A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWUOD AUTHORIZING PkOVISIUN OF DEFENSE
WHEREAS, litigation has been commenced in the matter of Sandra Read
~^. vs. Charles Gomez, E. L. Morris, and the City of Lynwood in Los Angeles Superior
`C Court Case No. C49U938 (the "Action"); and
WHEREAS, the City has received from each of E. L. Morris and Charles
Gomez a request that the City defend such individuals in the Action; and
WHEREAS, Section 995 of the California Government Code provides
generally that a public entity shall provide for the defense of any civil
action or proceeding brought against an employee based upon allegations based
upon a net or omission in the scope of employment as an employee of the public
enti ty;
NOW, THEREFORE, the City Council of the City of Lynwood does resolve
as follows:
Section 1. The City Council of the City of Lynwood approves and
authorizes the provision of defense of E. L. Morris and Charles Gomez,
individually, in the Action. Such defense shall be subject to a reservation
of rights in law of the City of Lynwood based upon Section 825.6 of the Calif-
ornia Government Code.
Section 2. The City Attorney is authorized and directed to proceed
with or cause to occur the provision of a defense for the City of Lynwood as
described herein.

The undersigned has been named as a party defendant in a
civil action entitled Sandra Read vs. Charles Gomez, E.L.
Morris, and the City cf Lynwood, Los Angeles Superior Court
Case No. C490938 (the "Action"). The undersigned:
1. requests that the City of Lynwood provide a defense in
the Action for the undersigned;
2. acknowledges that such defense, if provided, may be
provided subject to a reservation of rights on behalf of the
City of Lynwood for indemnity pursuant to Section 825.6 of the
California Government Code; and
3. acknowledges that, in the event that any punitive or
exemplary damages are awarded in the Action against the
undersigned, the City of Lynwood shall not make any payment or
reimbursement of such damages.

EXHIBIT A
Representatives of the City and the Management Group have met and agreed that
the salary range for the classification of Director of Community Development
be adjusted from 12M to lOM on the Management Salary Schedule effective upon
City Council review and approval. This action reflects prior changes in the
responsibilities of the classification.
