ROLL CALL President Betsy Crowder called the meeting to order at 7:30 P.M. Members Present: Ginny Babbitt, Betsy Crowder, Wim de Wit, Nonette Hanko, Robert McKibbin, and Pete Siemens. Member Absent: Teena Henshaw. Personnel Present: Craig Britton, Jean Fiddes, Randy Anderson, John Escobar, Malcolm Smith, Del Woods, and Deborah Zucker. II. ORAL COMMUNICATIONS There were no oral communications. III. ADOPTION OF AGENDA J. Fiddes requested that the Proposed Option for Addition of Acronico Property to Long Ridge Open Space Preserve agenda item be considered later in the meeting when C. Britton arrived from Sacramento. B. Crowder stated that the agenda, as revised, was adopted by Board consensus. IV. ADOPTION OF CONSENT CALENDAR The following requests were made to remove items from the consent calendar: N. Hanko - Revised Claims 93-11; G. Babbitt - Solicitation of Bids for Rancho San Antonio Field Office Expansion. Motion: R. P. Siemens seconded the motion. The motion passed 6 to 0. V. BOARD BUSINESS A. Issuance of 1993 Certificates of Participation (Report R-93-74) M. Foster stated that the 1993-1994 budget adopted by the Board included the issuance of about $14.6 million of certificates to refinance the 1990 Certificates of Participation and to obtain $3 million additional land acquisition funds to meet 1993- 1994 land acquisition commitments. He recommended, based on the outcome of the state budget, that the Board approve an increase in the issuance of 1993 Certificates of Participation to $17.2 million, which would yield $5 million of new land acquisition funds. He stated that the present value savings on the refinancing portion of the issue would exceed $500,000 over the life of the certificates and that the District would only increase its debt service payments by $160,000 over the next four fiscal years. He introduced Doug Charchenko, Kidder, Peabody & Co., the underwriter for the transaction, and Rhett Currier of Orrick, Herrington and Sutcliffe, bond counsel for the transaction. Motion: N. Hanko moved that the Board adopt Resolution 93-24, a Resolution of the Board of Directors of the Midpeninsula Regional Open Space District Authorizing the Execution and Delivery of a Site Lease, a Project Lease, a Trust Agreement and a Certificates of Participation Purchase Contract Relating to the Midpeninsula Regional Open Space District Certificates of Participation (1993 Open Space Project), Approving a Preliminary Official Statement and an Official Statement for Such Certificates of Participation and Approving Certain Other Matters in Connection Therewith. R. McKibbin seconded the motion. The motion passed 6 to 0. B. Volunteer Trail Patrol Pro ruam (Report R-93-71) J. Escobar reported that the Volunteer Trail Patrol Program was one of the mitigation measures included in the adopted Trail Use Guidelines and Mitigation Measures. He introduced Joan Young, volunteer coordinator, who explained the purposes and the proposed implementation of the volunteer trail patrol. She stated that 30 patrol volunteers would be trained in September by District staff and that patrols would begin in October. She said that first aid training would be recommended but not required. Meeting 93-13 Page 3 Board discussion focused on the Boards support of the program, worker's compensation for volunteers, and provision of radios for volunteers. Peter Fournier, R.O.M.P., 3241 Greentree Way, San Jose, said that he was delighted with the District's decision to create a volunteer patrol, recommended helmet covers, rather than vests, to designate volunteer bicycle patrol members, and said that radio contact would be very important for volunteers. C. Solicitation of Bids for Rancho San Antonio Field Office Expansion (Report R-93-76) G. Babbitt asked the Budget Committee if the Board would receive a report on the District's budget and on the effect of the release of funds for the expansion. R. McKibbin stated that the expansion had already been approved for the 1993-1994 budget and that the hold had been put on the project pending the outcome of the state budget. He said the Budget Committee would be reporting to the Board on projects that had been placed on hold or initially not included in the budget. J. Fiddes said that a Budget Committee meeting was scheduled for July 28 at 6:00 P.M. Motion: G. Babbitt moved that the Board authorize staff to solicit competitive bids from independent contractors for expansion of the field office at Rancho San Antonio Open Space Preserve. P. Siemens seconded the motion. The motion passed 6 to 0. B. Crowder stated that the Board would consider Revised Claims before considering the report on the Proposed Option for Addition of Acronico Property. VI. CLAIMS N. Hanko asked for an itemization of claim number 4427 for Herbert Grench. J. Fiddes stated that it was for trips to Sacramento on May 12 and June 16 during the state budget negotiations. She said the expenses were for air fare, automobile expenses, parking, and non-local telephone expenses. Motion: N. Hanko moved that the Board approve Revised Claims 93-11. B. Crowder seconded the motion. The motion passed 6 to 0. VII. BOARD BUSINESS (continued D. Proposed Option for Addition of A r nico Pro rty to Long Ridge Open Space Preserve (Report R-93-77� D. Woods described the 179-acre property and showed its location between Long Ridge and Skyline Ridge Open Space Preserves on a wall map. He said that the i Meeting 93-13 Page 4 property encompassed the headwaters of Peters Creek. He showed slides that included the property's steep sandstone formations, waterfalls, forest, watershed, magnificent views, and wildlife habitat. He said that the District had been involved with rescue operations in the area and that the only trail work that had been done was some tree clearing to facilitate rescues. He stated that a trail through the property connecting Long Ridge and Skyline Ridge Open Space Preserves was unlikely because of the steepness of the terrain. n reported in the area were h less than 10 0 of the accidents e o J. Escobar stated that % p recreational climbing accidents. D. Woods said that the District's legal counsel would be involved in review of the signing program for the property. C. Britton stated that the option would give the District the right to purchase the property before December 31, 1994 for a purchase price of $690,000. He said that the option agreement required a payment, upon execution of the agreement, of $40,000, applicable to the purchase price. He said that an additional payment of $20,000 would be made by the District and $5,000 would be paid by insurance companies to Mark Budart, who had performed bulldozing work on the property during the period of his prior contingency agreement for the purchase of the property, and for which he was entitled to payment in settlement of his claim against the property owners. He stated that the total cost for the purchase, including net settlement costs, would be $710,000. R. McKibbin asked about the minor cross-complaint referred to in the report. C. Britton stated that it was a claim for real estate commissions for the prior purchase agreement between Mark Budart and the Acronicos. Motion: N. Hanko moved that the Board adopt Resolution 93-25, a Resolution of the Board of Directors of the Midpeninsula Regional Open Space District Approving and Authorizing Execution of Option Agreement, Authorizing Officer to Execute Memorandum of Agreement, and Authorizing Acting General Manager to Execute Any and All Other Documents Necessary or Appropriate to Closing of the Transaction (Long Ridge Open Space Preserve - Lands of Acronico). R. McKibbin seconded the motion. The motion passed 6 to 0. VIII. INFORMATIONAL REPORTS G. Babbitt proposed a review process by the Dog Committee for canine access to District preserves similar to the resource management review process. The Dog Committee agreed to begin the process by holding a public workshop on September 28, 1993 at 7:30 P.M. G. Babbitt stated that the place of the meeting would be determined and a notice Meeting 93-13 Page 5 i F would be included in the next District newsletter. D. Woods stated that people who had previously expressed interest in canine access, as well as others on the resource management mailing list, would be informed of upcoming planning activities for both resource management and canine access. B. Crowder stated that San Mateo County Supervisor Ruben Barrales would hold a meeting concerning Edgewood County Park on Wednesday, July 23. W. de Wit said that he was collecting signatures for the CALPAW initiative. C. Britton stated that the District settled the permanent easement for access to El Sereno at Overlook Drive for the former Stevens College property. He said that the District paid $500 in the settlement securing the District's patrol rights, and that the drive would not be for public use. He announced that a Rails-to-Trails conference was upcoming on September 29 and that the District was one of the conference hosts. G. Babbitt said she was interested in attending the conference. C. Britton reported that the San Mateo County Board of Supervisors would be considering the matter of creating a park in perpetuity at Edgewood County Park at its July 27 meeting, including a recommendation to grant Golden Gate National Recreation Area an easement over the property. C. Britton reported on his July 14 trip to Sacramento. He stated that signatures w r e e , being collected for the CALPAW initiative; that California Park and Recreation Society was not supporting the motor vehicle tax initiative that would benefit state and local parks and recreation districts. He noted that the initiative, however, was moving ahead with support from others. He proposed that the Board express special thanks in the form of loan of District photographs to Senator Rebecca Morgan and Assembly Members Byron Sher and Chuck Quackenbush for their support of the District in their state budget recommendations. He also recommended that District legislative counsel, Ralph Heim, be paid an additional $2,000 for the extra time he spent on lobbying activities for the District during the state budget deliberations. The Board concurred with his recommendations. M. Smith said that media training for the Board and some members of the staff would begin with a training session on July 15. R. Anderson reported that the Saratoga Planning Commission voted three to two in a recent meeting not to extend the city's sphere of influence. He reminded the Board that the Resource Management Committee should be formed as soon as possible in order that the process established at the last Board meeting stay on schedule. B. Crowder stated that she would be contacting Board members to determine who was interested in serving on the committee. Meeting 93-13 Page 6 J. Escobar reported that he attended the Mountain View City Council meeting on July 13 to hear its discussion about Deer Hollow Farm at Rancho San Antonio Open Space Preserve. He said that the meeting was adjourned before the item could be discussed. He summarized incidents on District preserves, including four bike accidents and one jogging accident. C. Britton reviewed the protocol for non-committee members of the Board attending noticed committee meetings as observers. IX. CLOSED SESSION C. Britton announced that a litigation matter to be discussed in Closed Session, M.R.O.S.D vs. Meyer, fell under Government Code Section 54956.9 (a). The Board recessed to Closed Session on litigation and personnel matters at 9:20 P.M. X. Joseph ' s Hill and Jones Road , I was almost seriously injured by a bicyclist . He came down that section of trail at a very fast speed and lost control . The accident was so close that his front tire touched my back. His attitude is what prompts this letter . He felt I should have heard him come up from behind me and I should walk single file down this trail (which in reality I was because the only other person on the trail was three feet ahead of me) . Needless to say I feel there should be some measures taken to insure the safety of everyone on this trail . My suggestions include: l . a posted speed limit. 2 .Require bicycli,13tS to purchase a permit to use the trail . I fully realize sug(,.estion #2 will be difficult to implement but the next walker or jogger may be seriously injured and some- thing should be done soon. It should be noted that the permit would be helpful in identifying those bicyclists who are not obeying the rules and the funds could be used to maintain the trail . It cannot be deny that the bicyclists do the most ecological harm to the trail . Your consideration in this matter is greatly appreciated ! Sincerely, Gail H. Ducot6 3180 Gleneeden Way San Jose, CA 95117 Dear Ms. Ducot& Thank you for your July 7, 1993 letter regarding bicyclists at St. Joseph's Hill Open Space Preserve. The District's Board of Directors reviewed your comments at our Regular Meeting last night. We are sorry you had an unfortunate experience, and are glad you were not injured. It is important for our ranger staff to know when incidents like this occur. We would appreciate it if you would call our Foothills Ranger Office at (415) 965-3264 and file a report with a ranger. Your suggestion to set a speed limit is timely. At last night's meeting, the Board adopted the District's revised land use regulations, which included a speed limit for bicyclists. We are also working with the Town of Los Gatos to open an alternative bicycle route at St. Joseph's Hill. The Board's Trail Use Committee has considered requiring permits for bicyclists. However, because of the difficulty in managing such a program, the committee decided against it. With the above measures and the District's continued efforts to educate the public about proper trail etiquette, we anticipate a decrease in trail-use conflicts. We hope your future visits to District preserves are pleasant. R. McKibbin seconded the motion. The motion passed 6 to 0. VI. BOARD BUSINESS A. Introduction to Revisions to Land Use Regulations Ordinance 83-1) (Report R-93- 681 J. Escobar stated that the primary purpose of the review and revision of the land use regulations was to implement the Board-adopted Trail Use Policies and Guidelines and that a secondary purpose was to update, clarify, and improve the existing land use regulations. He outlined the review process used and said that the land use regulations ordinance and bail schedule recommendation to the court would be presented for adoption at the Board's July 28 meeting. He said that the ordinance would become effective 30 days after its adoption and that publishing the ordinance in a local newspaper was required by law. J. Escobar highlighted the proposed regulation changes, including the proposed 15 miles per hour speed limit. He said that a numeric speed limit would be specific, would improve the District's ability to enforce speed regulations, and would educate the public about their speed on District lands. He emphasized the need for an enforceable speed law because excessive speed was one of the primary causes of accidents on District lands. J. Escobar stated that the ordinance requiring helmets, except in the area between Rancho San Antonio County Park and Rancho San Antonio Open Space Preserve, was supported by participants in the workshop. He stated that the trail use ordinance referring to walk-only zones was intended to apply to cyclists and not to runners and equestrians, and that the ordinance was rewritten under Section 400 to apply to cyclists. Christian Johnson, Responsible Open Space Mountain Peddlers (R.O.M.P.), 4100 The Woods Dr. Apt 1021, San Jose; Mike Weston, 1323 Bess Court, San Jose; Bill Lithgow, R.O.M.P., 129 Stratford Street, Redwood City; Bob Kain, R.O.M.P., 1411 San Tomas Aquino Road, San Jose; and Lori Fena, R.O.M.P., San Jose; Ray Alley, 3298 Kimber Ct. #145, San Jose, spoke in opposition to the speed limit re ulations and made various recommendations to the Board, especially the adoption g Y and testing of a basic speed law, instead of a 15 mph speed limit. Other comments Meeting 93-12 Page 3 included support for the requirement of helmet use by all cyclists on all District lands, the use of trail education stations to educate and poll trail users concerning trail use regulations, the comparison of the proposed District speed limit regulation with no speed regulations in Bureau of Land Management-managed wilderness areas, the use of bells on bicycles, a recommendation to prohibit the use of headphones on trails, trail repair assignments in lieu of fines for violations of basic speed regulations, the application of walk-only zones to runners as well as cyclists, and alienation of bicyclists by adopting a speed limit regulations. The Board questioned staff concerning the revisions and recommendations from the public. In response, J. Escobar stated that no accidents had been reported that involved the use of headphones and that no citations had ever been issued for violations of basic speed. He said that radar would eventually be used as a tool to enforce the 15 mph speed limit, that the goal of establishing a speed limit was to make clear what was expected on District trails, to the public and to the courts, and that there was no determination that trail damage related specifically to speed. T. Henshaw stated that she supported the adoption of a 15 mph speed limit for the safety of all trail users. She said that helmets should be strongly recommended, if not required, for all cyclists in Rancho San Antonio Open Space Preserve. P. Siemens recommended a regulation requiring that the person overtaking another trail user from behind yield to the person in front. J. Escobar stated that it would be more appropriately stated as trail use etiquette, and not as a bailable offense to be included in the ordinance. N. Hanko said that she strongly supported the helmet requirement, including the requirement that helmets be worn at Rancho San Antonio Open Space Preserve, and that if the District required helmets there, staff should work with Santa Clara County to establish a similar requirement in the county park as well. She asked if the number of accidents would be reduced by adopting a 15 mph speed limit and if public education would precede issuance of citations. J. Escobar said that less than 10% of accidents involved trail conflicts, that about 40 accidents per year involving severe injuries and requiring rescue operations were incurred by speeding cyclists, and that the regulation would be phased in with appropriate education, signs, and warnings before citations would be issued. C. Britton stated that, with Board approval, staff would work with Director Siemens to determine the appropriateness of including passing or overtaking in the trails etiquette brochure, and with Santa Clara County concerning a helmet requirement throughout Rancho San Antonio County Park and Open Space Preserve. Meeting 93-12 Page 4 i D. Woods stated that in his experience working with the Trail Use Committee, the issues of congestion, speed, and safety were repeatedly raised. He also stated that the issues for urban open space are very different than they were for wilderness areas managed by the National Park Service or by the Bureau of Land Management. P. Siemens asked if Board members were considered employees in Section 200.3 of the ordinance, or if the Board should be exempted separately and in addition to employees. R. McKibbin asked that grass skating be specifically prohibited by regulation. N. Hanko asked why the regulation prohibiting indecent exposure was eliminated. J. Escobar responded that the regulation referring to indecent exposure was included in the Penal Code. N. Hanko asked how patrol volunteers would be affected by Section 407.4. J. Escobar said that volunteers would not be responsible for enforcement of any District regulations. S. Norton asked the Board for confirmation that the additional revisions requested by the Board included specifically prohibiting grass skating and exempting the Board from the regulations. The Board agreed on the additional revisions. B. Options for Proceeding with the Sale of Surplus Property, Teague Hill Open Space Preserve (Report R-93-69) C. Britton reviewed staff findings on how to proceed with the sale of the surplus property. He stated that he and R. Anderson met with the Town of Woodside planning director to establish a reliable development density for building on the surplus parcels at Pinto Drive and Summit Springs Road. His recommendation to make the property more desirable for purchase from the District was to first establish its development density. He said that a subsequent action by the District would be to obtain a tentative map for development of the parcels but that he did not recommend that the District undertake the task at this time. C. Britton stated that he and R. Anderson would propose that the District attempt to auction the property once again instead of agreeing to list the property for sale with a real estate broker. He said that the marketing technique was not the reason for the failure to sell the property at the first auction in April, and that improved real estate market conditions and an assurance to prospective bidders of the development density would increase the probability of a sale at auction. He also recommended that a $50,000 deposit be made fully or near-fully refundable. r I Meeting 93-12 Page 5 P. Siemens recommended that the District consider the possibility of working with a developer to subdivide the parcels and obtain a tentative map and that a cooperative agreement could be made that would not require that the District pay the developer for participation in obtaining the tentative map until the property was sold. R. Anderson stated that joint ventures between developers and public agencies were not unusual but that they were often complex and risky. Motion: R. McKibbin moved that the Board accept the report and authorize the Acting General Manager to work with the Town of Woodside to establish a density of six lots, while preserving the maximum amount of public open space, to be followed by a new offering of the property at public auction. Anderson reviewed the background for the development of a carefully structured process for formulating and adopting resource management policies. Motion: R. Hanko remarked that she enthusiastically supported the purchase of the 4.11-acre parcel situated above the Rogue Valley Trail as an addition to Rancho San Antonio Open Space Preserve. Motion: T. Henshaw moved that the Board adopt Resolution 93-22, a Resolution of the Board of Directors of the Midpeninsula Regional Open Space District Authorizing Acceptance of Purchase Agreement - Bargain Sale, Authorizing Officer to Execute Certificate of Acceptance of Grant to District, and Authorizing Acting General Manager to Execute Any and All Other Documents Necessary or Appropriate to Closing of the Meeting 93-12 Page 6 Transaction (Rancho San Antonio Open Space Preserve - Lands of Peninsula Open Space Trust); that the Board tentatively adopt the Preliminary Use and Management Plan recommendations contained in the report, including naming the Peninsula Open Space Trust property as an addition to Rancho San Antonio Open Space Preserve, and indicate its intention to dedicate the property as public open space. P. Siemens seconded the motion. The motion passed 6 to 0. E. Approval of License Agreement for Native Plant Landscaping and Irrigation System on Monte Bello Open Space Preserve (Report R-93-66) N. Hanko stated that the improvements included in the agreement would benefit the District by beautifying the environment at Monte Bello Open Space Preserve as well as benefitting Mr. & Mrs. Calvin. Hanko moved that the Board authorize the Acting General Manager to execute the License Agreement for Noel and Karen Calvin to install and maintain an irrigation system, and plant and maintain native species of trees and shrubs for the purpose of visually screening the City of Palo Alto water tank located on Monte Bello Road. R. McKibbin seconded the motion. The motion passed 6 to 0. VII. INFORMATIONAL REPORTS R. Anderson reported on the meeting concerning the San Francisco watershed held on June 14. He said that a group wanting to preserve San Francisco watershed lands raised concerns about the effect of the ridge trail on the watershed lands. P. Siemens said that he and C. Britton met with Congressman Norman Mineta, who expressed his support of the cleanup at Mt. Umunhum by the Army Corps of Engineers and the purchase of the Phleger property and its addition to the Golden Gate National Recreation Area. C. Britton stated that the House Appropriations Committee had approved approximately $5.25 million to fund the purchase of the Phleger property this year, and has recommended funding the remainder of the project next fiscal year. T. Henshaw reported that she, M. Smith, and J. Fiddes attended the dedication of the City of Sunnyvale's Baylands Park. C. Britton stated that he would update individual Board members on the current State i I Meeting 93-12 Page 7 budget information. He reported that San Mateo County was interested in giving the , District and the Golden Gate National Recreation Area a restrictive easement at Edgewood Park that would preclude golf course use. He said that an amendment to the joint powers agreement would be presented to the Board after the San Mateo County Board of Supervisors had considered the matter. M. Smith reported on his attendance with J. Fiddes, T. Henshaw, W. deWit, and P. Siemens at a funding workshop held by Trust for Public Land. He said that KBAY radio had broadcast a free speech message delivered by T. Henshaw urging listeners to call state legislators about the District's funding as it related to the state budget. R. Anderson said that a meeting was scheduled for Tuesday, July 7 at 7:30 p.m. with the Golden Gate National Recreation Area at the San Mateo City Council Chambers. He said the meeting was concerning the widening of Highway 92. W. deWit said that he would attend the meeting. J. Escobar informed the Board that the Fremont Older House tours would be on Sunday, June 27. J. Escobar's summary of incidents included three solo bicycle accidents, two hiker injury accidents, and an auto burglary. VIII. REVISED CLAIMS G. Revisions to Land Use Regulations (Ordinance 83-1) ACTING E L MANAGER'S RECOMMENDA Adopt the attached Ordinance 93-1, Regulations for Use of Midpeninsula Regional Open Space District Lands. BACKGROUND At your June 23, 1993 meeting, staff presented the proposed changes to the District's current land use regulations. Staff has revised the draft as requested by the Board. Staff has also made some other minor changes, which are outlined in this report. The adoption of the attached ordinance will complete the land use regulations revision process. Bail schedule recommendations are addressed as a separate agenda item. DISCUSSION Since your June 23, 1993 meeting, staff made the following changes to the draft. These revisions were not formally requested by the Board. SECTION 200.3 This section was modified to exempt only District employees and officials from District land use regulations. Lessees, contractors, and consultants are now addressed in the added Section 200.4, which is more restrictive. SECTION 701.1 The original draft of this section combined both "dogs prohibited" and "leash required" into a single regulation. This section has been divided to permit a separate bail for each regulation. SECTION 806 The language of the two subsections contained in this section have been combined into a single regulation. If you adopt the attached Ordinance 93-1 at your July 28, 1993 meeting, the regulations will become effective September 1, 1993, because publication of the ordinance in a newspaper of general circulation is required within the next 30 days. The Board of Directors of the Midpeninsula Regional Open Space District does hereby adopt the regulations contained in the document captioned "Regulations for Use of Midpeninsula Regional Open Space District Lands," a copy of which is affixed hereto as an exhibit and by reference made a part hereof. Section 3. A copy of this Ordinance including said exhibit, shall be published at least once in a newspaper of general circulation printed, published, and circulated in the District and be effective from and after September 1, 1993. i I i REGULATIONS FOR USE OF MIDPENINSULA REGIONAL OPEN SPACE DISTRICT LANDS CHAPTER L DEFINITIONS I SECTION 100. TITLE. The following regulations shall be known as "Regulations for Use of Midpeninsula Regional Open Space District Lands" and may be referred to as "land use regulations." SECTION 101. PURPOSE. These regulations are adopted to provide responsible stewardship for District Lands, to establish orderly use, and to maintain a natural and quiet environment for persons on the lands. They are established according to the Basic Policy of the Board of Directors of Midpeninsula Regional Open Space District, adopted March 27, 1974, that "The District will follow a land management policy that provides proper care of open space land, allowing public access appropriate to the nature of the land and consistent with ecological values." SECTION 102. DEFINITIONS. Unless the context otherwise requires, the following definitions shall govern the construction and interpretation of these regulations. SECTION 103. DISTRICT. DISTRICT LANDS DEFINED. "District" means the Midpeninsula Regional Open Space District. The term "District Lands" includes all lands, structures, improvements, and waters owned, controlled, or managed by Midpeninsula Regional Open Space District. SECTION 104. PERSON DEFINED. "Person" means any individual, firm, corporation, club, municipality, district, or public agency, and all associations or combinations of persons whenever acting for themselves or by any agent, servant, or employee. SECTION 105. PERMIT OR PERMISSION DEFINED. Unless otherwise expressly provided herein, "permit" or "permission" means permission, granted in writing by the general manager or an authorized representative of Midpeninsula a Regional Open Space District. SECTION 106. BOARD DEFINED. "Board" means the Board of Directors of Midpeninsula Regional Open Space District. SECTION 107. HEADINGS AND DIVISIONS. Headings and divisions are for convenience only, and shall not be considered in the interpretation of this Ordinance, and shall not in any way affect the conduct or activities covered by other sections of this Ordinance. CHAPTER 11. REGULATIONS SECTION 200. GENERAL REQULATIONS. District Lands shall be open and accessible to all persons, except as may be provided by resolution, regulation, or rule of the Board or by individual site use and management plans adopted by the Board. 200.1 The Board may, by resolution, regulation, or rule*, provide for a system of permits and the issuance thereof. It may by such system require permits for the use of certain lands, exempt certain lands or classifications of permits therefrom, and establish a system of fees and other policies in connection with the administration of a permit system. 200.2 Any person entering upon District Lands shall abide by the rules and regulations of the District, the regulations or provisions of any sign or posted notice, the conditions of any permit, the lawful order or other instruction of any District ranger or police officer appointed by the Board, the laws of the State of California, and all applicable county and other local ordinances. 200.3 The provisions of this Ordinance shall not apply to employees and officials of the District acting within the scope of their authorized duties. However, District employees and officials shall abide by the laws of the State of California and all applicable county, and other local ordinances. 200.4 All District lessees, contractors, and consultants shall abide by all provisions of this Ordinance unless the provision(s) conflicts with a written contract or agreement with the District. When a conflict occurs the conditions of the written contract or agreement shall take precedence. However, lessees, contractors, and consultants shall abide by the laws of the State of California and all applicable county, and other local ordinances. SECTION 201. SPECIAL REGULATIONS. Special regulations or requirements do not preclude the application of general regulations unless expressly indicated. CHAPTER M. GENERAL RULES SECTION 300. AUTHORITY. All sections of this Ordinance are adopted pursuant to Sections 5541, 5558, and 5559 of the Public Resources Code of the State of California, and apply to all District Lands. A title, where used, does not limit the language of a section. 2 SECTION 301. VIOLATIONS OF ORDINANCE A MISDEMEANOR OR INFRACTION. Any violation of this Ordinance or of any rule or regulation adopted by the District is, at the discretion of the prosecutor or the court, a misdemeanor or infraction. (Public Resources Code, Section 5560). SECTION 302. SEVERABILITY. If any chapter, section, subsection, paragraph, subparagraph, sentence, or clause of this Ordinance is, for any reason, held to be invalid or unconstitutional such inva lidity ty or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The Board of Directors declares that this Ordinance, and each chapter, section, subsection, paragraph, sentence, and clause thereof, would have been adopted regardless of such possible finding of invalidity or unconstitutionality and, to that end, the provisions of this Ordinance are hereby declared to be severable. SECTION 303. AMENDMENT OR REPEAL. When a section, rule, or regulation is amended or repealed, acts and commissions occurring before the amendment or repeal may be prosecuted as though such section, rule, or regulation had not been amended or repealed. SECTION 304. PUBLICATION. This Ordinance shall be published once, within 30 days after adoption, in a newspaper of general circulation printed, published, and circulated in the District and shall be effective from and after September 1, 1993. i CHAPTER IV. PRESERVE USES - GENERAL SECTION 400. CAMPING. 400.1 General. No person shall erect or use a tent or shelter of any kind, arrange bedding, or prepare food in such aw P P ay that will enable a person to remain after closing hours,g u s, except b written pe rmit m P Y Pe designated areas. I 400.2 Juvenile. No juvenile shall camp on any District Lands, except when: a) accompanied by a parent or guardian; b) part of a group supervised by at least one adult responsible for each ten or fewer juveniles; c) the juvenile is an emancipated minor. 400.3 Definition. A juvenile is defined as any person under the age of 18 years. 3 SECTION 401. SWIMMING. ............. 401.1 General. No person shall swim, wade, or engage in any water-contact activity in any water areas of the District except in designated areas. 401.2 Definition. "Water-contact activity" is defined as an activity in which the body of a Y Y Y person comes into physical contact with water areas, including, but not limited to swimming, wading, aqua-planing, paddle boarding, skin diving, and water skiing. It does not include boating or fishing. 401.3 Definition. "Water areas of the District" is defined as all water areas on District Lands, including, but not limited to, natural and artificial swimming pools, reservoirs, ponds, lakes, creeks, streams, bays, tidal areas, and flood control channels. SECTION 402. BOATING. I 402.1 General. No person shall place, or attempt to place, a boat, kayak, rubber raft, or other vessel of any description in the water of reservoirs, lakes, streams, or other water areas owned, managed, or controlled by the District, except as expressly allowed by permit or rule or regulation of the District. SECTION 403. FIREARMS TRAPS WEAPONS AND DANGEROUS DEVICES. 403.1 General. No person shall carry, possess, set, leave or deposit, fire or discharge, or cause to be fired or discharged, across, in, on, or into any portion of District Lands j any weapon, gun or firearm, spear, missile, bow and arrow, cross bow, sling shot, trap or hunting device, air or gas weapon, paint ball gun, ammunition, throwing knife or axe, martial arts throwing device, or any other weapon or device capable of injuring or killing any person or animal, or damaging property or natural resource. 403.2 Exceptions. This section shall not apply to: a) the possession of unloaded firearms or dangerous weapons on public roads solely for the purpose of transporting such firearms or dangerous weapons through District Lands for lawful purposes; b) the possession of firearms or other dangerous weapons at a place of residence or business located on District Lands by a person in lawful possession of the residence or business; c) the possession and use granted by permit for resource management or educational purposes. SECTION 404. FIRES. 404.1 General. No person shall light, build, maintain, or attempt to light, build, or maintain, a fire of any nature on District Lands, except in permanent fixed barbecues, camp stoves or fireplaces established by the District. A fire shall include, but not be 4 limited to, a. campfire, ground fire, warming fire, _.gnal fire, charcoal fire, camp stove, gas lantern, punk, candle, smudge stick, flare, fuse, or any other incendiary device. This shall not apply to the permitted use of gas camp stoves or gas lanterns when used in designated camping areas. 404.2 Smoking. No person shall smoke on District Lands, except in designated areas. SECTION 405. SANITATION. 405.1 Disposal of Effluent. No person shall deposit waste water, sewage or effluent from sinks, portable toilets, or other fixtures upon or into the ground or water. 405.2 Use of Facilities. No person shall deposit any waste in or on any portion of any restroom or other structure except into fixtures provided for that purpose. 405.3 Protection of Facilities. No person shall place any bottle, can, cloth, rag, metal, wood, paper, stone, or other substances in any fixture in such a manner as would interfere with the normal operation of such fixture. 405.4 Public View. No person shall defecate or urinate in public view. SECTION 406. METAL DETECTORS. 406.1 General. No person shall use a metal detector or similar device on District Lands, except as provided in subsection 702.5. SECTION 407. DISTURBING THE PEACE. 407.1 Obstructing; Free Passage. No person shall by force, threat, intimidation, or by any unlawful signing, fencing or enclosing, or any other unlawful means, prevent or obstruct any person from peacefully entering any property of the District, or preventing or obstructing free passage or transit over or through any lands of the District. 407.2 Intimidation. No person shall engage in behavior or speech that provokes a breach of the peace or disrupts, alarms, disturbs, intimidates, or unreasonably interferes with others in the normal, safe use of District Lands or facilities. 407.3 Noise. No person shall play or operate any sound or energy amplification devices, including radios, television sets, public address systems, musical instruments, or similar devices in such a way as to be audible beyond 100 feet of such device or musical instrument, or in such a manner as to disturb the quiet of District Lands and facilities, without prior written permission. 407.4 Lawful Order. No person shall disobey, ignore, or in any manner fail to comply with any request, direction, or order given by any ranger or other employee charged with the control, management, or protection of District property or resources when such request, direction or order is given in the lawful performance of his or her duties. 5 SECTION 408. ASSEMBLY. No person or group shall conduct a meeting, rally, or similar event on District Lands without first obtaining a permit for the use of the specific areas or ' facilities involved. No such permit shall be granted if it is found that the time, place, and/or size of the meeting, rally, or similar event will disrupt or unreasonably interfere with the normal use, operation, or management of the site or facility, or have an adverse impact on the ecological or historical characteristics of any District Lands. 408.1 Permits. No person shall hold, conduct, organize, or take part in any group activity or event on Dis trict Lands without written permission when the activity or event: a) is advertised or noticed in any publication, poster, or flyer; or b) requests or requires a fee be paid for participation; or c) may be attended by 20 or more people. SECTION 409. MISCELLANEOUS DANGEROUS ACTIVITIES. 409.1 Fireworks. No person shall possess, give, sell, discharge, set off, or cause to be discharged, on or into any portion of District Lands any firecrackers, missiles, rockets, fireworks, or explosives. i 409.2 Harmful Substances. No person shall possess, place, or apply any substance on District Lands harmful to any person, property, wildlife, or vegetation. 409.3 Golf. No person shall drive, chip, or in any other manner play or practice golf, or hit I golf balls on, over, or into District Lands. 409.4 Model Craft. No person shall operate any model airplanes, boats, automobiles, or other model craft of any kind or description on, over, or into any portion of District Lands, except by written permit in designated areas. 409.5 Human Flight. No person shall hang-glide, parachute, parasail or engage in any Y human flight on, over, or into District Lands, except by written permit in designated areas. 409.6 Skating. No person shall rollerskate, in-line skate, grass skate, or operate a self- propelled or motorized skate board or other similar device on District Lands. 409.7 Reckless or Negligent Activity. No person shall engage in any recreational pursuit or activity, or operate any device that recklessly or negligently endangers the safety of any person, or property, or interferes with visitor activities. SECTION 410. ALCOHOLIC BEVERAGES. 410.1 General. No person shall possess or consume alcoholic beverages except beer and wine, and only as part of a picnic meal. 6 410.2 Designated . a. No person shall possess or conSL__,t alcoholic beverages in an area that has been declared by the general manager or an authorized representative to be a prohibited area. SECTION 411. SIGNS. 411.1 Defacement. No person shall remove, deface, change, mark, or otherwise alter any sign duly erected or posted on District Lands. 411.2 Unauthorized Signs. No person shall post or fasten any notice, including but not limited to, any bill, advertisement, directional or informational sign, or inscription whatsoever on any tree, fence, building, monument, or other property on District Lands, without written permission. CHAPTER V. PRESERVE USES - RIDINGMIKING TRAILS SECTION 500. RIDINGMIKING TRAILS. 500.1 Trail Use Speed Limit. The maximum speed for all trail uses is 15 miles per hour, unless otherwise posted; however, speeds shall be reduced as conditions warrant. Bicyclists and equestrians are required to slow to 5 miles per hour when passing others or approaching blind turns. In no case shall a person operate a bicycle, or ride a horse or other such animal at a speed greater than is reasonable, prudent, or safe. 500.2 One-way Trails. NO person shall operate a bicycle or similar device, or ride or lead a saddle horse, pony, mule, or other such animal on a one-way trail in a direction of travel designated or signed to prohibit such use. 500.3 Gates. Any person opening a gate shall close the gate. SECTION 501. SADDLE ANIMALS. 501.1 Closed Areas. No person shall ride, drive, or lead a saddle or pack horse, pony, mule, or other animal in any area designated or signed to restrict such use. Saddle or pack horses, ponies, mules, or any other animals must stay on designated trails, roadways, and cultivated firebreaks. 501.2 Unsafe Use. No person shall ride, drive, or lead any saddle or pack animal in a reckless or negligent manner so as to endanger public property, or the life, limb, or property of any person or animal. No person shall allow his or her saddle or pack animal to stand unattended or insecurely tied. 7 501.3 Carts and Wagons. No person shall have or allow a cart, wagon, or similar device attached to a horse, mule, donkey, or other animal on District Lands without a written permit. SECTION 502. BICYCLES. 502.1 Closed Areas. No person shall possess or operate a bicycle or similar device on District Lands in areas designated or signed to restrict such activity. Bicycles must stay on designated trails and roadways. 502.2 Unsafe Operation. No person shall operate a bicycle in a reckless or negligent manner so as to endanger public property, or the life, limb, or property of any person or animal. 502.3 Helmets. No person shall operate a bicycle or similar device on District Lands without wearing an A.N.S.I. or Snell-approved helmet for head protection, with the exception of the trails open to bicycles east of Deer Hollow Farm at Rancho San Antonio Open Space Preserve. 502.4 Walk-Only Zones. No person shall ride a bicycle on a section of trail designated or signed as a walk-only zone. Any person may dismount and walk a bicycle through a walk-only zone. SECTION 503. TRESPASS. The following acts, among others, are declared to be unlawful by Section 602 of the Penal Code of California. 503.1 Destruction of Private Property. No person shall willfully open, tear down, or otherwise destroy any fence on the enclosed land of another, or open any gate, bar, or fence of another and willfully leave it open without the written permission of the owner, or maliciously tear down, mutilate, or destroy any sign, signboard, or other notice forbidding shooting on private property. 503.2 Private Property Rights. No person shall enter any lands, whether unenclosed or enclosed by a fence, for the purpose of injuring any property or property rights, or with the intention of interfering with, obstructing, or injuring any lawful business or occupation carried on by the owner of such land, his or her agent or by the person in lawful possession. 503.3 Entering Posted Lands. No person shall enter any lands under cultivation or enclosed by a fence, belonging to, or occupied by another, or enter any lands where signs forbidding trespass are displayed at intervals not less than three to the mile along all exterior boundaries and at all roads and trails entering such lands, without the'written permission of the owner of such land, his or her agent, or of the person in lawful possession, and no person shall: a) refuse or fail to leave land, real property, or structures belonging to or lawfully occupied by another and not open to the general public, upon being requested to leave by the owner, his or her agent, or the person in lawful possession thereof; 8 r- b) tear L ,n, mutilate, or destroy any sign, signooard, or notice forbidding trespass or hunting on such lands; or c) remove, injure, unlock, or tamper with any lock or any gate on or leading into such lands; or d) discharge any firearm. CHAPTER VI. PRESERVE USES - COMMERCIAL/REVENUE SECTION 600. SOLICITING. 600.1 General. No person shall solicit, sell, hawk, or attempt to solicit, sell, or hawk, or otherwise peddle any goods, wares, merchandise, liquids, edibles for human consumption, or distribute commercial circulars, pamphlets, or flyers on District Lands except by written permission. SECTION 601. GRAZING. 601.1 General. No person shall allow cattle, sheep, goats, or any animal to graze, browse, or feed on District Lands except with written permission. SECTION 602. HARVESTING AND PLANTING. 602.1 General. No person shall plant, cultivate, harvest, or attempt to plant, cultivate, or harvest any plant or agricultural crop on District Lands except with written permission. SECTION 603. COMMERCIAL FILMING. 603.1 General. No person shall operate a still, motion picture, video, or other camera for commercial purposes on District Lands except pursuant to a permit authorizing such activity. This section shall not apply to the commercial operation of cameras as part of the bona fide reporting of news. 9 i i CHAPTER VII. PRESERVE FEATURES - PROTECTION SECTION 700. HUNTING AND FISHING. 700.1 Hunting. No person shall hunt, pursue, molest, disturb, injure, trap, take, net, poison, or harm any animal, living or dead, or remove, destroy, or in any manner disturb the natural habitat of any animal, except by permit. 700.2 Fis . No person shall take, net, molest, disturb, injure, poison, or harm any fish in lakes, ponds, reservoirs, water areas, portions of San Francisco Bay, or streams located in any District preserve except in areas declared by the District to be permitted fishing areas, where state laws regulate the taking of game fish. SECTION 701. ANIMALS. 701.1 Dogs. No person shall allow or have a dog on District Lands except in those areas designated by the District. This subsection shall not apply to: a) guide and service dogs under physical control, specifically licensed to assist the blind, deaf, or disabled; b) use authorized by written permit. 701.2 No person shall allow or have a dog within a designated area, unless the dog is at all times under control on a leash not to exceed 6 feet. 701.3 Nuisance Dogs. No person shall allow or have on District Lands a dog that is threatening or a nuisance to people, other animals, or property. This includes, but is not limited to growling, barking, baring of teeth, or challenging in any manner, people, animals, or property. 701.4 Disturbance or injury to Wildlife. No person shall allow a dog, cat, or domesticated animal, even if leashed, to disturb, chase, molest, injure, or take any kind of native wildlife, whether living or dead, or remove, destroy, or in any manner disturb the natural habitat of any animal on District Lands. 701.5 Horses and Livestock. No person shall keep or raise cattle, horses, sheep, or other livestock on District Lands, unless pursuant to a lease, license, or other entitlement of use granted by the District. 701.6 Other Pets. No person shall allow or have any pet, domesticated animal, or other living creature on District Lands, unless specifically permitted by another section of these regulations. 10 701.7 Removal of �imal Excrement. No person respoi. ie for an animal shall allow its excrement or feces to remain in an area if it poses a health hazard, a public nuisance, or is in an area posted requiring its removal. 701.8 Abandoned Animals. No person shall abandon or release a dog, cat, fish, fowl, or any other living creature, wild or domestic, on District Lands without written permission. SECTION 702. NATURAL AND CULTURAL RESOURCES 702.1 Plants. No person shall damage, injure, take, place, plant, collect, or remove any plant, tree, or portion thereof, whether living or dead, including, but not limited to flowers, mushrooms, bushes, vines, grass, cones, and deadwood located on District Lands. 702.2 Possession of Gathered Wood Prohibited. No person shall transport or possess a tree or unmilled wood on District Lands without satisfactory evidence of lawful acquisition, such as a sales receipt or written authorization from the owner of the land from which the tree or wood was acquired. 702.3 Geological Features. No person shall damage, injure, take, collect, remove, or attempt to damage, injure, take, collect, or remove earth, rocks, sand, gravel, fossils, minerals, features of caves, or any article or artifact of geological interest or value located on District Lands. 702.4 Archeological Features. No person shall damage, injure, take, collect, remove, or attempt to damage, injure, take, collect, or remove any object of paleontological, archeological, or historical interest located on District Lands. 702.5 Special Permission. Special permission (Section 105) may be granted to remove, treat, disturb, or otherwise affect plants, animals, or geological, historical, archeological, or paleontological materials for research, interpretive, educational, or operational purposes. SECTION 703. VANDALISM AND UNLAWFUL ENCROACHMENT. 703.1 Vandalism. No person shall cut, carve, deface, write, paint, mark, or alter any natural feature, or any fence, wall, building, monument, or other property on District Lands. 703.2 Unlawful Construction. No person shall erect construct install lace an P , , or P Y structure building, shed fence trail equipment, material sign,, eq pbanner, or apparatus of any type or for any purpose on, below, over, or across a preserve except by written permission, specifying in detail the work to be done and the conditions to be fulfilled pursuant to the terms of such authorization. 703.3 Unlawful Maintenance. No person shall perform, or cause any mowing, trimming, cutting, grooming, or spraying of District Lands or perform any such grounds maintenance for any purpose except by written permission. 11 � i CHAPTER VM. DISTRICT LANDS OPERATIONS - GENERAL SEC TION 800. LITTERING. 800.1 Littering or Dumninv. No person shall litter or cause to be litter cause t littered, or dump o be dumped � or i ped any material or waste matter in or upon any District Lands. It shall be unlawful to place, deposit, or dump, or cause to be placed, deposited or dumped, any rocks, dirt, or fill material in or upon any District Lands without a Permit authorizing such activity. 800•2 Definition. Littering is defined as the willful or negligent throwing, dropping, placing, or depositing of any waste matter on District Lands in other than appropriate storage containers or areas designated for such purposes. PARKINQ. 801.1 Rest___ric_�. No person shall park a mo tor or an vehicle, or when in compliance with the directions of a peaces officer, rain emergency or cy District employee, in any of the followinglaces: ranger, P a) In areas where prohibited by "NO PARKING" signs b) On any fire trail c) On any equestrian or hiking trail d) In such a place or manner as would block or obstruct any gate, entrance, or exit e) In such a place or manner as to take up more than one marked parking space in any authorized parking area f) In such a place or manner as to block or obstruct the free flow of traffic g) Within 15 feet of a fire hydrant h) Adjacent to any curb painted red i) On any District Lands after sundown except pursuant to a written permit j) In areas signed for permit parking on District Lands without a written permit k) In any other place on District Lands not designated by the District as an authorized area 12 SECTION 802, OPERATION OF MOTOR VEHICLES: OFF-ROAD VEHICLES. 802.1 General. No person shall operate, propel, or leave standing a motor vehicle on District Lands. Motor vehicle includes, but is not limited to, motorcycles, off-road vehicles, "dirt bikes," and similar vehicles. 802.2 Exceptions. This section shall not apply to: a) emergency vehicles operated within the scope of official use; b) roads, trails, or paths, which may from time to time be set aside and posted by the District for the use of specifically designated vehicles; c) roads and parking areas open to the public during regular open hours. SECTION 803. SPEED LIMITS. 803.1 General. No person shall drive or operate a vehicle on District P Lands at as peed greater than the posted speed limit or than is reasonable or prudent, having due regard for traffic and road conditions. In no event shall a vehicle be driven at a speed which endangers the safety of persons, property, or wildlife. SECTION 804. ABANDONED VEHICLES. 804.1 72 Hours. No person shall permit a vehicle to be parked or left standing within the District for 72 consecutive hours or more except in camping areas pursuant to a valid permit. 804.2 Removal. Any vehicle parked or left standing in violation of this Section may be removed as provided in the Vehicle Code of the State of California. 804.3 Abandonment. Whenever a District ranger has reasonable grounds to believe that a vehicle has been abandoned on District Lands, the vehicle may be removed as authorized by Vehicle Code Section 22669. SECTION 805. PROHIBITED AREAS. To insure the safety and health of persons, to avoid interference with development, construction, and management, or to provide for security, safeguarding, and preservation of District Lands and facilities, the general manager or an authorized representative may declare an area closed, prohibited, or limited to further entry. The declaration may include such reasonable classes of persons who may enter, in the conduct of proper activities or official duties, as the general manager or an authorized representative may prescribe. 805.1 Closed Areas. No person shall, without a written permit issued by the District, enter or remain in an area of District Land or facilities declared closed, prohibited, or limited by the general manager or an authorized agent. 13 805.2 After Hours Use. No person shall enter or remain on District Land "after hours" without a written permit issued by the District. The term "after hours" is defined as one-half hour after official sunset to official sunrise the following day. SECTION 806. USE FEES. 806.1 Nonpayment of Fees. No person shall use District Lands or facilities without payment of the prescribed fee or charge. Any fee or charge established b the Board for use of District Lands or facilities shall be paid in advance of such use,y unless later payment has been authorized by the general manager or an authorized representative. 14 Open Space MIDPENINSULA REGIONAL OPEN SPACE DISTRICT R-93-83 Meeting 93-14 July 28, 1993 AGENDA ITEM Revisions to Land Use Regulations Bail Schedule f ACTING GENERAL MANAGER'S RECOMMENDATION Approve the attached bail schedule recommendations and direct staff to forward the recommendations to the presiding judges of the Santa Clara and San Mateo County Municipal Courts for review and implementation. BACKGROUND In conjunction with revision of the District's Land Use Regulations (see report R-93-82), the municipal courts of Santa Clara. and San Mateo counties will be updating the District-related elements of the Municipal Court Bail Schedule. The presiding judge of each municipal court will accept recommendations from the District. However, final determination of the bail assigned to each regulation is the responsibility of the municipal courts. DISCUSSION Staff has prepared the attached bail schedule recommendations for your review. In developing these recommendations, staff reviewed existing bail schedules for the State of California Fish and Game Code, Vehicle Code, and Penal Code sections, as well as county park-related regulations. The initial draft was reviewed by interested field and office staff. The attached chart outlines the current and proposed bail, as well as the total fine and court division assignment for the Santa Clara County Municipal Court. The following key should assist you in interpreting the bail recommendations chart. Bail The actual recommended fine assigned to the violation of a District regulation. P.A. The Wnalty assessment is a fee added to the bail by the state and county to fund a variety of special funds such as the Victim Restitution Fund and the Peace Officers' Training Fund. Currently the assessment is equivalent to 170% of the bail, based on an incremental table contained in the county-wide bail schedule. The current bail schedule provides for a default bail for all new regulations. The default bail for infractions is $25. The misdemeanor default bail is $150, with a mandatory court appearance. DISCUSSION i In September, 1992, Governor Wilson signed Assembly Bill 408... This new law makes parking violations a non-criminal offense, removes parking citation processing and hearings from the courts, and establishes a system of administrative adjudication for parking violations. Peace officers will no longer be required to appear at hearings to provide testimony or be questioned by the motorist. On July 1, 1993, the Santa Clara County Municipal. Court system stopped conducting court hearings for contested parking citations, with the exception of pre-scheduled cases. Assembly Bill 408 requires all agencies that issue parking citations to assume responsibility for implementing a hearing examiner program known as "administrative review." Administrative review hearings will be handled through a new civil judgment process, which will work in cooperation with the Department of Motor Vehicles for the collection of outstanding parking penalties. Because District rangers issue less than 75 parking citations per year, it is not feasible to hire our own parking examiner. The City of Palo Alto has offered to provide administrative review services by sharing its parking examiner with the District and the City of Mountain View. Cost to the District will be $25 per administrative hearing. Under the proposed bail schedule, the parking citation will be $25 per violation. Staff estimates that the total annual cost will be about $200, since very few of the parking citations we issue are contested. This amount can be covered in the Contract Services budget for Operations. The term of the District's agreement with the City of Palo Alto will be one year, with automatic extensions each year unless the city or the District terminates the agreement. Lockheed IMS, our processing agency, will continue to handle parking violations and all other District-issued citations, including fee collection, record keeping, and placement of vehicle registration holds with the Department of Motor Vehicles. SECTION 4 . Issuing Agency' s Rights and Obligations. 4 . 1 Issuing Agency or Processing Agency, or both, agree to coordinate the administrative review of the contest of any Notice of Violation with the Parking Examiner in accordance with Issuing Agency laws, the California Vehicle Code, and the Palo Alto Municipal Code, including the submission to the Parking Examiner of a copy of the Notice of Violation, a copy of the results of the investigation by the Processing Agency as required by Sections 40214 or 40215 of the California Vehicle Code, or any amendment thereto, the written request of the contestant seeking an adminis- trative review of a Notice of Violation, and any other appropriate information as set forth in "Exhibit All . 4 .2 Issuing Agency or Processing Agency, or both, shall make available to the Parking Examiner a copy of all current Issuing Agency laws applicable to the administrative review of contested Notices of violation, and shall promptly furnish the Parking Examiner with any amendments thereto. 4 .3 Nothing in this Agreement shall be construed to prohibit the Parking Examiner at any time from requesting of Issuing Agency or Processing Agency, or both, any additional information which may be deemed by the Parking Examiner to be reasonable and necessary to a review of the contested Notice of Violation. 4 .4 Issuing Agency hereby designates its Visitor Services Supervisor and Processing Agency hereby designates its Customer Service Supervisor to communicate and coordinate with City' s Revenue Collections Supervisor or the Parking Examiner, or both, on all matters pertinent hereto. 4 .5 In consideration of the performance of administra- tive review services by the Parking Examiner, Issuing Agency shall pay or shall cause to be paid to City the sum of twenty-five dollars ($25) for each contest reviewed by the Parking Examiner. City shall submit to Issuing Agency or Processing Agency, or both, at the request of Issuing Agency, monthly statements in triplicate covering the costs of administrative review and other related 3 930715 syn 0070425 services and charges, including, without limitation, the services of an office assistant to the Parking Examiner. The obligation to make payment to City shall survive the termination of this Agreement. 4 . 6 Nothing in this Agreement shall be deemed or construed to require City to collect from the contestant any parking violation fee, penalty, charge, or other cost. Issuing Agency and Processing Agency shall be jointly and severally liable and responsible for the collection of any parking violation fee, penalty, charge, or other cost levied by Issuing Agency or, in the event of a successful appeal to a civil court by the contestant, any fee, penalty, charge, or other cost required to be paid by Issuing Agency or Processing Agency, or both. 4 . 7 City reserves the right to modify the fee set forth in Section 4 .5 in accordance with its costs of operations not more than once each year. Any such modification shall be determined by City on or about July 1 of each fiscal year, and shall become effective within thirty (30) days after receipt of notice of such modification by Issuing Agency or Processing Agency, or both. SECTION 5 . Indemnification and Waiver. 5 .1 Each party agrees to indemnify and hold harmless the other parties, their officers employees, and agents from any and all demands, claims, liabilities, losses, charges, costs, or damages caused by or arising out the Parking Examiner' s negligent acts or omissions, or willful misconduct, provided, however, any review by the Parking Examiner of a contested Notice of Violation in accordance with the requirements of Issuing Agency laws, the California Vehicle Code, and the Palo Alto Municipal Code shall not be deemed or construed as a negligent act or omission or an act of willful misconduct of City. 5 .2 Issuing Agency and Processing Agency, for and in behalf of themselves and their officers, employees, and agents, expressly waive any and all claims or causes of action which either Issuing Agency or Processing Agency may now or hereafter have against City, its officers, employees, or agents, including the Parking Examiner, for any sum, cost, charge, penalty, loss, fee, or damage (including reasonable attorneys' fees) which Issuing Agency or Processing Agency, or their officers, employees, or agents, may sustain or incur or be liable to pay by reason of the review of a contested Notice of Violation by the Parking Examiner. SECTION 6 . Notices.. Each file shall be submitted not less than two calendar days before the scheduled administrative review date of the contested Notice of Violation. Issuing Agency or Processing Agency, or both, at ao cost to City, shall be responsible for reclaiming each file from the Parking Examiner after the conclusion of the review at the times and in the manner mutually agreeable to the parties. 2 . DISCUSSION As a result of some recent federal legislation and a proposal by the employee steering committee, certain sections of the Personnel Policies and Procedures Manual need to be revised. Below is a description of each of the proposed revisions. Also, attached is the actual text of the proposed changes. Deletions are shown as strike-outs, and new wording is italicized and highlighted in gray. For represented employees, the Memorandum of Agreement with Local 715 takes precedence over the Personnel Policies and Procedures Manual. However, if a particular section in the Personnel Policies and Procedures Manual has no equivalent section in the contract, then that section will also apply to represented employees. Appointment Title I of The Americans with Disabilities Act (ADA) makes it illegal to discriminate against qualified individuals with physical or mental disabilities, and requires employers to provide reasonable accommodation to applicants and employees where plausible. Section 37. Sick Leave As a result of an employee steering committee proposal, language for the sick leave policy has been expanded to allow employees to use sick leave to care for relatives living outside of the employee's household, and domestic partners [Section 37(b)(3), (g), and G)l• Sections 37(b)(5), (c), and (d) have been changed to clarify that sick leave time may be used for health care appointments including medical, dental, vision, and employee assistance program appointments. This section applies to nonrepresented employees only. 3. Section 38. Employee Disability/Family Care Leave Family and Medical Leave Act of 1993 The Family and Medical Leave Act of 1993 (FMLA) becomes effective August 5, 1993, and requires employers to grant eligible employees a total of 12 work weeks of leave without pay during any 12-month period for the birth or adoption of a child, for the care of a spouse, child or parent with a serious health condition, or for the serious health condition of the employee. The Act further requires the employer to continue group health benefits for the employee during the 12 week period, and to allow intermittent leave or a reduced leave schedule if medically necessary. California currently has a similar family care law on the books, allowing employees to take four months of leave without pay in a 24-month period, but without benefit continuation. MROSD Current Leave Policies The District's current leave policies already meet or exceed most of the requirements of the FMLA. Under Disability Leave and Maternity Disability Leave, employees can request a maximum of 12 months leave without pay for the birth and care of a child, or the serious health condition of the employee. Benefit coverage is continued for the first three months of the leave. Under General Leave, employees can request leave without pay for any purpose, including the birth or adoption of a child or the care of a spouse, child or parent with a serious health condition. However, employees are not eligible for benefit continuation under General Leave. Proposed MROSD Employee Disability/Family Care Leave The proposed Employee Disability/Family Care Leave would consolidate Disability Leave, Maternity Disability Leave, and the new FMLA provisions into one leave. I R-93-79 Page 3 This new leave would be granted for up to four months, with monthly extensions up to an additional eight months granted on a month-to-month, case-by-case basis with the general manager's approval. This allows for the same total potential leave period of 12 months, while guaranteeing at least the first four months. (The current leave policies do not provide any guaranteed leave time.) i To be eligible for a family care leave, employees must have worked at least one year for the District from their date of hire, in either a full-time or part-time capacity. Family care leave requests from staff members with less than one year of service are not mandated but would be considered on a case-by-case basis. As before, there is no minimum service requirement to be eligible for the employee disability leave. The proposed leave includes provisions for intermittent or reduced leave schedules, and also allows employees to take leave to care for domestic partners. This section applies to nonrepresented employees only. For employees covered by a collective bargaining agreement in effect on August 5, 1993, FMLA becomes effective on the earlier of the date that the contract expires or one year after the date of enactment (February 5, 1994). 4. Section 39.a Bereavement Leave This section includes domestic partners in the definition of family, in order to be consistent with the sick leave policy. Such applications will be considered without prejudice to the employee's present position, and regular District staff applicants qualified for a vacant position will be given due consideration in the filling of the position. Such consideration may include, but not be limited to, the use of a selection program for District employees only. If a given temporary staff position is reclassified to a regular staff position, and the position is currently filled by a temporary employee, the temporary incumbent in the position shall be considered for the position at the same time as regular staff applicants. Orientation All new employees shall be provided with a copy of the Personnel Policies and Procedures Manual, District Safety Manual, and other information about the structure, employees, salary and benefit administration, and other activities of the District as may be deemed appropriate. Emplo ees shall be YY required to sign a statement which stipulates they have received and will take it upon themselves to read all pertinent materials. Section 9. Probationary Period (a) All appointees to regular District Positions shall fulfill a standard probationary Period of at least six consecutive months of service. In the event a longer period is necessary to demonstrate an employee's qualifications, the probationary period may be extended; however, no probationary period shall be extended beyond nine months from the date of an employee's appointment. Employees shall be notified in writing of any extended probationary period beyond six consecutive months of service and the reason for the extension. (b) During the probationary period, a new employee shall accrue vacation time but shall not be entitled to use accrued vacation time unless the employee's Program Leader grants special permission. A promoted employee can use accrued vacation time during his or her probationary period (c) A probationary employee can be terminated at time during his or her probationary Period. The probationary employee shall be given a complete review of all issues and reasons which have led to the employee's termination before such termination has been finalized. (d) In the case of promotional appointment, a promoted employee may, at any time during the probationary period, be reduced in classification or terminated and reinstated in the class designation from which he or she was promoted. Prior to reducing a promoted employee in classification and reinstating him or her in the class designation from which he or she was promoted, the employee will be re-evaluated to determine whether he or she is still qualified to fill the class designation from which promoted. If the employee is qualified to fill the position and if the reinstatement necessitates the layoff of another District employee currently filling the position, the choice of which employee will be laid off will be based on an evaluation of the respective employees' merit, qualifications, and fitness to fill the position. (h) Upon termination, employees shall be compensated at their current hourly rate of pay for any vacation accrued but not used. (c) Adjustment of Anniversary Date/Vacation Accrual: If an employee is on leave of absence without pay in excess of two complete pay periods, the employee's anniversary date for purposes of evaluation, pay increases and vacation accrual shall be extended by the number of days included in the period of leave without pay. Leave of Absence With Pay (a) Bereavement Leave: A leave of absence with pay not to exceed three consecutive working days will be granted a regular District employee in the event of the death of a member of the employee's immediate family. The Administrative Services Manager may allow the use of accrued sick leave for up to two days to supplement the three days of bereavement leave when travel to distant locations or other circumstances require the employee's absence in excess of three days. Regularly scheduled worktime lost because of such duty shall not affect the employee's accrual of vacation, sick, or personal holiday time. (c) Military Leave: A regular employee who is a member of the National Guard or a reserve component of the Armed Forces of the United States shall be granted a temporary, short-term military leave with pay, up to one month in one fiscal year, when the employee receives bona fide orders to temporary active or training duty. Such leave, which shall be requested in writing from the Administrative Services Manager, shall be granted without loss of time, pay, or other leave and without impairment to merit ratings or other rights or benefits to which the employee is entitled unless the employee fails to return to his or her position at the District immediately following the expiration of the period for which he or she is ordered to duty or fails to reimburse the District for any compensation received from the United States Government for services rendered while on military leave from the District. Time Off to Vote (a) If a voter does not have sufficient time outside of working hours to vote at a statewide election, the voter may, without loss 'of pay, take off enough working time which, when added to the voting time available outside of working hours, will enable the voter to vote. (b) No more than two hours of the time taken off for voting shall be without loss of pay. The time off for voting shall be only at the beginning or end of the regular working shift, whichever allows the most free time for voting and the least time off from the regular working shift, unless otherwise mutually agreed. (c) If the employee on the third working day prior to the day of election, knows or has reason to believe that time off will be necessary to be able to vote on election day, the employee shall give the employer at least two working days written notice that time off for voting is desired, in accordance with the provisions of this section. Said written notice should explain why the employee does not have sufficient time outside of his or her working hours to vote and should be forwarded to the Administrative Services Manager via the employee's supervisor. MIDPENINSULA REGIONAL OPEN SPACE DISTRICT NONDISCRIMINATION REGULATIONS Policy It is the policy of the Midpeninsula Regional Open Space District to promote an employment environment free of unlawful discrimination. Discrimination on the basis of race, religion, creed, political affiliation, color, national origin, ancestry, sex, sexual orientation, age, familial status, or mental or physical disability is unlawful and will not be tolerated by the District. The District strongly forbids any form of discrimination by its officers or employees, and has enacted these regulations to identify and eliminate unlawful discrimination. Any employee, including managers, supervisors or otherwise, engaging in harassment or other discrimination may be subject to disciplinary action, up to and including discharge. Both State and Federal law provide protection for employees who have been the subject of unlawful employment discrimination, and prohibit retaliation against employees who have reported or otherwise opposed discriminatory practices. Employees who assist the District in discovering and eliminating unlawful discrimination will not be retaliated against for their participation. Harassment Harassment on the basis of race, religion, creed, political affiliation, color, national origin, ancestry, sex, sexual orientation, age, familial status, or mental or physical disability is prohibited. Conduct which might constitute harassment would be conduct reasonably considered to be offensive, including: (1) Offensive verbal conduct, including epithets, derogatory comments, slurs, demeaning jokes, nicknames, sexual innuendos, whistling, propositions, threats, or profanity; (2) Unwanted physical conduct including touching, assault, impeding or blocking movement, interference with normal work, or gestures; (3) Offensive visual conduct, including display of posters, calendars, cartoons, drawings, or pictures; or (4) Unwanted sexual favors. Sexual Harassment Sexual harassment is a foi A unlawful sex discrimination and w.__ not be tolerated by the District. Federal and State guidelines provide that unwelcome sexual advances, requests for sexual favors and other verbal, visual, or physical conduct of a sexual nature constitute unlawful harassment when: (1) Submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment; (2) The submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual; or (3) Sexual advances, requests for sexual favors or other verbal or physical conduct of a sexual nature have the purpose or effect of unreasonably interfering with an employee's work performance or of creating an intimidating, hostile, or offensive work environment. Sexual harassment does not refer to occasional compliments or other behavior of a socially acceptable nature. It refers to conduct that is not welcome, that is offensive, that fails to respect the rights and dignity of others, that lowers morale and that, therefore, interferes with work effectiveness. COMPLAINT PROCEDURE The goal of a nondiscrimination complaint procedure is to stop discriminatory behavior in a prompt and effective manner, while still maintaining a good working relationship among the District's employees. All District employees have the right to file complaints of alleged discrimination. The procedure for filing such complaints is as follows: Informal Complaint: Any employee who has been harassed should attempt immediately to resolve the problem informally by expressing his/her discomfort with the behavior of the offender in a constructive manner, and by requesting the offender to stop the behavior. The District strongly urges use of the informal complaint procedure, but it is not a prerequisite to the filing of a formal complaint. Formal Complaint: Any employee who believes that he or she has personally suffered unlawful harassment or discrimination, or one who has learned of such conduct in his or her official capacity, shall promptly report it, either orally or in writing to his/her immediate supervisor, or directly to the District Administrative Services Manager/Personnel Officer. In making such reports, the employee need not follow any established chain of supervision, so long as the matter is reported to any of the following supervisory or managerial employees: (1) Administrative Services Manager/Personnel Officer (2) Any Program/Department Manager (3) Any Supervisor (4) General Manager (if above not appropriate) The complaint may be referred to a person designated by the General Manager to investigate such complaints, as appropriate. Investigation of Complaint: Upon receipt of a complaint of discrimination, the designated investigator will conduct a prompt investigation into the allegations. The investigation may include meeting with the complainant, the accused, and any witnesses to the conduct. Resolution: Once the investigation is complete, the responsible manager will make a determination of the appropriate corrective action, if any, and will inform the complainant. Written findings shall be made when appropriate. In the event the complainant is not satisfied with the corrective action taken, the responsible manager will inform the complainant of their right to file administrative charges with the Department of Fair Employment and Housing (DFEH) or the Equal Employment Opportunity Commission (EEOC). Confidentiality: Throughout the process, the matter subject to the complaint shall be kept as confidential as possible. Materials pertaining to the complaint which do not form a basis for discipline shall be maintained in a file separate from the personnel files of the participants. Dissemination of Policy: Copies of the Districts Nondiscrimination Regulations, and of these complaint procedures, shall be provided to all employees of the District upon issuance, and to all new employees at the time of hiring. From time to time, the District may also conduct training for its employees to assist them in learning how to recognize, avoid and correct discriminatory behavior. Managers and Supervisors: In addition, managers and supervisors are responsible for: *ensuring that their employees are aware of the District's policy on nondiscrimination; *enforcing the District's policy among those they supervise; *when discriminatory behavior is found to be occurring, taking prompt, appropriate corrective action that is reasonably designed to make the behavior stop. All employees are also encouraged to communicate with one another to assist co-employees to avoid harassing, discriminatory, or otherwise offensive behavior. Adopted by the Board of Directors March 24, 1993 Cppen Space 1 R-93-81 MIDPENINSULA REGIONAL OPEN SPACE DISTRICT Meeting 93-14 July 28, 1993 AGENDA ITEM Authorization to Solicit Bids for a Replacement Water System at S Ridge Open Space Preserve ACTING GENERAL MANAGER'S RECOMMENDATION Authorize staff to advertise for bids to replace the water system at Skyline Ridge Open Space Preserve. DISCUSSION You approved the use and management plan for Skyline Ridge Open Space Preserve at your April 8, 1992 meeting (see report R-92-47). The report contained a recommendation to redesign and construct a new water system servicing all structures on the preserve, including those contained in the Wasserman family compound. As mentioned in the use and management plan, the current water system is spring-fed. The springs are located in the interior of the preserve below Horseshoe Lake. Water is pumped, via several intermediate tanks, to a large redwood holding tank on a hill overlooking the field facility. Water flows to its various destinations by gravity via a series of water lines. The existing water system (tank, piping and electrical system) is approximately 50 years old and has served well beyond its life expectancy. The main redwood tank leaks to the point that it cannot hold water to its full capacity, requiring additional electrical service for pumping to replace the leaking water. Constant electrical shorts result from gophers gnawing on the underground wire insulation, and the substandard electrical design of the entire system combine to create a major ongoing maintenance problem for field staff. For the past several years, field staff have been required to check the water level of the redwood tank on a daily basis to insure adequate service. In addition, spring-fed systems are discouraged by the San Mateo County Department of Health due to the potential for contamination of the water. Spring-fed systems tend to have high coliform counts due to decomposing organic material on the land surface. The existing system is no exception and therefore the use of the water for drinking purposes is not y P g P rP recommended. This project is a high priority and has been since April of 1992 when .it was P J g P Y P first approved. Permits for a new well were obtained from San Mateo County and the well was drilled last summer. District staff has recently received a building permit from San Mateo County to complete the water delivery system. The current project consists of replacing the old redwood tank with a new steel tank and installing the water lines to serve the field office and residences on the preserve. The cost is estimated at $75,000. Phillips and Dennis Danielson. My husband and I have long enjoyed your Russian Ridge facility, so on June 29 1 introduced a friend to its pleasures, promising her an exciting day. That turned out to be a considerable understatement. We parked in the Cal-Trans View Area and hiked for about 90 minutes, returning to the parking lot to find my brand new Honda Civic missing! In shock, we hitchhiked to the Saratoga Summit fire station, where the fireman contacted Ranger Phillips. He drove to the fire station, and transported my friend and I back to Russian Ridge. The California Highway Patrol had refused to refused to respond to our dilemma because my car was so new that it did not have license plates so Ranger Phillips examined the tread marks left by my stolen car. He then agreed to transport us to my friend's car which was parked'at the intersection of Highways 35 and 92. As we drove north along Highway 35, we spotted my undamaged car abandoned by the side of the road. Ranger Phillips called for Ranger Danielson, and for a deputy from the San Mateo County Sheriff's office. While we waited for them, Ranger Phillips was efficient, warning us not to touch the car, but he was also very personable. He chatted with us, easing our distress. Ranger Danielson arrived, and also was very efficient, opening the ear's trunk to evaluate what property had been stolen. But he too was very warm, to the extent of telling a few funny stories. Both men, while dealing professionally with the situation, defused it for us. It is symbolic of Ranger Phillips attitude toward this whole experience, that as he waited for us to start the car and drive away, he urged us not to hold this incident against the Open Space District, and to come back and enjoy Russian Ridge again! Hayter 1691 Yale Drive Mountain View, CA, 94040 Dear Mr. and Mrs. Hayter: Thank you for your recent letter about conflicts between mountain bikes and other users in the Purisima Creek Redwoods Open Space Preserve. We are aware of the conflicts between hikers and bicyclists on the Whittemore Gulch Trail. The safety of all preserve visitors is a primary concern to us. The board recently adopted detailed trail use guidelines that will help resolve trail use conflicts to provide for a safe and enjoyable trail experience for a variety of users. We are in the process of inventorying specific trail conditions and problems and applying these guidelines to address them. The Purisima Creek Redwoods Open Space Preserve is high on the list of preserves to receive this attention. The board will consider adoption of a' 15 miles per hour speed limit for bikes at its July 28th meeting. The District has also published a trail etiquette brochure to encourage courtesy among all trail users. We are actively working with user groups to get their input and help in resolving conflicts. We are encouraged by the progress made thus far. Our staff is installing more control and informational signs where needed. Also, our rangers are patrolling problem areas more frequently. Rangers can issue citations for reckless cycling when they witness the violation. We will add you to the mailing list for future trails committee meetings.
