HomeMy Public PortalAboutResolution 84-2323 Election: Calling of Election for March 26, 1985 and measure relating to zone changeRESOLUTION NO. 84 -2323 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLD- ING c: A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, MARCH 26, 1985, FOR THE SUBMISSION TO THE QTALIFIED ELECTORS OF SAID CITY AN ORDINANCE RELATING TO A CHANGE OF ZONE FROM R -1 TO RPD FOR PROPERTY SITUATED AT THE NORTHEAST CORNER OF LOWER AZUSA ROAD AND GOLDEN WEST AVENUE KNOWN AS PROSPECTIVE TRACT NO. 43136 WHEREAS, the City Council of the City of Temple City did on October 16, 1984, duly adopt Ordinance No. 84 -553 providing for a change of zone from R -1 to RPD for property situated at the northeast corner of Lower Azusa Road and Golden West Avenue known as prospective Tract No. 43136; and and WHEREAS, the said Ordinance was duly published as required by law; WHEREAS,, pursuant to authority provided by statute a petition has been filed with the legislative body of said city signed by more than ten per cent of the number of qualified registered voters of said city protesting the adoption of the hereinabove ordinance referred to; and WHEREAS, the City Clerk of said city has duly examined and from the records of registration ascertained that the petition is signed by the requisite number of voters, and has so certified; and WHEREAS, the City Council of said city has not voted in favor of the repeal of the ordinance; and WHEREAS, the City Council of said city is thereupon authorized and directed by statute to submit the Ordinance to the qualified voters; NOW, THEFEFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIF- ORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities within said State, there shall be, and there is hereby called and ordered held in the City of Temple City, County of Los Angeles, State of California, on Tuesday, March 26, 1985, a Special Municipal Election of the qualified electors of said City for the purpose of submitting the following proposed ordin- ance, to wit: Shall Ordinance No. 84 -553 providing for a change of zone from R -1 to RPD for property situated at the Northeast corner of Lower Azusa <load and Golden West Avenue known as Prospective Tract No. 43136 be adopted? : YES : • : NO SECTION 2. The proposed ordinance submitted to the voters is as follows: "The following property is hereby rezoned from Zone R -1 to Zone R.PD: The Northeast corner of Lower Azusa Road and Golden West Avenue known as prospective Tract 43136. Furthermore, the Zoning Map of this City is amended accordingly." SECTION 3. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 4. That the polls for said election shall be open at seven o'clock a.m. of the day of said election and shall remain open continu- ously from said time until seven o'clock p.m. of the same day when said polls shall be closed, except as provided in Section 14301 of the Elec- tions Code of the State of California. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by Yaw for holding municipal elections in said City. SECTION 6. That notice of the time and place of holding said elec- tion is hereby given and the City Clerk is hereby authorized., instructed and directed to give such further or additional notice of said election /in time, form and manner as required by law. SECTION 7,. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. SECTION 8. That this Resolution shall take effect immediately. PASSED, APPROVED AND ADOPTED ON December 18, 1984.
