAS, the Merit System Board, Department of Personnel, State of New Jersey
issued its final administrative action on June 15, 2001 regarding (the "Appellant"), In
the Matter of David Csimbok, DOP Docket No. 1997-5166, OAL Docket No. CSV
789-99; and
WHEREAS, pursuant to said action the Merit System Board accepted and adopted
the decision and recommendation of Administrative Law Judge Solomon A. Metzger
(ALI), who rendered his initial decision on October 24, 2000; and
WHEREAS, adopting the recommendation of the ALJ, the Merit System Board
ordered that the Appellant receive an appointment to the position of Police Sergeant
within 30 days of the Borough's receipt of said decision and that upon his successful
completion of a working test period, Appellant should receive a retroactive date of
appointment to October 16, 1997; and
WHEREAS, the Board additionally ordered that Appellant receive differential back
pay from October 16, 1997, to the date of appointment within 30 days of receipt of
said decision and awarded counsel fees to the Appellant; and
WHEREAS, the Governing Body has reviewed the decision and determined that it
is not in the Borough's best interest to expend additional funds to further appeal the
matter;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council that the
appropriate Borough Officials are hereby directed to take the necessary action to
implement the foregoing order of the Merit System Board.
