COUNCIL MINUTES
FEBRUARY 27, 1965
The Council of Bal Harbour Village met at 9:30 A. M.
Saturday, February 27, 1965 in the Village Hall.
Present: Messrs: Beatty, Faulkner, Sanders and White.
Absent: Mr. Frank C. Hart, Jr.
Also present were W. H., Webb, Village ..Manager; Mary
T. Wetterer, Village Clerk; and Thomas H. Anderson, Village
Attorney.
Upon motion of Mr. Sanders, seconded by M`r, White and
unanimously voted, the minutes of the previous meeting of
January 30, 1965 were approved as submitted.
The Village Clerk read
ORDINANCE NO. 113
Amending Ordinance No. 68
by increasing the taxi rates in Bal Harbour Village to 10
cents for 1/4 mile. Upon motion of Mr. White, seconded by
Mr. Sanders and unanimously voted, Ordinance No, 113 was
adopted.
Mr. Faulkner reported that he had been working with Mr.
Roy Struble, a Rotary Club member on the "Sister dity" pro-
gram. Panama City had been ruled out as a Sister City to Bal
Harbour and they will pursue the matter further and report at
a future meeting.
Regarding the matter of beach nourishment in Bal Harbour,
the Village Manager reported he had not received a reply to
his letter of February 1st from Mr. Hoke Welch. He further
advised that Mr. Gordon had requested a copy of Mr. Webb's
letter to Mr. Welch be forwarded to him. At another meeting
with Mr. McCue of the Public Works Department of Dade County,
Mr. McCue had indicated to Mr. Webb that some action is under
discussion at Metro at the present time. It was the Council's
recommendation that we wait another week or two and if no
answer is received from Mr. Welch, the Village Manager follow
through with another communication.
The Village Manager informed the members that the cost
for paving the area between the bank and sewer station No. 2,
including the 12 parking meters installed, would be $1,353.40.
Mr. White moved to approve the expenditure, from surplus, of
$1,353.40 for the paving andparking meters. Motion seconded
by Mr. Sanders and unanimously voted.

Corporation appeared before the members asking if a decision had
been reached on whether or not the.ward.•"Spa!'. could be added
to the hotel name. After discussion, Mr. Beatty moved to allow
the use of the name "Regency Spa" on the Bal Harbour Hotel
sign subject to the'size of the sign as provided for in our
sign ordinance. Motion seconded by Mr. Sanders and unanimous-
ly voted.
A discussion then followed on the Metro Penal Code Ordin-
ance and in this connection Mayor Faulkner asked Mr. Anderson
if Bal Harbour Village would be subject to any legal violation
by not certifying our ordinances to. Metro. Mr. Anderson re-
plied no. Mr. Beatty reported that the Dade League of Muni-
cipalities had been very active on this matter and at a meet-
ing last week, Mr. Britton, attorney for Metro had indicated
they were going to modify the ordinance. A Dade County
Commission meeting is scheduled for March 2nd and 3rd and, in
Mr. Beatty's opinion, the Council members should waitand see
what develops at this meeting. The members were in agreement
on this matter.
The Village Clerk advised that the Bahamas Development
Limited had applied for an occupational license to operate
a sales promotion business at the Beau Rivage Hotel which is
quite similar to the operation of the Gulf Land Development
Corporation at the Balmoral Hotel. After consideration, Mr.
White moved that the Village Clerk issue an occupational
license for Bahamas Development Limited on a year to year
basis. Motion seconded by Mr. Beatty and unanimously voted.

Hoffman of Pershing Auto Rentals appeared request -
he be allowed to take only one permit for one U�
car at the Bal Harbour Regency Hotel. Mr. White"
grant one permit to Pershing Auto Rentals. Motion
by Mr. Sanders and unanimously voted.
The Village Clerk read ,'a..letter from the City of Miami
Beach asking for our participation in their 50th Anniversary
Parade Celebration on March 27, 1965. It was mutually
agreed that we should participate and the Village Manager
was requested to ask'Ed Morse to allow us the use of a
Cadillac for the parade and a banner be made with the Village
name.
Mr. Webb briefed the members on the progress of the Bal
Harbour Shops project stating that Mr. Whitman is preparing
a section of the shopping center for permanent parking. In-
asmuch as the permanent parking is being started, Mr. Webb
asked that they build the buffer wall at this time. Plans
for the wall had been submitted and approved.
Mr. Webb stated we need more land as we are forced to
park our garbage trucks on the streets at night. He advised
that he had contacted Mrs. Florence S. Gifford regarding her
two lots, Lots 1 and 2 of Block 1. Residential Section of Bal
Harbour, to see if she might be interested in selling. These
lots are 200 feet on the bay side and 242 feet on Bal Bay
Drive. If we could procure these lots, another garage build-
ing could be built to handle the heavy equipment and we could

also set up a public parking lot. Mr. Beatty made a motion
that the Village Manager engage an independent appraiser to
find out what would be a fair price for these lots and pro-
ceed with negotiations with Mrs. Gifford to find out what
price she would accept. Motion seconded by Mr. Sanders and
unanimously voted. In this connection Mr. Anderson stated
that in selecting an appraiser, the appraiser be advised
that we may need his testimony in court in case of condemna-
tion proceedings.

Amending Ordinance No. 11
setting up a special parking district. Mr. Sanders moved to
adopt Ordinance No..114. Motion seconded by Mr. White and
unanimously voted.
Mr. Beatty made a motion to adjourn. Motio
Mr. White and unanimously approved.
