Dutcher Repairing Fire apparatus etc. 9.75 $ 248.65 The Ordinance Committee were granted further time to prepare an Ordinance for petitions for streets to be accompanied with bonds for costs Farmers Union The Farmers Union were awarded the Contract awarded Coal oil bid to supply Coal oil for the balance of the term of the present Board at 26 <Twenty six> cents per gallon, under the head of New business the following petition was presented We, the undersigned property owners and residents Petition for Town to within the Town of Livermore, Alameda County, Calif - accept gift of Plaza ornia, represent to the Board of Trustees of the Town from Waterman of Livermore, to Joseph Waterneau, George C. Stanley Stanley & Bartlett and W. P. Bartlett, and to whom it may concern as thf follows. Whereas, on or about the 20 day of Septem- ber 1875, Alexander Esdon caused to be filed in the office of the County Recorder of Alameda County a map known as the "Map of the Northern Addition to the Town of Livermore" surveyed for Alexander Esdon July 1875 by W. F. Boardman, C. E. upon which may there is delineated a space on which the word "Plaza" is written, bounded by the following designated streets; Livermore Avenue, Park, L and Walnut streets, and whereas, there was no dedication or grant for any public use, or intention to dedicate or grant for the public use of the land represented by said space marked "Plaza" at said or any other time, and no act of any kind by said Town of Livermore, or by any owner of any of the land within said tract, or by the public, or by any per- son, corporation or body of persons accepting or in any way recognizing said land represent- ed by said space marked "Plaza" as dedicated, granted or offered as a public square or for any public use, and Whereas, said Esdon and his successors in interest in said last named land have held and claimed the exclusive and adverse posession and ownership thereof as against the public, and have cultivated and used the same as there own ever since said 20th day of September 1885, and whereas Joseph Waterman, George C. Stanley and W. P. Bartlett have made considerable improvement upon that block or portion of said last named land bounded by K, Park, L and Walnut streets, and now offer to dedicate said last bounded block of land as a Plaza for use by the public as a place of recrea- tion and pleasure Now therefore we respectfully request that said Honorable Board of Trustees of the Town of Livermore on behalf of the public recognize and accept the said dedication of said block bounded by K, Park, L and Walnut streets as a plaza or public square, and that proper provision be made for its perpetual care and improvement Dated January 1886. Trustee Mendenhall presented the following which was adopted "Whereas a petition has been presented to this Board asking that the Board accept a certain block in the Northern Addition for a Plaza, and Whereas, all the recitals in said petition are true, new therefore, Resolved, That the offer made by Joseph Waterman, George C. Stanley and W P Bartlett to dedicate said Block of land bounded by K. Park, L and Walnut streets in the Northern Addition to the Town of Livermore as a Plaza, for use by the public as a place of recreation and pleasure be accepted, Resolved, That this Board hereby agrees to expend at least seventy five dollars each and every year hereafter in the care and improvement of said Plaza, Resolved, That the Clerk properly certify and acknowledge a copy of the foregoing preamble and resolutions and deliver the same to Messrs Joseph Waterman, George C Stanley and W. P Bartlett. The tender of the Block of land for use as a "Plaza" was as follows To the Board of Trustees of the Town of Livermore, Gentlemen, We, the owners of the Bock of land in Livermore bounded by K, Park, L and Walnut streets hereby offer to dedicate the same as a "Plaza" for use by the public as a place of recreation and pleasure with the understanding that the dedica- tion shall be deemed accepted and completed only upon your adoption of the following preamble and Resolution Resolution by the Board of Trustees of the Town of Livermore Whereas, a petition of which the following is a copy has been presented to this Board We the undersigned property owners and residents within the Town of Livermore, Alameda County California, represent to the Board of Trustees of the Town of Livermore, to Joseph Waterman, G. C. In the absence of the Town Clerk Trustee Beck was appointed clerk pro tem. A petition was read against the opening Petition against of Rail Road Avenue in accordance with the opening Rail Road Avenue report of the Commissioners, on Motion petition received and placed on file Trustee Mendenhall moved that the report of the Commissioners in the matter of opening of th Rail Road Avenue adopted December 29 1885 Report of Commissioners Rail be annulled, giving as his reason for the motion Road Avenue rejected that he was satisfied that the report was not legal, and would not stand law, as the com- missioners had taken the valuation of prop- erty and not benefits and damages accrueing as a basis for their report - seconded by Trustee Callaghan, Motion carried, all Trustees present voting for same On motion nomination for New Commission- New Commissioners ers in the matter of opening of Rail Road Avenue Rail Road Avenue appointed was ordered, and resulted in the election of Jesse Bowles, Jos. Called Meeting The Board was called to order at 8 P.M. President Beazell in the chair, There were present Trustees Mendenhall and Beck, absent Trustees Mitchel and Callaghan Trustee Beck was appointed clerk pro tem in the Clerk pro tem absence of the Town Clerk. The chairman stated the object of the meeting was the point that the appraisers appointed for assessing dam- ages and benefits in the opening of Rail Road Avenue had not advertised in accordance with the Town Charter, and if they continued their actions would not be legal Trustee Mendenhall moved that the same Com- mittee viz - Jesse Bowles, Jos. H. After considerable discussion the matter of Rail Road Avenue was taken from the table and Trustee Mendenhall offered the following, Resolved - That the Rail Road Avenue prayer of the petitioners be granted in reference only taken from table to that portion of Rail Road Avenue Commencing parallel with the South Westerly line of "K" street, thence running South Westerly to the North Westerly line of L street as per map and report of Geo L. Neusbaumer th adopted November 30 1885. Resolved, That Rail Road Avenue in the Northern Addition of the Town of Liver- more commencing parallel with the South Westerly Part of Rail Road Avenue declared line of K street, thence running North Easterly Con public highway necting with Front street as surveyed and mapped th by Geo L. Neusbaumer adopted November 30 1885 be and hereby is declared one of the public highways of the Town of Livermore, The foregoing Resolutions were adopted all Trustees present voting for same. Inspector of election The Chairman stated that D. M. Conner had re- appointed signed the position of Inspector at the coming Town election and appointed Jos. H. Mitchell Town Clerk Approved James Beazell President Board Town Trustees New Board Convened The Clerk called the Trustees elect to order, and tem- porary organization was effected by placing Trustee Beazell in the chair- On motion Trustee Beazell was elected Chairman for the ensuing term. Chairman elected Applications for Town Clerk were read from D. M. Clerk elected Connor and F. A. Anthony. D. M. Conner was elected on the first ballot. W. F. Mitchell and Theo Gomer were placed in nomi- nation for Town Treasurer, Mr Gomer was elected Treasurer elected to the position on the first ballot. Watchman appointed Pat Coughlan was elected Night Watchman by acclamation. J. W. Harlan was elected Town Steward Steward appointed by acclamation The Bond of Town Marshall with W. M. Mendenhall, Bonds of Marshal approved Moritz Hupers, Wendel Jordan and Leonard Beck was approved. The subject of increasing the Bond of the Treasurer was discussed No action taken Dr L. H. The bonds of Theodon Gomer, town Treasurer Official Bonds in the sum of $4000, with C. J. Stevens and Peter McLeaney as sureties: Norman J. McLeod, town Treasurer, in the sum of $2000, with George Bernard, Theodore Gomer, W. H. Wright, and George Meyer as sure- ties, and of D.M. Conner, Town Clerk, in the sum of $2000, with N.D. Comegys, the retiring Treasurer, of all the Moneys, books, and other property of the Treasurer's office in his possession to Theo- Gomer, the present Treasurer Messrs Waterman, Stanley and Bartlett, presented Matter of Public Park a Deed of Gift, Conveying to the Town of Livermore a block of land in the Northern Addition. on Condition that said block of land should never by used for any purpose other than those of a Public Park, and that the town expend not less than $75- annually in improving and maintaining the same. Trustee McLeod, Laumeister, Bailey and Schaffer spoke in opposition to receiving or accepting the do- nation with the conditions imposed. Mr. Bartlett on behalf of the donors with- drew the deed and the offer of donation. An application was received from S. L. Sagar, requesting the appointment as Chief Engineer of the Fire Dept. Trustee Beazell nominated J.H. Dutcher for the same position, and on the first ballot J.H. Opening The Board met pursuant to the call of the President and was called to order at 8-15 O'Clock, P.M. by President Beazell. Object of Meeting. All the members present Except Trustee Schaffer. The President stated the object of the Meeting to be "The consideration of the use of fire Crackers and other Explosives within the Corporate limits of the town, on the coming Fourth of July, and such other business as Might come before the Board" as was stated in the Call for the Meeting. The matter of the use of fire crackers and Explosives other explosives was discussed, but no ac- tion was taken therein. On Motion of Trustee Laumeister, the Marshal Extra Police was authorized to employ two extras Night Watch- thth men on Saturday Night and Sunday Night, the 4 and 5 of July next, and two extra Policemen on Sunday th July 4, if he deemed in necessary. Graham, Town Justice, from Officers Reports thth June 7 to July 7, 1886, was received and filed, and Town Justice shown that since last report twelve cases have been brought before the Justice, and disposed of as follows, viz: In Each case a plea of "guilty" was Entered, In nine cases fines were im- 00 posed and paid, aggregating $77 and said sum paid over to the Marshal: in two cases the defendants were committed to the Custody of the Marshal, in default of payment of fines imposed and in one case, (The People vs. John Welsh,) the defendant was given time to pay his fine of five (5) dollars. Health Officer The Report of Dr. L.H. Cutler, Health Officer, was Received and filed and shows: That in the Month of May there were four births, three males and one female: and two deaths, one from Brights disease and one from consumption; in the Month of June, three births, two males and one female. and no deaths. (Sex of deceased not given.) During said period (May and June,) there were four cases of diptheria, all recovering. The report further show the Sanitary condition of the Town to be "Excellent," Except as it may be affected by the Wash-houses, and recommends that they be confined to certain limits. President Beazell stated the object of the Meet- Object of Meeting ing to be the consideration of the proposition to levy a property tax, and such other business as might properly come before the Board. Tax Trustee Schaffer Entered and took his seat at 8-50- Trustee Laumeister moved that a tax of ½ of one per cent. be levied upon all real and person- al property within the town limits- Trustee McLeod seconed the motion. Trustee Schaffer moved to amend, by substituting "1/4 of one percent.," for "1/2 of one per cent." The amendment was accepted, and subsequently withdrawn by consent. The motion was then put and carried. Sprink'g Sts C.J. Stevens presented a petition signed by owners of property on the Streets named therein praying that said Streets be sprinkled during the dry season of the year, and that as assessment upon the lots and lands fronting on said Streets be levies and collected, to defray the Expenses of such sprinkling= The following are the Streets named, viz: First Street, from Lizzie the "M" Streets: Lizzie Street, from Second St to the Railroad Crossing: Livermore Avenue, from the Railroad Cross- ing the Chestnut St: Front St. from Lizzie St to the Railroad Crossing: and "L" St. from Third St to the Railroad Crossing- The petition was received and filed- and the Matter was referred to the Ordinance Committee, with instructions to report at the next regular Meeting. On motion of Trustee McLeod the Clerk was directed to advertise for proposals to sprinkle the Streets above named. No action was taken. The Clerk reported that he had Communicated with the R.R. authorities, relative to "flagging" the Lizzie Street Crossing, but the Division Supt, in his letter, had declined to place a "flagman" at the Crossing, but stated that he had issued orders for all trains to reduce speed at the crossing. A petition was presented, signed by a large number of the inhabitants of the town and vicinity, requesting the passing of an Ordinance prohibiting the sale to, and use of tobacco in public by, minors under 16 sixteen years of age. The ordinance Committee reported an an ordinance prohibiting the sale or Ordinances furnishing of tobacco cigars, or cigarettes to Minors under 16 years of age, and smoking Smoking by such minors in public places _ which was adopted: ayes, Bailey, Laumeister, and Schaffer. Noes , Beazell and McLeod. Also, an ordinance prohibiting the Carrying Concealed weapons of concealed weapons, Except by peace officers, without a permit, which was laid over until the next meeting. Trustee Laumeister reported that he had com- Miscellaneous municated with the Rail-road authorities rela- tive to the crossing of Front Street, near the Catholic Church, but that nothing had been done. The clerk was directed to call the attention of the proper authorities to the dangerous Con- dition of the Crossing, and urge the necessity of remedying the same. Trustee Schaffer reported that the Committee Night-watch on Extra Night watchman had secured Geo. Brenzel, who had served one Month. Geo. Brenzel presented a petition, asking Petition to be appointed Night watchman. The petition was placed on file, and on motion of Trustee Laumeister the petition was granted and Geo. Brenzel was appointed Nightwatch. Trustee Laumeister reported that with the Finances. aid of the Marshal he had Examined into the financial status of the town, and found that on the present basis of receipts and Expendi- tures, there wold be about $100 on the treasury at the End of the term of the present members of the Board.
