HomeMy Public PortalAbout09-09-1997PLANNING COMMISSION MINUTES - SEPTEMBER 9, 1997 PRESENT: JERRY BROST, CAROLYN SMITH, ANNE HEIDEMAN, SUSAN MACKAY, ELIZABETH WEIR, FRANK MIGNONE, BRUCE WORKMAN AND LENNY LEUER. KATHY COOK ARRIVED AT 7:44 P.M. ALSO PRESENT: PLANNING AND ZONING ADMINISTRATOR LOREN KOHNEN AND PLANNING AND ZONING ASSISTANT SANDIE LARSON. Chairperson Anne Heideman called the meeting to order at 7:37 p.m. 1. MINUTES OF AUGUST 12, 1997 MOVED BY FRANK MIGNONE AND SECONDED BY CAROLYN SMITH TO APPROVE THE MINUTES AS PRESENTED. MOTION CARRIED. 2. JODY CHANIN - 32 HAMEL ROAD - CONDITIONAL USE PERMIT FOR ANTIQUE STORE/OFFICE/STORAGE - PUBLIC HEARING - 7:38 P.M. Loren Kohnen read his memo to the planning commission. He said that Director of Public Works Jim Dillman said that the only way parking would work is to have 2 spaces in front of the building and park parallel to the building. He put up an overhead of the survey showing the parking and also an overhead showing the plans for the interior of the building. Lenny Leuer asked about the survey and wondered about the building to the north which appeared to be on the lot line. He wondered if this required any action by the attorney because of where the monuments are placed. Ed Chanin, said that he was a real estate attorney and because of the discrepancies in the surveys, they have gotten title opinion. He said that the original lot lines were established in the 1920's. Frank Mignone asked if both the house and this property were non -conforming. L. Kohnen said yes, the house because it is residential. There was discussion of non -conforming houses in the Hamel area. Anne Heideman said because the driveway serves the dwelling is it considered part of the dwelling so that the responsibility is theirs and not the Chanin building. 1 L. Kohnen said it is between the two owners. L. Leuer said that there is questions of easements, using the driveway, etc. There was continued discussion of lot lines, driveways, etc. A. Heideman said that she is concerned with the upkeep of the driveway. E. Chanin said that the applicant has no objection to fixing the driveway. Elizabeth Weir said that she is appalled with the amount of blacktop and wondered if there was any way to mitigate it and still keep the parking. Jody Chanin said that there were some flower boxes there now and she planned on more flowers. Susie Mackay asked if she planned on taking up any blacktop and putting in grass and Jody said no. E. Weir asked if the ring around the telephone pole where there were flowers could be made bigger. L. Kohnen said that is public property. A. Heideman said that if the back room was for furniture repair, volatile chemicals could be involved, glue, etc. and there is no exit or window there. L. Kohnen said there doesn't have to be. A. Heideman asked about the re -finishing and Loren said that it would not be done there. J. Chanin said that most of the re -finishing would be done at home and the final finish would be done at the shop and that there is a window on the west side in that room for ventilation. Carolyn Smith said that downtown Hamel could be very charming and what Jody is doing in a great improvement. MOVED BY SUSIE MACKAY AND SECONDED BY JERRY BROST TO RECOMMEND APPROVAL FOR THE CONDITIONAL USE PERMIT FOR JODY CHANIN AT 32 HAMEL ROAD FOR AN ANTIQUE SHOP/OFFICE/STORAGE WITH THE FOLLOWING CONDITIONS: 1. It is acknowledged that part of the building will be leased space for an office 2. All exterior lighting to be downcast 3. Building to meet fire and building codes 2 4. Parking area must be blacktopped and in good condition with surface to be approved by public works director. Blacktop to be extended onto private drive and also the part that is publicly owned. 5. Driveway location to be approved by Public Works 6. Building and grounds to be maintained in good condition 7. No outside speakers or ringers allowed 8. No outside storage of any kind 9. Two parking spaces in front of building are permitted but must be parallel with front of building 10.Any landscaping enhancements are encouraged to add to the impervious surfaces 11. All signage to meet city codes L. Leuer wanted to know if #3 triggered fire department review. L. Kohnen said no, that all commercial buildings are gone thru periodically and checked. C. Smith wanted to know if there would be an address on the building. J. Chanin said that the address sign is being painted and will be put back up on the building. MOTION PASSED Carolyn Smith said that she wanted to talk about the downtown Hamel area. She said that the setbacks for the urban commercial zone are not reasonable in the Hamel area. This could be a unique area and she would like to preserve the little city look. She said that it seems it would harm the area to force the setback, hardcover, etc. requirements. Elizabeth Weir said she supports what Carolyn has said. She said part of the charm is having residential and commercial together. Susie Mackay said maybe it would be possible to create a historic district. Loren Kohnen said parking is one thing that has to be watched. C. Smith said it would be nice if the church would offer their lot for parking. Mary Caldwell, realtor, said that there is a real demand in the Wayzata area for small offices. This just might be the place to send people for that use. They look for older homes for the use and this could be very unique. Everyone agreed Anne Heideman said that we could look at our heritage preservation ordinance. C. Smith said that it was critical to bring those affected by different ideas into the discussion. 3 3. COMPREHENSIVE PLAN Loren Kohnen said that there was a meeting this Friday with the Mayor and a representative from the Metropolitan Council and there will be discussion on how we should proceed with our revision process for the comprehensive plan. He stated that there are 8 areas to work on and that there should maybe be a committee to work on each area. There was discussion of what would take place. Committees were discussed. It was decided that each committee should include a city council member. Discussion for Friday's meeting: 1. Council members on committees 2. Public notification, mailing to every property owner 3. Public meeting and process 4. What the council is thinking on `hot' issues for this revision 5. Special concerns 6. Major priorities At the October planning commission meeting there will be discussion on ideas for a city wide mailing/survey concerning the comprehensive plan. MOVED BY KATHY COOK AND SECONDED BY CAROLYN SMITH TO REQUEST THAT THE PLANNING COMMISSION IS KEPT UP TO SPEED ON THE TREE ORDINANCE THAT IS BEING WORKED ON MOTION PASSED.
