Is the variance being sought due to circumstances related to the soil conditions,shape,or topography of such land or structures, and especially affecting such land or structures but not affecting generally the zoning district in which it is located? Yes,the site is unique because it is a private way.The house is set back further than required from the front lot line due to the private way.Although the private way is not included in the lot size we believe the 556sf of land should be a consideration.There is no way to mitigate the current locations of buildings.The existing home is compliant with three setbacks. 2. Would enforcement of the Zoning Ordinance involve substantial hardship,financial or other? YES/NO, Explain. Yes,without these improvements the second floor unit will not have adequate egress in the potential event of a kitchen fire,or a fire at the rear of the house.The added space at the rear of the house allows for the creation of adequate egress.Egress at the right side yard will remove the only limited greenspace on the property.Please see following page. 3. Would granting of the desired relief be a substantial detriment to the public good? YES/NO, Explain. No,the proposed addition of space is 102sf and does not increase the existing building footprint.The use of a direct egress path from the kitchen over the garage to grade is for the good of the occupants,public and emergency responders. 4. Would granting the desired relief nullify or substantially derogate from the intent of this Zoning Ordinance? YES/NO, Explain. No,the intent of the additional space is to stay within the existing building footprint.The proximity of structures to the lot lines and each other is an existing condition.The proposed direction of exterior egress is a life safety concern.
