AUTHORIZING THE CARTERET PLANNING BOARD TO CONDUCT A
PRELIMINARY INVESTIGATION AND MAKE A RECOMMENDATION
AS TO WHETHER A PROPOSED MIDDLESEX A VENUE RESIDENTIAL
REVITALIZATION DISTRICT IS AN AREA IN NEED OF REDEVELOPMENT
PURSUANT TO THE LOCAL REDEVELOPMENT AND HOUSING LAW,
N.J.S.A. 40A:12A-l, ET SEQ.
WHEREAS, the governing body of the Borough of Carteret has determined that it is in
the public interest to consider designating and establishing a Middlesex Avenue
Residential Revitalization District within the Borough in accordance with the Local
Redevelopment and Housing Law (codified at NJ.S.A. 40A: 12A-I et seq.
"Redevelopment Law" ); and
WHEREAS, pursuant to Section 6 of the Redevelopment Law, no area of a municipality
shaH be determined a redevelopment area unless the governing body of the municipality
shaH, by resolution, authorize the planning board to undertake a preliminary investigation
to determine whether the proposed area is a redevelopment area according to the criteria
set forth in Section 5 of the Redevelopment Law; and
WHEREAS, the governing body wishes to assign the conduct of the preliminary
investigation and hearing(s) to the Carteret Planning Board pursuant to the provisions of
the Redevelopment Law.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
ofCarteret, County of Middlesex, State of New Jersey as foHows:
1. That the Carteret Planning Board is hereby authorized to initiate and undertake a
preliminary investigation and hearing(s) to determine whether a proposed
Middlesex A venue Residential Revitalization District is a redevelopment area as
required by Section 6 of the Local Redevelopment and Housing Law.
2. That the Carteret Planning Board, foHowing said preliminary investigation and
hearing(s), make a recommendation to the Mayor and Council pursuant to
Subsection b. of Section 6 of the redevelopment Law as to whether a proposed
Middlesex Avenue Residential Revitalization District is an area in heed of
redevelopment.
3. That a copy of this Resolution be forwarded to the Carteret Planning Board for
action consistent therewith.
