Rios at approximately 7:00 P.M. on Thursday, November 9, 2004, Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: ROLL CALL Council President Ronald G. Rios Councilmember Randy Krum " Susan Naples " Frank Parisi " Joseph Sitarz Also noted present was Borough Attorney Robert J. Bergen, Esq. Noted absent were Mayor Daniel J. Reiman and Councilmember Brian NOTED ABSENT Sosnowski. The meeting was opened with a moment of Silent Prayer and The PRAYER, PLEDGE Pledge of Allegiance led by Council President Ronald G. Rios. OF ALLEGIANCE The Clerk stated that on January 6, 2004, the 2004 Annual Meeting APPROVAL OF MINUTES Notice was published in The Home News Tribune, The Star-Ledger and posted on the bulletin board. Council President Ronald G. Rios presented Mrs. Stolte with a COMMENDATION Mayoral Commendation. He thanked Mrs. Stolte for her donation of a SOPHIE STOLTE defibrillator in memory of her husband George to be kept in the Senior/Community Center. The Clerk stated Ordinance #04-31 was introduced and passed upon ORDINANCE #04-31 First Reading at a Regular Meeting of the Borough Council held on AN ORDINANCE TO October 28, 2004. It was duly published in the Home News Tribune AUfHORIZE THE on November 2, 2004 with notice that it will be considered for final ACQUISITION AND/OR passage after Public Hearing to be held on November 9, 2004 at CONDEMNATION OF REAL PROPERTY, RE: approximately 7:00 P.M. The Ordinance was posted on the bulletin CARTERET LANDFILL board and copies were made available to the general public and RECLAMATION according to law, she read the Ordinance by title. IMPROVEMENT DISTRICT Upon MMS&C, by Councilmembers Sitarz and Naples and unanimous PUBLIC HEARING affirmative vote of the five (5) Councilmembers present, Council President Rios declared the Public Hearing to be open: I NOVEMBER 9,2004 I HEARING CLOSED There being no comments or objections to the Ordinance, Council President Rios declared the Public Hearing to be closed, upon MMS&C, by Councilmember Sitarz and Krum and unanimous affirmative vote of the five (5) Councilmembers present. Upon MMS&C, by Councilmembers Krum and Sitarz ORDINANCE #04-31 "AN ORDINANCE TO AUTHORIZE THE ACQUISITION AND/OR CONDEMNATION OF REAL PROPERTY WITHIN THE CARTERET LANDFILL RECLAMATION IMPROVEMENT DISTRICT" ADOPTED was finally adopted. Upon individual roll call vote, Councilmembers Krum, Naples, Parisi, Rios and Sitarz voted in the affirmative. Councilmember Sosnowski was noted absent. Reiman Advertised as Finally Adopted: November 16,2004 COMMENTS Borough Attorney Bergen briefly explained the Ordinance for the Councilmembers. ORDINANCE # 04-32 The Clerk stated Ordinance #04-32 was introduced and passed upon APPROVING THE First Reading at a Regular Meeting of the Borough Council held on ACQUISITION OF October 28, 2004. It was duly published in the Home News Tribune BLOCK 134, LOT 1 & on November 2, 2004 with notice that it will be considered for final BLOCK 135 LOT 1.01 passage after Public Hearing to be held on November 9, 2004 at ON BEVERLY STREET, approximately 7:00 P.M. The Ordinance was posted on the bulletin RE: HILL DISTRICT board and copies were made available to the general public and STORM WATER according to law, she read the Ordinance by title. MANAGEMENT/ DRAINAGE PROJECT PUBLIC HEARING Upon MMS&C, by Councilmembers Sitarz and Krum and unanimous affirmative vote of the five (5) Councilmembers present, Council President Rios declared the Public Hearing to be open: 2 NOVEMBER 9,2004 There being no comments or objections to the Ordinance, Council HEARING CLOSED President Rios declared the Public Hearing to be closed, upon MMS&C, by Councilmember Sitarz and Krum and unanimous affirmative vote of the five (5) Councilmembers present. Upon MMS&C, by Councilmembers Sitarz and Krum ORDINANCE #04-32 "AUTHORIZING THE ACQUISITION BY PURCHASE OF UNIMPROVED PROPERTY KNOWN AS BLOCK 134, LOT I & BLOCK 135, LOT 1.01 LOCATED ON BEVERLY STREET, CARTERET, NEW JERSEY, FOR THE PURPOSE OF THE HILL DISTRICT STORM WATER MANAGEMENT/DRAINAGE PROJECT" was finally adopted. Upon individual roll call vote, Councilmembers ADOPTED Krum, Naples, Parisi, Rios and Sitarz voted in the affirmative. Councilmember Sosnowski was noted absent. Upon individual roll call vote, Councilmembers ADOPTED Krum, Naples, Parisi, Rios and Sitarz voted in the affirmative. Councilmember Sosnowski was noted absent. Reiman Advertised as Finally Adopted: November 16,2004 A copy of each Resolution was placed on the table for public review MEETING OPENED prior to the meeting in accordance with the Rules of Council and upon PUBLIC INPUT ON MMS&C, by Councilmembers Sitarz and Krum and unanimous ALL RESOLUTIONS affirmative vote of the five (5) Councilmembers present, the meeting was opened for public input on all Resolutions/Agenda items and any new business. Joseph Novakowski, President of the Carteret Community Seniors COMMENTS thanked Mrs. Stolte for her donation. There being no further comments or objections, Council President MEETING CLOSED Rios declared the Public Hearing to be closed, upon MMS&C, by Councilmembers Parisi and Sitarz and unanimous affirmative vote of the five (5) Councilmembers present. The Borough Clerk asked if any Councilmembers wanted any CONSENT AGENDA Resolutions to be taken off the Consent Agenda and asked for a motion. Council President Rios said he would like to table Resolution #04-348 and asked for a motion. Upon MMS&C, by Councilmember Sitarz and Naples a motion was MOTION TO TABLE made to table Resolution #04-348. Upon individual roll call vote, RESOLUTION # 04-348 Councilmembers Krum, Naples, Parisi, Rios and Sitarz voted in the affirmative. Councilmember Sosnowski was noted absent. 5 NOVEMBER 9,2004 I Upon MMS&C, by Councilmembers Sitarz and Naples and unanimous affirmative of the five (5) Councilmembers present, Resolutions #04- 344 to #04-350 were approved. Resolution #04-348 was tabled. RESOLUTION # 04-344 RESOLUTION #04-344 was introduced Council President Rios and REFUNDOFTAX referred to the Council for action. AND/OR SEWER USER FEES Upon MMS&C, by Councilmembers Sitarz and Naples RESOLUTION #04-344 "AUTHORIZING REFUND OF TAX AND/OR SEWER USER FEES OVERPAYMENT" ADOPTED was adopted. Upon individual roll vote, Councilmembers Krum, Naples, Parisi, Rios and Sitarz voted In the affirmative. Councilmember Sosnowski was noted absent. RESOLUTION # 04-345 RESOLUTION #04-345 was introduced Council President Rios and TRANSFER OF referred to the Council for action. SURPLUS FUNDS Upon MMS&C, by Councilmembers Sitarz and Naples RESOLUTION #04-345 "RESOLUTION PROVIDING FOR THE TRANSFER OF SURPLUS FUNDS" ADOPTED was adopted. Upon individual roll vote, Councilmembers Krum, Naples, Parisi, Rios and Sitarz voted In the affirmative. Councilmember Sosnowski was noted absent. RESOLUTION # 04-346 RESOLUTION #04-346 was introduced Council President Rios and PROPERTY TAX referred to the Council for action. CANCELLATION Upon MMS&C, by Councilmembers Sitarz and Naples RESOLUTION #04-346 "PROPERTY TAX CANCELLATION" ADOPTED was adopted. Upon individual roll vote, Councilmembers Krum, Naples, Parisi, Rios and Sitarz voted In the affirmative. Council member Sosnowski was noted absent. 6 NOVEMBER 9,2004 RESOLUTION #04-347 was introduced Council President Rios and RESOLUTION # 04-347 referred to the Council for action. AUfHORIZING BIDS FOR WASTEWATER DISCHARGE Upon MMS&C, by Councilmembers Sitarz and Naples MONITORING RESOLUTION #04-347 "AUTHORIZING RECEIPT OF BIDS FOR INDUSTRIAL W ASTEW ATER DISCHARGE MONITORING CONTRACT" was adopted. Upon individual roll vote, Councilmembers Krum, ADOPTED Naples, Parisi, Rios and Sitarz voted In the affirmati ve. Councilmember Sosnowski was noted absent. RESOLUTION #04-348 was introduced Council President Rios and RESOLUTION # 04-348 referred to the Council for action. PROFESSIONAL SERVICES-CME ASSOOATES, RE: Upon MMS&C, by Councilmembers Sitarz and Naples PHASE II-ROOSEVELT AVENUE STREETSCAPE PROJECT RESOLUTION #04-348 "AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH CME ASSOCIATES FOR PHASE II ROOSEVELT A VENUE STREETSCAPE PROJECT" was tabled. Upon individual roll vote, Councilmembers Krum, TABLED Naples, Parisi, Rios and Sitarz voted in the affirmative. Council member Sosnowski was noted absent. RESOLUTION #04-349 was introduced Council President Rios and RESOLUTION # 04-349 AWARD OFBID-2003 referred to the Council for action. MINIBUS REPAIR Upon MMS&C, by Councilmembers Sitarz and Naples RESOLUTION #04-349 "AWARDING CONTRACT FOR 2003 MINI BUS REPAIRS" was adopted. Upon individual roll vote, Councilmembers Krum, ADOPTED Naples, Parisi, Rios and Sitarz voted In the affirmative. Councilmember Sosnowski was noted absent. I 7 NOVEMBER 9,2004 I RESOLUTION # 04-350 RESOLUTION #04-350 was introduced Council President Rios and REQUESTING THE referred to the Council for action. GOVERNOR INVESTIGATE PRICE GOUGING BY THE Upon MMS&C, by Councilmembers Sitarz and Naples OIL INDUSTRY IN NJ RESOLUTION #04-350 "REQUESTING THAT THE GOVERNOR OF THE STATE OF NEW JERSEY INVESTIGATE PRICE GOUGING BY THE OIL INDUSTRY IN THE STATE OF NEW JERSEY" ADOPTED was adopted. Upon individual roll vote, Cot:ncilmembers Krum, Naples, Parisi, Rios and Sitarz voted In the affirmative. Councilmember Sosnowski was noted absent. COMMUNICATIONS The Clerk stated that she was in receipt of a Communication form the Township of North Brunswick-Resolution requesting Governor investigate price gouging by the oil industry in the State of New Jersey. Upon unanimous affirmative vote of the five (5) Councilmembers present, all Communications were ordered to be received and placed on file. PAYMENT OF BILLS Upon MMS&C, by Councilmembers Sitarz and Parisi all bills appearing on the prepared list properly audited and signed were ordered to be paid. Upon individual roll call vote, Councilmembers Krum, Naples, Parisi, Rios and Sitarz voted in the affirmative. Councilmember Sosnowski was noted absent. REPORTS The Clerk stated that she was in receipt of the following reports: DEPARTMENT 1. Clerk's Office-October 2004 Upon MMS&C, by Councilmembers Sitarz and Krum and unanimous affirmative vote of the five (5) Councilmembers present, all reports were ordered to be received and placed on file. 8 NOVEMBER 9,2004 BUILDING & GROUNDS: Committee Chairperson Naples said STANDING COMMITTEES Building and Grounds employees are still preparing to move offices out of Borough Hall to other sites. She said the roof at the Hot House is almost complete and gave the details. She spoke about the repairs to the interior of the trailer the Borough has acquired for the Domestic Violence Program which the Buildings and Grounds Department would redo and said she hoped they would have it completed soon. FINANCE & ADMINISTRATION: Committee Chairperson Parisi spoke about the transfer of funds and collection of the fourth quarter taxes. FIRE: Committee Chairperson Krum said two Firefighters attended a class for flammable liquids. He said two Officers from the Volunteer Fire Department completed a safety officer class. He thanked Mrs. Stolte for her donation to the Senior Center and said the Fire Department will provide training on the defibrillator. He reported progress. PARKS & RECREATION: Committee Chairperson Rios congratulated the Carteret Sportsman's Junior Pee Wee Football Team for wim1ing the 2004 Pride Bowl Championship. He said they would be re-opening the Skateboard Park which has been painted and said he hoped the problem with graffiti will not happen again. He thanked the Recreation Commission for the fine job they did on the Halloween Parade, he said everyone had fun. He spoke about the Veteran's Day services that will be held on November 11th by the VFW at Carteret Park and the American Legion which will be held at Borough Hall. He reported continued progress. POLICE: Committee Chairperson Sitarz spoke about the trailer which was donated by the Dolan family for the Domestic Violence Program. He said it will be a great assist to the committee. He spoke about the tickets being given out in West Carteret for trucks driving on Roosevelt Avenue towards the Turnpike. He said the police will be there as often as they get a chance. He reported progress. I 9 NOVEMBER 9,2004 I STANDING PUBLIC WORKS: Councilmember Sitarz In the absence of COMMITTEES Committee Chairperson Sosnowski said the Municipal Garage is fixing equipment to be ready for the snow season. He said (he Streets and Roads Department is picking up leaves which will be ongoing for the next month and a half. He reported progress. BOARD OF EDUCATION: Committee Chairperson Naples said the November Superintendent's Forum would be rescheduled because of a conflict with the Board of Education meeting. She spoke about the Fire Department's Fire Prevention Poster Contest.
