Aubury presented an Ordinance declaring The Streets of Livermore, Public Highways and Ordinance 46 adopted # numbered by Clerk 46. Adopted by the following Vote on Motion of Kennedy. Ayes. Comegys, Alward, Mendenhall, and Kennedy Noes None. After consultation the Ordinance forbiding minors on the Street after certain hours was th laid over untill March 7 1881. After some discussion on the danger of Small Pox being brought into town. An Ordinance was introduced by the Town Attorney Ordinance 47 Entitled an Ordinance establishing a Board of establishing a Board of Health adopted health. On motion of Alward, The Ordinance as read was adopted by the following vote. Ayes, Comegys, Alward, Kennedy and Mendenhall Noes. None. # Ordinance Numbered by Clerk 47. On motion the Board preceeded to ballot for Dr. W.S. Taylor Health Officer, The clerk was instructed to cast elected health Officer the ballot for Dr. W.S. Taylor Dr. Taylor was declared elected. On motion of Kennedy a commitee of three was appointed to provide a pest house, and make such other arrangments as necessary to Commitee appointed prevent the disease from getting into Town. to provide Pest House Kennedy, Mendenhall and Alward were appointed Said commitee. Streets refered to Street commitee. asking for the There being a vacancy on Said commitee by Extention of "J" and absence of Gardmeyer, On motion G.E. To prevent Minors from being on the Streets after certain hours, Numbered Ordinance No 48 adopted by Clerk No. 48. read and adopted as read. communication from Communication received from Clerk and H & L Co. regarding Foreman of Hook and Ladder Co. asking that Exempt Certificates Exempt Certificates be issued to Simmon Anspacher Garrison Gerst, Solomon Watermun, and F. Sangmaster, they having served five years continously in Livermore Fire Department. On motion the Chief Engineer was authorized to issue Said certificates. st Petition from property holders on 1 Street Petition asking for asking for Side walks in accordance with grade st grading of 1 street received and refered to Street Commitee. On motion of Kennedy Dr. L. H. Cutter was Appoint's appointed to act in conjunction with Dr. W.S. Taylor as health Officer. Comegys in the chair. Roll Call Present Comegys, Mendenhall, & Kennedy. Absent Alward & Gardmyer. Mendenhall from commitee on Streets reported Report of Street Com he had examined into the matter of Petition of Property holders on South East Side of First Regarding raising Street and thought the work should be done. grade of side walk of The meeting was then opened for Statements from "First" street property holders present in relation to grade. and to get their views as to the feasibility of raising grade of Said Side walk 6 inches above the Street grade as Surveyed by E. Dyer. After discussion, on motion of Trustee Kennedy second of Mendenhall, The work was ordered sidewalk ordered on done. And the Clerk instructed to Post notices "First" st from as required by the Charter. Said Side walk to be "Lizzie" to "L" street Laid 10 ft wide and placed on Town Sidewalk line in accordance with Said Survey raised 6 inches. Said Walk to be laid from Lizzie Street to L. Street. The President Stated the meeting was called to decide as to material to be used in Constructing Said Sidewalk as ordered at previous Special meeting. On motion of Mendenhall Sec. of Kennedy. It was ordered that Said Side walk be laid of not less than onbe and one half inch Plank of good quality lumber with curb Similar to curb of Walk of M. S. Palmer On motion Board adjourned Attest F. Bills allowed Alward from commitee on Streets asked for further time, to report on the extension of L. Street, granted. Street Com. The Clerk reported License drawn for Anspacher & Brs. Regarding extension Lumber business, They declined to pay, on the of "L" st. ground that both their Commission and General Licenses Merchandise License covered the Same. Anspacher Bros The Board entertaining the Same view, The Clerk was Lumber License authorized to credit the Marshal with Same. remitted An Ordinance granting the priviledge of erecting Ordinance and maintaining gas works, in The Town of Livermore Granting to Jos. To Joseph Waterman was read and examined by Waterman franchise for gas works the Board, after striking out the words exclusive, It was adopted, Trustee Alward entering his protest, and voting against. On motion of Alward Seconded of Gardmyer, The time st for Laying Side walks on the South East Side of 1 Street Work Time limited to 60 Street form Lizzie to L was set at 60 days from days for completing th April 4 1881. And the clerk authorized to issue notice side walk on "First" st That if the Same is not completed in accordance with Said order. The Town will complete the Same and assess the property for the cost of the work. Board proceeded to vote for Night Watchman E. Boothby Election was elected on the Seccond ballot having received E. Boothby elected c 3 , Harding 1, MCabe 1. Night Watchman E. Boothby being present was Sworn in by the Town Clerk. On motion the Clerk was instructed to issue a Proclimation of election to be held on the Seccond Proclamation for Monday in May in accordance with the Law Town election governing elections. Mendenhall from commitee on Streets reported that' owing to shortness of time the present board of Trustees Reports of Standing having but one week longer to Serve, The Petition Com. Petition regarding "L" of property owners for extension of L. Street be st laid on table laid on the table So ordered. Kennedy from Finnance Commitee reported having examined most of the reports of Officers and asked for further time to make final report, granted. On motion of Kennedy Sec of Mendenhall the Clerk was authorized to allow a rebate on Licenses ## 71 & 197 the Same being unpaid for good cause. Mendenhall made a motion to grant One Hundred Rebate on Licenses st Dollars to be used in improving 1 Street from Lizzie 71 & 197 allowed Marshal to L. out of the Town Treasury claiming the Same Had been done on other Streets, and first Street paying Proposition to grant Two Thirds of the taxes he claimed it as just. $00 100 to improving After refering the matter to the Town Atty, and "L" st lost finding the Same legal, Kennedy Secconded the motion which was lost by the following vote, Ayes. Comegys in the chair Special Meeting Present Comegys, Alward, Mendenhall, Kennedy, & Gardmyer. A full board. Roll Call The President Stated the object of the meeting to be to Canvass the returns of the Election held the first to Elect 5 Trustees, One Town Marshal, Result of election Canvassed and one Assesor. The Sealed returns were then placed in the hands of the board, by the Clerk. On being opened were found to contain Tally lists & Ballots as follows. Total Vote 155 Trustees C.J. Stevens 115 Votes " Peter Moy 114 " " S. Witterau 107 " " W. M. Mendenhall 94 " " P. Callahan 81 " " F. Mally 63 " " N. B. Holmes 44 " Trustee J. Alward 6 Votes Scattering 44 " Town Marshal L. Hilton 138 " " " J.H. Alwell 6 " Assesor H. Bailey 144 " Geo. E. Kennedy was appointed a Commitee of one to announce the vote. On motion of Alward, C.J. Stevens Peter Moy Result of election S.Witterau, W.M. Mendenhall, and P Callaghan were announced declared elected Trustees for the ensuing year and untill their Sucessors are elected and qualified. On motion of Kennedy, L. Hilton was declared L. Hilton elected elected Marshal for the ensuing term. Town Marshal On motion of Kennedy H. Bailey was declared Elected Assesor, for the ensuing term. H. Committee accepted On motion of Mendenhall Sec. of Gardmyer, the Clerk was instructed to present Bill for One Hundred and Seventy Eight Dollars to Supervisor J.Green of Murry Bill to be presented to Township The Same having been paid out on account Board of Supervisors for Expenses of small of Small Pox outside of Town of Livermore. pox The Town Clerk Presented a Statistical report of receipts and expenditures of the Town for the fiscal th year, Ending May 16 1881, which was read for the benifit of those present. The business of the present Board being finished. The retiring President G. W. Comegys tendered to the board his hearty thanks for their cooporation and kindness and to the Clerk for his faithfullness. On motion of Kennedy a vote of thanks was given to President Comegys by the Board Vote of thanks to The Town Clerk personaly tendered his thanks G.W. Comegys to the President and board for their kindness and consideration during his term of Office. After which The Board adjourned Sine Die at 9.15 PM. Attest F. A. The new Board took their Seats, On motion of P. Callaghan, C. J. Stevens was chosen C. J. Stevens was chosen Permanet Chairman permanent Chairman, Election of Officers On motion of Mendenhall, there being no applicants for Town Clerk, the Board elected the present incum- bent, T. A. Anthony. F. A. Anthony elected Wm. M. Mendenhall nominated W. C. Massie for Treasruer Town Clerk Mr. Massie having received the vote of the Board was declared elected Treasuer. W. C. Massie elected The Atty, was passed over for future consideration. Town Treasurer C Lawrence. MCabe handed in an application for Night Police, There being no other applicants on c L. MCabe elected motion of P. Callaghan he was declared elected Night Watchman & Night Police, Being present he Steped forward and sworn in was Sworn in by the Clerk and the following described property of his Office turned over to him. Regular Meeting Present Stevens, Witterau, Moy, Mendenhall, and Callaghan, a full board. Roll Call th Minuites of meeting held May 16 1881 read and approved as read. Bond of Marshal and Town Clerk received Reading Minuites refered to the board and accepted on motion of Mendenhall Bonds Town Justice R.W. Graham presented his report of Marshal and Town thth from May 16 to June 6 1881. Received and placed Clerk approved on file. Mendenhall from commitee on Streets, reported st Side walk laid on 1 Street as ordered excepting Bills allowed 50 ft. in front of D. Leunlan Property. After Some explination by Mendenhall Stating the owners of property lived out of town Reports of Coms regarding side walk on "First" st Town to lay side walk and wished one weeks further time to complete commence on J Scunlon property the work, Time granted. if not done in one On motion of Mendenhall Sec. of Moy the Marshal week. was instructed to advertise for bids to do the work under direction of the Town if not commenced within Said time. Mendenhall made a motion to expend One Hundred $00 100 donated $00 Dollars 100 out of the Town Treasury for repairing towards repairing first Street under direction of Street Commitee. "First" st. Carried. A Pettion was presented Signed by Fifty residents Pettions of the Town asking for an ordinance Preventing the to close saloons at 10 Sale of Liquor and Opening Saloons after 10 P.M. P.M. laid on table of each day. On motion of Mendenhall Sec'. of Callaghan the resolution was laid on the table. It having been Stated by J.F. Myers that a Hydrant was needed on the vicinity of K & L Streets between Regarding a new Fourth & Fifth the Fire commitee were instructed Hydrant to look into the matter and report at the next meeting. W. Jordan Foreman of Hook & Ladder Co. Stated the Company wished to sell their entire property to the $00 Town for the Sum of Twelve Hundred Dollars (1200.) Proposition from H & R.W. Graham addressed the board in favor of L. Co. to sell their the purchase. There being no motion before the property Board, it was passed, And the matter of Selecting an Attorney came up. After Some discussion on motion of Callaghan Sec.' of Moy, it was decided to employ Counsel from time to time No regular town as needed. Attorney to be employed Mendenhall made a motion the the Board hold th a special meeting on Tuesday evening June 14 1881 Regarding special to take into consideration the question of purchasing meeting about buying the property of the Hook & Ladder Co.
