RESOLUTION NO. 84 -2320
A RESOLUTION OF 'THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY APPROVING WITH ADDITIONAL
CONDITIONS RESOLUTION NO. 84 -1140 PC AND
CUP 84 -721 AND TENTATIVE TRACT MAP NO. 43195
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS
FOLLOWS:
SECTION 1. Based upon a public hearing on the appeal of
Resolution No. 84 -1140 PC, the City Council hereby confirms in full
Resolution No. 84 -1140 PC, thereby approving the Environmental Impact
Report, Conditional Use Permit 84 -721 and Tentative Tract Map No. 43195
as conditioned by the Planning Commission, subject, however, to the
following additional conditions:
1. That a fire sprinkler system, as approved by the Fire
Department shall be installed in each garage prior to
occupancy.
2 That in settlement of the pending dispute regarding an
alleged public nuisance and code violation by the same
owner of adjacent property and to avoid any claim of the
City creating an escalated nuisance condition, it is
understood that no Final Map shall be applied for or
granted on any part of such property until:
(a) Covenants, Conditions and Restrictions (CC &R's) have
been recorded and a Division of Real Estate Report
issued which, to the satisfaction of the City Attorney,
have:
(i) advised potential buyers of said property or any
condominium therein that such alleged nuisance
is extant and that sales are consummated with
full knowledge thereof; and
(ii) indemnified, insured, and held harmless the City
and its officers by the owner of both the subject
property and alleged nuisance property to the
north against any and all claims, litigations,
costs or fees in connection with the existence
of such alleged nuisance and code violation.
(b) the requirements of (a) above shall endure until such
time as such alleged nuisance and code violations have
been resolved either by pending or other court action
or by compromise and settlement through administrative
procedures.
(c) these conditions shall be binding upon all successors
in interest and run with the land.
3. Applicant and developer shall countersign this Resolution
indicating acceptance of all conditions, the materiality
thereof and the recognition of the compromise of all parties
with regard thereto. Acceptance of any of the benefits of
this Resolution shall include acceptance of its burdens.
SECTION 2. The City Clerk shall certify to the adoption of this
Resolution.

on the 20th day of November, 1984, by the following vote of the Council.
