HomeMy Public PortalAbout09-11-2002PLANNING COMMISSION MINUTES - SEPTEMBER 11, 2002 PRESENT: JERRY BROST, RANDY BRINKMAN, MARY VERBICK, LIZ WEIR, LENNY LEVER, SHARON JOHNSON, BILL LOE, DICK PICARD AND RON JOHNSON. ALSO PRESENT PLANNING AND ZONING ADMINISTRATOR AND PLANNING AND ZONING ASSISTANT SANDIE LARSON Chairperson Elizabeth Weir started the meeting with the Pledge of Allegiance and a moment of silence in recognition of September 11, 2001. 1. WARA REAL ESTATE - COUNTY ROAD 116 SO OF FOXBERYFARMS - PLATTING - REZONING AND SITE PLAN REVIEW FOR OFFICE BUILDINGS MOVED BY MARY VERBICK AND SECONDED BY DICK PICARD TO TABLE THE APPLICATION OF WARA REAL ESTATE FOR FURTHER INFORMATION. MOTION PASSED. 2. DAVID AND SHARON DEZIEL - 2190 MEDINA ROAD - RE -PLAT 2 LOTS TO 1 LOT - PUBLIC HEARING Loren Kohnen read his memo to the planning commission and put up overheads of the area. He explained the history of this property. Mary Verbick asked about the septic easement for the Scherer property. L. Kohnen explained. Lenny Leuer said that he could not find the survey stakes on County Road 24 for the property. He questioned whether the buildings on the Long Lake Glass property were on or over the lines. L. Kohnen said no, that he and the city engineer had walked the lot lines back when Mr. Libby owned the property. L. Leuer then asked about the septic site protection. David Deziel explained where the sites were and stated that they were staked as was the easement for the Scherer alternate site. There was discussion of a driveway easement for the property to the north and told Mr. Deziel that he should check to see if there was an easement in place and if not, make sure that there was one done between himself and the property owner to the north. Leuer asked Loren about the City's private driveway agreements and Loren said that they come into play when there are three or more homes served by the same driveway. L. Leuer said he wanted to make sure there would be no access from County Road 24 for the southern portion of the property. There was discussion of 24 access and it was stated that it would be a determination of the County. Mr. Deziel said he had no intention of pursuing an access from 24. MOVED BY RANDY BRINKMAN AND SECONDED BY JERRY BROST TO RECOMMEND APPROVAL OF THE RE -PLAT OF LOT 1 AND LOT 3, LIBBY ADDITION TO 1 LOT WITH THE FOLLOWING CONDITION: 1. All drainage and utility easements as recommended by the city engineer. MOTION PASSED. 3. NATHAN & ELIZABETH DUNNQUERY - 4645 WALNUT STREET - RE -PLAT 2 LOTS TO 1 LOT - PUBLIC HEARING Loren Kohnen read his memo to the planning commission and put up an overhead of the site. He explained that the Dunnquery's were planning an addition to their home which would be too close to the rear lot line. They owned the lot behind them also, so by combining the lots, the rear yard setback variance would not be needed. He also noted that the city engineer had said that an easement should be in place at the southern portion of the Dunnquery's property for the neighbor's driveway. He pointed out where this was on the overhead. Nathan Dunnquery stated that they intend to give the Randolph's an easement for their driveway. He said he was told it would be a private easement. Sharon Johnson said the survey shows that the east side of the existing home is 9.6' from the property line. She wondered if a variance would be needed for the addition or will the addition stay within the setbacks. Lenny Leuer said it has not been unusual for the lots in Independence Beach to be granted variances because of the narrow lots. He said he believed we would be pretty restrictive on the Dunnquery's that we haven't been for others if we did not give them a variance. L. Kohnen said we would need an application for a variance for the addition to stay within the lines of the existing house. There was discussion on if the addition could be designed so that a variance would not be needed. N. Dunnquery said that they already had the plans drawn up for the addition and it does stay within the lines of the existing house. Planning Commission Minutes September 11, 2002 2 L. Kohnen said that for the building permit, he would need to have the addition surveyed onto his survey, so that it would note the exact distance from the property line. Maybe the house did not sit exactly straight on the property, and the addition may be a different distance than the existing house. A smaller or larger variance, or none at all, may be needed. Loren explained to Mr. Dunnguery the dates that a variance would have to be applied for. Jerry Brost said today's recommendation would just be on the re -platting. Sharon Johnson said let's talk about vacating streets. (After this application) Dick Picard asked if the applicant could design the addition so that a variance would not be required. L. Kohnen said yes. N. Dunnquery stated again that the plans were already done. MOVED BY JERRY BROST AND SECONDED BY RANDY BRINKMAN TO RECOMMEND APPROVAL OF THE RE -PLAT OF LOTS 8 & 17, BLOCK 9, INDEPENDENCE BEACH , ALSO INCLUDING THAT PORTION OF VACATED BEECHNUT THAT HAS BEEN VACATED, INTO 1 LOT WITH THE FOLLOWING CONDITIONS: 1. All recommendations of the city engineer MOTION PASSED. 4. MINUTES OF AUGUST 13, 2002 These will be available at the next meeting Elizabeth Weir wanted to commend Sharon Johnson on her initiative and excellent writing on the Planning Commission Training Guide. Loren Kohnen said that the Wara Real Estate application should be on the next agenda. There was discussion on vacating road easements. MOVED BY JERRY BROST AND SECONDED BY MARY VERBICK TO ADJOURN.
