The regular meeting of the City Council of the City of Temple City was called to order by Mayor Merritt at 7:40 p.m. in the Council Chambers of the City Hall. 2. The invocation was given by Elder Hagen, Seventh Day Adventist Church 9664 E. Broadway, Temple City. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: PRESENT: ABSENT: ALSO PRESENT: Councilmen - Briggs, Gilbertson, Harker, Merritt Councilmen - Tyrell City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Director of Public Works Pizzorno,.Assistant City Manager Recupe ro Councilman Briggs moved to excuse Councilman Tyrell for business reasons, seconded by Councilman Gilbertson and carried. 5. APPROVAL OF MINUTES: A. Regular Meeting of June 16, 1970 - Councilman Gilbertson noted the following omissions on seconds to motions; Page 2, Item 9B, add "seconded by Councilman Gilbertson and unanimously carried" completing action on renewal of agreement with Los Angeles County for recreation program at Emperor School; and Page 5, Item 16A, add "seconded by Councilman Briggs and unanimously carried" completing action on authorizing payment of costs and appropriating funds for Phase 1, off - street parking studies, Parking District No. 3. It was moved by Councilman Gilbertson to approve the minutes as corrected, seconded by Councilman Briggs and carried, Councilman Harker abstaining. B. Adjourned Meeting of June 22, 1970 - It was moved by Councilman Briggs, seconded by Councilman Gilbertson and carried to approve the minutes of the Adjourned Meeting of June 22, as printed. C. Adjourned Meeting of June 30, 1970 - It was moved by Councilman Briggs, seconded by Councilman Harker and carried to approve the minutes of the Adjourned Meeting of June 30, as printed. UNFINISHED BUSINESS: 6. PUBLIC HEARING: Re. Jack -in- the -Box Drive -In Restaurant, 9202 Las Tunas Drive - Determination of Possible Public Nuisance. City Manager Koski presented background information as to previous Public Hearings and complaints concerning the Jack -in- the -Box Drive -In Restaurant located at 9202 Las Tunas Drive, together with reports from the Sheriff's Department as to surveillance of the premises, correspondence from Foodmaker, Inc., and a complaint from a resident, all on file in the City Clerk's office. Following introductory discussion, Mayor Merritt declared the Public Hearing open, inviting those present to speak on the matter. Council Minutes, July 7, 1970 - Page 2 Mrs. Hilda Lawless, 92122 Las Tunas Drive, stated that on Saturday, June 13, she had been insulted by an employee of Jack -in- the -Box, which complaint was on file. She also com- plained, of the late hours of operation, noise emanating from the trash bin area during the cleaning operation and the dis- carding of dirty water from the cleaning operation. Michael Fiori, District Coordinator, Jack -in- the -Box Operations, verified the intentions of Foodmaker, Inc. to meet the conditions established by the City Council for the operation of Jack- in -the- Box. He discussed with the Council and expressed willingness to cooperate in additional efforts such as utilizing plastic liners for trash cans to reduce noise, to minimize cleaning time after closing and any other efforts to provide an operation compatible to the community. Mrs. Lorane Flowers, 5823 Encinita, advised that while she had previously opposed the Council allowing a drive -in restaurant at the location, the operations were now much improved and she had no complaint with the operation. Further, she expressed concern relative to a complaint against an employee of Jack -in- the -Box who was a minor, and felt that the matter of whether or not he had in fact insulted Mrs. Lawless was a civil matter. Jim Zito, 58252 Encinita, advised that he was the brother of the employee agains-t whom Mrs. Lawless had filed the complaint, advising that he too felt this was a civil matter. He considered the operation of Jack -in-the -Box to be acceptable to the community and meeting the requirements set forth by the City Council. No one else came forward to Speak Councilman 3riggs moved to close the public hearing, seconded by Councilman Gilbertson and carried. Following discussion and on recommendation of the City Attorney, Councilman Gilbertson moved as follows: "On the basis of the conditions previously laid down by the City Council, and on the basis of the representative of Jack -in- the -Box, Mr. Fiori, and letter of July 7, 1970, from Foodmaker, Inc., indicating that they would attempt earlier cleaning time than to 1:30 a.m., implement the use of noiseless trash containers and maintain the premises in a clean and orderly fashion, the City Council finds the public nuisance allegations, which must be established by a pattern, to have been largely cured; that we will never cure individual or spasmodic complaints, but the pattern at this point seems to be cured; and that the matter be terminated subject to the prescribed conditions." The motion was seconded by Councilman 3riggs and carried. 7. PLANNING COMMISSION RECOMMENDATIONS: Meeting of June 23, 1970. Tentative Tract Map 30308, Revised - Santa Anita Convalescent Hospital. Planning Director Dragicevich presented background information relative to Tentative Tract Map 30308, Revised. He advised that the map now includes portions of several R -1 lots abutting existing _sanitarium' . facilities, and that the pro- posed addition to the sanitarium complex was granted by Res- olution No. 70 -377PC on May .1.2, 1970, ,- . in .,Zon.e. Variance Case No. 70 -313, and requested Council approval of tentative tract map dated January 1969, Revised. Councilman Briggs moved to approve, seconded by Councilman Harker and carried. Council Minutes, July 7, 1970 - Page 3 8. PARKING COMMISSION RECOMMENDATIONS - Meeting of June 17, 1970. Permit to Cross Over Pedestrian Mall - Zager -Smith Carpet Co. Director of Public Works Pizzorno advised that the Parking Commission recommended extending the permit for Zager -Smith Carpet Company to pass over public right -of -way on Mall 1A, located behind 9510 Las Tunas Drive, for a one -year period from September 1970 to September 1971, subject to the following conditions: 1) the permit is for loading and unloading of commercial delivery vehicles only, and 2) the area to the rear mall entrance to be repaired by clearing weeds from the cracks in the asphalt and cracks filled and area resurfaced with an asphalt coating. Councilman Briggs moved to approve as recommended, seconded by Councilman Harker and carried. 9. TRAFFIC COMMISSION RECOMMENDATIONS - Meeting of July 1, 1970. A. Item 5 - Las Tunas Drive at Hart Avenue - Intersection Re- evaluation. Director of Public Works Pizzorno advised that the Traffic Commission recommended removal of the crosswalk on Las Tunas Drive at the west line of Hart Avenue and removal of red curb marking on the south curb of Las Tunas Drive, adjacent to the existing crosswalk, replacing it with a marked parking stall. Council discussed the proposal and alternative suggestions that had been considered by the Traffic Commission, with the consensus that elimination of the crosswalk at a T- intersection was not acceptable, with preference for alternative No. 2 described in memorandum dated June 25, 1970. Councilman Briggs moved to delete the crosswalk on the west side of Hart Avenue and relocate to the east line, at right angles across Las Tunas Drive, which would necessitate a minimum removal of one space on the north side and one space on the south side for parking. The motion was seconded by Councilman Gilbertson and carried. B. Item 6 - Oak Avenue, south of Las Tunas Drive - Commercial Loading Zone. Director of Public Works Pizzorno advised that the Traffic Commission recommended placing a large commercial vehicle loading zone on the west side of Oak Avenue, commencing 44 feet south of the south curb line of Las Tunas Drive to a point 69 feet south of the south curb line. Councilman Gilbertson opposed the placing of this loading zone, in that it would cause a tightness in the traffic pattern. Councilman Briggs moved to grant as recommended, seconded by Councilman Harker. The motion carried by the following roll call vote: AYES: Councilmen - Briggs, Harker, Merritt NOES: Councilmen- Gilbertson ABSENT: Councilmen- Tyrell C. Item 10 - Las Tunas Drive -- Temple City Boulevard - Back-to-School Safety Posters Director of Public Works Pizzorno advised that the Traffic Commission recommended approval of the placement of "Back -to- School" safety posters and banners by the Junior Woman's Club of Temple City in conjunction with a possible City -wide safety drive prior to the beginning of school in September, subject to the posters being removed at the conclusion of the project and meeting the City's insurance requirements. Councilman Briggs moved to approve as recommended, seconded by Council- man Harker and carried. Council Minutes, July 7, 1970 - Page 4 D. Item 14 - Las Tunas Drive - Signal Operation. Director of Public Works Pizzorno advised that the Traffic Commission had reviewed the request of the City Council to set signals at two intersections on full operation on specific nights, and that to do so would require a cost of $400 per intersection because of the timing mechanism. Because of the costs involved, the Commission recommended extending full operation of traffic signals on Las Tunas Drive, from 7 to 10 p.m., on Friday nights only, at those intersections not presently so timed. Councilman Gilbertson moved to approve as recommended, seconded by Councilman Harker and carried. 10. LOS ANGELES COUNTY SANITATION DISTRICTS: Joint Refuse Transfer and Disposal Systems. City Manager Koski presented an analysis of the proposed Los Angeles County Sanitation Districts Joint Refuse Transfer and Disposal System, with the recommendation that based on the need for additional landfill sites and long range planning in solid waste disposal, that it was more feasible to remain with the Joint Refuse Transfer and Disposal System. Councilman Harker discussed the problems of disposing of solid waste and the need for communities to concern themselves with a reduc- tion in waste materials. Councilman Gilbertson moved that staff recommendation be accepted, wherein the City would remain with the Joint Refuse Transfer and Disposal System. The motion was seconded by Mayor Merritt and carried. 11. TRAFFIC SIGNAL MAINTENANCE AGREEMENT: Traffic Signal Maintenance Company of Monterey Park (5 -year agreement) Director of Public Works Pizzorno advised that at the present time the County Road Department is maintaining our traffic signals, including preventive maintenance and extraordinary maintenance, at a cost of $55.50 per month, and that the Traffic Signal Maintenance Company of Monterey Park proposed to do the same maintenance for a monthly fee of $21.48. By computing all costs involved, savings for 1970 -71 were estimated to be $4,114. A proposed agreement for the service had been approved by the City Attorney as to form, and arrangements in order to commence the service on August 1, 1970. Councilman Briggs moved to approve the agreement as outlined, and to authorize the Mayor and City Clerk to sign, seconded by Councilman Harker and carried. 12. RESOLUTION No. 70 -1026: Warrants and Demands, Demand Nos. 2413 through 2548 in the amount of $64,751,29. Councilman Briggs moved to adopt Resolution No. 70 -1026 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $64,751.29, DEMAND NOS. 2413 THRU 2548, seconded by Council- man Gilbertson and carried. 13. RESOLUTION' N0. 70 -1027: Adopting a Salary Schedule and Pay Plan. City Manager Koski pointed out that Resolution No. 70 -1027 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING A SALARY SCHEDULE AND PAY PLAN included those changes in position classifications discussed by the Council at previous meetings, and as included in the 1970-71 budget adopted on June 30, 1970. Councilman Gilbertson moved to adopt, seconded by Councilman Harker and carried. 14. COMMUNICATIONS: There were none, 1 Council Minutes, July 7, 1970 - Page 5 15. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: No one came forward.. 16. MATTERS FROM CITY OFFICIALS: A. Councilman Briggs inquired regarding the review of signal timing operation on Temple City Boulevard. Flashing operation for late evening hours was discussed and referred to the next meeting of the Council following further review by individual Councilmen and staff. B. Councilman Gilbertson discussed the irresponsible action of the Board of Supervisors in not holding the budget of the County within more reasonable limits; that this community is seriously affected both by the increase in taxes and the salary scales which they force upon other cities for compar- ison purposes; and suggested that a letter be drafted to the Board of Supervisors, signed by all members of the Council, to convey the feelings of the Council in this regard. Councilmen Harker and Briggs also spoke of the seriousness of the matter. Mayor Merritt directed staff to draft a letter to the County Board of Supervisors for the Council, which letter would convey the feelings of the Council as expressed. C. Councilman Gilbertson inquired as to the progress of repair of the intersection of the Southern Pacific Railroad at Lower Azusa. He was advised that materials are presently being delivered and that work was to commence within 10 days. D. City Manager Koski presented a report relative to costs to the City for alternative health insurance plans. The report was deferred for study and action by the Council at their next meeting. E. City Manager Koski advised that a report from the Fire Department had been received relative to the number of calls received over the 4th of July weekend. He advised that the report indicated that only two calls were due to fireworks, and that these were both firecrackers and not the safe and sane type. One fire was in an automobile, and the other was in tree shrubbery on Garibaldi, causing minor damage. 17. ADJOURNMENT: At 9:30 p.m. Councilman Briggs moved to adjourn to executive session, seconded by Councilman Gilbertson and carried.
