RESOLUTION NO. 84 -2307
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY, PERTAINING _
TO THE ESTABLISHMENT OF PROCEDURES
FOR ADOPTING "DEVELOPMENT AGREEMENTS."
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE, ORDER,
AND DETERMINE AS FOLLOWS:
WHEREAS, presently uncertainties exist in the implementation of real
estate development projects, involving waste of resources, escalation of
costs, discouragement to investment and negation of good faith commitment
to comprehensive planning; and
WHEREAS, strengthening of the planning process and the protection of
private investments in future private real estate development ventures
are needed to attain these collation private and public concerns; and
WHEREAS, the Municipal Code has not established procedures to ac-
commodate this mutual interest between the private parties and public
agencies; and
WHEREAS, California Government Code, Sections 65864- 65869.5, author-
izes cities to enter into binding development agreements with persons
having legal or equitable interests in real property for the development
of such property, and authorizes the City Council to establish procedures
for consideration of applications for such agreements; and
WHEREAS, it is in the public interest to do so and the public health,
safety and welfare will be promoted thereby.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY HEREBY ESTABLISHES THE FOLLOWING PROCEDURES FOR DEVELOPMENT
AGREEMENTS:
SECTION 1. Persons having legal or equitable title to real property
within the city, or their authorized agents, may apply for a development
agreement with the city.
SECTION 2. The City Council may enter into binding development agree-
ments submitted, considered and approved in accordance with the provisions
of this resolution.
SECTION 3. Applications for development agreements shall be submitted
in accordance with the Precise Plan Procedures as contained in Section
9446 of the Municipal Code, wherever applicable.
SECTION 4. Hearings shall be held, and notices therefor shall be
executed, in accordance with the Code. Amendments, modifications, can-
cellations, in whole or in part, pertaining to development agreements may
be executed by mutual consent of the parties with advertised public
hearings.
SECTION 5. Ten (10) days after a public hearing and adoption of a
development agreement, or revision of a development agreement, the final
document as adopted or modified shall be recorded in the County Recorder's
Office.
SECTION 6. The City Clerk shall certify to the adoption of this
Resolution.

I HEREBY CERTIFY that the foregoing Resolution was adopted by the
City Council of the City of Temple City at a regular meeting held on
the 18th day of September, 1984, by the following vote of Council:
AYES: Councilmen- Atkins, Dennis, Gillanders, Tyrell, Swain
NOES: Councilmen -None
ABSENT: Councilmen -None
