RESOLUTION OF THE CITY COUNCIL OF THE 'CITY OF LYNWOOD
FINDING THAT THE CONTRACT FOR PUBLIC RIGHT-OF-WAY
PROJECT -- VARIOUS LOCATIONS CAN 8E MURE ECONOMICALLY
AND tFF1CIENTLY EFFECTED THROUGH INFOKMAL OPEN-MARKET

WHEREAS, Division 3 of the Lynwood Code provides that contracts for
public works projects in. the amount of Five Thousand Dollars ($5,000) or more
be contracted for and let to the lowest responsible bidder after notice,
unless the City Council, by resolution passed by not less than 4/5th vote of
its members, determines that such an acquisition may be more economically and
efficiently effected through the use of an alternative procedure; and
WHEREAS, on February 15, 1984 bids were sought anticipating a bid
price below $5,000; and
WHEREAS, on February 23, 1984 the lowest responsible bidder, Whitaker
Concrete Corporation, submitted a bid which was $155.01 above the informal
bidding limit; and
WHEREAS, the City Council desires to have the work completed by the
most cost effective procedure, with time being of the essence; and
WHEREAS, the formal bidding procedure is a more costly and time con-
suming.,procedure;
NOW, THEREFORE, the City Council of the City of Lynwood does hereby
find, determine, order and resolve as follows:

Section 1. The contract for the Public Right-of-Way Improvement
Project -- various locations can be more economically and efficiently effected
through informal open-market method.
Section 2. This resolution shall take effect immediately upon its
adoption.
PASSED, APPROVED and ADOPTED this 6th day of March 1984.
